L. Green to open a veterinary clinic at 1887 Msyport Rawd (corner
of Dora Street end Mayport Road). The property is Sn a
Cowwercisl General zoning district. Soave wewbers expressed
concern that Dora Street vas too narror and that barking dogs
could disturb neighbors in close proxiwity. Other wewbere argued
that thv property fe zoned for such higher intensity uses rithout
exception. A wotion to recowserd denying the wpplication failed
to pass by a three to three vote.

The Professional Services Evaluation Committee me[ a[ 3:00 PM on Thurs-
day, Fehruary 11, 198R, in the Cf ty Nall conference room, C1[y Rall,

Present Were City Attorney Mullis and City Manager Fellows. Committee
member 7olin son vas absent due co a trip overseas. Also present were
Peter Rumple and Tnm McNett represen[Ing Clements/Rumple/Coodwln/D'Avi,
Architects mid Planners.
The committee members each acknowledged receiving a copy of proposals
from [he architects proposing to develop the information required in two
phases. Php se I would 6e a review of the existing Atlantic Beach Cicy
Rail to determine the adequacy of existing facil it iea and to determine
[he feasibility of expansion and/or mod if SCat ion of the present facility
to a¢ommoda[e future needs of City government. The architects propose
co conduct personal interviews with Ci[y personnel related Co apace
needs and job functions, analyze, evaluate and review the informs[ ion
thus acquired co prepare a writ[ en program of currenC and future
spatial requirements for the City's review and approval. Such report
and revieu might yell contain generalized site drawings to establish
relationships between the size of the building, adequacy of parking,
etc. The cost for this study is to be based on an hourly rate times a
2.5 multiplier, with a total fee not to exceed 54,500.00. A copy of the
proposal is attached hereto ar,d made a pare hereof. Ro wrk mould be
undertaken on Phase I until approved by the Ci[y Covention and au-
xhorized fn writing [hereafter.
Once a determination has been made as co the status of the old building,
the designers would [hen, after approval by the Ci[y Commission and upon
written authorization, proceed vich Phase II, which would be the design
and/or modification of [he exist ing structure or [he design of a new
City Nall [o be located adjacent to the Public Safety Sulldiog off
Seminole Road. This work which mould anticipate the design of approxf-
macely 5,000 co 5,500 square fee[, would consist of all of the necessary
plans and specifications, etc. for a lump sum fee of $36,000.00. This
proposal is attached hereto and made a part hereof.
Considerable discussion ensued relative to encoursging [he erchltects,
should the City Coareiss ion approve Phase I, to conceive and/or develop
some innovative imaginac lve proposal relative to what uses might be made
of the current City Nall building should it be detevlaed it not be
suitable foe expansion and/or modification for the purposes of future
governmental use. Specifically mentioned were museums or exhibition
halls which might be utilized and partially funded by portions of the
Convention Development Tax, etc.
Following further discussion, it vas the recommendation of the to~lct ee
to recommend to the City Commission chat [he proposal of Clnenca/Rumple
/GoodwSn/D'Avf for Phase T and Phase II be accepted, contingent upon
approval by the City Co®ission and author iza[1on Sn writ ing before
proceeding vich each of the phases.

defalcations were discovered in the scope of our
examination.
9. The financial report for the year ended September 30,
1987 filed with the Department of Banking and Finance
pursuant to Section 218.32, Florida Statutes, is in
agreement with the annual financial audit zeport for the
same period.
9. In connection with our examination of the general
purpose financial statements of the City, for the year
ended September 30, 1987, in accordance with the
standazds for financial and compliance audits contained
in the F s ~'t f Governmental
~y ations Programs Acti sties and Functions,
issued by the U.S. General Accounting Office, the Single
Audit Act of 1984; and the provisions of OMB Circular
A-128, Atdits of State and Local Governments, we noted
no instances of noncompliance wrth laws and regulations
related to Federal programs.
The Rules of the Auditor General, State of Florida, require
that this report be filed with the Auditor General together
with audited financial statements.
Chapter 10.550, Rules of the Auditor General - Local
Government Entity Audits further require that this report
specifically address, but not be limited to, the matters
described in Rule 10.554(1)(K). Accordingly, in connection
with our examination of the financial statements of the
City, for the year ended September 30, 1987, we report the
following:
1. No irregularities were reported in the preceding
examination.
2. All recommendations made by us in connection with the
preceding annual financial audit have been followed or
adequately addressed except as noted in Section I of
this report.
3. Recommendations, if any, to improve present financial
management, accounting procedures and internal
accounting controls are addressed in this report.
4. During the course of our examination, nothing came to
our attention to cause us to believe that the City:
a) was in violation of laws,
rules and regulations;
b) made any illegal expenditures.
However, it should be noted that our examination was not
directed primarily towards obtaining knowledge of all
possible violations or improprieties and our study (and
therefore our procedures and 'tests) were limited as
described in the second and sixth paragraphs of this
report.
5. No improper accounting procedures were found within the
scope of our financial audit. Circumstances, if any,
involving the adequacy of accounting procedures are
addressed in this report.
6. Ro failures to properly record financial transactions
were found within the scope of our financial audit.

