September 20, 1999
A regular meeting of the Tree Conservation Board was held Monday, September 20, 1999,in the City
Hall Commission Chambers. Present were Mae Jones, Chairperson,Richard Bell, Camille Hunter, Judith
Jacobson,Eloise Koerber and Staff Members George Worley and Susan Dunham.
The meeting was called to order by Chairperson Mae Jones at 7:30 p.m.

4.A.New Business/Tree Removal Applications
1. Lot 69A,Unit 3,North Atlantic Beach: Jeff Tabb appeared before the Board on behalf of Custom
Homes by Bryan Landry and explained his application for removal of trees to build a single family
home. After discussion,the Board noted that the 36"oak cluster located on the west side of the lot is
not a multi trunk tree and,therefore, is not protected. Richard Bell moved that the Board accept the
application for removal of 32"of oak and 24"of palm to be mitigated with a 5"oak and 8"oak on
site and a new 4"oak, and the palms to be mitigated with a minimum of 12"of palm on site. Eloise
Koerber seconded the motion,which passed unanimously.
2. Lot 80, Saltair, Section 3: No applicant was present for this item. After numerous questions from the
Board on the application, Judith Jacobson moved that the Board defer action on this application for
• two reasons(1)there are trees marked for removal on the site which are not marked for removal on
the site plan; (2)there are trees marked for removal on the site which are public trees on public right
of way, and that the applicant be informed that these issues need to be addressed. Camille Hunter
seconded the motion,which passed unanimously.
3. Tree removal on Lots 4 and 5, Block 244,Lots 4 and 5,Block 245, Section H: George Worley
advised Mr. Merve Russell that his tree removal application would be on the agenda today but Mr.
Merve Russell was not in attendance. Also,Mr.Merve Russell did not provide any new updated
information to his original tree removal application. The Board determined that there were two issues
to be addressed: (1)the trees cut down without a permit, and(2)the request to remove additional
trees.
Judith Jacobson moved that in light of the violation of the Tree Ordinance in regard to the site
described as Lots 4 and 5,Block 244,and Lots 4 and 5,Block 245, Section H,the Board directs the
City Staff to inform Mr.Merve Russell that he is obligated to pay the appropriate financial mitigation
for 90.5"of hardwood cut without a permit. This payment should either be made or negotiated into a
payment plan no later than 30 days from the date of this motion. Richard Bell seconded the motion.
Judith Jacobson amended the motion: In light of the violation of the Tree Ordinance in regard to the
site designated as Lots 4 and 5,Block 244, and Lots 4 and 5,Block 245, Section H,the Board directs
the City Staff to inform Mr.Merve Russell that he is obligated to pay the appropriate financial
mitigation for 14"of oak and 76.5"of hardwood for a total of 90.5"cut without a permit. This
payment should be made or negotiated in the payment plan no later than 30 days from the date of this
motion. Richard Bell seconded the motion,which passed unanimously.

• With respect to the request to remove additional trees,Eloise Koerber moved to defer any action on
the tree removal on Lots 4 and 5,Block 244,and Lots 4 and 5, Block 245, Section H,until such time
as Mr. Merve Russell is present at a regular Tree Board meeting to answer questions regarding his
application for tree removal. Camille Hunter seconded the motion,which passed unanimously.
4. Reports and Announcements
Tree Conservation Board's memo submitted to the City Commission regarding tree removal on public
property: The Board asked George Worley if there was any action the Board could take regarding the
inaction of the City Commission with regard to the memo. George Worley stated that the Board could
submit a memo back to the Commission stating that the Tree Conservation Board believes this issue is
important enough for the City Commission to take action and requesting that it be put on an agenda for
future action.
Draft Historic Tree Preservation Ordinance: George Worley has received all bids for preparing a survey
and will proceed with obtaining a purchase order. George Worley will continue working on the
computer-generated presentation to show to the City Commission.
6. Approval of Minutes of Meeting of September 7, 1999
Eloise Koerber moved to approve the Minutes of the meeting of September 7, 1999 as submitted: Judith
Jacobson seconded and the motion carried.
7. Adjournment
There being no other business before the Board, the meeting was adjourned at 9:15 p.m.
