Dear Mr. Fellows:
Based on final inspection of the referenced work on July 22, 1986:
(1) Me certify the work to be complete and in accordance with approved plans
and specifications.
(2) We recommend that the Commission by appropriate resolution formally
accept the work, effective date of acceptance to be either July 22, 1966
(coincident with final inspection) or July 31, 1986 (when substantial
punch list Items, Nos. 3.1 and 3.2) were personally observed by the
undersigned to have been completed.
(3) The one-year warranty period (Para. 13.1.3 of GENERAL CONDITIONS) should
conmence July 22, 1986 and extend through July 21, 1987.
With regard to minor items (servicing of air release valves, modification of
screenings chutes, etc.) which you report remain incomplete, we believe such
items to be of the type and scope normally to be expected in the initial
year's operations and routinely corrected under warranty. Me particularly note
the excellent quality of this Contractor's work; his total willingness to
cooperate with City staff to make requested, beneficial changes at no cost, or
nominal cost, to the City; that you have had beneficial usage of the treatment
facilities, effluent pond and effluent pumps since May 21, 1986; that the
Contractor will be working on-site (Part 4A work) for the coming nine months
and that his Part 2 performance bond remains to effect until the end of the
warranty period, both factors tending to assure prompt attention to warranty
Items as the same may arise from time to time.

For Professional Services Rendered,
The Amount of f 4,689.68
Services consisted of redesign and redrafting of Pumping Station 'D' to result
in latreri ng the station to provide 4.0-foot maximum Drojectlon above finished
grade; services were provided pursuant to the Mayor's instructions to the
Engineers during a meeting with concerned citizens at City Hall on Friday, May
9, 1986. Following completion of redesign and redrafting, negotiation of a
change order price with the Contractor and acceptance of said price by the
City Commission on May 21, 1986, the City Director of Public Services
negotiated further configurational changes with the Contractor and on Friday,
May 30, directed that the Engineers' drawings be revised to reflect these
further changes.
The original Pumping Statt on 'D' design had previously been approved by the
City and by FDER as the basis for grant offer and bidding and award of the
construction torttrac t. The redesign is, thus, an 'Additional Service' as
defined to Paragraph 4.1.2 of our fienenl Agreement for Consulting Engineering
Services, dated November 22, 1982. The arount due is deternined in accordance
with Subparagraph 5.3, "Additional Services' of Paragraph 5, 'Payments to the
ENfi1NEER', of the fieneral Agreement, and as follows:

1985, when four copies of a sketch shoving the lo[ and sewer main
location were delivered to them showing the proposed additional 10 fee[

could construct a house on the lo[ outside of any encroachment into Che
proposed eaaeme n[. These fatts were reconfirmed recently Sn a telephone
conversation with Grenville d Meuse prior co [heir acquis[ion of lnt 56.
With these facts in mind, I have enclosed easement documents to be
execu [ed by [he appropriate parcles to resolve this conflict.
Additionally, I am requesting by [his le t[er chat A. J. Johns rev Sew the
"as-built" drawings prepared by [hem [o insure chat no other
discrepancies exist.

Hr. Dov Meuse, owner of Lot 86, Selva Norte subdivision, recently
applied to the City for a building permit. Ac the time of making the
application, Mr. Meuse produced a survey of the property indicating a
sever main crossed a portion of his property diagonally, and very Close
to the area of his proposed building foundations.
the "AS Built" drawings issued to the City, and purporting to shoe the
actual location of lines and manholes as construct ed, depict the sever
main as being within a standard utility easement located between Lo[s 86
and 87, and at the rear of Lo[ 86. A follow-up site inspection has
revealed the actual location of the sever main and manhole is as show
on Mr. Meuse's survey. The Ci[y of Atlantic Beach informed Mr. Meuse it
will vot issue a building pewit alloying a sever main to pass within
five feet of the building foundations without first being issued a hold
harmless agreement which vwid run with the land. Mr. Meuse has
d eclived to issue such agreement, therefore, it appears the only
recourse is to have the respwsible parties make 1t right and relocate
the maiv into the easement as indicated on the "AS Built" drawings.
5fiile the City has officially accepted the area improvements for
main [enance, it cannot accept any responsibility for the mis-location of
this sever main which must be considered as a latent defect in the sever
system and must be corrected by the developer, the engineers, and/or the
utility contractor.

