(AGES) has completed the shallow exploratory auger borings at the subject lot; as authorized by Mr. Richard Thompson. No deep soil test borings were requested or conducted as part of this limited exploratory testing program. This letter briefly describes the field testing performed, presents the collected test data, and includes a preliminary evaluation of site conditions with respect to the proposed residential construction. The field exploration was performed July 16 and 17, 1996, and consisted of four(4) 3-to 5-foot deep auger boring/dynamic cone penetrometers at the locations shown on the attached Field Exploration Plan. The test locations were selected by AGES personnel, and were approximately located in the field using paced and taped measurements from the existing survey control. The locations shown on the attached Field Exploration Plan should be considered approximate. The attached Auger Boring Records present the descriptions of the soils and groundwater levels encountered at the boring locations. The depth designations on the boring records represent the approximate boundary between the various soils encountered, as determined in the field by our personnel. In some cases, the transition between the various soils may be gradual. A brief discussion of the testing techniques is also provided. The subject lot was partially wooded and has some moderate undergrowth of shrubs, bushes, and vines. The site topography is generally level. Maximum site elevation differential is estimated to be approximately one to two feet. No wetland like areas were observed at the site. Surface soils consisted of slightly silty fine sands with some roots. The auger/dynamic cone penetrometer borings generally encountered a 12-inch thick surficial stratum of loose to very loose grey slightly silty fine sand with some root matter. The surficial soils were underlain by loose to firm light grey fine sand which extended to a typical depth of 2-feet, and exhibited equivalent standard penetration resistances of 5 to 12 blows/foot. Very Firm to Dense dark grey slightly silty to silty fine sand was encountered below a depth of two feet, which extended to the maximum boring termination depth of 5-feet. Equivalent standard penetration resistances within this stratum were on the order of 25 to 35 blows/foot. Groundwater was encountered at depths of 1.8 to 2.5 feet below the ground surface. Seasonal high water levels at the lot may be within one to two feet of the ground surface. It is our opinion that near-surface soil conditions are adaptable for support of a one or two story wood or block residential structure upon a conventionally designed and constructed shallow foundation system. However, a some pre-construction site preparation will be required to adequately prepare the site. Specifically, site p8 e a ation should include: (1) clearing of the existing vegetation (and its root H. . box 331373•Atlantic Beach, Florida 32233 (904) 249-7002• (904) 247-7292 (FAX) THOMPSON CONSTRUCTION August 3, 1996 Jacksonville Beach, Florida Page 2 systems) located within the proposed construction area; (2) stripping of any unsuitable topsoils encountered at the site during initial site preparation; (3) addition of approximately one foot of compacted structural fill to raise the building pad so that it is a minimum of one feet above the existing street elevation. High water table conditions encountered in portions of the site could require that tracked dozer equipment be used during site preparation. It is also noted, that addition of fill to this site could cause consolidation of any soft compressible clayey soils which may be located below the maximum auger boring termination depth of five feet. The presence of potentially compressible layers, the estimated magnitude of potential fill induced consolidation, and the rate of consolidation cannot be predicted with the limited geotechnical data available. Therefore, we strongly recommend that the fill be added as soon as possible and that it be allowed to consolidate any underlying compressible zones for a period of at least one to two weeks prior to starting vertical construction of the residence. We also suggest that AGES personnel be retained to periodically inspect site preparation operations to verify adequacy. AGES appreciates the opportunity to be of service to you on this project. The auger borings were drilled in general accordance with ASTM D 1452-80 ("Soil Investigation and Sampling by Auger Borings"). Representative samples of the soils brought to the ground surface by the augering process were placed in glass jars, sealed, and transported to our laboratory where they were examined by a geotechnical engineer to verify the driller's field classification. Dynamic Cone Penetrometer Test Dynamic Cone Penetrometer tests were performed at various test depth in bore holes advanced by augering techniques. The dynamic cone penetrometer data was obtained using a 45 degree cone penetrometer having a projected area of 11.4 square centimeters. After augering to the test depth, the cone