Subject: Board Actions of June 17, 1986 with recomsendations
Your Advisory Planning Board considered the following requests at its
regularly scheduled meeting of June 17, 1986.
1. The Advisory Planning Board recommends to defer the request for
Use By Exception (Grandfathered) by Atlantic Beach Ffini Storage, Inc.
The Board would like to postpone any action until the City Commission
votes on mini warehouses as a use in Con®ercial General zoning.
2. The Advisory Planning Board recommends to defer the request for
Use By Exception by Ashland Investments, Inc. The Board requests that
an updated list of tenants be submitted to determine if all current
businesses are operating as permitted uses and Use By Exceptions and
that there are no business operating improperly under this zoning.
3. The Advisory Planning Board recommends to defer the request For
Rezoning by James R. Patton for lots 1-4, block 241, section lI; currently
zoned RG1A to zoning CG. The Board would like the opportunity to look
into rezoning a larger area immediately south of the ILK area off of Levy
Road to a commercial zoning as a buffer from residential to commercial:
4. The Advisory Planning Board discussed items for the Public Hearing
of June 23, 1986. The Board expressed some concern over Lawn Care and
Pest Control being permitted under Service Establishments. Because of tho
chemicals that they use the Board feels that these businesses should be
under Use By Exception to control locations of this type of business.
The Board also wanted to point out that they had purposely left out mini
warehouses iv CG zoning and had put it into ILW where they felt it was
sore appropriate.
5. The Advisory Planning Board would like to recommend that an ordinance
be created to regulate auto/truck service garages by requiring opaque fencing
8' high around the property and also making it necessary to perfona all .. -
repairs inside an enclosed building. - ~ -

As we discussed, due to the heavy traffic and parking at the 1layport
Elementary School, it would be pretty much a waste of time for us to seed the
area where we excavated for the force main until school is out. Also, due to
the serious lack of rain it seems wise to wait until a more normal rainfall
resumes.
Our Contract breakdown has a value of 52,000.00 for seeding and I will add
51,000.00 more retainage to this.
Ne would perform the seeding sometime around mid-June and than bill for the
final f3,000.00.
I am enclosing a pay request for job completion less 33,000.00.
Also I am showing a deduct of f600.00 for using PVC in lieu of ductile iron
at the road bore. No formal Change Order was issued, but I guess that isn't
necessary.
Also enclosed is the As-built Drawings, Consent of Surety for Final Payment,
Lien-Ilaiver from our sole supplier, Contractors Affidavit of Release of
Liens, and Gaurantee Letter.

INSPECTION REPORT FORM
PROJECT: Westside Force Main
INSPECTOR: Daniel Pelham

The final inspection of the Westside Fozce Main was completed
without any maj oz discrepencies found.
The inspection was attended by McDonald Construction ~,
representative, Ty Nowe, and Buccaneer Sezvices representative,
Milton Deveveaux.
The Force Main has been on line for approximately two weeks.
During this time, Buccaneer Services, who will maintain the line
for Atlantic Beach, has checked the line periodically and found
it to be satisfactory.
The remainder of the work encompasses the sodding of the areas on
and around Mayport Elementary.
The sodding work has been postponed until summer months when ,
packing lot traffic is reduced and we will have a possible
increase of rainfall.
Atlantic Beach has approved the postponed sodding work.

Pursuant to our recent neeting rith the Clty Council, Gee 8
Jenson Engineers-Architects-Planners, Inc., has prepared the
folloring Scope of Services associated rlth the above referenced
matter. For purposes of the proposal contained herein, Gee
d Jenson, Engineers-Architects-Planners, Inc., shell be referred
to as the Engineer end the Clty of Atlentlc Beach shall be referred
to es the City.

used by Traffic patrol, or a 4-wheel cart, such es used by
Security patr:~ls et hospitals, etc. It may also be as simple
ae a bicycle. It should be operated by a civic employee vrho
hoe been deputized to issue citations. It might even be a life-
guard, properly nuthorize d.
Although we have been told that only pollee officers are
so authorized, we do observe from time to tLne that others
are Riven authority, for exempla at Gator Bowl gamos, when
an extra 2 or 3 hundred "polka" ere added for the occasion.