Mr. parks stated that his !rpstairs apartment-at 377 Plaza hatl a
rear euit thr^ough the kitchen. He stated that the kitchen was of
subst ar,d ar•d height ar,d that the doorway was very low. He stated
that he had moved the doorway to the east side and constructed a
deck from the dvor• ar•o and to the rear of the apart nter,t. He
stated that the construction took place two years ago ar,d that,
at that time, he was not aware of ttte need to obtain a building
per•rni t. The d?ck extends 2. 6' into the 5' east side setback,
leavi r,g a setback of c. 4'. Mr. Gar•ks submitted a letter of
approval froru his neighbor to the east. The following property
owners were present and spoke in favor of the variance:

Mr. Armen[rou[ and other representatives from Smith b Gillespie in connection
with [he rehabilitation of the sewer lines that had been discussed earlier.
There was a possibility the gran[ hoped for might not 6e available, and the
Commission might no[ want [o go into any of the business extep[ [he [elevis Lng
of Che sewer lines. No de[ermina[ion on Che gran[ could be made until after
[hey did the analysis of the televising of the sewer lines. This was a budgeted
item for $30,000. Smith d Gillespie es[ima'_ed [he cos[ to be approximately
$4,000 and televising of [he lines would run approximately $20,000.

The City Attorney advised [he Commission [he attorneys representing rir. Lewis in
the case of Lewis vs [he City of Atlantic beach had expressed some interest in
settling the case out of tour[ and he asked fcr guidance from the Coimoiss ion.
The Commission authorized the City Attorney Lo settle for a nominal amount he
felt would be in the best interest of [he city in view of the expense of
litigation. '

Mr. H£11 explained, in his original letter [o [he Commission, he had shown a
15X contingency on all construction, and had gone back and broken [he ISX con-
tingency out line by line on [he road construction, drainage, water and sever.
In addtion, he went back to the total engineering fees and proportioned out
all design costs back into [he roads, etc. based on [heir share of [he design.
Mr. Hill estimated [here were 89,412 lineal fee[ of lot front footage to be
considered for improvements. The original purpose of the plan vas cake care
of existing problems, but also plan for [he future, and part of [ha[ plan dealt
with collector roads versus local roads versus residential roads.
Total value of all improvements shown on cos[ assessment was $3,723,977.
Mr. Hill felt water and sever should be paid by everyone. Only the main col-
lector streets should be shared by the city on some basis, along with [he
drainage associated with [hose roads. They would be curb and gutter roads and
Che thoroughfares for Section H. He looked at the side streets as being typical
subdivision streets in Section 11 and would be left up [o [he property owners [o
part is ipate with [he developers for improvemen [s. He listed Area I as: lfayport

Hr. William Weathers of Southeast llunicipal Bonds, Inc. offered several types of
financing the city could consider for Section N improvements:
1. Option of [he Gasoline [ax [hat could be used for any transportation
purpose, roads, paving, drainage, curbs and gutters. (i0 years)
2. 10 yr. paper privately placed with Commercial banks,tn state or out of
state- interest race reasonable. issuance cost low (financial advisor's
fee, legal fees with opinion from bond counsel). Mr. Weathers said [his was
a very viable source of financing for ten years or less.
.3. Hr. {sill said if they hired him, lie would investigate in depth, the Florida
League of CEties loan program which had nine years left. interest rate

construction design costs for each of [he three areas of [he Maser PL
for provSding city services in Section N. He briefly outlined what [he

asked for guidance when [he Commission desired them to commence.
Following discussion on financing $178,000.00 Eor construction design
and contingency costs, the Commission agreed [o hold a Wo rkstiop mee[in

