MINUTES OF THE REGULAR MEETING OF THE TREE CONSERVATION BOARD August 27, 2003 A regular meeting of the Tree Conservation Board was held Wednesday, August 27, 2003, at the City Hall Conference Room. Present were Chair Barbara Mears, Charles Carroll, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. Absent was Bill Permenter. 1. Call to Order The meeting was called to order at 7:03 p.m. 2. Introduction of New Member Chair Mears introduced new board member Charles Carroll. 3. Recognition of Visitors None. 4. Approval of Minutes of Meetings of August 13, 2003 A motion was made by Board Member Shaughnessy seconded by Board Member Carroll, and unanimously carried to approve the Nlinutcs of August 13, 2003, as written. 5. Old Business A. Tree Removal Applications: None. 6. New Business A. Tree Removal Applications: 1) Lot 5, Block 56 (West 14"' Street): This item was addressed later in the meeting. 2) Lot 639, Section 1, Saltair (Magnolia Street): This item was addressed later in the meeting. 3) Lot 1, Block 144, Section H (Begonia Street): The applicant, Mr. Bob Alligood, was present at the meeting. Chair Mears advised that the applicant was removing a protected 20" pine and a protected 12" oak, and the applicant had 16.75" of oak for mitigation on site. A motion was made by Board Member Sliauglinessy, seconded by Board Member Carroll, and unanimously carried to direct the Building Official to issue a permit for the removal of a 20" of pine and a 12" of oak to be mitigated on site with 16.75" of oak to consist of an 8" oak, a 4" oak and a 4.75" oak. 4) Lot 2, Block 144, Section H (Begonia Street): The applicant, Mr. Bob Alligood, was present at the meeting. Chair Mears informed Mr. Alligood of the following additional trees on site that were not shown on the survey: an 8" palm, a 24.75" double oak, a 25.5" double oak and a 7" palm. Mr. Alligood advised that these trees were not to be removed. Chair Mears advised the applicant that the 5" magnolia and the 7"palm located in the city right-of--way were under the jurisdiction of Public Works. The board determined that no protected trees were being removed. A motion was made by Board Member Shaughnessy, seconded by Board Member Carroll, and unanimously carried to direct the Building Official to issue a permit for the remova[ of trees with no mitigation required. In addition, the board recommended to Public Works Minutes ojTree Conservation Board August 27, 2003 Page 2 that they allow the removal of the 7" palm and the 5" magnolia in the right-of--way with no mitigation required. Begonia Street Sewer Extension: Mr. Alligood informed the board that he redesigned the sewer plan as proposed by city staff, and Public Works approved the new plan. 3) Lot 639, Section 1, Saltair (Magnolia Street): Mr. Robert Pennington, the applicant, introduced himself. Chair Mears stated that the applicant was proposing to remove all the trees on the site except for the China Berry, which was an invasive tree. Chair Mears requested that the applicant remove the China Berry tree. Mr. Pennington responded that all the trees proposed for removal were located in the interior zone so he had no choice but to remove them. Chair Mears stated that the 96.25" maple cluster should have been pruned for it's health so the board reduced the size of the maple cluster to 76.26." Chair Mears advised the applicant that palms must be mitigated with palms, maple must be mitigated with hardwood and all trees must be planted at least ten feet apart. Mr. Pennington asked if he could plant the trees on the right-of- way. Building Official Ford responded that the applicant could plant trees in the right-of--way if the board allowed off-site mitigation. The board discussed off-site planting. Chair Mears informed Mr. Pennington to be very careful when planting trees around underground lines. Building Official Ford stated that the applicant must call for locates prior to planting. A motion was made by Board Member Sluaugtunessy, seconded by Board Member Carroll, and unanimously carried to direct the Building Official to issue a permit for the removal of 32" of palm and 76" of maple to be mitigated as follows: 1) 10" at $117.00 per inch to be paid into the Trec Fund; 2) plant additiona128" of Hardwood and 16" of palm on site; and 3) allow applicant to plant on the property line or on the right-of--way with approval of Public Works. In addition, the board requested that the China Berry tree be removed with no mitigation required. 1) Lot 5, Block 56 (tiVest 14`h Street): Building Official Ford advised that Mr. Smallwood was not able to attend the meeting but he had requested that the board review his application. Building Official Ford advised that the applicant was going to relocate the 7.32" oak on site and would like to use this tree for mitigation. A motion was made by Board Member Shaughnessy, seconded by Board Member Carroll, and unanimously carried to direct Building Official to issue a permit for the removal of 50.5" of pine to be mitigated with 25.25" of hardwood as follows: a 5.75" oak was to be protected on site and 19.50" of hardwood tivas to be planted on site or paid into the Trce Fund. 7. Reports and Announcements Champion/Challenger Tree: Chair Mears informed the board that she researched "champion" trees with the Department of Forestry who advised that a "champion" tree was determined by several criteria to include history, height and diameter. She stated that she found that there were only 20 "champion" trees in the entire state of Florida. Building Official Ford advised that the Tree Conservation Board had designated five "champion" trees since he had been assisting the board, and they were all located in Tresca Park. The board discussed how to save trees such as a 36" oak. Chair Mears requested that the city purchase a book from the State of Florida which included the definitions of "champion" and "challenger" trees. Discussion was held with regard to possibly changing the ordinance to include the definition of "challenger" trees. Minutes ojTrec Conservation Board Au~~st 27, 2003 Pagc 3 Begonia Street Sewer Extension: Building Official Ford displayed the amended plans for the Begonia Street Sewer Extension. He advised that originally Mr. Alligood was going to remove nine trees including a 34" pine and a few large oaks. However, Building Official Ford stated that Mr. Alligood amended the plans pursuant to staff suggestions so no trees will be removed. 8.
