SUBJECT: CAPITAL E%PERDITURE REQUEST F1' 1985-86
The City's present fire engine is a 1973 1,000 gpm Ford LaFrance. Fire
engines generally arc kept as first line engines for IS years, and in
reserve for 5 years. The American LaFrance Company is bankrupt, which
may or may not affect parts availability and resale value in the future.
Our engine has given good service and may coot inuc to give service for
some time. W'e have, however, received the best years of its life. The
City Commission needs to be aware that a replacement should be
considered in the near future.
The price of fire engines range from $65,000 to $IJS,000 depending on
pump size, engine size, type of manufac tare, etc. They will never be
any cheaper. ?f we do not buy one this year, we should set aside money
for a future purchase to case the burden.

As directed, I have inves[igat ed the above referenced business and
property with regard to proper licensing and the possibility of
encroa^lu9ent onto adjoining property.
In checking with the City Clerk, I find that the business is properly
licensed and is operating legally under the "grandfather" clause of the
City Code. A physical examination of the property located the survey
stakes, revealed that the cars do not encroach on complainant's
property, that there is sufficient room for ingress and ogres_ to the
complainant's property, and that the business is being conducted in
compliance with its licensing.

Section 24-17 - Definitions.
"Bond" shall mean any form of security including a cash deposit,
surety bond, cash deposit, surety bond, collateral, property or
instrwment of credit in any amount in form satisfactory to the City
Commission. All bonds shall be approved by the City Commission wherever
a bond is required by this chapter.
(a) Ffaint enance Bond: Upon issuance of a certificate of
completion, or when required improvements are installed prior to
recording the plat, surety must be posted in the amount of ~5$ 100$ of
the original engineer's estimate of the cost of improvements. The
condition of this obligation is such that the City will be protected
against any defects resulting from faulty materials and workmanship of
the aforesaid improvements for a period of twa one year.

problems connected with this matter have been resolved.

Beach to the St. Johns River. There vas also a meeting held at ?:W PM
on Friday afternoon with Peter Martin, President of Atlantic Utilities.
Mr. Martin had requested the three Beach cities to allow Atlantic
Utilities to tie their effluent into the regional system and was told to
first discuss the matter with Atlantic Beach to sec whether or not a
plan could be devised for Atlantic Utilities to tic their of fluent into
the Buccaneer outfall. After the meeting, Peter Martin was instructed
to prepare a uritt en proposal relative to what he had in mind and this
is to be sent [o the City for consideration. [ anticipate this will
come before the City Commission at some future date when there is
something more concrete to go on.
o The City auction is now set for September . It was necessary to
change the date from August S1 because Chief Royal, who is coordinating
the event, was going to be out of town on that date. It is now set for
10:00 A!d, Saturday, September 7, at the Public Korks yard. N'e have been
asked whether or not City employees would be allowed to bid on the
it ans. N'e discussed this with the City Attorney and it seems there
might be a perception by the public that City employees uou ld have some
"in" when bidding on the items which would give them some type of
advantage over the normal bidder. At the present time, therefore, we do
not intend xo allow City employees to bid on the items. Please let us
know if anyone has any other thoughts on the matter.
o hlac0onald Construction Company has asked us to make a determination
as to where they might set up their headquarters for the construction of
the regional outfall. It appears the area at Water Plant k?, just north
of Fairway Villas, is the most logical spot for him to operate from.
Unless there are some objections from the City Commission, we plan to
allow him to utilize this area with the understanding that he will
replace any sod or grassing that is torn up as a result of the heavy
equipment chat wilt be stored there.
o We have received an inquiry from Aubrey Deal who represent=_ Louis
lluntley regarding property located at the southeast corner of Plaza and
Mayporc Road. We understand Muntley owns about 7 acres here but is
utilizing only a part of the property now for a Jiffy Store on the
corner. fie proposes to build a shopping center here. The current
zoning where the .Jiffy Store is located is CL, and the remainder of the
property is zoned RG-2. The proposed zoning is a combination of CL, the
new CPO, and RG-2. The City will probably shortly receive a request
that the zoning here be reconsidered during ehe public hearings on the
Mayport Road corridor.
o A research of some of the City files turned up an old engineering
drawing for improvement of the drainage sy'st em on the lagoon west of
Seminole Road. The plans were drawn by Pa ppy Parks but were preliminary
and not designed for bidding. We asked Pappy to update the plans, but
he has pretty much retired now and recommended that we send the plans to
Connelly E h'ic ker and he would work with them to get them updated. We
have these under review now and once completed will discuss with the
City Commission their desires relative to upgrading of the dra inagc
system.