penetrometer was seated two inches into the undisturbed soils and then driven 1-3/4 inches using a 15 pound hammer falling 20 inches per blow. the number of blows for the 1-3/4 inch penetration provides and index to the strength and density of the soils tested. the dynamic cone penetrometer resistance can be correlated to the SPT N-Value (ASTM D1586) using the correlation presented below. TREE CONSERVATION BOARD Minutes of June 17 , 1996 The Board held its regular meeting on Monday, June 17 , in the City Commission Chambers. Present were : Hope Van Nortwick, Chairman Mae Jones Judy Jacobson Rick Bell Staff: George Worley , Designee Carl Walker, Coordinator The meeting was called to order by Chairman Hope Van Nortwick at 7 : 30 PM. The first item of business was review of the tree removal ap- plication for property at 430 20th Street. , Curtis Conner, contractor for the room addition to be built at that location was present. The application specifies removal of 6 palms and 2 gum trees. Of these, it was calculated that only 2 palm trees, each with a 12" DBH , were protected trees. Discussion followed as to which remaining tree/trees on the property would be identified for mitigation purposes. Mr. Conner pre- ferred that a 14" DBH gum tree be so specified. Judy Jacobson moved to accept the plans, as proposed, with the requirement that the 14" DBH gum tree be designated as a protected tree for mitigation. Hope Van Nortwick seconded and the motion carried unanimously. Mr. William Walton, Jr. of North Florida Classic Homes intro- duced himself to the Board for the review of the application for Lot # 1 , Block # 124, Sec. H. , as well as the next four applications for adjacent lots in the same block . He stated that the building footprints for each of the lots were now designated on the plans. Mae Jones voiced concern that more trees on site were marked in red , indicating proposed removal , than indicated on the plans and/or application. She cited, as an example, Lot # 1 . Nine trees on the lot are marked in red; the application in- dicates only 2 trees are to be removed . She, as well as other Board members, felt this would make it difficult for proper removal of only those trees permitted . It was also noted that the site plans did not indicate which trees were to be removed. Following discussion with the applicant, it was agreed, by consensus, that action on the 5 applications would be defer- ted until the plans and markings on site were corrected and coincided . There was no representative present to discuss the applica- tion for removal at 135 13th Street. The Board reviewed the plans and determined that 2 trees were protected, a 13" DBH magnolia and a 12" DBH palm. There were sufficient palms to remain on the lot to mitigate the removal of the 12" DBH palm and one 5" DBH bay tree was designated as partial mitigation for the removal of the protected magnolia. Board members expressed regret that the two magnolias on the property were to be removed and were in hopes that the appli- cant could find an alternative. The absence of the applicant did not allow the Board to pursue this recommendation and it was pointed out that it was unknown whether the applicant de- sired to replace, on site, the remaining 1 1 /2" DBH of hard- wood trees or to contribute to the City tree fund. By consensus, the Board agreed to defer action on this tree removal application until such time as the applicant or his representative was present for discussion. Richard Thompson , contractor for the structure to be built on Lot # 307 , Saltair Sub. , Sec. # 3, introduced himself and apologized for the delay in the trees on site being marked. f JSL� There was some discussion as to jurisdiction of the pines proposed for removal which were on City right of way adjacent to the lot. It was determined that the applicant could only obtain permitting from the Board for those trees which were lined with the proposed driveway. It was also agreed that the trees within the house footprint were not protected trees and could be removed without Board approval . It was suggested that the driveway entry be changed from Mag- nolia Street to Seaspray Avenue thereby saving many of the pines proposed for removal . The contractor and property ow- ner were not receptive to this change. A total of 115" DBH is proposed for removal , 8" DBH of which is oak, the remain- der pine trees. The trees to be removed were identified on the original site plan. Hope Van Nortwick made a motion to accept the plans with the stipulation that removal of the 10 trees shown on the plans totaling 115" , including 8" DBH of oak, be mitigated with a total of 57 . 