Miller: I am responding to your letter dated June 28 , 1995 regarding a screened enclosure constructed at 1494 Linkside Drive in Atlantic Beach. I apologize for the lengthy time period we have taken to investigate this complaint . We are a two-man department -and this is the busiest time of the year for us . Mrs . Geraldine Meyer applied for a permit on July 25 , 1995 after three meetings with myself and Mr . Grunewald, Code Enforcement Officer . Mrs . Meyer had the structure built by Able Screen and Awning of Jacksonville on or about March 7 , 1995 . As a homeowner, Mrs . Meyer' may obtain a homeowners permit for this structure . Due to the fact she is obtaining an after the fact permit the permit fee will be doubled. Mrs . Meyer has secured an attorney to convince Mr . Mac Matthews of Able Screen and Awning to accept responsibility for this job and to insure he follows up any quality control problems at her screen room. The normal inspection process will be followed by the Building Department to insure the structure is built according to the code. The three requests you have asked for in your letter cannot be adhered to due to legal restrictions placed on the department in regard to guidelines established by city ordinance and the Standard Building Code. You are welcome to review any and all of the building files and correspondence concerning this case. May 30, 1995 Carl Grunewald, Code Enforcement Officer City of Atlantic Beach City Hall Atlantic Beach, Florida Ref: Un-permitted screen enclosure addition to 1494 Linkside and my fax message of May 23 and your phone call to me also on Tuesday Dear Mr. Grunewald: As I explained to you on our phone conversation Tuesday, May 23rd, our chapter meeting was yesterday, May 24th. I related your comments and explanation to the membership with respect to this case and sought their comments and guidance in selecting a course of action. First, I want to relate to you the substance of their comments so that you will know how they felt about this situation. Prior to doing so, however, you should know that our feelings are expressed candidly in an effort to resolve this issue (and issues like this one) and should not be taken personally, the comments were not meant as such. Also, I think that there is a great temptation to take this one anecdote and make an unfair inference that this is a'typical' example of bureaucratic behavior. We are making a conscious effort not to succumb to this temptation. Rather, our fond hope would be that the resolution of this problem would be a typical example of how public and private sector entities can work in concert to facilitate public safety accompanied by law-abidding commerce, for the greater good. For the sake of this discussion, I shall refer to the homeowner at 1494 Linkside as"Ms. H", and to the builder of the enclosure as"Builder". The ire of the membership is directed at both the Builder and Ms. H, but principally the Builder.This is a person (pseudo-contractor in the sense that no evidence of a license has yet surfaced)we would like to eliminate as unjust competition, thus we would like to track him down (in the administrative sense)and facilitate some financial penalty or penance for this act as a means of discouraging him from repeat performances. Point 1) Ms. H presumably chose this Builder for some reason, we suspect that her motivations were financial. You know that she has likely paid less for this job than she would have to someone who had gotten a permit to do the work. Thus, she has had an ongoing investment in exploiting your compassion as an official of Atlantic Beach. Even if this Builder were duly licensed and therefore had all of the required expensive insurance coverages (which, we suspect, is not the case) and did not have a price advantage for that reason, he still would have a significant price advantage for not permitting the job. That is: 1)so far as I am aware, your building department is requiring concrete footings, but, no permit, no need for footings, money saved; 2) no cost of drawings; 3) no cost of permit fee; 4) no cost of carrying the permit to the building department; 5) no waiting to start the job until a permit has been obtained, and especially without the footing requirement; 6) moreover, the builder is relieved from responsibility for making any and all job corrections that may have been required as a result of a building inspection, and all of this is assuming that this Builder is paying all of the normal and customary costs of doing a legitimate contracting business, which we both suspect is not the case. Therefore, this individual had an unjust financial competitive advantage part of which was transferred to Ms. H by virtue of their contractual arrangement to construct this job. But, the other citizens of Atlantic Beach and the city administration have also lost an appreciation of property appraisal/value by virtue of the addition as facilitated by the building permit, thus Ms. H escapes a potential property tax increase and her share of this tax burden falls upon her neighbors. Point 3) Neither of us have any assurance that this job was constructed in a manner that would be consistent with similar work done with permit, plan checking and inspection. Presumably, one of the rationales for having a building department at all is so that future purchasers of properties can be at least partially assured that a bureaucratic overseer has protected them by maintaining a minimum standard of structural integrity. Ms. H's addition has yet to have this scrutiny. A more'gut-level' expression of frustration goes like this, "Look, the guilty go free while in the innocent are punished." (Punished in the sense that they are jumping through the administrative hoops and investing the necessary funds to comply with the law) We are committed to not letting this situation remain stagnant. We have no interest in or propensity for embarrassing you or your department. We look forward to resolving this with you and/or your department quietly, efficiently, and effectively. This is what we want: 1) Learn (if you have not already)from Ms. H the identity of the Builder and advise us, there is a possibility that this individual is a licensed contractor and would be subject to censure in many forums for that reason by virtue of this act. If you have not already done so, get a copy of Ms. H's agreement with this Builder. Let us render to you an opinion as to how much money, if any, Ms. H has saved as a result of her complicity. 2) Let us (the building official [Don Ford], yourself, and at least one and no more than two, of us), in concert, inspect the job,to make an assessment of its compliance with current standards and structural integrity. 3) On the basis of information gleaned by actions#1 and#2 then determine a just(fair)financial penalty for Ms. H and/or Builder, and further,what work should be done to this job to bring it into compliance. Please recall my preface, we are not looking to do finger-pointing at you or Atlantic Beach. Let's try and work this out together for the benefit of all parties.