so many dogs, that she left the beach. I walked approximately
one mile, and courted no fewer than 25 doge, almost every one

The issue was "Dogs on the beach", an issue my family has
sought to address during the 5 years we have lived here.
I enclose a aeries of newspaper clippings which
well document the oublle's reaction to the problem. You
need only peruse the clippings to ba aware that the problem
still exists and continues to grow. _

the bench can read again that "dogs are barred". The Task

SCOPE OF 1:ORK: Provide all labor, equipment and material [o resurface existing

All bids must De made on the appropriate proposal forms, properly executed and

The proposal shall be accompanied by bid security in the form of a Bid Bond
exec u[ed by [he Bidder, a surety duly qualified to do business in the State of

or state bank in an amount equal [o five percent (Sx) of [he bid amount, and

o In connection vlth the proposed Ordinance on dogs, I would like to
suggest for your consideration, chat if the Ordinance passes, it be made
no[ eff ect lye until Monday, July 7 in order co give the Police
Department and the adminlstra[ive staff an opportunity of coordinating
the enforcement efforts. I[ may be necessary for us to work out a
cooperative plan vi[1, the Jacksonville Mimal Control office for the use
of [heir animal vehicles in the event i[ becomes necessary for us to
impound an animal off the beach. It would also give people an oppor-
tunity of adjusting to the new law without 1t having to go into effect
the very next day. We would appreciate your consideration of this. As
an alternative to an effettlve date of July 7, you could make is effec-
tive July I which would enable us co clear the beach of dogs prior to
the big July 4 weekend.
o Some time ago the City, as a result of the hydraulic overloading of
the sewage treatment plan[, adopted a Resolution calling for a
moratorium oo sever collections outside of the City. Since that time
the City has completed its new wastewater treatment plant and has
approved Beachside and Ocean Edge subdivisions for connection to the
City's system. A number of residence whose properties abut these
subdivisions are making inquiry as to how co go about connecting into
the system, and in view of our progress, I would suggest the City
consider abolishing the provisions of [hat Resolution requiring
individual permission to hook to [he system.
o We have been notified the loan closing dace has now been sec for
July 9 for the monies anticipated to be received from the Florida League
of Cities loan program. The need for the sludge hauler tractor rec®tly
advertised is urgent and ve, therefore, request permission of the Ci[y
to approve a budget amendment [o alloy us co use money from Retained
Earnings tc pay for the tractor and reimburse those funds to Retained
Earnings of ter the loan is closed on July 9.
o We will have an agenda item on rionday night to request approval of
the change order on the dune overvalk project in the amount of
$14,621.80. The increase in the contract price comes about as the
result of having to almost double the length of [he handicapped ramps in
order to provide wheel chair handicapped persons with access Co the hard
sand, and in addition to that, a number of [he areas required repair of
the approaehes to [he sea wall, and in one instance, a repair to the sea
wall itself where the steps crossed over. These changes were apprmed
by the Department of Natural Resources, and in order to close out the
project ve will need approval of the change order by the Cicy
Commission.
o Construction work began Friday morning on installation of the new
drainage culverts across Plaza Road near the Public Safety building.
The contractor hopes to finish by the weekend and plans [o start w the
Seminole Aoad crossing on Nanday.

