Hours [o complete---LOTS-Like many community groups it will take them a lot of time to learn what they are about and how to function. 6. Grants: a. Status--- The main activity in this area has been research. Also other grant related action was included under the other headings. one promising grant maybe the City of Jacksonville's landfill rehab fund. The Mapor's Office intends to ask the Council to allow them to use this fund for Parks within three miles of a closed landfill. Most of our Parks are within three miles of the Grivin Landfill. b. Hours Expended To Date---33 hours. c. Hours to complete--- On going as grants become available. 7. Other: a. Status--- I have researched possible sources of revenue for the Budget. Vision Gae is one possible source of revenue through their franchise. This franchise didn't produce revenue last year, but it should this year- Parking is another possible revenue, but the political problems need to be considered. In the old business district there are 61 parking places. Some of the businesses might want to lease these spaces. This has been done in downtown Jax. Enforcement of parking regulations -handicap, tags and general parking. This work could be done by part time workers. Z still strongly favor privatization of solid waste. This could save at lease S3 a month per house. In addition it would Director) and others. Also, ae met with Bill Lewis to exchange information. Community Development Corporation: a. status--- I have spent much of my time on this project completing the Z.R.S. forms for the CDC to become a non profit. Also, I have discussed their status with the IRS. Until the receive their 501 3 c. status the CDC can not move forward. Ia addition, i helped with the planning of their Banquet. Also, I am in the process of planning a festival fund raiser for the CDC. Early in June, I worked on legislation and a contract for the CDC to receive the five City Houses on Frances Street. In addition, I coordinated the inspection of the house they intended to use for their meetings. Also, Z have spent time coordinating with NCNB to get them interested in assisting the CDC. I have met with Ivan Browning, David Young and Jim DelVecco of NCNB. I have, also, met and talked with Bob Nosey, Porrest Boone, and Paul Tanner of City HUD in reference to the Home program. There is a good chance we good use this program to raise the quality of our housing stock. In general, I have advised the CDC Officers on a number of issues, developed a plan of aork, and developed a community affairs process for them. Recommendation------ 1. Sponsor a seminar at city hall on how residents can use Department and Curt Wendland. New methods of meter reading were discussed. Bob indicated he would explore and set up a ~ demonstration. Also, he indicated that the would address their additional manpower needs in their budget request. After discussing the route problem, there didn't seem to be much of a problem. The main benefit of the meeting, for Curt and I, ass a better understanding of how that operation works. The major problem, which I feel needs to be resolved, is a better management of tasks and setting of priorities. Toward Chat end, i wrote a management memo to Bob for you. Follow-up in this area should be considered. , As I mentioned in my last report, the billing on a monthly basis should not be a problem. Once the Budget is finished, I will work with Curt to implement the monthly billing. b. Hours Expended---28.5 c. Hours to Complete---20 3. Purchasing System Review: a. Status--- i again met with Nr. Status During the early part of June, I found out that a developer wanted to put as many as 36 units of scattered site housing in Atlantic Beaeh. Thirty-six is to high considering that A.B. already has a number of such sites and other areas of Jax. are not excepting any sites. After meeting with you concerning this issue, I have had multi-meetings and phone conversations with Dick Brown, Bob Harris (the developer), Paul Tanner IJax HUD), Dick Boxers (former NUD June 17, 1992 To 'm D. Our discussions covered millage, the Barge Canal Funds, services, revenues and etc. In addition, Z talked with John Delaney, early June, concerning a process for resolution. Which lead to Hayor Austin, at the meeting of the 19th, directing John to begin discussions with Atlantic Beach on the Inter-local Agreement. Aa you know, we have had two meetings with Delaney. Both meetings where very productive. Also, I am to call John on the week of the 12th for a follow up. We will meet again on the week of the 19th. I have called three times to set up the next meeting. I have not received a return call from Delaney yet. In preparation for last months activities, I have spent time conducting research, informational calls, and meeting with different parties related to the process. Also, Dick Brown has asked me to prepare a paper on the Inter-local Agreement. He will use the paper to educate Jacksonville. b. Hours Expended to Date---187.5 c. Hours to Complete----3 or 4 hours per day it is still hard to estimate the actual time needed to complete this assignment. When the purchase order vas received by Mike Wren, the owner of the company, he called to say chac