5" DBH of hardwood trees, 4" DBH of which must be oak. Mae Jones seconded; the motion carried unanimously. In other business, Mae Jones distributed copies of a listing (copy attached) of contacts she received as nominations for historic or otherwise unique trees within the City. Rich Bell also passed on information on contacts made to him. Hope Van Nortwick volunteered to take photos at the sites. - 2 - George Worley reported that the Code Enforcement Officer had given notice to Safa Mansouri regarding the failure to comply with the Tiffany by the Sea agreement for replacement tree planting. George felt that he and Hope would be required to attend the Code Enforcement Board meeting when the case is heard. Hope informed the Board of her discussion with Don Ford, building inspector, on enforcement of Board and Ordinance re- quirements . There was discussion on the possibility of a fee being accessed for a tree removal permit to offset the cost of the additional inspections required. Hope is to further pursue this with the City Manager. Mae Jones made a motion to approve the minutes of the last meeting , as read. The motion was seconded by Judy Jacobson and passed unanimously. Present were : Hope Van Nortwick, Chairperson Rick Bell Rick Beaver Judy Jacobson Mae Jones Staff: ' George Worley, Designee Alan Jensen, City Attorney The meeting was called to order by Hope Van Nortwick, Chair- person , at 7 : 40 PM. — P- No representative , including the applicant , Mr. Rausch, his attorney, or the builder/contractor, was present for the re- view of the reconsideration request of mitigation require- ments for- Lot # 307 , Saltair subdivision. Considerable discussion by the Board took place on the issue , and the following points were made : the original tree survey submitted when the application first came before the Board was presumed to be accurate . The footprint of the house was "flipped” on the lot which moved the placement of the drive way. This change affected the trees which were removed but the revisions were not -brought back before the Board. Very few trees remain on the lot , and it is not possible at this time to determine the exact location, quantity or size of the trees removed. It was noted the some of the trees removed may have been on city ight of way and not a part of the original permitting . Members expressed that the con- fusion of the removal created a situation which could in- crease the mitigation requirements , not reduce them. It was discussed that the ordinance did not require that a professional survey be submitted with a tree removal appli- cation. However, when the survey is not professionally done , it is expected to be accurate so that the Board can rely on it to properly evaluate the removal proposed and the miti- gation, if required. FEBRUARY 11,2002 After final Board review, Judy Jacobson moved to deny the r. request for reduction of the mitigation requirements . Rick Bell seconded and the motion unanimously passed. George Worley advised that the tree removal permit violation would be referred to Code Enforcement for their handling . He will meet with the Code .Enforcement Officer for this purpose -+►and keep the Board members advised. On the subject of the January meeting schedule , it was agreed that the first meeting in January will be held, as scheduled, on Monday, January 6 . The second meeting date falls on Mar- tin Luther King Day, January 20 , a city holiday. There is a conflict with meeting rooms and dates for Tuesday, January 21 . George and Carl will schedule a date for this meeting and so advise the Board . Under reports and announcements , Hope Van Nortwick questioned when the landscaping , approved by the Community Development Board, will begin at the Atlantic Theater. George reported that' the irrigation plan has been submitted and is being re- viewed by Public Works for approval . Johansen Park plans were also discussed and George estimated that it would probably be approximately 6 months before work would begin. Hope reported that the City Manager had con- tacted her and expressed that he wanted the Tree Board in- volved in all phases of the project . Mae Jones passed around aerial photographs and old postcards showing the palm trees in the area of the old Continental Hotel and surrounding property. She expressed that some type of action should be taken for these trees and others which have been nominated as either historic or significant . Con- siderable discussion followed on the program and it was agreed that it would be helpful if the Board met as a group and studied the trees on site . George advised that this was allowed under Sunshine Law requirements if notice of the meeting is properly posted . It was agreed that the work-shop type meeting would be held on Saturday, January 25 , at 10 AM and would take place at the Adele Grage Community Center. George reported that he and Karl Grunwald, Code Enforcement Officer, have reviewed the paperwork on the violation by Pulte Homes of removal of trees prior to permitting . A special meeting may be called by the Code Enforcement Board during the latter part of January. Possibly the violation by Mr. Rausch could be reviewed at the same meeting. In 19971 removed several dead and diseased pine trees with a combined diameter of 57 inches in order to build my house. This was done after repeated phone calls to City Planner, George Worley, which were never returned. Shortly thereafter, Atlantic Beach contacted me regarding this removal and requested I pay $4743.75. 