is presently zoned CL and does not appear to require any additional
change in zoning. The Adviso q' Planning Board has recommended approval
of the exc epiion subject to the development by the owner of an
acceptable site plan. They will also need to make reservation far sewer
capacity.
o Chief David Thompson has received the written resignation of Office
Gene Ilan. Officer Hall claims to have been experiencing severe health
problems over the past several months and has decided to seek employment
in some other occupation.
u The ordinance containing the changes in zoning classifications for
use in connection with the M1lavport corridor rezoning has been prepared
and a copy included for your study. The ordinance will be introduced at
the meeting on Monday night, and then advertised fora public hearing so
that both the new ordinance and the Maynort corridor zoning ordinance
will come up fora final public hearing at the first meeting in October.
o The owners of kagtime ha~'c made inquiry regarding the exception
granted to them to serve beer and wine for on-nrem ise consumption at
their restaurant at Atlantic Boulevard and Ocean Boulevard. We have
researched the documents on this particular case and have found the
application for the ezc epiion requested a Part of Lot 7 anJ All of Lot 8
in the particular block, and it therefore appears the exception granted
in 1982 for 40 or SO scats would cover their request to create an
additional i0 scats in the store next door to their current location.
In any event, City Attorney Mullis is looking into this and we will keep
you aJvised.
o The Board of Adjustment he1J its meeting on Thursday, August 15,
1985, in the City Commission Chambers and grant the request of Carl B.
Hooten II for a variance on his property at 6th Street and Ocean
Boulevard. This matter had come before the Codes Enforcement Board on
charges the property owner was encroaching onto the public rights-of-way
and the Board ordered the removal of the encroachment and asked that
Ilooten appear before the Board of Adjustment and seek the most
reasonable variance possible to enable him to reach the second story of
his home with a minimum amount of encroachment into the City
right-of-way. This action should dispose of the matter.
o AC the last meeting, we had several comments from a member of the
audience relative to Johnny's C,arage in Section I1. I asked the Codes
Enforcement Officer to check into this, and his written report is sent
along for your information.
o On EriJay, August Iii, the engineers on the regional outfall held a
preconst notion conference in the City Commission Chambers at 10:00 AD1.
MacDonald Construction Company, the successful bidder, was given
detailed lust ructions regarding the manner in which he is to undertake
Part 5, which is the construction of the regional outfall from Atlantic

advise of the Buccaneer Consulting Engineer and as discussed at Ci[y Commissioners
meetings, Buccaneer Service authorized vo rk required for the Eu[ure treatment
plant No. 3. The work vas authorized to prevent the future shut-down of an
operating plan[ at full capacity for a period of five [o six. weeks which would
have created env ironmen[ally prohibitive problems.

Attachment "B" is a detailed summary of [he work actually performed for [he
future Trea[meni Plan[ No. 3. The s[a [ment is in error in that [he work actually
included routing a IO inch effluent Pipe through treatment tank No. 1 as yell
as two 4 inch sludge lines. Details are contained in [he New Waste Treatment
Plant plans and specifications by Alan N. Potter, P.E. dated Mar. 18, 1985
2nd amended May 24, b May 29, 1985. These plans were par[ of the Stock Purchase
Agreement signed by the City and Buccaneer on June 3, 1985.
This work was required to provide sewer capacity for future City of A[lan[ic
Beach/Buccaneer Water S Sewer Dis trio customers and as such was budgeted as
part of [he City Capital Outlay for a Sewer Zrea[ment Plant No. 3 and payable
Erom Construction Agreement Funds now available for such use.
I[ is requested that authorization for expenditure of the amount shown in
attached invoices be placed on the agenda for the next Commission Meeting
and that funds be drawn from [he Construction Line of Credit established
for this purpose. I[ is also requested that the attached statement be paid

