Commissioner Cook asked if we should include [he new force at Ponte Vedra in the agreemenc. Hayor Howell replied they were in a different county. The City Attorney said you could perform your services outside your corporate limits and into another county provided you were in hot pursuit of someone. As it was jurisdictional, he would have to research the subject. Commissioner Morris requested a Commit tee be selected and volunteered co serve. Com misaioner Morris also commended Mayor Howell for his letter sent to Hr. Raeford, artd said he would like to see a breakdown on how many cal our police department are making to Neptune Beach and Jacksonville eve year and the cost incurred. In my wildest dreams, I cannot believe that an elected official in your position could make such an uninformed statement. In all fairness to yourself, the City of Atlantic Beach, and the public in general, I suggest that you sake steps to publicly wrrect this totally inaccurate statement. As you know, the government of the City of Atlantic Beach has re- mained neutral in connection with the move by the citizens of Seminole/North Atlantic Beach in their request to the Duval County legislative delegation to be annexed by the City of Atlantic Beach. The City of Atlantic Beach intends to stick by this position. As you know, a great deal of harmony has existed between our two cities since the conclusion of extensive litigation and it should be the aim of both of us to promote rnntinued harmony, so I respectfully request that this matter be clarified. i would appreciate your prompt attention to correct this mis- mnception, and set the record straight. Your present grant of $834,785. is hereby reduced by $141,459. resulting in a revised grar amount of $693,326." Ne advised [he Commission he had talked by phone with DER that day to ask if [here vas any way to recapture those funds. Ne suggested demolishing the old pump s[acions which are still [here ar will have to be demolished at our own expense. DER informed him that he could not because when the project vas firs[ se[ up, [hey notified Che city on August 9, 1984 [ha[ the grant for the pumping station could onl be honored for the amount of what it would have cost [o rehabilitate tl pumping stations, not [o rebuild them. There was an estSma [ed cost put out and when the bids came in [hey nego tia [ed [he $50,000 lower price by cutting out some of the gold plate on [he pumping, and because of that the city vas losing SSX of the money the city saved the state and ourselves at [he same time. There didn't seem to be an incentive for a community to cry to use the dollars most effectively, because if you save money, the state will take away 55Y. they gave you in [he first place. The seond problem vas the outfall line and that was when they increases the outfall line from 20" to 24" [he S[a[e would not participate in any of Chat. The above two items were the reasons for the reduction in the gran[ amount. Cov®iasioner Gullf Eord commenced the City of Atlantis Heath had expanded the size of [he line because of our neighbors that were participating Fn [he outfall, and [hey should share in some portis of that expense incurred to go to 24". Hr. Fellows said they were shari in the same amount [hey were sharing originally. We gave them written notice when Chey recommended going to the 24" line chat the Ci[y of Atlantic Beach anticipated there would be no additional expense to the city. I[ vas pointed out we anticipated there would be no additional expense, but unbeknoving [o the city DER had come back with the reduces grant. I[ was suggested we should find out how much of [hat represen[es the increased 24" and bill the cities of Neptune and Jacksonville Beacl their fair share. Tvo bids were received om the 4-inch double diaphragm pump and, it appearing both bids meet specifica[i~ns, and both companies submitting bids are reputable, the committee recommends the City award a contract to M.D. Moody and Sons of Jacksonville, Florida, for a new Seth 4-inch double diaphragm PAP. [railer mounted, with an air cooled diesel engine, for $6,600.00. After discussing the lone bid received from Superior Tractor of Jacksonville, for moving tractors, the committee recommended the award be made to Superior Tractor in the amount of $12,790.00, less trade-in of $1,500.00, for a net price of $9,790.00 for two Yanmar 276 tractors provided, however, chat co®ittee members were unable to make a determination between the date of the committee meeting and the next Commission meeting, that rebidding [he project would be to the City's advantage. This chronology viii include the contacts and evaluations of April 19$5 through lfarch l7, 19$6. In April of 19$5, the police department h<id been experiencing numerous problems with the existing Repeater/Base S[a[fon. Repairs had resulted in one bill from Communications Services for $900.00, considerably more than [I~e unit vas worth. At [Li[ time we questioned why a fairly new repeater vas giving us so much [rouble. He found that [he repeater vas no[ fairly nev. City records and maintenance personnel conF Srmed that [he pollee department did no[ buy a nev repeater several years ago. The department mod Lf led the existing tube-type base station (approx ima[ely 15 years old) [o give St repeater capabll it its. The use- ful life of such a base station Ss about ten years, and i[ needed to be replaced. The $900.00 bill vas settled for about $400.00 Co cover the business's expense, and later [he repeater/base station qu l[ working again. We initiated steps to secure nev equipment. During this time frame, [he police department started functioning on the Sheriff's tIe[vork. This vas not our assigned police frequency, but i[ me[ our needs. All of Che police department's mobile units had [he Sher lEf 's Network frequency, and five of our portables were altered to include it. The units were not served by a repeater, but L[ vas tolerable under the conditions. In lfay of 19$5, Ch Sef Royal and Ch ieE Thompson met several times with Bill Crosby of Motorola. They discussed the Eunt [!.onal and equipment needs [or Yubl is Safety, and preliminary sketches were prepared. It became apparent that a sign iE Scan[ investment you ld be required [o secure a quality system for Police and Fire. In Nay of 19$5, Ch ieE Thompson contacted the Florida Department of Central Ser- vices, Division of Covmunicat ions. Because of [he antic Spat ed ex pence of [he nev equipment, it vas felt that [he police department and the City c~cld benefit from the professional guidance of communications experts with no financial interests in Che equ ipmen[. The Division of Common Stations charges no fees Eor tonsultat ion, and their adv tee is strictly advisory in nature. Ne were originally told [ha[ the Division of Common Stations did not have [be funding [o handle the [ravel expenses [o send someone [o an on-sigh[ evaluation. The committee discussed the lack of competitive bidding on this prof ecc, and discussed in detail the fact the City had bid this project out [vice and had received only one bid the first time, and the second time two responses and only one of those vas a bid. As this vas discussed in some detail the members of the committee felt the specifications prepared by the state were unduly technical and complex, which in turn may have resulted in a too narrowly defined prof act. The current franchise agreement provided for biannual payments of the fees, but JEA had been collecting a 6X monthl fee from each customer in Atlantic Beach since 1983 when the State Pub Service Commission ruled that such fees paid to a municipality must be collected only from the residents In the municipality charging the fee and [ha[ the fee could not be included in the rate structure.