- Commissioner Morris commenced [here had been a lot of talk about tl~e
mess of human and animal on [he beach and asked if anyone had ever in-
vited Stale sanitary and County health people here [o inspect just how
safe/unsafe the beach vas. Mayor Howell said no, but until just recent.
[he beach vas washed Cvice daily with the ocean. Commissioner Morris
offered for future Chinking [he point that as [he city prows and our ni
for recreation grows, [he greatest park and recreational facility we
had vas the beach. He asked if i[ could be possible to place the beach
under a Park and Recreation Department within [he city and give i[ the
proper clean-up as the city does Russell and Donner parks, and possibb
give us some advan [ages to gran[ monies for recreation. Mayor Howell
reminded him of the last renourishment vhen [he sand fences were put
in and the sea oats planted which now prohibits [he Jacksonville beach
cleaner machine from being used vhen it was no[ broken. He felt the
basic polo[ was getting the people [o cooperate. fie suggested crash
cans be placed on the beach again at all street ends.
Commissioner Gulliford said relative to [he dog ordinance jusc passed,
he felt the city did no[ sufficiently inform new citizens on rules and
regulations of our city. He suggested someone draft a sheet of our
regulations to be passed out or mailed co all new residence. Mr. Fe Llo~
said they have jusc recently added to their information sheet relative

Commissioner rSorris asked how long the city had been holding animals
[he control officer had picked up. Mr.Fellows said the tieree picked up

daily. Coa®issioner Cook said he would vote for [he Ordinance, but felt
they were being punished because of the resin is of the prior Ordinance.
He said he had owned a dog since he was a shall boy and played and
' wrestled with them all of his life, but had never had a case of impetip
ringworm or any other kind of skin eruption because of it. lie also fell
i[ was incumbent on Che parents of children [o control Che children as
much as [hey wan[ us to control our dogs, and he also felt harassed ane
it vas an undue punishment. He concluded by saying he would voce Eor [t
Ordinance, because out of strict courtesy, he could not argue against
picking up dog defecation off of the neighbor's lawn.
Commissioner Culliford observed unfortunately like the character in thi
ugly American, Conunissioner Cook would get it from his prospective and
not necessarily what happened with other people. Objectively, he said
[he young lady [ha[ referred to the problems with dogs was referring n
[hose dogs owned by irresponsible people, just as [he children he re-
ferred to, and when you let your dogs run loose, obviously they will gi
into things that can transmit diseases. He agreed they were Caking a
punitive action because people were irresponsible, but one wrong did n~
correct another wrong, and he felc they should address the human waste
on [he beach also.

police personnel. These departments and [heir services are [rod i[ional

The meeting was called to order by Mayor Howell. The invocation,offere
by Commissioner Cook was followed by [he pledge [o the flag.

2. Recognition of Visitors
Mr. Ronald Brew, representing Teril Watson, 645 Ocean Blvd. asked for
Commission help [o have a water meter installed in front of their hou=
Her water meter is located on Beach Avenue and for [he past 26 years ,c
and on, [he vaCer bills have reflected excessive water usage which Che
felt was no[ correct. City Hall had informed Ms. Watson [hey would re-
place Che meter for $500. but he felt after paying excessive water bi]
for the past 26 year the city should move the meter..:1r. Fellows sail
one of the main problems in moving [he meter vas the main line vas on
the vest side of Ocean Blvd. and the city would have to cu[ the street
or hack under so [hat was the reason for [he cos[ estimate. Mayor How<
suggested they use the existing lines and move the meter west onto [he
property. Mr. William McGee suggested [he city install two meters for
few months and see if one leaked. N.r. Brew said he would contact Mr.
Fellows again.
3. Con®issioner Morris wi tl: a repot[ from [he committee appointed to
evaluate [he bids on playground equipment for Russell Patk
Commissioner Morris reported [he Conmictee me[ on Tuesday, July 22,19E
and following a foil discussion on the rela [ive merits of each of the
companie¢ bidding, recommended award be given to [he lowest bidder,
Hunter-Knepshield oC Louisville, Ky. in the amount of $10,021.33, lest
a $600. deduct for purchasing all of the equipment at once. They were
also protected by bid bonds. Tl:e spe~iEications required the equipment
be placed on site at Ausaell Park. Comm£ssloner Morrie added Hunter-
Knopshield had also offered a liability policy on the equipment that I
other bidders had no[ offered.