complying with [he Crow[h Management Plan, and also provide cos[ esti-

a copy of which I have included for your consideration. YOU will note
the cost is proposed a[ $2,200.00, and we you ld recom,oend the City
Commission proceed with [he authorization [o undertake this study as
soon as possible.
o Construction of the Wes[side Force Main in [he Buccaneer Water and
Sewer District teas been completed. We have received a final inspection

release of lien from Davis Water and Waste Industries, Inc., and a
one-year maintenance bond from Wausau Insurance Company on behalf of [he

week [o go over some of [he preliminary figures and costs in the master
plan being developed for Section N. I had hoped he would be ready to
make his report at [he meeting on Monday nigh[, but he now Indicates
that S[ will be the meet ing of July IG before the plan will be ready.
Initial recommendations will be for [he immediate priority paving of
Hain S[ree[ as far as Wes[ Fourteenth, resurfacing from West Fourteenth
to Church, and [he construction of West Sixth and West Ninth S[ree[s
from Maypor[ Road to connect with Main Street. I also sugges [ed to Mr.
Hill the fl rm give some consideration to recommending areas which might
be set aside for a future recreational development. We also discussed
Che possibility of [he Ci[y having [o obtain land For a sanitary
transfer station. These considerations are being examined.
o A[ the request of Mayor Howell, the firs[ item on [he agenda will
he [he public hearing and final reading of an Ordinance which would
prohibit animals on [he beach from May 1 Co Oc[obet 1 of each year. The
Mayor has indicated the Ordinance, during the public hearing, should he
amended [o provide that seeing eye dogs for blind people would be exempt
from the provisions of [he Ordinance. This could be handled by
modifying the Ordinance to add a sentence at the end of each of the
sections being amended [o state that "animals used by blind persons, and
commonly referred [o as seeing-eye dogs or guide dogs are exempt from
[he provisions of this article."

we will be announcing for the record that Sam Waters has transferred a

Law is basically an agreement of compromise hetween two or more individuals setting
forth rules whereby these individuals can co-exist peacefully. By its very nature
lay is a restriction on [he freedom of [he individual. This does no[ mean, however,
[ha[ one individual should be completely rescr is [ed so as to alloy comp late freedom
for another individual. Remember the watchword -- compromise.
Be are gathered here tonight co consider passage of an ordinance wt,ich bans animals
from [he beach between May 1 and October 1 of any calendar year. Does the idea be-
hind Chia ordinance assume [hat animals will cease functioning during [his period?
Don't you believe it. They will continue [o run, exercise, urinate, and defecate -
only now all these activities will be moved up to our streets and yards. CAn [he
ordinance, as written, be enforced by our own law enforce¢en[ officers? Bill it be,
if passed?
Pe1lufps we need co approach the problem much as [he problem of smoking in public
places has been handled; [ha[ ie, designate certain areas as open to animals which
are on leashes and under control and other areas as closed [o animals altogether.
This vas presented to me in a faceeious manner buc perhaps it is a viable compromise.
Any ordinance passed should be enforceable by our awn law enforcement officers or iC
should not be passed. Unenforceable lay, especially one which many consider to be
unjust, is often violated, making a mockery of law in general and most certainly
lowering citizens' respect for it.
Personally, I feel that the present law is adequate - if it is enforced! I[ does
not eliminate the problems of animal waste on the beach buc i[ does require responsi-
bility by the animal owners in proscribing their activities. A comparable responsi-
bility for their children by parents and a watchful eye by all adults would eliminate
most of the problem and the beach could be enjoyed 6y all.
In a simple democracy rule is simply by the major i[y, no matter how oppressive it
might be. In a republic the rights of the minority are considered co be as sacred
as those of the majority. Thank God we live in a republi<.

[he Sun Times poll on the dog ordinance. There were 32 for the leash L
16 votes for letting dogs run loose, and 15 votes to ban doKs from [he
beach.