1 made three payments of$263.54 each. 1 replaced the pine trees in February 1997 with palm trees totaling 60 inches in diameter. Therefore, I feel I am entitled to a refund of $790.62. I am requesting your assistance in the refund of my money and the voiding of the contract with Atlantic Beach. January 28, 1007 - The Code Enforcement Board levies a fine of$250.00 against Mr. Rausch for removing trees not permitted by the Tree Board. October 27, 2001 - Mr. Rausch meets with Don Ford and requested refund of three payments and "voiding" of agreement for tree mitigation. information from Mr. Rausch turned over to the city attorney. October 29, 2001-Allen Jensen notifies M. Rausch of failure to pay agreement and possible legal action. November 8, 2001 - Mr. Rausch letter to Mayor, City Manager, and Don Ford requesting help in "voiding" agreement. November 13, 2001 -Allen Jensen letter to Mr. Rausch referring to City Commission for possible relief. Suggests Mr. Rausch pay according to agreement. RECOMMENDATION: Direct city attorney to proceed with case to collect tree mitigation, interests and attorney's fees or send case to tree board to review possibility of reducing mitigation. The Board reviewed the plans and determined that 2 trees were protected , a 13" DBH magnolia and a 12" DBH palm. There were sufficient palms to remain on the lot to mitigate the removal of the 12" DBH palm and one 5" DBH bay tree was designated as partial mitigation for the removal of the protected magnolia. Board members expressed regret that the two magnolias on the property were to be removed and were in hopes that the appli- cant could find an alternative. The absence of the applicant did not allow the Board to pursue this recommendation and it was pointed out that it was unknown whether the applicant de- sired to replace, on site, the remaining 1 1 /2" DBH of hard- wood trees or to contribute to the City tree fund. By consensus, the Board agreed to defer action on this tree removal application until such time as the applicant or his representative was present for discussion. --,"Iichard Thompson, contractor for the structure to be built on Lot # 307 , Saltair Sub. , Sec. # 3, introduced himself and apologized for the delay in the trees on site being marked . There was some discussion as to jurisdiction of the pines proposed for removal which were on City right of way adjacent to the lot. It was determined that the applicant could only obtain permitting from the Board for those trees which were lined with the proposed driveway. It was also agreed that the trees within the house footprint were not protected trees and could be removed without Board approval . It was suggested that the driveway entry be changed from Mag- nolia Street to Seaspray Avenue thereby saving many of the pines proposed for removal . The contractor and property ow- ner were not receptive to this change. A total of 115" DBH is proposed for removal , 8" DBH of which is oak, the remain- der pine trees. The trees to be removed were identified on the original site plan. Hope Van Nortwick made a motion to accept the plans with the stipulation that removal of the 10 trees shown on the plans -��otaling 115" , including 8" DBH of oak, be mitigated with a total of 57 . 5" DBH of hardwood trees, 4" DBH of which must be oak. Mae Jones seconded; the motion carried unanimously. In other business, Mae Jones distributed copies of a listing (copy attached) of contacts she received as nominations for historic or otherwise unique trees within the City. Rich Bell also passed on information on contacts made to him. Fees due are as follows: TREE MITIGATION $4,743.75 We have determined that payment of the above fees may be extended for a period of eighteen months for an amount due monthly $263.54 due and payable on the fifteenth day of each month. The first payment shall be due on the date of execution of this agreement with the next payment becoming due on January 15, 1997 and continueing on the 15th day of each month thereafter until paid in full. Failure to make scheduled payments shall constitute a violation of this agreement and the remaining balance shall become due immediately. Water and sewer service may be discontinued for nonpayment of fees due. A lien for the full amount shall be executed and recorded against the above referenced property. The lien shall be in the form of a note and mortgage on subject property. The owner hereby agrees to pay all recording fees and costs involved with the execution of the note and mortgage. Upon payment being made in full, the lien shall be released of record. Please indicate your acceptance of the provisions of this agreement by signing in the place indicated. Your signature also signifies your agreement to indemnify and hold harmless the City of Atlantic Beach from any and all damages resulting from your failure to timely make the above payments, including reasonable attorneys fees and court costs. Mr. Rausch recently built his home at 301 Magnolia Street. .Last week, through the