09-08-98 v • TREE CONSERVATION BOARD Minutes of meeting of September 8, 1998 The Board held meeting on Monday September 8, 1998 at City Hall. Present were: Mae Jones, Chairman Rick Bell Mary Emerson-Smith Staff: George Worley, Community Development Director: absent The meeting was called to order at 7:35 PM by the Chairman. 2.A.1. Tree Mitigation issue at 470 Orchid Street: Discussion of this item was deferred to later in the meeting. 2.A.2. Tree removal at 1801 Sevilla Boulevard: Scott Sessions introduced himself to the Board as homeowner and explained that he was before them to request a reduction in the required mitigation on his lot. He explained that he was having difficulty obtaining 4"replacement trees and was requesting to be allowed to plant 2.5"to 3.5"replacements instead. After discussion Rick Bell moved to require five 3"oaks and 2.5" other hardwoods to meet the required 14"oak and 6"hardwood required as mitigation, due to the applicants • difficulty in obtaining 4"oaks. Mary Emerson-Smith seconded the motion which passed unanimously. 3.A.1. Tree Removal for Sandar Industries Phase III:James King and James Milligan introduced themselves to the Board and described previously approved phase I and II construction and mitigation. Mr. Milligan then described the intended work under phase III. Mr. King explained that the submitted plans also showed the probable extent and impacts of phase IV in order to give the Board an idea of the full extent of the development. Mr. Milligan also advised the Board that he expected to have to locate some of the phase IV mitigation trees within the phase III area. Mae Jones explained to the Board that the standards for calculating mitigation had been modified by action of the Board at the time of the approvals of phase I and phase II. She also noted that one pine tree noted on the plans as 15"was, in fact, 17"and should be calculated into the mitigation required. After review of the proposed mitigation,the Board determined that the total mitigation proposed was 3"below the required mitigation. Some discussion occurred regarding the expected growth potential of the Wax Myrtles being used for part of the mitigation. Rick Bell moved to approve the removal of 52"of oak and 86"of pine,to be mitigated by 30"of oak and 39"of hardwood planted on-site. Mary Emerson-Smith seconded the motion which was approved unanimously. 3.A.2. Tree removal at Lot 8, Block 7,Ocean Grove Unit 1:Mr. Doane introduced himself and his contractor to the Board and explained his proposed construction. The Board discussed the apparent inaccuracy of the survey and felt that it needed correction before the Board could take action. Following discussion the applicant agreed to have the survey corrected and return at the next meeting. The Board then took up the discussion of the tree mitigation issue at 470 Orchid Street. Mae Jones related to the Board that she had been contacted by city staff and informed that Pulte Homes had submitted a check for $1,237.50 to the city for mitigation of the 30"oak which was lost due to construction of the home. She asked the board members for their comments on this situation considering that the mitigation required by the Board • was to be on-site. Discussion occurred regarding the fact that the Board must formally amend its mitigation requirement and that the submittal of the check by Pulte does not change that fact. Action on this issue was deferred until Mr. Worley could take part in the discussions. • 4. Reports&Announcements. The Board discussed the exemptions to theermittin requirements in the Tree Ordinance as a result of a P g request for information by the owner of a duplex. Following this discussion Mae Jones discussed the historic trees in the old city area and submitted a selection of photographs taken by her and Judy Jacobson. After review of the photographs and discussion of the method of submitting the Boards proposal to the City Commission. No action was taken.