During the ezamination of the financial statements as of
and for the year ended September 30, 1987 the following
conditions were noted:
INVERTORY
Finding - The City had an inventory consulting study done
in April 1987. Since that time the City has begun
implementing those recommendations. The following
recommendations have yet to be implemented by the City:
Re^ommendations:
A centralized public Works inventory location should be
established which would include water and sewer parts
inventory.
An oil pump lock should be purchased and the pump
should be locked when not in use.
. The stock room at the water plant should be locked and
materials removed should be logged out by part number,

PAYROLL
Finding - During the 1987 fiscal year, the City instituted
a time clock requirement for all personnel. The time clock
procedures have been clarified several times during the
year through personnel memorandums. we recommend that the
City further improve the time clock process by implementing
the following comments.
Recommendations:
All time clock policies and procedures need to be
consolidated into one document and be added to the City
personnel manuals at the Wert printing.
The policies should require employees and department
supervisors to sign time cards before submitting them
to the payroll department. Department supervisors
should also be required to initial any hand-written
entries on a time card.
Any overtime work should be accounted for on the time
card, including weekend work when the time clock is not
accessible and approved by the supervisor.
Public Works time cards should be controlled by a
single individual who hands out time cards to the
proper employees and controls the time cards at times
other than clock-in, clock-out times.

During the year ended September 30, 1987, all
recommendations brought to the attention of management in
the management letter for the year ended September 30, 1986
were addressed with the ezception of the following:
Finding - The City does not presently use an encumbrance
accounting system in its Governmental Fund Types and other
budgeted Eunds.
Background - The City presently manages its ezpenditure
budgets by comparison of actual ezpenditures incurred to
budgeted amounts. This requires considerable judgment as
total ezpenditures approach their budgets in that the
Finance Department must accumulate and manually determine
the eztent of outstanding and in-process purchase orders
and estimate emergency ezpenditures. An encumbrance system
is a widely-used and valuable tool in this process. With
an encumbrance accounting system, the initial accounting
for ezpenditures begins with the purchase order or request
which ie recorded on the system as an appropriation prior
to the actual ezpenditure. This allows for more efficient
management of budgets as outstanding purchase orders
representing encumbered funds are recorded and accumulated
on the system.
Recommendation - The City Should study the feasibility of
establishing an encumbrance accounting system over
ezpenditures in Govecnmental Fund Types and other Budgeted
Eunds.

inherent limitations in any system of internal accounting
control, errors or irregularities may nevertheless occur
and not be detected. Also, projection of any evaluation of
the system to future periods is subject to the risk that
procedures may become inadequate because of changes in
conditions or that the degree of compliance with the
procedures may deteriorate.
Our study and evaluation made for the limited purpose
described in the second paragraph would nut necessarily
disclose all material weaknesses in the system.
Accordingly, we do not ezpress an opinion on the system of
internal accounting control of the City taken as a whole or
any of the categories of controls identified in the second
paragraph. However, our study and evaluation disclosed no
condition that we believe is a material weakness.
Our study and evaluation did, however, disclose the
attached matters that, although not considered by us to be
material weaknesses, are weaknesses is internal accounting
control for which corrective action might be taken.

