Ne will advise and assist me obtaining all permits and health
requirements and all other phases involved in starting the
vending cart business.
Initially, I would like to sef up [he car[ on [he weekends
(Sat b Sun) from 9 or loam [0 5 or fipm. Eventually, I would
also like co have the cart sec up during the week (Non thru Fri)
from about IOam co 4pm.
I will provide a trash bin by [he car[. I will also canvass and
remove trash vithin a mile radius of [he set up on the beach a[
the end of each business day.
I will agree to pay 2x sales tax on gross sales to Che Ci[y (monthly
quarterly, semi annual or annual, however the City wishes) for
on-going beach cleanup.
In summary, I believe [hat everyone including the Ci[y will benefit
by the service this will provide. I would be open to any
suggestions or recommendations in reaching an amicable agreement.

As we discussed yesterday by Ce le phone, I am submitting a request to sell

Firs[, I would like to give you a little background of myself. I vas
born and taised in Tampa, Florida. I moved to Anchorage Alaska in 1968
where I 6e gan my Federal Civil Service career. I transferred to San Diego
in June 1978 to move ahead in my federal career. In June 1979 I transferred
to Jacksonville, Florida [o be closer to my family. I have enjoyed 8 years
of living in the Jacksonville area and most recently I moved ( in November
1985) from south Jacksonville beach Co Atlantic Beach. I feel I have
true ly found my home because I love Atlantic Beach and plan to retire here.
In looking ahead Coward an early retirement ( in approxima [e ly 8 years), I
realize that after working all my life I will no[ be happy if I am idol.
I also realize [here is a constant increasing cos[ of living. Therefore,
I have given great [hougl~c as ce whac I'd like [o do when I retire, with
an emphasis on scarring a small business now vh ith would ptovlde me no[
only added income but could be something I'd enjoy doing after retirement.
Because I love [he beach, any business chat I could do on the beach would
be my primary choice. This is the reason I am submitting the attached
proposal [o you.

As a result of our efforts, the defendant was comJicted of
Armed Kidnapping, Armed Sexual Battery and Armed Robbery. Judge

WHEREAS, the Board of Trustees of the Internal Improvement
Trust Fund is vested with Citle to all sovereign beaches within
the State of Florida and that said title is held in trust for the
citizens of Florida under Article X, Section 11, of the Florida
Constitution and Chapter 253, Florida Statutes, and
WHEREAS, the beaches of Florida constitute this state's
greatest recreational and economic resource and the Legislature
has given increasing importance to management of state beaches
including acquisition, protection, restoration and use, and
WHEREAS, public beach access plays an essential role in the
use and enjoyment of the beaches and the opportunities and issues
of public beach access vary along the state's shoreline and the
quality and quantity of public beach access has a direct impact
on local economies and the quality of life in the community, and
WHEREAS, beach access programs and the problem of inadequate
access will become worse and solutions will become more difficult
and expensive as time progresses, and
WHEREAS, the City Commission of Atlantic Beach recognizes
that it is essential to balance the rights of private property I
owners with those of the public and will encourage and promote
incentives to provide public beach access, and
WHEREAS, [he City Commission will acquire only the interests
necessary to provide beach access and will ensure the surrounding
property owners that such access rights-of-way will be
constructed and maintained in a manner aesthetically compatible j
with the surrounding property.

Dear Mr. Fellows:
Sevilla Condominiums have taken weekly water meter readings since
January 20, 1.987, and the average weekly consumption has been
].12,333 gallons. The yuarterly useage (Jan 20-Apr 21.) was
1.,412,000 yallons which included 57,000 gal Ions t.o refill our
swimming pool after repairs. Tn fact, an additional 18,000 to
20,000 ya1].ons was drained from the pool. and refilled during the
work completion.
It would appear that the water meter is functioning properly and
a check at this time would be a waste of time and money.
we still do not have an answer for the 900,000 gallons over aver-
age useage in the 4th yuarter of 1986. Could the meter readout
mechanism have malfunctioned? We have written Rockwell Inter-
national for details of the readout design but have received no
answer to date.
It is also possible that water was taken from a fire hydrant
located off our premises and on the 12.5 acres west of Sevilla
owned by the Florida National Bank. These hydrants are on the
same water main that feeds Sev_Lla and there is only one water
meter for the entire water system.
To the best of our knowledge this water main system became the
property of Atlantic Beach after the development phrase.
In view of the above circumstances, we feel the city has a
responsibility in hel.piny to resolve this matter.

Mayor Howell presented in full, in writing Resolution No. 87-20, a
Resolution transferring $122,000 to provide the budgetary authority
for the purchase of land to be used for a sanitation transfer station
located on Blks. 5, 6, 7, 8, and 9 Section H fronting Atlantic Blvd.
On February 23, 1987, Resolution No. 87-8 vas adopted authorizing [h.
City Attorney to commence necessary proceedinBS to acquire the proper
through [he use of eminent domain.
Motion: Passage of Resolution No. 87-20.
Mr. Hullis advised the city had title to [he property as of June 2,
1987 when Judge Oakley entered [he order of taking. The city needed
only to pay the money into [he registry of the court in compliance
with. There would be no additional Fees as far as the property owners
were concerned. He told the Commission that going through the zegis [r;
of the court vas [he best way to handle the acquisition.

