party of the first part" hereinafter called Developert and R-C.-
B-S Corporation, a Florida Corporation, party of the second part:

ffl�:REASI said Developer is the owner in fee simple of all
the lands in a subdivision known as Selva Marina Unit No. 6,
accord!.rig to a plat thereof recorded in Plat Book 34, pages 51,
51A and 51B, of the current public records of Duval County,
Florida, except for Lot 6 in Block 5 as shown thereon, and is the
owner in fee simple of all of the lands in a subdivision known as
Selva MArina Unit No. 7, according to a plat thareof recorded in
Plat Book 34, page 52 , of the current public records of Duval
County, Florida;
WHEREAS , said party of the first part and said party of the
second part are the owners in fee siMple of certain lands lying
northerly of said subdivision;
NO.1 THEREFORE in cohsideration of the premises and other
valuable considerations, the sufficiency whereof is hereby
acknowledged, the parties hereto covenant and agree with each
other as followsi
1 . These restrictive covenants shallrun with the title to
the land in said subdivision owned by Developer and shall be
binding upon the Developer; its successors and assigns, and all
persons claiming by, through and under Developer, and shall
remain in full force and effect until January 1, 2000, except
as hereinafter provided. After December 31, 1999, these restric-
tive cpvemamts shall be automatically extended for successive
periods of ten ( 10) years unless an instrument signed by the then
owners of a majority of the lots in said subdivisions has been
duly recorded, agreeing to terminate or- change said covenants
in whole or in part.
2 . No building shall be erected, placed, altered or permitted
in said subdivisions other than one detached single-family dwelling
( together with the usual outbuildings thereof) , containing an
enclosed floor area (exclusive of any porches, garages or out-
buildings ) of not less than:
( a) In the care of a single-story dwelling-
( 1 ) 11400 sq. ft. for Lots 9 through 19 in Block 5,
Lots 9 through 17 in Block 13, Lot 23 in Block
14 and Lot 1 in Block 15, all in said subdivision
of Selva Marina Unit No. 6.
(2 ) 11600 sq. ft. for Lots 7 and 8 in Block 5, in
said subdivision of Selva Vlarina Unit No. 6;
Lots 1 through 8 in Block 12 , in said subdivision
of Selva Marina Unit No. 7; and Lots 1 through
8 in Block 13 and Lot 1 in Block 14 in said
subdivision of Selva Marina Unit No. 6.

(c) In the case of a two-story dwelling, the enclosed floor
area (exclusive of any porches, g=irages or outbuildings) shall
be 400 qq. ft. more than the square footage in the case of a
singla-zrory dwelling, as provided in sub-paragraph ( a) above.
3. Detached outbuildings shall no't be more than one story
in height a-.id shall be used only for such purposes as are

or as a nvest I-ouse. Garages, servants ' rooms and rooins used

provided with an automatic opening and closing device.
4. No sign of any kind shall be displayed to the public
view in said subdivision except one professional sign of not
more unan one ( 1 ) square foot, one sign of not more than three
( 3) sqaare feet advertising the property for sale or rent, or
si�,,ns used by a builder to advertise the property during the
cor.struction and sales period, or signs pertaining to or
advertising said subdivisions.
5. No noxious or offensive trade, business or occupation
shall be carried on in said subdivisions , nor shall anything
be done thereon which shall be or become an annoyance or a
nuisance to the neighborhood.
6. No building- shall be erected, placed, altered or
permitted in said subdivisions nearer to the street line than
the building restriction line (B. R. L. ) , as shown on said
subdivision plats, nor nearer to the rear lot line than thirty
( 30) feet, nor nearer to the side lot lines of adjoining lots
than:
.4-,a) Fifteen ( 15 ) feet for Lots in block 5, 13t 14 and
15 , and Lots 1 through 8 in Block 12 .
(b) Seventeen and onw-half ( 17.5 ) feet for Lots 12
through 22 in Block 6 and Lots 16, 17 & 18 in Block
10, and Lots 9 through 15 in Block 12.
Twenty ( 20) feet for Lots 3 through 8 in Block 10
and Lots 7 through 11 In Block 11 .

Control Committee when a building has been erected or
construction substantially advanced, provided that in the
opinion �f said Akchitectural Control Committee such
violation will not detract from the appearance and value
of adjoining properties.
7. Temporary buildings and sheds used during the
construction period of the permanent dwelling may remain only
during the required construction period.
8. No lot, or lots, in said subdivisions shall be re-
subdivided by any instrument, c6nveyance or plat unless such
re-subdivision is the act of the Developer, or unless such
re-subdivision is first approved by the Architectural Control
Committee, but any lot may be divided between and become a
part of the adjoining lots on either side.
9. No. structure or building shall 'be erected, placed,
altered or permitted in the subdivisions until the building
plans? specifications and plot plan showing the location of
such building have been approved by the Architectural Control
Committee ,as to quality of workmanship and materials, harmony
of exterior design and location with existing stru--tures and
as to location with respect to front, rear and side lot lines
and to topography and finished grade elevation. The Archit—
ectural Control Committee is hereby established and is composed
of three members as follows:

A majority of the Committee may designate a representative to

shall have full authority to designate a successor. Neither
the members of the Committee, nor its designated representative
shall be entitled to any compensation for services performed
hereunder. At any time the then record oviners of a majority
t-6f the lots in said subdivisions shall have the power, through
a duly recorded written instrument, to change the membership
of the committee, or to withdraw from the committee or to re-
ttotesto:-it, any of its powers and duties. The committee 's
approvalp disapproval, or waiver, as required in these restric-
tive covenants shall be in writing. In the event the committee
or its designated representative fails to approve, disapprove
or waive within thirty ( 30) days after plans and specifications
or other applications have been submitted to it, or in any .
event if no suit to enjoin the construction has been commenced
prior to completion thereof, approval will not be required and
the related restrictive covenants shall be deemed to have been
fully complied with.
10. .`iny person having an interest in said subdivisions or
lots therein shall have the right to institute and prosecute
and appropriate proceedings at law or in .equity to prevent the
violation of, or to recover damages for, the restrictive coven-
ants herein contained should same be violated or an attempt to,
violate the same be believed imminent or intended.
Il . The pa_rties hereto agrz!e that every contract of sale
or deed that sliall agreeing to convey or con-
veying any lot in tF�id 3t-ibdivisions prior to January 1, 20001,
shall be made expressly subject to the provisions of this re-
strictive agreement.
12. The restrictive covenants contained in t�is instrument
shall not apply to Lot 6 in Block 5 and Lot 23 in Block 6 of
said subdivisions. The restrictive convenants contained in
instrument recorded om Vol. 84, page 366l Official Records of
Duval County, Florida. shall be applicable to Lot 6 in Block 5
and Lot 23 in Block 6 of said subdivisions.
13. Invalidation of any one of these restrictive convenants
by judgment or court order shall inno wise affect any of the
other provisions hereof which shall remain in full force and
effect,