Mr.Mullis said [he Board may be substantially reduced in size.
Commissioner Cook asked the City 4fanager for details on item 5 of the
Advisory Planning Board's report. They recommended an Ordinance be
created to regulate auto/truck service garages by requiring opaque
fencing 8' high around the property and also making it necessary for a:
repairs to 6e done inside an enclosed building. Mr. Fellows explained
one of [he members of [he Board had obtained several Ordinances from
other communities and discussed with Che Board members as [o how [hey
handled auto/[ruck garages. The end result oC [he discussion was to
encourage [he Cosm:iss ion [o adopt an Ordinance [o require auto/[ruck
service garages [o operate with proper type of visual buffering so
they would try to do all [heir work in an enclosed building and/or
put up some type of opaque fencing.
Commissioner Cook asked Mayor Howell [a amend his statement "Beginning
on July 1st there were going to be strict enforcement of [he animal
Ordinance". He asked [he Mayor to wait until the fines were amended
so they did no[ have [o make arrests that would send people [o jail.
Mayor Howell said he vas confident all [he citizens were Koing [o
obey the laws.
Commissioner Edwards reported [hey were facing a severe problem in som
parts of Royal Palms such as junk cars in [he yards, windows broken,
doors off, and lawns in bad shape. Mr. Fellows advised those signed
complaints he and Mrs. Tucker had received were turned over m [he Cad
Enforcement Officer, and Letters had been sent out [o :he offenders.
He also said if [he officials of [he city saw a violation oC the law
[ha[ was absolutely flagrant, [he city would take action without [akin
a complaint. Mayor Howell commented Che city could no[ control es[he[i
Discussion followed. Mr. Fellows sugges [ed [hey atcemp[ to get a Xroup
from Royal Palms [o form a Community Association and [hey could se[ up
meetings in the park, etc. The Committee could go around [o the houses
and try [o instill some pride of ownership in the neighborhood. Un-
fortunately, a large percentage of the houses are rental properties.
The Ci[y Attorney commented there were laws on the books that could
be enforced. Discussion followed on usinK [he Code En forcemen[ Board.
Commissioner Morris asked [he Chief of Police about unpaid parking tic

for [he purpose of approving [he final papers and authorizing the
necessary offit ials to sign, assuming July 9th closing date held.

outside [he city in Che early 70's. That cond iCion no longer existed a

rescinded. The proper steps be taken [o allow the issuing
of permits for sever hook-ups outside [he city without
coming before [he Covuniss ion.
Commissioner Gulliford asked if figures were available on what excess
capacity we have, less Chose projects either under way or projected is
[he next year. Mr. Braid responded [here may be some excess rapacity
the moment, but when the modifications of [he plan[ cook affec c, prob-
ably August Ist, they would be back to 1,000,000 daily. Once the mod i'.
cations were complete and [hey stop some of [he in[low infiltration, 1
Braid estimated we would have approxima [e ly 500,000 gallons per day
excess. Conmtissioner Gulliford asked realistically, how long would th;
provide for our needs. Mr. Braid said that would depend on how fast
Section H developed. Commissioner Cull iford expressed a desire, if [h~
motion passed, for the Commission [o put some kind of limitation when

Beach outlining the scope of services fur a preliminary evaluation of
[he Atlantic Beach Comprehensive Plan per rule 9J-5 Criteria. The firm
offered [o do a report Chat would evaluate how [he city stands as of
now, and which would include some schedulinK priorities [he city would
need to address regarding complying with the Growth Management Plan,
and provide cost estimates for ul tima[ely updating [he comprehensive
plan.
Mo [ion: Authorize [he firm of Gee and Jenson Engineers-Architects
Co prepare an evaluation report and priority schedule in
regards [o [he new Florida Growth Management plan in
the amount of $2,200.00.

Mayor Novell [hen opened the floor for a Public HearinK and invited
comments from [he audience of approximately 110 people. Mrs. BeC[y
filers, 369 Third S[. asked the Commission m ban dogs twelve (I2)
months of the year from [he beach due to the health hazard. She
presented the Commission a petition banning dogs from [he beach that
was signed by fifty-one (51) residents of A[lan[ic Beach. The petition
is attached hereto and made a pare hureof. Those present agreeing with