of the City o£ Atlantic Beach, Florida (the 'City') for the
year ended September 30, 1987, and have issued our report
thereon dated December 31, 1987. Our eaamination was made
in accordance with generally accepted auditing standards
and the standards for financial and compliance audits
contained in the ~`andards for Audit of Governmental

by the U. S. General Accounting Office and, accordingly,
included such tests of the accounting records and such
other auditing procedures as we considered necessary in the
circumstances.
REPORT ON INTERNAL ACCOIINTING CONTROL
As part of our ezamination, we made a study and evaluation
o£ the system of internal accounting control of the City.
For the purpose of this report, we have classified the
significant internal accounting controls in the following
categories: cash receipts and disbursements, investments,
receivables, budgets, fired assets, payroll, purchasing,
grants, debt administration and general ledger. Our study
included all the control categories listed above. The
purpose of our study and evaluation was to determine the
nature, timing and eztent of the auditing procedures
necessary for ezpressing an opinion on the entity's
financial statements. Our study and evaluation was more
limited than would be necessary to ezpress an opinion on
the system of internal accounting control taken as a whole
or on any of the categories of controls identified above.

CONTAGIOUS DISEASE POLICY
I. Purpose: The purpose of this policy is to provide guidelines for
the handling of contagious disease cases (including Acquired Immune
Deficiency Syndrome (AIDS)), as they relate to employees of [he
City of Atlantic Beach.
II. Employment Positions:
General: An individual infected with a contagious virus may
continue to work in [heir designated capac i[y as long as they are
able [o perform the responsibilities of the job, and so long as
there is a medically-based opinion that there would 6e no signifi-
cant health and Jor sai ety risk of exposing other empioyees [o [he
virus, there is no inherent danger [o the employee or the public in
routine situations, and specific precautions will be taken to
address exceptional circumstances.
In [he event that [he inf ectzd employee requires extended medical
leave, it will be granted consistent with [he City's Extended
ried ical Leave Policy.
The City will assume that all employees who have contracted the
AIDS virus wish the condition to remain conf iden[ia 1. All sucl.
cases will be referred to the City Hanager, and the right [o
privacy of [he affected employees will be respected.

?he Commtttce appointed to evaluate [he bids for a vice mesh storage
facility inside the Pu61 is Works buf ld ing, met on Wednesday morning,
January 27, 19ft8, at 9:45 in the City Hanager's office, City Hall.
Present vas the chairman, Comm isstoner Robert Cook, CS[y 1lanager Fel-
lows, and Public Services Director Braid. Public Works Division Chief
Hogans could not attend.
Each member of [he committee acknowledged recely ing a copy of the
[abulatlon of bids and discussion took place regarding [he quallfica-
[ions of the apparent low bidder, George Coyle and Sons of Jacksonville.
Evaluation of the bids indicate the bid price for the first floor enclo-
sure, the firs[ additive alternate, and the second additive alternate
coral $2,876.00 vh1cL is well wit hin the $3,000.00 budgeced for Chis
project.
The Cfty Manager pointed out this vas a good example of how the bidding
process saves money inasmuch as George Coyle and Sons had furnished the
City with a yr it[en proposal some months ago to do this same work, said
proposal 6e ing over $4,000 and when bidding [he same scope of work out,
the bid had come In almost $1,200 less.
Further discussion ensued following which St vas the unanimous decision
of the committee [o recommend [o [he C1[y Commiss ion [ha[ [he bid of
Ceorge Covle and Sons of Jacksonville, in the total amount of $2,876.00

projects, namely, for preparation of a master drainage plan and the
preparation of plans and specifications for the rema Sning eater and
sever lines on Rearh Avenue M1e[ween Sixteenth and Twentieth S[ree[.
Present for [he meeting were City Hanager Fellows, Committee Member
Peter Johnson of A[I:wtir Reaob, and Ci[y A[[o rnev Mullis, vho arrived
late.
Each member of the rnmm i[t ee had prey iously received copies of [he
information sent out by [he interested enq ineers and acknowledged
reviewing the qualif ira[inns of [he various Etrms. The firms vho had
expressed an interest in the projects vete Bessen[, Hammack b Ruckman;
Gee b .Ienson; Hathnr Engineering; Hill Boring and Assot la[es; RJN
Environmental Assoc la[es; Smith 6 Gillespie, and Na i[z S Prye.
Each of the engineers vas given an oppor[un i[y to make a brief presenta-
tion to the crnmoi[tee during which they stressed [heir goal if ica[ions,
and were invited to tell the committee any special goal if ice[SOns or
ideas they had which trey felt would help the committee make a decision
on clie firm best qualified [o handle the projects.
Following a present a[ton by each of the engineers, a brief discussion
took place among the committee members as [o [he firms the comittee
felt most qualified to undertake the projects.
Discussion opened regarding Harbor Engineering and Hill Boring and
Assoc is [es since these two firms had no[ done any previous wrk for the
City. After discussing these two firms, is vas the unanimous feeling of
each of the co®aittee members [ha[ neither of the firms had [he depth of
personnel nor the necessary experience to undertake the projects.
Discussion then ensued regarding RJN Environmental Associates, and the
coot~ittee felt that because of their local ion in Boca Racon, it would
not be economically feasible for the committee to recommend chem.
Further discussion ensued relative to the remaSning four firms, and
based on expertise, depth of knowledge, personnel, past accoepli shments
in doing work for the City, the committee reco®eended short-31st ing Cee
S Jenson, Smith S Gillespie, and Bessent, Hammack 6 Buckman.