WHEREAS, the Advisory Planning Board of the City of Atlantic Beach
has made a stud)' of the zoning along the Ffayport Road Corridor, and
KHEREAS, the Advisory Planning Board has held public hearings on
the same, and has made its recommendations to the City Coruoi ssion, and
WHEREAS, the City Commission finds the recommendations of the
Advisory Planning Board relative to comprehensive rezoning of thu
Mayport Road Corridor is consistent with the Land Development Code :end
the Comprehensive Plan adopted by the City, and the zoning will not
adversely effect the health and safety of the residents of the area, and
and will not be detrimental to the natural environment or to the use or
development of the adjacent properties in the general neighborhood,
NOW, THEREFORE, BE IT ESACTED BY TfiE CITY COy4fISSION OF TIIE CITY OF
ATLANTIC BEACH, FLORIDA:
Section 1. The real property depicted on the attached map and made
a part hereof is hereby zoned as indicated under the zoning code of the
City of Atlantic Beach, Florida, in compliance with the recommendations
of the Advisory Planning Board to the City Commission.
Section 2. This ordinance shall take effect on its adoption.

8. Action by the City Commission [o receive a tentative budge[ for
the nev fiscal year beginning October 1, 1985, and certifying of [he
millage foz [he Property Appraiser of Duval Co un[y.
To comply with the State Law, Mayor Howell recommended [he City Com-
mission set a tentative millage of 2.8, the same as 1985 with the clear
understanding is would probably be lowered. Mayor Novell said "The
tentative millage of 2.80 mills vas the absol uce maximum, and as far as
I am concerned, it's above the maximum". ne announced a Budge[ Worksho
meeting would be held on August 5, 1985; a Pubiic Hearing would be hel
on [he tentative budge[ and proposed millage on August 26, 1985, and o
September 9, 1985, the Ci[y would adopt the final budget and millage.
Conwissioner Gulliford adamantly and vehemently opposed a 20.2 percent
cent increase in property assessments in Atlantic Beach, the highest
increase in the county." A 20% increase in property assessments is in-
flationary, counterproductive and unfair. It's just too doggoned much.'

and what that anounted to and adjust [he city's millage downward [o re
fleet not an increase in [axes because of the assessment, Cho ugh cer[a' -

whereby if a person requested a ninety day reservation they would pay
25X of the total impact fees up front, a six month reservation would
require SOX and a year's reservation would require 100X impact fees

o The St. Johns River W'a ter Management District has issued a
consumptive use permit for the water system in the Buccaneer Water and
Sewer District. The permit provides far 822,000 mgd in 1985, 1,3U0,000
mgd in 1986, and increases each year up to 1992 when the City will be
authorized to draw 3,333,000 gallons of water daily. Attached to the
permit arc a number of conditions, the main one of which requires us to
conduct a feasibility- study for using treated effluent as irrigation
water for landscaping, etc. W'e must complete the study and submit it to
the Water hanagement District within six months of the date of issuance
of the permit.
o Relative to the request for enginceri ng assisC~nce on developing a
master plan for Section 11, be advised we have received indications of
interest from Smith E Gillespie, Gee E Jenson, Connelly E Kic kcr,
Bessent, Ilammack E Ruc kman, and England, Thims E hli ller.
In order to proceed under the statute, it will be necessary for the City
Commission to authorize a selection and negotiation process to determine
that a suitable fee basis may be established. If we are unable to
establish an acceptable fee for referral to the City Commission, we
would proceed to number two engineer. We shall await your pleasure.
o The h'ayor yesterday was furnished with a suit in the Federal
District Court alleging discrimination and unequal treatment under the
We Process Clause of the U. S. Constitution against Fred Lewis, his
ui Fe, and the present operator of the old "Casablanca". The City
Attorney has been Furnished a copy and we have a copy at City hall if
any of you wish to see it.
o The transition of the buccaneer Water E Sewer Uist rict from the
City to Jax Utilities was accomplished on August 1, 1985. The
smoothness of the transition is due to the excellent cooperation between
Harry Royal, Carlene Matthews, Ellen Lava kc, and the operators of Jax
Utilities.
o Please rend over the letter from Buccaneer Management Partnership
relative to their request that we pay J. W. '4eadors E Company $9,543 for
work they accomplished under the old Bucc anecr Service Company which
accrues to the benefit of the City on the construction of the new
400,000 gallon tank. Buccaneer has requested we pay this bill direct to
J. W. Meadors from our currently on-hand construction agreements fund.