he had quoted much too low oa the proj etc, but that he veuld honor it. Some short time afterward, it vas noticed that [he medians badly needed cutting. I called Nike and he advised that when he had first gone out to cut the medians, he found them already cut, and assumed we were maintaining them ourselves. I assured him that vas not the case, and asked that he cut them. (I'm told chac Public Works may have done the cutting because [he area looked so bad.) Some time after this initial cutting, it again came to my attention chac the medians looked neglet [ed, and I again called Nike. Ne told me he really wuldn'[ mind if ve gave the job co someone else, adding chac he vat almost killed by the traffic when he last cut. The next low bidder on the proj etc vas Green Frog at {250.00 per month. By this time, the project had diminished to a point where only five months remained of the original purchase order, and the increased price would no[ exceed the approved amount. Green Frog agreed to finish the project, and a purchase order vas to that company vas issued on July 9. During the 1970's the area in question was rezoned RS-2, (single- family detached), whereas the area southwards from the middle of Block 6, was Zoned RG-1 (duplexes and to wnhomes); this in spite of the fact that the two areas contained a somewhat similar mix of duplexes and single-family homes. As a result, the property, the subject of this appeal, was isolated with duplexes to the North, the West and across the street, end with a five-unit apartment building adjoining it to the West whose rear windows, witA washing hanging out to dry, overlook and dominate the property. (See maps and photos.) the attached zoning map shows that, where an intensive apartment use exists (RG-2 or RG-3), there is typically a buffer zone of RG- 1 between it end RS zoning; this is because nobody would wish to Lave a detached single-family residence in the shadaitocEathe City apartment complex. The divisions of the southerly p are typical of responsible zoning; CG (eommerci al) gives way to RG-2, then to RG-1, then to RS-2, providing a reasonable transition from the most intensive to the least intensive uses. Rare exceptions, such as "The Cloisters", generally have open spaces and streets between them and adjoining properties. The owner bought the property with the idea of building something for her family; subsequently she moved to Mashington with her husband and has attempted to sell Lt since then Eor use as a single-Family detached building site. After 21 months on the market she bas had no offers at any price, as prospective purchasers do not want to be surrounded by rental properties, and especially Dy the overpowering 5-unit building adjacent. Hr. Frank Thrower is xilling to purchase the property if he can De allowed to build two attached townhomes, designed for owner- occupancy, not rental, of which plane and pLotographs are attached; the Lomas xo uld have enclosed garages and additional parking space far in excess of the facilities available on the adjoining sites. This application was forwarded to the Community Development Board for Public Hearing and a recommendation. This tot is adjacent to the west side of a five unit apartment building which is zoned RG-2. To the west of this lot is an existing duplex on 8 lot zoned RS-2. Throughout the area are a number of other nonconforming tluptexes built on RS-2 lots. RECOMMENDATION: After a presentation by John Baille, representing the applicants, the Community Development Board debatetl the issue, taking into account comments from neighbors. As a result of the discussions a motion was made and Seconded Lo recommend DENIAL of this application. The motion passed unanimously. WHEREAS, The existing street known as west 12th Street would be more appropriately known as West Plaza in that it lies on the western side of Hayport Road opposite the intersection of Plaza and Hayport Road, and WHEREAS, The existing drainage easement lying between 11th and 12th Streets and currently known as west Plaza requires no name, and WHEREAS, it is the desire of the City Commission of The City of Atlantic Beach to rename west 12th Street to West Plaza, NOW THEREFORE, be it ordained by the City Commission of the City of Atlantic Beach Florida: SECTION 1. JENSEN City Attorney ~,.. ~~ 9 ORDINANCE NO. 80-92-48 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ATLANTIC BEACH, ALLOWING FOR EXTENDED PAYMENT PLANS FOR WATER SYSTEM CONNECTION AND IMPACT FEES. PROVIDING AN EFFECTIVE DATE. WHEREAS, Sec. 22-17t of Lhe Code of Ordinances allowed extended payment of connection fees for existing buildings or structures for up to five (5) years for sewer connection fees and impact fees, and WHEREAS, the City has increased the maximum allowable Lime for such extended payment plans to 15 years, and WHEREAS, the City desires to make the same allowance available for water impact fees. NON THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA: Section 1. Sec. 22-18 of Chapter 22, UTILITIES, of the Atlantic Beach Code, is hereby amended by atlding the following: "Sec.22-18(e). Pavment of connection fees and. impact fees. Payment of connection fees and impact fees shall be due and