In response [o Coormissioner Cook's request a[ [he last meeting for ch,
City Attorney to investigate the possibility of opening accesses to [1
beach north of 16th Street, Mayor Howell advised the Commission they
had discovered an existing 10' easement at Devees Avenue Chat had nevE
been opened. The City Hanager had several discussions recently with [t
abutting property owners regarding the easement. The suggestion vas m:
[o instruct [he Ci[y Manager to have plans designed for a walkway fen<
on each side at Devees similar to the walkways Oceanvalk As socia[es hz
constructed. Commission agreed.
Discussion vas held on an access a[ 20th S[. There had never been an
easement at 20th so it may have to be done by condemnation for an
easement only, possibly 4 - 5 fee[. The walkway would be constructed
an attractive manner and fenced on both sides.
Nr. Hullis briefed the Commission on the history of 17th Street From 1
to the present time. Hr. Hullis suggested the city authorize him to ins
cute eminent domain proceedings co acquire easements of egress and ing
from public roads to the Atlantic ocea.~ at 17th and 20th Streets.

SUBPARAGRAPH (a) TO CLARIFY REQUIRED OFF-STREET PARXING AND LOADING
REQUIREMEMfS FOR CONFORMING BUILDINGS AND USES EXISTING AS OF JULY 26,
1982; PROVIDING AN EFFECTIVE DATE.
Mayor Novell presented in full, in writing Ordinance No. 90-87-121
on second and final reading. Said Ordinance vas posted in line with
Charter requirements. The Mayor opened the floor fora Public Hearing
and invited comments from the audience. A Lady in the audience, new c
the area, asked for clarification, as the Ordinance vas not clear. Mr.
Hollis explained it vas designed solely for [he purpose of requiring
off-street parking for non-conforming buildings wherein there vas no
increase in the area of property constructed. You should be required
to have off-scree[ parking iE you increased [he area of the property.
On July 26, 1962 off-street parking requirements were se[ forth in
the Ordinance that made some buildings non-conforming. The new Ordi-
nance would correct the off-street requirements for commercial uses.
As no one else spoke for or against [he Ordinance, the Efayor declared
the Public Hearing closed.
!(o [ion: Passage of Ordinance No. 90-87-121 on second and final
reading.
Commissioner ?orris objected as it would be more confusing to the
public than [he old Ordinance as written in the Code. Commiss inner
Gulliford agreed and said [he Ordinance did not address the problems.
Commissioner riorris suggested a Committee look at off-scree[ require-
ments for all uses and one simple relief would be to increase all by
two (2) units. Fur restaurants, rather than four seats per parking
space, give them six seats per parking space, etc., and it should be
done for all businesses, not just construction built prior to 1982.
Nr. Mullis found no problem in increasing the number of seats per
parking space, but expressed concern you would still have to make
Some differentiation between buildings that exist as of a certain
date, than you would if you constructed a new restaurant on a 10
acre tract on Nayport Road.
Following a lengthy discussion, Commissioner Gulliford moved for a
Substitute Notion:
Substitute motion: Defer passage of Ordinance No. 90-87-121 and
request the Mayor appoint a Committee for further study
to come back with recommendations.

The Ci[y Manager explained the Ordinance vas prepared [o enable [he
city to charge the state generation charge on master meters, i. e.
the shopping center at the corner of Seminole Rd. and Atlantic Blvd.
where [here were four stores under one meter. It vas not clear in the
Ordinance how the slate revenue generation charge and the meter charge
vas to be made. The question vas asked what effect it would have, in
the future, on impact fees. Mr. Fellows responded they charged the
fmpact fees based on the number of units. He said [he sever Ordinance
had a rather complicated structure of a base charge, volume charge,
and a charge of $5.50 per unit for the state revenue Eeneration. The
way [he Ordinance vas written, [he city could not levy vhe $5.50
against each unit. Passage of the above would permiC [he city [o levy
the charge. Those units were not being charged a[ the present time.

Mrs. Podzamsky asked for a clarification on what [he city wanted re-
lacive to easements on Beach Avenue north of Twentieth S[. She vas
under the impression the street owners were only granting an easement
to one property over. Mayor Novell told her the move on the part of
the city to commence condemnation if necessary vas co be able to
provide eater and sever service [o all the property owners on the
street. In lieu of condemnation procedures by the city, an easement
vas given to Hr. Mullis, the City Attorney by her attorney, Mr. Aines
for the purpose of providing water and sever services to anyone [hat
abuts/fronts on [hat street. Hr. Mullis told Nrs. Podzamsky if other
problems developed later on, he would get in touch with her.

Subject: Board Actions and Recommendations of May 19, 1987
Your Community Development Board took the folloring actions et
their regular meeting on May 19, 1987:
" The Board granted a rear setback variance to Merk end Gail
Wynne, 1820 North Sherry Drive. the variance rill allot them
to construct a screen enclosure over an existing deck rEthin
13' from the rear prcperty line.
" The Board denied a request by Mark Kredell for aide end rear
yard variances on a 50' x SU' parcel on the corner of 18th
Street end Beach Avenue. The Board felt it tee a self-created
hardship in that it tea an un-buildable parcel then he
purchased it.
In addition, your Community Development Board makes the follorf ng
recommendations:
" The Hoard recommends approval of a request for a home
occupation by Terry Perkerson at 510 Orchid Street for en
ambeatos eswpling and eonsuJ.ting service. The hone office
rould 6r used only for clerical rot k. All samples rill be
obtained on-site and taken directly to a laboratory.
• the Board recowmende approval of a use by exception for retail
sales of autosobilee end boats by Terry McCue at 600 Meyport
Road subject to ingress and egress being from Slzth Street
rather then Meyport Road and that the exception be granted to
Mr. McCue personally end not to the land. The Board further
recommends granting tewporery relief from the septic tank
waratoriuw subject to Mr. McCue tying into city serer then it
becowea sveilable.
