The purpose of that meeting was to discuss Planning staff denial of approval for a two- family dwelling unit to be constructed on the property described below: PHYSICAL ADDRESS 420 -422 DUTTON ISLAND ROAD LEGAL DESCRIPTION 46 -11 17- 2S -29E STEWART S/D 2"' R/P LOT 3 PARCEL IDENTIFICATION 172374 -1015 Plans in support of a building permit application for the above - described property were submitted on June 24, 2011. Upon review, Planning staff determined that the proposed development did not comply with the maximum density allowed by the Future Land Use Designation of Residential Low Density (RL) according to provisions of the adopted Comprehensive Plan, and subsequently, did not meet the minimum lot area required for the construction of a two - family dwelling unit within the Residential Two - Family (RG) Zoning District, as provided in Section 24- 107(d) of the adopted Land Development Regulations: (1) Minimum Lot Area in the RG Zoning District: i. Single - family dwellings: 7,500 square feet ii. Two - family (duplex) dwelling or two -unit townhouse: Lands designated as Low Density by the Future Land Use Map: 14,500 sq ft Lands designated as Medium Density by the Future Land Use Map: 6,200 sq ft Lands designated as High Density by the Future Land Use Map: 5,000 sq ft With dimensions of 75 feet width by 140 feet depth, or 10,500 square feet, the subject property is clearly deficient 4,000 square feet from the required standard. According to Section 24- 82(e), "No structure or property shall be developed or used so as to exceed density allowed under the terms of the Comprehensive Plan or the limitations for the Zoning District in which such structure is [to be] 420 -422 & 424 -426 Dutton Island Road / Beaches Habitat July 11, 2011 / Page 2 of 3 located." Section 24-64, states that a variance shall not reduce the required minimum lot area, and Section 24 -46(d) states that the City Commission shall not grant a waiver for any term prohibited as a variance. Thus, Planning staff denial of the application seemed clear -cut, given there were no other routes to remedy the deficiency. However, at the July 1" meeting, you presented an email dated February 26, 2010 from then - Community Development Director Sonya Doerr, stating the subject property, as well as an identical lot directly to the west, met the requirements for each to be constructed with a duplex, or two- family dwelling unit. You also confirmed that it was upon the basis of Ms. Doerr's assessment that Beaches Habitat purchased the two lots and proceeded with plans to develop. You expressed that there had already been substantial expenditures ($90,000 for purchase and $20,000 for infrastructure) on this project, and inability to complete the project as planned would result in a financial crisis for the nonprofit organization. Given Ms. Doerr's recent departure from the City, Building and Planning staff agreed that staff needed to research the issue and possibly speak with Ms. Doerr to determine if the property had some sort of vesting. Below is a summary of our findings. • February 24, 2004: Letter from Ms. Doerr in response to an inquiry from former property owner Kevin Bennett - who did own three identical contiguous lots, but conveyed the two easternmost lots to BHH in June 2010 - regarding minimum lot standards. • December 30, 2005: Building Department records related to a building permit application (DPLX 05- 00031907, renewed as MULT 06- 00034398) submitted by Mr. Bennett to construct a duplex or two- family dwelling on the westernmost lot, now known as 450 -452 Dutton Island Road. During this period of time, Ms. Doerr was returning from a medical leave, and then - Building Official Don Ford was reviewing all plans for compliance with planning and zoning regulations in her absence. It appears that Mr. Bennett submitted a letter from Ms. Doerr dated March 8, 2004 regarding property located on Orchid Street - which is medium density and would accommodate a duplex or two - family dwelling - to Mr. Ford, who in turn gave Mr. Bennett's plans for the Dutton Island Road property preliminary approval. • January 20, 2006: Facsimile from Ms. Doerr to Mr. Bennett, addressing his erroneous submittal, and reiterating that the property on Dutton Island Road, known as Lots 1, 2, 3 of Stewart Subdivision, 2n Replat (46 -11), had been and still were designated as Residential Low Density according to the Comprehensive Plan, and that the Land Development Regulations clearly stated that "Two- family uses are also subject to the Comprehensive Plan Density limits." • January 24, 2006: Letter from Ms. Doerr to Mr. Bennett, explaining that she had neither authority nor administrative flexibility to give zoning approval in contradiction to the Land Development Regulations. She noted that the minimum lot standards had been in place since 2001 (prior to Mr. Bennett's purchase of the property), and the density had been set since 1990. She further pointed out that compliance with the densities set by the Comprehensive Plan was a requirement of not only the City, but also the State of Florida. Lastly, she explained that no other City department was authorized to grant zoning approval, and reiterated that she was unable to grant approval for something that was not compliant with the law. • January 27, 2006: Building Official Don Ford overrode Ms. Doerr's zoning denial and issued Mr. Bennett's building permit. Shortly afterwards, Mr. Ford retired from the City of Atlantic Beach. His successor, David Hufstetler, issued the Certificate of Occupancy on October 25, 2007. 420 -422 & 424 -426 Dutton Island Road / Beaches Habitat July 11, 2011 / Page 3 of 3 • June 17, 2010: Official Records Volume 15282, Page 01492, showing transfer of Lots 2 and 3 from Mr. Bennett to Beaches Habitat. • February 26, 2010: Email from Ms. Doerr in response to a request from Beaches Habitat to confirm the ability to construct a duplex or two - family dwelling on each platted lot. We spoke with Ms. Doerr and she has no recollection of, and cannot come up with any rationale as to why she would have confirmed these lots as buildable with two dwelling units each, except for the fact that the original property owned by Mr. Bennett consisted of three platted lots, or a total of 31,500 square feet, which clearly is sufficient for the construction of two duplexes or two two- family dwellings. We believe she may have done the calculation based upon the area of three lots, rather than the two purchased by Beaches Habitat. That being said, we do recognize an error was made, and by this letter we are documenting that fact and confirming our intent to uphold Ms. Doerr's density determination, as applicable only to the two lots described below.
