TREE CONSERVATION BOARD
August 6, 2001
A regular meeting of the Tree Conservation Board was held Monday, August 6, 2001, in the City Hall
Commission Chambers. Present were Chairperson Mae Jones, Richard Bell, Camille Hunter, Judith
Jacobson, Building Official Don Ford and Susan Dunham.
1. Call to Order
Chairperson Jones called the meeting to order at 7:40 p.m.
2. Recognition of Visitors
None.
3. Approval of Minutes of Meeting of July 16, 2001
A motion was made by Board Member Jacobson, seconded by Board Member Hunter and unanimously
carried to approve the Minutes of the Tree Conservation Board Meeting of July 16, 2001.
4.A. Old Business/Tree Removal Applications
1) Hidden Paradise Subdivision:
A motion was made by Board Member Jacobson, seconded by Board Member Hunter and
unanimously carried to address New Business first in light of the extensive work required on the
• application under Old Business.
5.A. New Business/Tree Removal Applications:
1. 640 Ocean Boulevard: Mr. Larry Hunt introduced himself and stated he is the superintendent for the
construction of this home and would represent the owner on this application. Mr. Hunt advised the Board
that they would not remove the 9.5 Sabal palm; instead, they would build the driveway around the palm.
Chairperson Jones asked Building Official Ford why this property did not come before the Board prior to
construction. Building Official Ford explained that the applicant did not originally intend to remove any
trees. Chairperson Jones responded that she was concerned because she has no knowledge of what was
under the foundation of the house prior to construction. Board Member Bell stated that he brought this lot
to the attention of Building Official Ford when a large pine tree was removed. Building Official Ford
responded that Mr. Geuther removed the pine tree approximately one year and three months prior to
applying for this permit. The Board determined that 28.33"of Sabal palm was being removed.
A motion was made by Board Member Jacobson, seconded by Board Member Bell and
unanimously carried to approve the application and direct Building Official Ford to issue a permit
for the removal of 28.33" of Sabal palm to be mitigated with the planting of a new 17" Sabal palm.
2) The north 40' of Lot 5, together with the south 40' of Lot 4, Block 130, Section H: The Board
moved on to the next Agenda item due to the fact that Board Member Bell was unable to verify the site
plan.
3) Lot 6 together with the south 10' of Lot 5, Block 130, Section H: Mr. Buddy Martin introduced
himself and stated that he is requesting tree removal permits to clear Lots 1 through 6 (Agenda Items
5.A.2-5)on which he plans to build four duplexes. Board Member Jacobson expressed her concern that
• she was unable to locate the 22"pine and that there were three additional large pines that were marked for

• removal on the lot but not shown on the survey. Mr. Martin presented an amended survey showing
additional trees on the survey. Board Member Jacobson stated that the additional trees Mr. Martin
presented were in the front of the lot and the trees she located were very close to the maple tree. In
addition, she stated that she would need to verify the survey before moving forward with the application.
Board Member Jacobson recommended that the applicant request the survey company return to the
property to correct the survey and then return to the Tree Conservation Board.
Board Member Bell advised Mr. Martin that the Board members assigned to verify the other three surveys
were not able to do so.
Board Member Hunter stated that when she looked at Lot 1, none of the markings matched her survey.
She asked Mr. Martin which property is located on West 6th Street and Mr. Martin responded that Lot 6 is
on West 6th Street. Board Member Hunter stated her survey indicates that Lot 3 is on West 6th Street so
she looked at the wrong property.
Discussion was held with regard to how the Board should address the rest of the applications. Building
Official Ford stated that the Board had an obligation to the applicant that was not fulfilled due to the
Board members not reviewing all the lots. The Board agreed to address Agenda Item 5.A.5. since there
are no protected trees being removed.
5) Lot 3 together with the north 10' of Lot 4 and the south 20' of Lot 2, Block 130, Section H:
Mr. Martin amended the site plan to include three 7"oaks to be removed. The Board determined that
there are no protected trees being removed on this lot.
• A motion was made by Board Member Jacobson, seconded by Board Member Bell and
unanimously carried to approve the application and direct Building Official Ford to issue a permit
since there are no protected trees being removed and no mitigation is required.
4) Lot 1 together with the north 30' of Lot 2, Block 130, Section H: Mr. Martin advised that there are
five trees located in the footprint including a 10"oak cluster. Discussion was held with the applicant with
regard to how to measure multi-trunk trees. Board Member Bell stated that when he reviewed this lot
previously,there was only one large tree on the lot, a 20"pine.
A motion was made by Board Member Bell, seconded by Board Member Jacobson and
unanimously carried to approve the application and direct Building Official Ford to issue a permit
for the removal of 20" of protected pine to be mitigated with 10" of hardwood on site.
2) The north 40' of Lot 5,together with the south 40' of Lot 4, Block 130, Section H; and
3) Lot 6 together with the south 10' of Lot 5, Block 130, Section H :
Chairperson Jones stated that she would like to have the opportunity to measure the trees on these lots. It
was requested that Mr. Martin have the surveys corrected and then come back before the Board.
A motion was made by Board Member Bell, seconded by Board Member Jacobson and
unanimously carried that the north 40' of Lot 5, together with the south 40' of Lot 4, Block 130,

• Section H and Lot 6 together with the south 10' of Lot 5, Block 130, Section H both be deferred
until accurate surveys are produced.
Discussion was held with regard to 44 Jackson Road due to the applicant's presence at the meeting. The
Board determined that they were not able to act on this application because it was not on the agenda.
4.A. Old Business/Tree Removal Applications:
1) Hidden Paradise Subdivision: Mr. Paul Nichols of Bestcon, Inc., introduced himself. He advised
the Board that they have designated the lot directly west of Lot 13 as a community picnic and storage
area. In addition, he said they would build a pole barn for community members to store canoes and
kayaks and the lot would provide access to the waterways. Mr. Nichols stated that since Lot 1 was
originally planned as the community picnic and storage area, he would have to come before the Board at a
later date to address this lot.
Mr. Nichols stated how difficult it is to understand the Tree Ordinance. The Board discussed the
possibility of preparing a laymen's guide for ease in interpreting the Tree Ordinance.
The Board determined that the applicant is removing 936"of oak and preserving 615"of oak on site.
A motion was made by Board Member Hunter, seconded by Board Member Jacobson and
unanimously carried to approve the application and direct Building Official Ford to issue a permit
for the removal of 1,505" of protected tree, of which 936" is oak,to be mitigated with 1,028" of tree,
• of which 615" is oak to be preserved on site,to be barricaded and must live for one year.