offices of the City Planner, Mr. Rausch was charged a fee in excess of $4,700 due to removal of certain trees. The City Planner alleged he had authority to do so under the City's tree ordinances. Mr. Rausch was denied his certificate of Occupancy, and advised that it would be withheld until he paid the $4,700 or signed an agreement to pay this money over time. When he objected, Mr. Rausch was advised that the CO might also be withheld due to his bad attitude. With no other living arrangements, Mr. Rausch was left with no choice other than to sign the agreement. He did so, under duress. He was not given a copy of the document he signed. Please accept this letter as Mr_ Rausch's complaint as to the manner in which he was treated, and as protest as to the enforceability of the agreement he was forced to sign. Present were : Hope Van Nortwick, Chairperson Rick Bell Rick Beaver Judy Jacobson Mae Jones Staff: George Worley, Designee Alan Jensen, City Attorney The meeting was called to order by Hope Van Nortwick, Chair- person, at 7 : 40 PM. -- b No representative , including the applicant , Mr. Rausch, his attorney, or the builder/contractor, was present for the re- view of the reconsideration request of mitigation require- ments for Lot # 307 , Saltair subdivision. Considerable discussion by the Board took place on the issue , and the following points were made : the original tree survey submitted when the application first came before the Board was presumed to be accurate . The footprint of the house was "flipped" on the lot which moved the placement of the drive- way. This change affected the trees which were removed but the revisions were not brought back before the Board. Very few trees remain on the lot , and it is not possible at this time to determine the exact location, quantity or size of the trees removed. It was noted the some of the trees removed may have been on city ight of way and not a part of the original permitting . Members expressed that the con- fusion of the removal created a situation which could in- crease the mitigation requirements , not reduce them. It was discussed that the ordinance did not require that a professional survey be submitted with a tree removal appli- cation. However, when the survey is not professionally done, it is expected to be accurate so that the Board can rely on it to properly evaluate the removal proposed and the miti- gation, if required. t a� After final Board review, Judy Jacobson moved to deny the request for reduction of the mitigation requirements . Rick Bell seconded and the motion unanimously passed. George Worley advised that the tree removal permit violation would be referred to Code Enforcement for their handling . He will meet with the Code Enforcement Officer for this purpose --and keep the Board members advised. On the subject of the January meeting schedule , it was agreed that the first meeting in January will be held, as scheduled, on Monday, January 6 . The second meeting date falls on Mar- tin Luther King Day, January 20 , a city holiday. There is a conflict with meeting rooms and dates for Tuesday, January 21 . George and Carl will schedule a date for this meeting and so advise the Board. Under reports and announcements , Hope Van Nortwick questioned when the landscaping, approved by the Community Development Board, will begin at the Atlantic Theater. George reported that the irrigation plan has been submitted and is being re- viewed by Public Works for approval . Johansen Park plans were also discussed and George estimated that it would probably be approximately 6 months before work would begin. Hope reported that the City Manager had con- tacted her and expressed that he wanted the Tree Board in- volved in all phases of the project . Mae Jones passed around aerial photographs and old postcards showing the palm trees in the area of the old Continental Hotel and surrounding property. She expressed that some type of action should be taken for these trees and others which have been nominated as either historic or significant . Con- siderable discussion followed on the program and it was agreed that it would be helpful if the Board met as a group and studied the trees on site . George advised that this was l allowed under Sunshine Law requirements if notice of the meeting is properly posted. It was agreed that the work-shop type meeting would be held on Saturday, January 25 , at 10 AM and would take place at the Adele Grage Community Center. George reported that he and Karl Grunwald, Code Enforcement Officer, have reviewed the paperwork on the violation by Pulte Homes of removal of trees prior to permitting. A special meeting may be called by the Code Enforcement Board during the latter part of January. Possibly the violation by Mr. Rausch could be reviewed at the same meeting. The Board will be notified of the Code Enforcement meeting date . - 2 - Minutes -Page -2- Special Called Meeting January 28, 1997 Code Enforcement Official Grunwald referred to the Board's amended order of January 7, 1997 concerning the property and reported the shrimp boat had been removed from the property resulting in a fine of$1,400.00 for the fifty-six(56) days the property was in non-compliance. 