TREE CONSERVATION BOARD
Minutes of March 6, 1995
The Board held its regular meeting on Monday, March 6, in the
City Commission Chambers. Present were:
Hope Van Nortwick, Chairman Mae Jones
Richard Beaver Jim Pelkey
Staff: George Worley, Designee Carl Walker, Coordinator
The meeting was called to order at 7:30 PM by Hope Van Nort-
wick, Chairman, in the City Commission Chambers.
The first order of business was a review of the tree removal
application filed for Lot # 4, Block # 164, Section H. Henry
Cooper introduced himself as agent for the builder, Chris
Danser. Mr. Cooper advised the Board that the proposed house
to be built was pre-sold. He also verified that the builder
intended to plant replacement trees on a basis of 1/3 of the
total amount of DBH inches to be removed.
There was considerable discussion on the saving of a 15" DBH
oak, proposed for removal, in the front of the lot but not
within the house footprint. Mr. Cooper advised that the tree
was located in the planned walkway leading to the front door
of the residence. He also pointed out that the overhanging
roof of the structure would be in contact with the canopy of
the tree. Several types of modification were suggested to
Mr. Cooper which would allow for the saving of the tree.
Hope Van Nortwick moved to accept the plans, as presented,
with the exception that the 15" DBH oak in the front of the
lot remain and that a total of 24" DBH hardwood trees be re-
placed on the lot, with a minimum of 3" DBH each. Mae Jones
seconded the motion which passed by a vote of 3-1 (J. Pelkey
against) .
Discussion followed on the recent ruling by the City Commis-
sion

sior, on the Tree Board' s requirement of replacement trees on
Lot # 20, Unit # 3, Oceanwalk. The Board members expressed
concern on the assertion by t h e City Attorney on the Board' s
inability to legally require replacement tree planting as a
form of mitigation.
George and Carl explained the Mayor' s request at that meeting
for staff, the Board and the City Attorney to meet for the
purpose of considering an amendment to the Ordinance to in-
clude a provision for mitigation. The Board discussed some
changes that they would like to incorporate and the staff
Committee will work to draft these into an amended ordinance
to be reviewed with the City attorney and the Tree Board
prior to the Commission meeting of March 27. Alan Jensen as
well as Mayor Fletcher are to be asked to attend the regular
Tree Board meeting of March 20.
Rick Beaver again brought up the infractions by the builders
in Section H, discussed at previous meetings, and which have
not been corrected. George Worley will handle, including the
issuance of "stop work" orders on the property if necessary,
for their failure to comply with proper tree barricading dur-
ing construction.
The letter to Safa Mansouri with Tiffany by the Sea, discus-
sed at previous meetings, was passed around for review. It
will be mailed over Hope' s signature, on March 7.
Hope Van Nortwick moved to approve the minutes of the last
meeting, as written. Mae Jones seconded and the motion unan-
imously passed.
There was no other business before the Board, and the meeting
was adjourned at 8:40 PM.
