MINUTES OF THE REGULAR MEETING OF THE TREE CONSERVATION BOARD September 10, 2003 A regular meeting of the Tree Conservation Board was held Wednesday, September 10, 2003, at the Adele Grage Cultural Center. Present were Chair Barbara Mears, Clyde Bradley, Charles Carroll, Bill Permenter, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order at 7:02 p.m. 2. Introduction of New Member. Chair Mears introduced new board member Clyde Bradley. 3. Recognition of Visitors None. 4. Approval of Minutes of Meetings of August 27, 2003 A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter, and unanimously carried to approve the Minutes of August 27, 2003, as written. 5. Old Business A. Tree Removal Applications: 1) Donners R/P Pt, Govt. Lots 2, 3, 4 Bock 21 (Simmons Road): Mr. Bill Barnett introduced himself. Discussion was held with regard to mitigation trees and Mr. Barnett stated that he would like to plant four oak trees, possibly five, but would like the option to pay into. the Tree Fund in case he was not able to plant all the trees on site. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to direct the Building Official to issue a permit for the removal of 57" of oak to be mitigated with 28.5" of oak to be planted on site or paid into the Tree Fund at $117 per inch. Board Member Bradley questioned the applicant with regard to planting the mitigation trees near overhead power lines. Mr. Barnett responded that the site plan showed the trees to be planted under the power lines but they would most likely be planted six to eight feet back from the lines. Discussion was held with regard to code requirements. Board members could not locate in the Tree Ordinance any reference to a requirement with regard to planting distance from power lines. Board Member Bradley stated that the Tree Removal Application required that utilities be shown on the site plan and that incomplete site plans should be rejected. Chair Mears stated that the board attempted to get all the information from applicants but it was very rare to have an application filled out correctly. Board Member Permenter advised that it was not the board's responsibility to monitor where trees were planted, it was the responsibility of the Building and Zoning Department. Building Official Ford informed Board Member Bradley that he was viewing a preliminary site plan related only to tree removal. He further advised that when the final plans were given to the Building Department, four different departments reviewed them at which time they determine that trees are not to be planted near any water lines, sewer lines or underground electric. Board Member Bradley reiterated that he would like to see complete plans presented to the board. Minutes of Tree Conservation Board September 10, 2003 Page 2 Building Official Ford responded that many times they were dealing with a 1,300 square foot home and it would be cost prohibitive for the applicant to pay a professional surveyor to show all items on the plans. Board Member Bradley responded that he did not care about the cost, that plans should be complete. Board Member Bradley resigned from the board and left the meeting at 7:25 p.m. 6. New Business A. Discussion and possible action to amend the Tree Ordinance to include the definition of "Challenger" tree. Chair Mears distributed an inventory of local trees listed in "Big Trees-The Florida Register." Board Member Shaughnessy advised that she acquired a list from the National Arbor Foundation. In addition, she stated that she found a 217" oak tree in Little Talbot Island while exploring. Discussion was held with regard to historic corridors. Board member Carroll proposed designating Hickory Lane, North Sherry Drive, Selva Marina Drive, Live Oak Lane, 19"' Street, Oak Circle and Creekside Circle as a historic corridor to protect the canopy over the roads. Building Official Ford stated that he would draft an ordinance and bring it to the next meeting. He also advised that this would require legal review, and a tree survey would need to be accomplished done to identify the trees to be protected in the rights-of--ways. A motion was made by Board Member Carroll, seconded by Board Memher Shaughnessy, and unanimously carried that the board look into the possibility of designating Selva Marina Drive, North Sherry Drive, Live Oak Lane, Hickory Lanc, 19te Street, Oak Circle and Creekside Circle as a historic preserve corridor as outlined in Section 23-47(c) of the Tree Ordinance. A motion was made by Board Member Carroll, seconded by Board Member Shaughnessy, and unanimously carried to prepare documentation that would be reviewed by new homebuyers to make them aware of the Tree Ordinance and any protected corridors. 7. Reports and Announcements 223 Ocean Boulevard: Board Member Shaughnessy advised that a cedar tree at this construction site was not barricaded. 106 West 3rd Street: Building Official Ford advised that this owner was entitled to cut down the trees because she was not cutting them down for construction purposes. Main Street: Board Member Shaughnessy stated that a 16" palm tree was removed last week. Building Official Ford responded that he would check this at final inspection. He also stated that if he had removed a protected tree, he would have to mitigate at 100 percent. 8. Adjournment There being no other business or discussion, the meeting was adjourned at 8:02 p.m. Barbara Mears, Chair