2. NEW BUSINESS: Case No. 97- 5531-Steven Rausch-301 Magnolia Street. The owner of the property is in violation of Chapter 23, Section 23-17 Code of the City of Atlantic Beach in that there exists on the premises located at 301 Magnolia Street the following condition(s): trees were removed from the property not authorized for removal by the Tree Conservation Board. Chairman Martin read the case procedures for the case and Hope Van Nortwick, Chairperson of the Tree Conservation Board, Community Development Director George Worley and Code Enforcement Official Grunwald were sworn in as witnesses. Mr. Rausch stated he did not want to be sworn in at this time because he would not be addressing the issue and was waiting for his builder, Richard Thompson, to arrive at the meeting and represent him. Mr. Grunwald presented the background for the case explaining that Mr. Rausch had appeared before the tree board and agreed to mitigation in the amount of$4,700.00 for the trees removed from the lot. It was explained that a payment plan had been set up for Mr. Rausch and two payments had been made. Photographs were passed out showing the trees remaining on the property. Hope Van Nortwick, Chairperson of the Tree Conservation Board, was called as a witness. Ms. Van Nortwick explained after the original permit was issued, Mr. Rausch came back before the Tree Board to have the original mitigation reduced, but neither he nor a representative was present at the meeting. The Board looked over the application and found that an additional nine (9)trees, not on the original application, had been removed from the lot. The Board was recommending a fine of$25.00 per tree or $00.05 per square foot for the tree permit violation. Chairman Martin inquired if the Board was asking for this fine in addition to the $4,700.00 required for mitigation. Ms. Van Nortwick stated the Board was asking for the fine in addition to the mitigation requirement because Mr. Rausch was in violation of the ordinance by removing the trees, but recommend the low fine because of the $4,700.00 figure. At this point in the meeting Mr. Rausch was sworn in and stated his builder had not informed him of the additional trees being removed. Richard Thompson, builder of the Rausch home, arrived at the meeting at 8:10 and was sworn in. Mr. Thompson explained an honest mistake was made in making the tree survey stating the survey stakes were five feet off the pins causing the problem for the two lots being developed Minutes -Page -3- Special Called Meeting January 28, 1997 simultaneously. Due to the survey error, six trees were saved on the adjoining lot but four or five trees, not nine trees as reported by the Tree Board, were cut down in error on Mr. Rausch's lot. It was also reported that two dead pine trees had been listed on the survey and two additional dead trees found. Mr. Thompson continued by stating he was due a credit for the two additional dead trees. Chairman Martin pointed out the Code Enforcement Board did not have the power to grant him credit for the dead trees and he would have to take that matter up with the Tree Board. Mr. Martin then recapped what had happened on the two lots and asked for Board comments. Board Member Dowling stated he believed the burden of proof for accuracy in the number of trees cut down was on Mr. Thompson. Mr. Dowling continued by stating Mr. Thompson needed all four irons to make a correct survey, the lack of which resulted in the inaccuracy. Mr. Dowling stated he would go with the Tree Board's determination that nine (9)trees had been cut down. After some further discussion, a motion was made by Theo Mitchelson, seconded by Pete Dowling and unanimously carried to find Mr. Rausch in violation of Chapter 23, Section ---�►23-17 of the Code of the City of Atlantic Beach. A motion was made by Chairman Ed Martin, seconded by Board Member Ken Rogosheske and unanimously carried to levy a one time fine of$250.00 against the property, payable to the City of Atlantic Beach within thirty days. Case No.97-5532-Pulte Home Corporation/North Florida Classic Homes-West 5th Street. The owner of the property is in violation of Chapter 23, Section 23-17 Code of the City of Atlantic Beach in that there exists on the premises located at West 5th Street the following condition(s): trees were removed from the property not authorized for removal by the Tree Conservation Board - clear cut the property. Representatives from Pulte Homes, including Cliff Gray, Project Manager, were sworn in. Prosecuting Attorney Green read the charges against Pulte Home Corporation and recommended a$5,000.00 fine, the highest which may be imposed, due to the irreversable damage imposed by clear cutting the property. Mr. Van Nortwick stated the permits were denied because when the Board went to view the site on December 2, 1996, the property had already been clear cut with only three trees remaining on the site.