Motion: Passage of Ordinance No. 95-86-29 as amended.
Commissioner Cook offered a s[a Cement prepared the day before. Copy of
which is attached hereto and made a par[ hereof. He commented he had
voted for both amendments which could possibly work, but he still felt
[he present Ordinance as written but reduce [he penal [y, would be much
better. He added he could live with [he Ordinance as amended. Fo lloving
discussion, [he question was called and [he motion failed with a vote
of three to two against Che motion. Mayor Howell ronmen[ed i[ vas un-
fortunate Che Ordinance vas up for consideration. He said "certainly,
this is not the answer, ve have cried this very same thing before and
[ha[ didn't work either. This is an exercise ir. [utility. I can assure
you starting July 1, 1986 you are going [o see some strict enforce-
ment, so pass Che vo rd to the vise, because ve are going to enforce
it. At the next meeting of the Commission, I am goinK to introduce
some legislation [o provide that anyone allowing [heir dog m defecate
on public property will be subject to a Eine if [hey don'[ clean i[ up.
He suggested another possible amendment [o close the beach from A[lanti
Blvd. to 7th S[. [o dogs from May until October 1st, and leave i[ open
north of 7th. Then in October, close [he beach north of 7th and open
open i[ from 7th [o A[lan[ic Blvd. A[ leas[ i[ would provide less of ar

$50.00 on subsequent offenses thereafter. Commissioner Culliford seconc

require dogs in Atlantic Beach on leashes too, ro have a license. Com-
missioner Gulliford suggested [he ci q• hire a full-time parson [o contr
dogs and use the extra license fees [o help defray [he cos[.
Mayor Hovell agreed if [ha[ vas [he route [he Commission wanted [o go,
but [hen there needed [o be other amendments that cer ca inly no one caul
object [o. He said "Let's put some teeth in i[. If you are found on the
beach violating [he law, the fine will be not $25.00, but $50.00. It's
only [hose who don'[ obey the law Cha[ will be fined anyway." He said
[he city had tried to sell doR licenses at $2.00 each for years, but up
until the prior Friday, [he city had sold a total of 52 licenses to 30
people, and since Friday 6 had purchased licenses. When you talk about
enforcement, i[ goes a little bit deeper Chan enforcement, because [he
problem originally raised its head back when Che people of [his s[a [e
voted out municipal courts, and now Cicke[s have Co go [o [he county
court which Will take a long time [o ever get before the county judge."

Amendment 1.[o Che motion: Amend Sec [ion 5-8 and 4-9 of Ordinance
No. 95-86-29 by inserting [he words "between [he hours of
9:a.m. to 5:00 p.m." immed ia[ely following [he words
"during the period May Is[ through October ls[".
Commissioner lbrris explained [ha[ would allow dogs on the beach
twelve months of [he year, but proh ibi[ Chem from being on [he beach
during the peak people times between 9:00 a.m. and 5:00 p.m. during [he
ho[ summer months when most of our residents were on C!:e beach. He said
he had talked to [he Ci[y Manager and Chief of Police to arrive a[ a
solution in the form of a compromise to offer Che public [o try to
a¢onmodate no[ only Che people, but [he dogs as yell. "He said I don't
think Atlantic Beach has to be exactly like [he rest oC [he beach ci[ie
down here. I think ve can, we }gave good citizens [hat are responsible,
[ha[ can, and will keep their animals under control". He recognized the
problem of Che mess on [he Seach, 6u[ felt Cha[ vas possibly some of [h
city's fault in not cleaning up [he mess. He presented a [001 he referr
to as a "pooper-scooper" to the Ci[y Manager and [he Director oC Public
Works in hopes they will put them out at the street ends and a[ Che tra
cans so folks can clean up the deiecat ion. He also proposed that see in
eye and guide dogs were no[ subject [o [he amendment. During discussion
before the vote, Convnissioner Gul liford noted he could appreciate what
Comdissioner Morris vas trying [o achieve, but said "I think [he biKKes
problem we confront is no[ so much how ve write these Ordinances and
what is contained therein, but a matter [ha[ Chis is a reaction to some
extent [o the fact we have no[ enforced a leash law [hat has been on
the books for some time and a lot of people have been vie [imized and I
don't know whether that is the proper way [o approach i[. I Chink firs[