Cvo parcels, ve should be able to star[ construction within 45 days.

Mayor Howell said PBS airing of "The Invisible City" on Channel 7
Sunday was excellent. He hoped they would show i[ again for chose who

Mr. Pellovs noted he had mentioned in the status report his desire Eor
the Commission to discuss the impact fees on water. The city is not
developing soffit ien[ revenues co perform the necessary maintenance of
the rater system as ve are in sever, and he asked [he Commission to
instruct the City Attorney to prepare an Ordinance for consideration a
[he next meeting. The present impact fee on vacer is $10.00 per fixcur
unit. This returns approximately $200.00 for a three bedroom, two bath
home as compared to the sever impact fee of $I,U35.00. Mr. Pellovs sai
they were developing sufficient revenues to maintain the syc[em and pa

Mr. Eckert advised the St. Johns River Management District dId not re-
quire [hem [o provide retention from [he standpoint of water quancity
because [he direct discharge of drainage from the project is to the
Intracoastal waterway. However, you do have to provide water quality
treatment, ellher the firs[ I/2 Snch of runoff from the entire proper[ ,
or the first inch of runoff from [he Smpervious area. They have handle
that requirement predominantly within the roadside swales. They have
also made use of [he West Plaza ditch by proposing to put in a shallow
control structure [o allow them co contain the first I/2 inch of run-
off.
Main, Hibiscus, and Orchid Streets will all have curb and gutters due
to the heavy traffic. The City Hanager has been asked [o check into
[he possibility of purchasing three lots on the north side of Wes[
3rd St., and one for on the south side to accommoda ce [he eater qualic
treatment.
Mr. Eckert told the Commission he had the assessment rolls set up and
all he had to do vas plug in the final dollars. The next step would be
to send a copy of [he cos[ estimates [o Mr. Bill weathers for [he
bonding costs; rework the assessment rolls, and hold Public Hearings.
Mr. Mullis asked if Bessent, Hammack and Ruckman had utilized their
proposed method of assessment any place else. Nr. Eckert said he would
have to check. He had personally used something similar, but not iden[ cal.
Their method vas very similar to an impact fee.
Polloving discussion, the Commission agreed to instruct Mr. Eckert to
send the cost estimates to the honding agent for his analysis.

Cownissfonet Edwards reported [he committee met on Wednesday, January
13, 1988 En the Cicy Nall conference room. After evaluation, the
Committee reconmiended the Co~moission award the bid to [he low bidder,
The Bello it Company of Jacksonville, in the amount of $91,657. As only
$79,000 had been budgeted for the project, a budget transfer would hav
to be prepared to cover [he deficit. I[ is anticipated the project wil
last approximately three to four months. The City Manager suggested th
amount of $15,000 be transferred to cover any contingencies.

Mrs. Pearson asked the Commission if [hey chose to amend the Ocd inane

Mr. Eckert offered a map of the proposed project and briefed the Commi
sion on [heir progress. Before the last Public Nearing, he had set up
assessment rolls whereby the large parcels north of Levy Road and soot
of Church Rd. were being assessed on a per square foot basis. That vas
deemed inappropriate at that point in time, and he vas instructed [o g
back and review [ha[ position, and come back with other recommendation
Through several meetings with [he Hayor and City Manager, during [he
pas[ months, they came to the conclusions that he would assess the pr
perties purely on a per front foot basis, and also make an attempt [o
take into account [he existing facilities. At Chat point in time, his
firm recoamrended [o [he Hayor and CS[y Hanager that they be allowed
co proceed with preliminary engineering so they could have better cost
by which to base their estimate per front foo [age assessment. The
preliminary engineering was delivered to the city approximately one
week ago. Nev cos[ estimates have been completed and he presented cops
to each Cov®issioner. A copy of his report is attached hereto and made
par[ thereof. To [al projected construction cost vas $3,934,856. ,of vhi

