Following completion of redesign and redrafting, negotiation of a change order price with the Contractor and acceptance of said price by the City Commission on May 21, 1986, the City Director of Public Services negotiated further configurational changes with the Contractor and on Friday, May 30, directed that the Engineers' drawings be revised to reflect these further changes. Ac the time of making the application, Mr. Meuse produced a survey of the property indicating a sever main crossed a portion of his property diagonally, and very Close to the area of his proposed building foundations. the "AS Built" drawings issued to the City, and purporting to shoe the actual location of lines and manholes as construct ed, depict the sever main as being within a standard utility easement located between Lo[s 86 and 87, and at the rear of Lo[ 86. A follow-up site inspection has revealed the actual location of the sever main and manhole is as show on Mr. Meuse's survey. The Ci[y of Atlantic Beach informed Mr. Meuse it will vot issue a building pewit alloying a sever main to pass within five feet of the building foundations without first being issued a hold harmless agreement which vwid run with the land. Mr. Meuse has d eclived to issue such agreement, therefore, it appears the only recourse is to have the respwsible parties make 1t right and relocate the maiv into the easement as indicated on the "AS Built" drawings. 5fiile the City has officially accepted the area improvements for main [enance, it cannot accept any responsibility for the mis-location of this sever main which must be considered as a latent defect in the sever system and must be corrected by the developer, the engineers, and/or the utility contractor. In addtion, he went back to the total engineering fees and proportioned out all design costs back into [he roads, etc. based on [heir share of [he design. Mr. Hill estimated [here were 89,412 lineal fee[ of lot front footage to be considered for improvements. The original purpose of the plan vas cake care of existing problems, but also plan for [he future, and part of [ha[ plan dealt with collector roads versus local roads versus residential roads. Total value of all improvements shown on cos[ assessment was $3,723,977. Mr. Hill felt water and sever should be paid by everyone. Only the main col- lector streets should be shared by the city on some basis, along with [he drainage associated with [hose roads. They would be curb and gutter roads and Che thoroughfares for Section H. He looked at the side streets as being typical subdivision streets in Section 11 and would be left up [o [he property owners [o part is ipate with [he developers for improvemen [s.