Atlantic Beach Ci[y Hall Tuesday, Nay 13, 1986 for purposes of
discussing disposition of solid waste.
Those attending the meeting were Charles R. Langley, Public Works
Director, City of Jacksonville Heach; Hayor Ish Brant; Chief Billy
Harding and Public Works Director, Harry McNally, of Neptune Beach; and
C3 [y Manager Fellows and Public Works Division Chief Iiogans,
representing Atlantic Beach.
Atlantic Beach Ci[y Manager opened [he meeting by explaining the
question involved had been brought up at one of the A[lan[it Beach City
Commission meetings by Commissioner Gull if ord oho had expressed some
concern over how Atlantic Beach would dispose of its sanitation probless
if the Girvin Road landfill Closed. Ne suggested the current meeting be
set up [o examine [he possibility of a cooperative Beaches effort toward
the acquisition of land and [he construction of the necessary buildings
and acquisition of equipment to equip a solid waste transfer station.
Discussion ensued with [he members of each of [he communities involved
expressing positive interest in such a matter, however, during
discussion i[ vas brought out that Jacksonville Beach currently
franchises out its commercial garbage pickup service, and is seriously
considering franchising out its residential service. Neptune Beaoh
rep resen[ative, Chief Narding, indicated Neptune Beach currently vas
Chinking of franchising out its commercial garbage service, and while
there clad not been a discussion involving residential, it vas a distinct
possibility that it might be discussed in the future.
Representatives of the three Beaches communities discussed further the
various levels of services now being offered at [he Beaches for garbage
pickup as yell as rates, etc., follov[ng which Charles Langley of
Jacksonville Beach agreed to contact [he City of Jacksonville and
determine whether or not Jacksonville City officials would be
Considering turning the Cirv1n Road Landfill Sn to a transfer station at
such time as they might close the sca[ion and transfer the sanitary
landfill operations to [he Bayard area. Mayor Brant and Chief Narding
are [a request [he Northeast Florida League of Cicies to investigate
further a regional approach [o solid waste disposition at [heir ne:[
regular meeting on Thursday, May 15. The City of Atlantic Beach v[11
take responsibility for getting together some more precise figures as to
the monies involved in the construction of a transfer station.
~i Each of [he communities has agreed to discuss with their respective
~~ leg LSla[ive bodies [he desirability of franchising out [he entire
Beaches solid waste disposal operation. IC vas also agreed co discuss

WHEREAS the Ci [y of Atlantic Beach, Florida, did adopt a
comprehensive zoning Ordinance on .luly 26, 1982, and
WHEREAS the Advisory Planning Hoard has recommended [ha[ the
referenced property at [ached hereto as appendix "A", be rezoned from
Residential General-Tvo (RG-2) to Residential General-Three (RG-3), and
WHEREAS [he City Commission does exercise its povers to amend the
Land Development Code, including Che official zoning district map in
order to encourage the most appropriate use of land,

Overall the budget increases from $273,500 to $328,320 or $59,820. Of
this increase $22,500 is electricity and $10,100 is insurance. The
increase is 20X to service an anticipated 70X increase in customers
billed and operate expanded plant.
Despite not spending entire Renewal & Replacenent budget in 1985/86, the
1966/87 budget is increased $3,600 as follows:
- $19,000 est 5~rmted for sewer outfall job
- $12,000 unprogrammed. City approval required for each job.
Attention is invited to 1985/86 and projected 1986/87 against the

Net cash from operations as projected for 1985 was realized in contract
yeaz 1985/86 and 1986 will be realized in 3011 proposed 1986/87 budget.
The delay in growth has resulted in less revenue, less expenses and about

progress for developments gives indication that growth will catch up to
acquisition projection in two yeazs or so.

