Present were Chair Barbara Mears, Bill Permenter, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. Absent was Tom Hill. 1. Call to Order The meeting was called to order at 7:04 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meetings of ,Tune 25, 2003 A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to approve the Minutes of the Trce Conservation Board meeting of June 25, 2003. 4. Old Business 1. 1814 Hickory Lane: This agenda item was moved to the end of New Business. 5. New Business: A. Tree Removal Applications: 1. Begonia Street Sewer Extension: Mr. Bob Alligood introduced himself and explained that he would like to remove trees to allow for an extension of a sewer line from Jasmine Street to the west to Begonia Street. Mr. Alligood advised that he wrote a letter to the mayor in December and requested that the city consider sharing the cost of the sewer line since it is being built to serve not only his lots but also would be available to serve other lots that were currently on septic tanks. He stated that he was advised that the city would not contribute to these costs but that he could design the sewer line to support his lots only. In response to a question from Board Member Permenter, Building Official Ford advised that the mitigation for removal of trees on rights-of--ways was 100 percent. Concern was expressed in regard to the two large pines that were proposed for removal. Building Official Ford advised that during the February 12, 1990, Commission meeting, the 34" pine had been protected. Discussion was held with regard to shifting the sewer line to save the pines. Building Official Ford presented a re-design to save the trees. He stated that with the elimination of certain materials and the cost to restore the street that there would be no additional cost to shift the sewer line, and all the trees would be saved. Mr. Alligood did not agree and advised that he could put in septic tanks and would avoid these problems. Further discussion was held and Mr. Alligood advised that he would follow the city's suggestions if the city departments would work together to coordinate this project. Chairs Mears suggested that it would be a savings to the city to share in the cost to install the stubs rather than to have to tear out the paving at a later date. Building Official Ford advised that historically the city had not shared developers' costs. Minutes of Tree Conservation Board July 9, 2003 Page 2 A motion was made by Board Member Permenter, seconded by Board Member Sliaugl~nessy, and unanimously carried to direct the Building Official to investigate with Public Works the re-design of the sewer system to avoid a 36" pine, a 31.5" pint, an 8" oak, an 11" oak, and a 21" t•vin oak located in the right-of=way. In addition, the Board suggested that Public Works consider installing taps for the adjacent properties while this project was being built to prevent future damage to trees. 4. Old Business 1. 1814 Hickory Lane: Building Official Ford advised the Board that the applicant would like to remove additional trees to install a pool. He further advised that the Code states that protected trees must survive for one year. Chair Mears stated that the 30" live oak had galls, it had been filled and cared for and the canopy looks fine with no signs of stress. A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter, and unanimously carried that the applicant re-submit a proper Tree Removal Application, that the trees used for mitigation from the previous application must survive for one year from the issuance of the Certificate of Occupancy, that the 30" live oak is fine and t}iat the board recommended that it remain. 6. Reports and Announcements The board recommended changes to the Tree Removal Application as follows: 1. Page 1: Change "Page 1 of 3" to "Page 1 of 4" 2. Page 2: Number 2: Correct the spelling "Brest Height" to "Breast Height" 3. Page 4: Add column "Inches to be paid into the Tree Fund" 7.
