Agenda Item 3AAGENDA ITEM # 3A MAY 23, 2011 May 16, 2011 ffu to TLJ W TO: The Honorable Mayor and Members of the City Commission FROM: Jim Hans City anager SUBJECT: Follow -u eport Johansen Park Several people at the last commission meeting said that it was their understanding that there were deed restrictions on the use of Johansen Park for "passive" recreation purposes. No such language exists in the park dedication documents. The park consists of four separate parcels that were dedicated to the City. Three of the four contain the following language; "...provided however, anything in this deed to the contrary notwithstanding, said tracks of land shall be used by the Grantee and its successors solely for park and beautification purposes, and upon discontinuance of such use, said tracks of land shall revert to the Grantor, its successors or assigns." The fourth parcel has a dedication that states "All terraces, drives, parks and easements for drainage, utilities and sewers as shown on said plat are hereby irrevocably and without reservation dedicated to the City of Atlantic Beach, Florida and its successors." Complaint about house on Ardella Road A citizen complained at the last meeting about the condition of a house located at 61 Ardella Road in Atlantic Beach saying that the house had been vacant, the doors and windows had been broken out, there had been graffiti painted on the house, and neighborhood kids had been seen inside. The house at 61 Ardella Road is owned by David Boerm who had already been cited by the City's Code Board for various violations. The case had already been scheduled to come back to the Code Board the night after the last city commission meeting (May 10 at which time the Board learned that the various violations at the residence had been brought into compliance before the meeting. The Board decided to lower the fines previously levied to $500 plus administrative fees. The person that complained about the violations at this address was notified that the issue was to come to the Code Board so that they could attend the meeting if they wanted.