For the new customer there is a nater reading if he does not nove in the

- Electricity One electric renter billing is questionable and additional
electric costs to meet Navy housing eater dumnd included in estimate
for 1985/8G plus two lift stations.
- Insurance National media generally indicated that insurance rates
doubled in the past year and this is appraximttel}• xtrat occurred in the
t3uccaneer contract.
- IL•tintenance All maintenance is being done yet it appears expense will
be substantially under budget. Maintenance is the least predictable
of all budget iterts. 71ris under-expense is attributable to lack of
casualties and rmjor mnintenance due to s}•stvn being in generally good
condition and good operating perfornnnce. A rtajor factor in the condition
of the system is that the rmjori q• of rt¢intenance oriented facilities are

Pazagraph n~ of the rtunagclrent agreement for the Buccaneer Water and
Sewer District provides that the cwrent contract year ends July 31,
198E end tltat the contract rtcty be extended and renewed subject to the
availability of funds.
Pazagraph XB provides that the Coe~~any will fwnish the City with an
estLmted annual budget no less than 75 days prior to the commncc~nent
of any renewal term of this agreement.
Jax Utilities {lanagement, Inc. (JUTE) has analyzed nine rronths of
operations. Our operations supervisor has talked to supervisors on
site at the many developments under construction to obtain a best
estirmte of the rate that new unity will be available for occupancy.
We have also taken into account known plant expansions by July, 1987.
Considering all of the above factors, JU{1 suGnits a revised and expanded
budget for the period 8/1/8G to 7/31/87. To enable the City to better
evaluate the budget, the sulmission also includes projected growth,
status at 9/3]/86 (9 months of contract year) and projected status at
the end of this contract year.
To anplify the budget, the following carnents are offered:

The committee appointed [o evaluate the bids for construe [ion of sand
fences along Atlantic Beach me[ on Friday, Hay 30, 1986 in the City
Hall.
Members of [he committee were Commissioner Bohn Morris, Ci[}' Manager
Fellows and Building Inspector Don Ford.
Only two bids were received and a [ho rough review of the specifications
and [he prices offered indicated the bid of George P. Coyle and Sons vas
[he lowest and best bid and, [herefo re, it vas the unanimous recom-
mendation of the committee the contract for installation and repair of
the sand fencing on Atlantic Beach be awarded [o George P. Coyle and
Sons in the amount of $5,575.00.
There being no further business to discuss, [he meeting vas adjourned

The committee appointed to evaluate Cbe bids received for a sludge
handler tractor met on Wednesday, June 4, 1986, at 10:15 AM.
Present for [he coa®it[ee meeting were Commissioner William Gu111ford,
City Manager Fellows, and Public Services Director Braid.
The com:ni tcee members evaluated the bid tabulation shoving Jacksonville
Ford Tractor Company of ]acksonv111e, bldd ing a Kubota a[ $13,622.00,
vich an alternate Kubota at $10,895.00, and a Yanmar ac $10,995.00.
Superior Tractor Company had bid a Yanmar a[ $10,495.00. Both companies
had submitted the required bid bond. Industrial Tractor Company of
Jacksonville had been inv iced co bid but submitted no bid.
AE[er reviewing [he bid specif Stations, i[ vas determined the Yanmar
tractor o[fered by Superior 7rac[or Company of Jacksonville, did not
meet Che specifications in a number of areas, however, the committee
deemed several of these [o be minor Sn nature, vich [he exception of the
hydraulic system. Some concern vas also expressed relative to tfie
hydraulic shuttle reversing transmission, which it was felt might result
in a less than smooth operation.
Further discussion ensued and the comma [t ee learned [ha[ prior to
developing [he bids for this particular piece of equipment, [he
operators a[ the sever plan[ had Cried out all of the existing tractors
capable of performing the sludge removal ac[iv i[y and had, in face, in
the pas[ day, evaluated a Yanmar on site and, considering all factors,
felt Che bid of Jacksonville Ford Tractor Company for a Kubota should be
recommended by [he committee.
After fully discussing [he pros and cons relative co the various pieces
of equipment, [he committee evaluated the bid of Jacksonville Ford
Tractor Company for a 35555 Kubota with a 1720 Loader as opposed co
their alternate bid of a Hodel 2850 Kubota vich a BF500 Loader.
Examination of [he specifications on the alternate bid and Stated tfie
alternate bid Kubota did not meet specifications as to horsepower,
lifting capacity, and separate hydraulic system. Considering these
factors, the committee unanimously recommends a cone race be awarded to
Jacksonville Ford Tractor Company for [he Kubota tractor and Loader
meeting spec if Stations which is the 35555 and Che 1720 Loader ac a price
of $13,622.00.

