Minutes of April 3 , 1995
The Board held its regular meeting on Monday, April 3 , in
the City Commission Chambers . Present were:
Hope Van Nortwick, Chairman Tom Frohne
Richard Beaver
Staff: George Worley, Designee Carl Walker, Coordinator
The meeting was called to order at 7 : 30 PM by Hope Van Nort-
wick, Chairman, in the City Commission Chambers .
The first tree removal application discussed was for Lot #83 ,
Unit #1 , Oceanwalk. Jim Lee , representing Mariah Homes , the
contractor, was present and confirmed that the plans had not
yet been presented to the Oceanwalk Architectual Review Com-
mittee. The Board pointed out that it was difficult to con-
sider the plans since neither the application or the survey
gave specific sizes on the trees proposed for removal or for
those to remain on the lot .
It was recommended to Mr. Lee that he return to the Board at
the next meeting with a more detailed application and survey.
It was also suggested that he obtain approval from Oceanwalk
prior to reappearing before the Tree Board.
David Willis , builder representing the property owners , was
present for the review of the next application for removal at
1948 Sevilla Boulevard, West. The survey included in the
plans did not show any sizes or descriptions for any trees on
the lot and no size was shown on the application for the 15
red maple clusters proposed for removal . Mr. Willis agreed
to return to the Board at their next regular meeting after
submitting a revised application and survey.
The application for Lot #1 , Block #183 , Section H, was re-
viewed with Mr. Gaudling , project manager for Dean Russell
Construction. Questions by Board members raised at the last
meeting on the application were answered and Mr. Gaudling was
cautioned about proper tree barricading practices to protect
the trees to remain on the lot. Rick Beaver suggested that
a tree surgeon be contacted to check the 30" DBH magnolia on
the tree to perform surgical work on the tree , as needed.
. It was noted that efforts had been made by the builder to
save a 14" oak in the driveway area and that additional trees
had been kept on the lot due to the placement of the house.
It was agreed that the dead 8" oak in the front of the lot
should be replaced although a good tree canopy remained else-
where on the property.
Rick Beaver moved to accept the plan as presented with the
exception that one 4" DBH hardwood tree be replaced in the
area of the lot where the dead 8" DBH oak was to be removed.
Tom Frohne seconded and the motion unanimously carried.
Hope Van Nortwick read to the Board a letter dated March 22
from Safa Mansouri with Tiffany by the Sea ( see attached ) .
The Board discussed each of the five conditions outlined by
Mr. Mansouri in his letter. George will prepare a response
for Hope ' s signature .
The draft of the proposed amendment to the Tree Ordinance was
further discussed and a few changes made in the wording of
the criteria for determining mitigation ( Sec . 23-17 f ) . The
Board also expressed that the wording of the owner occupied
residential provision ( Sec . 23-19 b) was somewhat confusing
to those unfamiliar with the intent of this provision. It
will be reworded prior to presentation to the City Commission
First reading of the proposed amendment is tentatively sche-
duled for the Commission meeting of April 10 .
The subject of enforcement of proper tree barricading prac-
tices was again discussed. George has again contacted the
offenders discussed at previous meetings and a stop work or-
der will be issued on April 4 if they are not in compliance .
It was suggested that inspections for proper barricading be
made a part of the responsibility of Code Enforcement .
The minutes of the last meeting were reviewed and a motion
made by Rick Beaver to accept them, as written. Tom Frohne
seconded and the motion passed unanimously. With no further
business, the meeting was adjourned at 9 : 10 PM.

Re: Tree planting at Tiffany
Dear Ms. Van Nortwick:
I have considered your proposal dated 3/21/95 regarding planting of trees along the Right of Way
on Saturbia Drive, and I find it agreeable with the following conditions:
1- This would completely fulfil my obligation to the City.
2- The trees are assumed to be any variation of Oak(I will decide on the type, and base
my decision on hardiness, shape, and salt tolerance) with a DBH of at least 3".
3- We will not accept any responsibility or liability for any damage to underground
utilities, wiring, street, etc.
4- Liability with respect to replacement guarantee be limited to 2 trees since we cannot
guarantee proper maintenance.
5- Credit be given to us for the planting of over 38 Palmetto trees, 2 Live Oaks, 1 Patio
Ligustrum, and 2 Canary Island Palms, in the right of ways and common areas in exchange for
the remaining trees.
Please let me know ASAP if these conditions meet your approval, so that I may commence work
immediately.