Mr. Scocc Lewis, 346 Sch St. said he had a serious problem with drain
on his driveway. He had been working with Mr. Braid and others for ap
mately one year. Tlie city sent an engineer out and [hey saw the probl
but apparently is would be too expensive [o fix. Originally, [here wa
culvert under each driveway, but over the years, [he yards have been
filled in, the scree[ has been re paved, e[c.and now when i[ rains har
he had water backing up about 20 feet, with 3 - 4" of eater standing~
[he driveway. He asked the Commission if he could build his driveway
and remove the broken sidewalk he had covered up. Hr. Fellows reporce
that Connelly b Nicker did some engineering drawings last year on 5th
and Mr. Levis had crea ced pare or the problem by coveting up his aide
walk, because the sidewalk was part of [he drainage. Hr. Fellows adde
chat he had [he plans from Connelly b nicker and it would cost about
$15,000. The city had been concen crating on through streets Eor side-

required for the Aclant is Beach sewage treatment plant once [he nee
operation permit is applied for. We have come to the conclusion,
therefore, it mould be best for us to scar[ calking vich the other two
beach cities, Jacksonville Beach and Neptune Beach, relative to a shared
program to address this nee requirement. Ne vfll keep you advised as to
progress.
o The question of selection for an architect for a proposed nee City
Nall will be an agenda item for Honday night. The two architects
currently under consideration are Gee b Jenson and Clements/Rumple/
Goodwin/D'avi.
o The Buccaneer vast avatar treatment plant and the City of Atlantic
Beach vasceva[er treatment plan[, have been designated Regional Sewage
Utility Plants by [he Department of Health, Nelfare and Bio-
Envizot~ental Services. The nee regulations require all regional
vastevater treatment plants co comply vi[h sewage treatment and disposal
regulations [o obca in eater quality standards. By January 15, 1989, we
are requited [o develop a master plan as outlined in [he Environmental
Protection Board's Rule 3, detailing t~ov [he utility will provide
service necessary to achieve eater quality standards within its service
area to include such things as expansion to accommodate growth, phase-
out of non-complying vasteva[er treatment plants, and reduction in
septic tank utilization. The study recently completed by Haitz b Frye
for the Buccaneer District relative to the capacity requirements of the
system for build-out will probably suffice for chat facility. It is
entirely possible [hat [he studies done by Robert 6a[es and Associates
for the expansion of our sewage treatment facilities may suffice to
answer these questions for [he Atlantic Beach vastevater treatment
plan[. In any event, ve shall keep you advised.
o Please find enclosed minutes of the committee meeting held by the
Professional Services Evaluation Committee for the selection of engi-
neering expercf se for the development of a master dra inage plan and
preparation of plans and spedfftations for [he remaining eater and

o The condition called to [he attention of the City Commission by
Scott Levis at 346 Pifth Street, has been investigated at length. Most
of the problem has been exacerbated by activities which Mr. Levis has

drainage, repair the broken sldevalk in frone of his house and the house

6 from Robert Bates and Associaces. The Change Order Ss revenue neu-

extends for sixty-five days [he tine for completing the project and vas
brought about because of delays in receiving some of [he items which
were installed in conjunction with previous Change Orders approved by
the City Co®ission.
o Just when ve were celebrating the City's victory Sn the Timothy
Cooper case, ve were advised by attorney, Peter Corbin, that Cooper has
filed an appeal from the District Court's ]udgement in favor of the City
to the United States Couzt of Appeals. Just for your edification, [his
particular law suit has been going an since July 1984, and within a few
months, will complete its four years of expense [o the CSty.
o Gee b Jenson has conducted the final Snspec[ion of the Public
Safely Building and is prepared on Monday night to recommend the City
accept the building as substantially complete. We are setting a tenta-
tive date of Saturday, Pebruary 20, 1988, ae the date for the public
Grand Opening of [he facility, and would like to have some input from