payable prior to the issuance of a building permit. For new and existing buildings or structures, the City Mananger may allow payment of fees on an extended payment plan for up to fifteen (15) years or the remaining life of an existing mortgage, whichever is less, if the owner has demonstrated to the satisfaction of the City Manager that the lump sum payment will constitute a hardship to the applicant. A lien for the amount due shall be executed in recordable form reflecting the payment schedule, and recorded at the applicant's expense. Upon all payments being made in full, the lien shall be released of record." Section 2. This Ordinance shall take effect immetliately upon its final passage and adoption. AR WATER DISTRIBUTION The design for the rater line replacement on let, 9th and 11th Streets is currently underray. Complaints of for rater pressure in Oceanralk rill be investigated by Tim Townsend and Shelton Florers. Note: Subsequent to the meeting, Tim and Shelton discovered that the problems rere mostly due to blockages in rater softeners. They rill prepare a mitten report on each of the residences they visited. 9. IKPACT FEES The Committee etranoly objected to lengthy, i. e. 15 year payments of Impact Fees, for 'Hardship cases'. The original plane rare prepared by Alan Patter and he has offered to provide plane for the ner plant to the City rithin Lhe next couple months. 9. DAN RARBOR SEVER SYSTEM Gee and Jenson has suDwitted a proposal for 555,000.00 to complete the plane and provide engineering services during construction. The Committee recommended authorizing Gee and Jenecn to cowplete the plans making sure that the contract indicated a delivery date of approximately three months from the time the contract rae signed. Some savings rill be realized during the construction phase Dy using City inspection. 5. AB YYTP Based on current flora, it is necessary to add 2.0 to 2.5 MGD capacity to the AB YYTP. Incorporated in this project could De the conversion of the current Davco Plant to a digester and providing clarification outside the Davco unit. The Committee recommended soliciting RFP's for the design rithin the next far reeks rith a complete design ready for mid-February 1993. 6. AB YTP Tim Tornaend suggested sending a letter to DER to get an extension on certain items rithin our Consent Order. In the Summer months it rill 6e difficult to take YTP •2 out of service. BUCCANEER Y11TP EXPANSION (SURGE TANK) The Committee agreed that the project should De closed out and a credit of 54,000.00 be given to the City for the su6etitution by the Contractor of PVC trcughe for the conveyors. Subsequent to the meeting, Bob Koeoy negotiated rith the Contractor and the City rill receive a 53,500.00 credit and final paperrork vas prepared to close out the project. The Committee recommended that Gee 6 Jenson provide a steel design for an additional hydroscreen and a relocation plan. Me should obtain a schedule for comDletlon of this rork. The design should be provided at no additional coat to the City. Regarding the odor complaints, re are running an air lift from the Chlorine Contact Chamber to the plant's lift station and plan to install a fence and plantings (dayblooming jasmines) betreen the WMTP and the affected business. 2. WHEREAS, Sec. 22-171 of the Code of Ordinances allowetl extended payment of connection fees for existing buildings or structures for up to five (5) years for sewer connection fees and impact fees, and WHEREAS, the City has increased the maximum allowable time for such extended payment plans to 75 years, and WHEREAS, the City desires Lo make the same allowance available for water impact fees. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA: Section 1. Sec. 22-18 of Chapter 22, UTILITIES, of the Atlantic Beach Code, is hereby amended by adding the following: "Sec.22-78(e}. Payment of connection fees and• impact fees. Payment of connection fees and impact fees shall be due and payable prior to the issuance of a building permit. For new and existing buildings or structures, the City Mananger may allow payment of fees on an extended payment plan for up to fifteen (75) years or the remaining life of an existing mortgage, whichever is less, if the owner has demonstrated to the satisfaction of the City Manager that the lump sum payment will constitute a hardship to the applicant. A lien for the amount due shall be executed in recordable form reflecting the payment schedule, and recorded at the applicant's expense. Upon all payments being made in full, Lhe lien shall be released of record." Section 2. This Ordinance shall take effect immediately upon its final passage and adoption. CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Extended Payment of Water Impact Fees SUBMITTED BV: George Worley, City Planner (,'(~ DATE: July 7, 1992 BACKGROUND: At the June 6th regular meeting the Commission approved on first reading an ordinance increasing the maximum Lime allowed for extended payment plans for Sewer Impact Fees. That ordinance was adopted June 22nd. At the first reading, during discussion, it was suggested that a similar extended payment plan may be feasible for the Water Impact Fees. Staff has investigated this