The City Manager reported [he concept had been considered by the City
Commission and [he Advisory Planning Board had recownended approval

Mayor Howell explained [here was an area off Main SL [ha[ a home was

easement to the public but had never been dedicated for utility lines
and emergency uses. Mr. Patton had requested the city accept the ease-
ment for ingress and egress and utility lines, but not for maintenance.
Motion: The city accept the 25'easemen[ without any agreement for

(d) William Baird and Clay Tousey requesting financial assistance
for Atlantic Beach Elementary School playground equtpmen[.
Mr. Baird, Vice President of the Atlantic Beach Elementary School PTA
and Hr. Clay Tousey, President oC [he PTA requested $2,500 from the
city for playground equipment for the school. Mr. Baird ezp la fined they
had gone [o [he School Board and were informed the Allan tic Beach
elementary school had all [he playground equipment allocated according
to [he pupil ratio. Mr. Baird said he had me[ with Mr. Fellows last fa
for information on obtaining a gran[ similar [o Che gran[ Seabreeze
elementary school had obtained by working with the City of Jacksonvill
Beach. The application was completed and unfortunately mailed to [he
S[a[e Sns[ead of returning it to [he City Hanager of Atlantic Beach.
Apparently it was too late [o re-submit [he application for the Curren
school year. Prior to hearing on [he application, the PTA raised appro
imately $4,700 [o purchase some playground equipment, and wanted to
purchase additional equipment for $2,500. Mayor Howell asked tt~e Actin
CL[y Attorney fot an opinion. Mr.Dickinson asked if the PTA had obtain
approval from the School Board and Mr. Baird replied in [he aEfirma[iv
Mr. Dickinson questioned for liability purposes, who would own [he equ

Beach. Ne added if all [he citizens of Atlantic beach could use the eq

o Commissioner Gullif ord had asked several meetings ago [ha[ [he City
initiate some action with the other beaches communities regarding a
possible cooperative effort in es[a611shing a solid waste transfer
station. We have had two meetings and we are enclosing copies of the
minutes of those meetings for your information and so as [o keep you
informed.
o A[ Che meeting of Apzll 28, John Toshner of Cee and Jenson, made a
presentation on the new comprehensive planning requirements in con-
nection wLth Florida's Growth Management plan. He offered to do an
initial letter report evaluation for between $2,000 and $J,000 [hat
would inform Che City how they stand, provide them with cos[ estimates
fOr meeting [he requirements Of Che growth management plan, and give
some scheduling and prior i[ies. We have received [heir letter proposal
which proposes to do [he work for $2,200. We would like the thoughts of
[he CI[y Commission on proceeding. This will be an agenda item for
Honday nigh[.
Transportation to initiate the needed traffic surveys at [he inter-
section of Maypor[ Road and Edgar Street, looking toward [he possltill[y
of [he installation of a traffic signal [o he funded from state funds.

depth with Robert Stubbs who did [he original analysis for the City, and
in order [o achieve fatrness throughout [he user charge cos[ recovery
Ordinance, ve are recommending the Ordinance be amended as i[ applies to
restaurants, laundries, cat washes and master metered coaonercial ac-
counts.
We have prepared as Ordinance addressing [his matter which ve urge

certified copy of Resolution R6-8 to the Legislative Delegation, which
contains [he official expression of [be Ci[y Commission opposing full
financial disclosure for elected Cicy officials.
o Committee meetings have been held and recovmendations will be
avai lable Eor action by the Ci[y Commission on bids for a sludge hauler
tractor, chaired by Commissioner Culliford, and bids on sand fences
chaired by Commissioner Morris. Copies of the committee minutes are
enclosed for your information.
o We anticipate that by Monday night we will have received certiEice-

Phase I have been constructed in accordance vi cl! the plans and speci-
fications. We also will have certification from the Director of Public