o The Florida Municipal Health Trust has announced a reduction in
their monthly rates for hospital and medical insurance. The rate next
year will $5.00 a month less than it is this year. However, the Florida
HMO has raised their rates approximately the same amount, so there does
not appear to be any chance for savings at the present time.
o We have received notification from the Department of Natural
Resources [hat our coastal construction permit for the dune overwalks
has been approved for processing. N'e also have received clearance from
the Division of Archives stating they feel no artifacts or other objects
of historical significance will be disturbed by the construction of the
dune m~en~alks.
o Several meetings have been held recently regarding new water and
sewer connections and these include:
1. New Oc eanwalk Subdivision composed of approximately
200 to 300 single family residential uni[s. h'at er
and sewer will be furnished from the City's Buccaneer
Water and Sewer District. Impact fees will be paid
upon appiicat ion for building permits.

relative to their plans for further development in
Seminole Beach. Akel plans 42 units and Grissett
plans a minimum of 80 units. Total impact fees arc
over $100,000 to be paid up front. N'a ter and sewer
service will be furnished by the City's Buccaneer
Water and Sewer District.
3. Comfort Inn, Mayport Road, is under const action.
Water and sewer is being furnished through the City's
lift station at Fairway Villas.
4. Selva Lakes, a planned development of over 100 homes,
is under way with the first phase of 54 homes being
implemented. These arc townhouses located off 11th
Street. They will be served by the Atlantic Beach
water and sewer system.
o We are planning to have an auction of surplus equipment on
Saturday, August 31, at 10:00 AAf at the Public Works yard. We are
enclosing a list of the items which will need to be declared surplus to
the City's needs by the Commission at the meeting on Monday night.
o As mentioned in previous correspondence, we are requesting approval
to hire Bob Braid as Director of Operations for the Public Works
Department for the remainder of FY 1984 -85. There are sufficient funds
in this year's budget to cover whatever expenses arc involved in this
appointment. We have included sufficient funds in the proposed budget
beginning October 1, 1985, to continue the arrangement if approved by
the City Commission.

meeting of the City Commission held on July 22, 1955. Also enclosed are
the minutes of the workshop meeting of August S, 1955.
o W'e are enclosing a copy of the Buccaneer Management Partnership
reply to the Smith E fi llespie maintenance report Jated July 1965. A
copy will be Furnished to Smith & Gillespie for their files.
o N'e are enclosing a copy of a hanJwritten memorandum from
Commissioner Yan Ness to members of the City Commission rcl ativo to her
absence from the City meetings.
o We are enclosing a letter from Bledsoe 4 Schmidt, Attorneys at Law,
relative to property located on Atlantic Boulevard close to the Ashland
Miniwarchouses. The letter is in opposition to the proposed rezoning
from CI to CG. This area is included in the proposed rezoning of the
Mayport Road corridor which, incidentally, will come up for public
hearing at the meeting on Monday night.
o The Sea Turtle Inn is sponsoring a volleyball tournament on the
beach on behalf of Easter Seals on Sunday, August 25, from 11:00 MI
until 4:00 PM. They have requested permission from The City for WAIV
radio to broadcast from their van on the beach at the volleyball site in
order to work up some enthusiasm for the tournament, announce the
winners, etc. PLCase let me know if there any objections to this one
time charitable event.
o Long & Associates have indicated the pay plan will not be
completely ready by the 15th of August and, therefore, we arc requesting
the Mayor cancel the workshop of August 19th and reschedule it for
Tuesday, August 27, at 7:15 Phl. N'c hope and trust all members of the
Commission will agree and be able to attend.