prospect. Two primary considerations were addressed. First the concept of standardizing regulations and lessening the financial burden of the City's Water Impact Fees on applicants with hardships. Adopting en Ordinance duplicating the regulations now in effect for extended payments of Sewer Impact Fees would accomplish this goal. The second consideration of Staff was the possible adverse impact upon the City. The burtlen in time and money for the City's personnel to administer and track payments of Water Impact Fees of approximately 5400 per house, extended over a period of fifteen years, would be considerable. In all probability it will cost the City more than the E4D0 to cover the costs of merely tracking payments. RECOMMENDATION: Given this burden on the City, and considering the smaller burtlen of Water Impact Fees on applicants as compared to Sewer Impact Fees, Staff recommends that no extended payment plan be enacted for Water Impact Fees. City Clerk Maureen King reported about a year ago the Commission signed a contract with Florida League of Cities for collection on delinquent and escaped license taaes for insurance companies, and she indicated the City had received its first payment of 55,520. Covissioner Edwards distributed copies of a Resolution adopted by Florida League of Cities opposing the stormwater management issue. He reported he called the National League of Cities who indicated they are also pursuing this vigorously. There being no further business the meeting adjourned 7:34 p. m. William I. He added future commissions would oversee the implementation of the ordinance, and, if the policy were abused in the future, the ordinance could be abolished. Commissioner Fletcher suggested having the City Manager give the Commission a monthly or quarterly report indicating tha applications that had been made and the disposition granted by staff. Substitute Motion: Approve ordinance Bo-92- 46, as amended, with the stipulation that a copy of each hardship application along with the disposition of same by City staff be Forwarded to the Commission on a regular basis. A discussion ensued concerning what recourse the City Aad, should an applicant refuse to make payments. It was determined in the past city contractual agreements stipulated that water and sewer could be cut off, should an applicant refuse to make payments- Commissioner Fletcher suggested granting authority to the City Manager to include language in 'the contractual agreement indicating the right of the city to cut off water and sewer services if the contract was not complied with and payments were not made. It was decided it would be more prudent to discuss this matter further and make sure this type of protection was written into all contracts and ordinances, and not ordinance ti80-92-46, only. The City Attorney was asked to check into how the City would implement water and sewer cut off, should an applicant refuse to make payments. The question was called and the motion carried unanimously. 7. City Manager Reuorts and/or Correspondence: The City Manager reported complaints had been received regarding odor problems at the Buccaneer Plant. He reported staff was working to alleviate this problem. The City Manager reported HUD had proposed 16 sites for scattered housing, and staff was meeting with HUD in order to have input concerning this matter. Ordinance X80-92-46 - Public Hearing AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CZTY OF ATLANTIC BEACH, INCREASING THE MAXIMUM TIME ALLONED FOR EXTENDED PAYMENT PLANS FOR SEWER SYSTEM CONNECTION AND IMPACT FEES, PROVIDING AN EFFECTIVE DATE. Mayor Gulliford presented in full, in writing, Ordinance No. 80-92-46, said ordinance having been posted in accordance with Charter requirements. He opened the floor for a public hearing and invited comments from the audience. Since no one wished to speak the Mayor closed the Public Hearing. City Manager Kim Leinbach reminded the Commission that at the meeting of June 8, 1992 it was decided to amend the ordinance by changing "existing buildings or structures" to "new and existing buildings or structures." Motion: Approve Ordinance BO-92-46, as amended: "existing buildings or structures" shall be changed to "new and existing buildings or structures." Commissioner Waters stated at the meeting of June 8, 1992 a discussion was held concerning the definition of "hardship" and a clear definition was supposed to be given to the Commission. He indicated he would like to know the deflnition of "hardship" before voting on the ordinance. City Attorney Alan Jensen explained if the Comma asion so desired applicants could be required to submit financial information and affidavits. Instead, he suggested utilizing a short form that applicants would fill out declaring that it would be a hardship to make a lump sum payment, and requesting monthly payments. Mr. Jensen stated it would be up to the Commission if they desired to place income levels on hardship cases. Commissioner Waters stated he found hardship cases, as a whole, not clearly defined within the City. The Mayor suggested the Commission rely on City staff, who would be administering the extended payment plan in cases of NAME OF COMMAS.
