Adjournment • If any person decides to appeal any decision made by the Tree Conservation Board at the above meeting, he will need a record of the proceedings, and for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record shall include the testimony of evidence upon which appeal is to be based. • MINUTES OF • TREE CONSERVATION BOARD April 16, 2001 A regular meeting of the Tree Conservation Board was held Monday, April 16, 2001, in the City Hall Commission Chambers. Present were Chairperson Mae Jones, Richard Bell, Camille Hunter, Judith Jacobson, Barbara Mears and Deputy Building Official Rusty Jakes. 1. Call to Order Chairperson Jones called the meeting to order at 7:35 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of April 2, 2001 A motion was made by Board Member Mears and seconded by Board Member Jacobson to approve the Minutes of the Tree Conservation Board Meeting of April 2, 2001. Board Member Hunter requested that the Minutes of April 2, 2001, be corrected as follows: 4.B.,third sentence to be changed as follows: "Board Member Hunter also stated that the trees with the double asterisk listed under the"Not Recommended for Mitigation"list are trees that she expects will soon be added to the list of the trees that are illegal to propagate and sell in Florida." A vote was taken and all members voted against the motion approving the Minutes as presented. • A motion was made by Board Member Hunter, seconded by Board Member Bell and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of April 2, 2001, as amended. 4. Old Business A. Recommended Tree List: This item was moved to the end of the Agenda at the request of Chairperson Jones. 5. A. New Business/Tree Removal Applications 1. Lot 2, Block 148, Section H: Mr. Warren Brew introduced himself and stated that he represents George and Janet Brew. Mr. Brew advised the Board that they would like to move the 3"and 4"water oaks located in the proposed driveway and the 8"and 4"water oaks located in the proposed walkway. Board Member Jacobson advised Mr. Brew that she found four multi-trunk water oaks that are protected measuring 25", 27", 22"and 24",totaling 96"of oak. The Board determined that the pine located at the back of the lot is 22"and not 30". Discussion was held with regard to whether or not the trees can be relocated on the lot. Chairperson Jones advised Mr. Brew that he has 10"of oak on site that can be used for mitigation. The Board moved on to the next application to determine if the applicant could use any trees on Lot 3 for the mitigation required on Lot 2. 2. Lot 3, Block 148, Section H: Mr. Brew stated that he is requesting approval to remove a 21"live oak, a 25" live oak and a 20"pine. Chairperson Jones stated that she agreed with the applicant that the 18"live oak was not in good condition Sand,therefore, would not require mitigation. The Board made the following corrections to the tree survey: the 20"pine is a 16"pine,the 21"live oak is a 19.2"live oak and the 25"live oak is a 23.24"live oak. The *Minutes of Tree Conservation Board • April 16, 2001 Page 2 • Board determined that the applicant needs to provide mitigation for a 7"water oak at the back of the property, a 23"live oak in the center of the property and a 7"twin oak in the front of the property for a total of 37"of live oak. Discussion was held with regard to which trees located on the lot the applicant could use for mitigation. Chairperson Jones advised the applicant that the trees designated for mitigation must be protected during construction. The Board determined which trees on Lot 3 could be used for the mitigation required on Lot 2. Lot 2, Block 148, Section H: A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 22" of hardwood and 96" of oak to be mitigated with 10" of oak preserved on site and the remainder of 38" of oak and 11" of hardwood to be planted on site. Lot 3, Block 148, Section H: A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 37" of oak to be mitigated with 19" of oak preserved on site. 3. 66 Dewees Avenue: The applicant was not present to address the application. The Board determined that the measurements of the trees and the species were incorrect. The Board also determined that there were two trees located in the City right-of-way. Chairperson Jones stated that the applicant should have had a permit from the Tree Board before they began work on the driveway. In addition, Board Member Hunter advised that there is a big hole with tree roots at the corner of the driveway and that a tree had obviously been removed at some time. • Discussion was held with regard to whether or not the applicant could continue with construction. The Board determined that the applicant could not remove the 18"bay. Further discussion was held with regard to whether or not the Board could move forward with this application due to its inaccuracies. A motion was made by Board Member Hunter, seconded by Board Member Jacobson and unanimously carried that this application be deferred due to problems with the application including the incorrect naming of the species, incorrect measurements and issues having to do with whether or not the trees are in the driveway and the City right-of-way which this Board cannot act upon. 4. Old Business A. Recommended Tree List: Discussion was held with regard to trees the Board should accept for mitigation. Board Member Jacobson stated that Article II, Tree Protection, Sec. 23-17(e)(2)a of the Atlantic Beach Code states: Trees shall be a species having an average mature crown spread of no less than thirty (30)feet in Northeast Florida. Based on the above,the Board determined that they would not require mitigation on the Crape Myrtle tree. Board Member Jacobson also stated that Article II, Tree Protection, Sec. 23-15, Intent, (2) states: Improve environmental quality by recognizing the numerous beneficial effects of trees upon the environment. She stated that this statement in the code should be referenced when the"Not Recommended for Mitigation List and the "Not Acceptable for Mitigation List"are finally approved. The Board requested Board Member Hunter to create the following lists: "Recommended Tree List,""Not Recommended for Mitigation List"and"Not Acceptable for Mitigation List." Board Member Jacobson • ' ? Minutes of Tree Conservation Board ' April 16, 2001 Page 3 0 clarified that the"Not Acceptable for Mitigation List"will include trees that the Board would not require mitigation on and would not accept as mitigation. 6. Reports and Announcements Board Member Hunter advised the Board that she has spoken with Alan Jensen,the City Attorney for Atlantic Beach, regarding a complaint filed against her with the Commission for Ethics. She stated that she advised Mr. Jensen that she never received a letter from the City of Atlantic Beach advising her that that she was required to fill out a disclosure form. She further stated that an investigator has been investigating this issue and agrees that there is no documentation to support that she received a letter from the City of Atlantic Beach. Board Member Hunter informed the Board that a hearing is scheduled in June in Tallahassee and Mr. Jensen advised her that he is available to assist her with this issue. 7.
