Adjournment • If any person decides to appeal any decision made by the Tree Conservation Board at the above meeting, he will need a record of the proceedings, and for such purpose,may need to ensure that a verbatim record of the proceedings is made, which record shall include the testimony of evidence upon which appeal is to be based. • • MINUTES OF TREE CONSERVATION BOARD May 7, 2001 A regular meeting of the Tree Conservation Board was held Monday,May 7, 2001, in the City Hall Commission Chambers. Present were Chairperson Mae Jones, Richard Bell,Barbara Mears,Judith Jacobson,Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order by Chairperson Jones at 7:35 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of April 16,2001 Board Member Jacobson requested that the Minutes be corrected as follows: (1)4.A. Recommended Tree List,paragraph 2, line 2: delete Redbud, Chinese Tallow,Popcorn Tree, Chinaberry, Citrus, Fringe Tree,Glossy Privet,Golden Rain Tree and Wax Myrtle. (2)4.A. Recommended Tree List,paragraph 3, line 3: change"She stated that if these trees have a negative affect on the environment,this further substantiates the Board's position."to"She stated that this statement in the code should be referenced when the 'Not Recommended for Mitigation List' and the 'Not Acceptable for Mitigation List' are finally approved." 41/) A motion was made by Board Member Jacobson,seconded by Board Member Mears and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of April 16, 2001, as amended by the changes in Section 4.A. on the Recommended Tree List. 4.A. Old Business/Tree Removal Applications 1) 66 Dewees Avenue: Mr. Matthew Fennell introduced himself as the contractor for the applicant. Mr. Fennell pointed out that the 6"oak tree next to the garage on the north side of the lot will conflict with the overhang that he would like to add to the side of the garage. In addition,he stated that the bay tree is located in the City right-of-way. Discussion was held with regard to jurisdiction of trees in the City right-of-way. Mr. Ford stated that at the request of the Public Works Department and the City Manager,the Tree Conservation Board previously reviewed trees in the City right-of-way. Mr. Ford advised that the Board could make a suggestion as to the disposition of the tree. Board Member Bell advised Mr. Fennel that the 8"oak by the porch is a 9"bay,the 6"oak by the garage is an 8"bay,the 18"double bay is 17",the 4'/."and 4"oaks in the entryway are yaupon hollys and the 7" bay by the air conditioner is oak. Board Member Bell stated that if the applicant is going to move his driveway,then he should mitigate for the 7 %2"bay on the City right-of-way. Chairperson Jones asked Mr. Fennel why he needs to remove the 11"bay. Mr. Fennel responded that if he removes the berm to install the driveway,then this would undermine the root system of the tree. III ' Minutes of Tree Conservation Board May 7, 2001 Page 2 1111 A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of 36" of hardwood requiring 18" of mitigation to be mitigated on site by the preservation of two yaupon hollys and a 13" oak. A motion was made by Board Member Mears, seconded by Board Member Bell and unanimously carried to recommend to the Public Works Department to allow the owner to remove the 7.5" bay and mitigate it with a new 4" hardwood tree to be planted in the City right-of-way adjacent to the property. 5.A. New Business/Tree Removal Applications: 1) Lot 95, Saltair Section No. 3: Mr. Chris Lambertson introduced himself to the Board and stated that they have worked very hard to try to save the trees on the lot. He advised that they went before the Community Development Board a month ago and requested a 5-foot relief at the front of the property to allow them to move the building forward to save the magnolia and oak trees at the back of the lot. He said that they were able to save the large oak tree at the front of the lot by curving the driveway around the tree. Chairperson Jones advised Mr. Lambertson that the 16"chinaberry tree is a mulberry tree. The Board determined that the removal of 13"of mulberry and 43"of pine requires 28"of mitigation. Mr. Lambertson asked the Board if there was any relief that could be provided with regard to mitigation since they worked so hard to save the oak and magnolia trees. Board Member Bell responded that the oak • and magnolia are protected trees and Mr. Lambertson is expected to attempt to save them. In addition, Board Member Bell pointed out that the advantage to saving the trees is that Mr. Lambertson saved himself further mitigation. A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of 56" of hardwood to be replaced on site with 28" of hardwood. 2) Lots 1, 2 and 3, Block 21, Plat No. 1, Subdivision "A": Mr. Claude Caviness introduced himself and advised that their intention at 407 Beach Avenue is to neither change the elevation nor the character of the property. He further stated that the specifications to the bidder and the executed contract state, "Any trees or mature plant growth requiring removal for either the demolition or the new construction that the contractor believes will not survive transplant will be replaced in kind and installed as close as practicable to the original location. There is an expectation that the contractor will provide new trees or mature plants." Mr. Caviness advised that he believes there are five palm trees located in the City right-of-way and requested that the Building Official deal administratively with the disposition of those trees. Chairperson Jones advised the applicant that the trees in the right-of-way are public trees so he could only transplant them on City right-of-way. The Board determined that the applicant was removing 40.12"of palm. Mr. Caviness stated that their intent is to relocate the trees and have the grove look essentially as it does now. • i' Minutes of Tree Conservation Board May 7, 2001 Page 3 110 A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of 40.12" of palm tree to be mitigated by a minimum of 20.06" of palm tree transplanted on site. A motion was made by Board Member Bell, seconded by Board Member Mears and unanimously carried to recommend to the Public Works Department to allow the five trees in the right-of-way to be moved to an adjacent location in the right-of-way. 6. Reports and Announcements 1) Mr. Ford advised that he received a letter from Bestcon Corporation indicating that they are creating another subdivision called Hidden Paradise. Mr. Ford stated that Mr.Nichols would like to schedule a workshop with the Tree Board to discuss the property. He said that prior to creating the final tree survey, Mr. Nichols would like to meet at the site with the Board. The Board determined that a workshop to walk the site,take measurements and vote would be an efficient use of their time. Discussion was held with regard to the time to hold the workshop. Chairperson Jones requested that Mr. Ford advise Mr. Nichols that the Board is in favor of the idea. 2) Mr. Ford advised the Board that the City is very short staffed. He advised that Pat Harris is still on leave and George Worley is no longer employed with the City. Mr. Ford stated that he would prepare a quarterly report for the next meeting. 3) Chairperson Jones asked about the status of the historical tree survey. Mr. Ford stated that the City's • IT person is still trying to retrieve documents that Mr. Worley stored on one of the drives. Mr. Ford advised that he has begun taking pictures to put together another presentation. 7.