plans and spec ificatlons and he has certified [he project as ready for

of improvements in Section ll. Bob Hill, of Bessen[, Hammack and
Ruckmar., will be at the meeting on Monday nigh[, and in accordance with
[he wishes of the Commission, Las calculated the per-lineal-foot cost
based on improvement construction by areas. You will also notice there
are several options. Please look [leis over, and if you }gave any
questions, give us a call.
o Nhile the new Ci[y Comprehensive Plan m be developed in accordance
with the new Ctovth Hanagemen[ bill is not due until 1550, the Legisla-
ture has already appropriated about eight million dollars Co assist
local governments in connection with the development of [he plan. I[
appears Atlantic beach may be eligible for about $13,000 to $15,000. We
will keep you advised as we get more information.
o Bids will be received on Monday nigh[ for the sludge hauler vh ich

sidewalks which ve included in Nye Ci[y budge[ [his year. The sidewalk

o About the middle of July we received an application for a building

examining [he survey of the property w•e noted improper location of the
sewer line in [he subdivision, a latent defect, vL ich only turned up
when someone applied for a building perm[ on [he property. The Ci[y
refused [o issue a buildfng permit, claiming the edge of [he huild Lng
would be too close Co Che sewer line, and' suggested [he sever line be
relocated into the easement as provided for in [he as-built drawings
furnished co [he Ci[y. The engineers for [he developer, England, Thims
and Miller, have suggested that an additional easement [en feet north
and parallel [o [he actual main location be granted [o [he Ci q• for
maintenance of [he sever line. WT:i le i[ appears [he foundation of the
proposed structure will lie on and adjacent to one side oC Che easement,
[here remains approxima[e7y [en fee[ from [he structure foundation [o
the sewer line, and while the distance fs marginal, [here probably are

of July 28, as well as thr special meeting of August 4, 1986. We are
also sending along any mail in your box that you had not already picked

o Enclosed you will find a copy oC a memorandum from Marvin Clayton
at [he Uepar[men[ of Insurance, relative [o information on legislative
changes to the police and fire retirement plans provided for by [he
Legislature. One impcrtan[ thing you will note is his comment in the
fourth paragraph [ha[ [he make-up of our current Board of Trustees seems
[o comp ly with [he provisions found in [he new legislation and
therefore, would not require any changes. One of Che most important
changes is found in [he second paragraph on page two, which seems [o
require employee contributions of at leas[ 17, of payroll from all
policemen and firemen. The Board of Trustees of [ile Pension Fund will
be evaluating [his requirement and making some recomanendati ons to the
City Commission in the very near future.
o Ceorge Moore, P[esiden[ of Ceorpe Moore Chevrolet of Jacksonville
Beach, will be appearing before [he Commission on Monday night repre-
senting [he Beaches Area Chamber of Covunerce. They will be discussing
with [he City their plans to plan[ palm trees on Atlantic Bou]evard from
[he Intracoastal Waterway [o Penman road on [he right of vay strip. As
I understand it, the Chamber of Co:mnerce will be Caking, responsibility
for [he maintenance oC trees for the firs[ year and after that i[ will

Mayor Howell has called a special meeting for Monday, August 4, 1986, to
discuss some of [he fin an dal ram if ica[ions of proposed imprcvemen[s in
Section H. Bill Weathers of Southeastern Municipal Bonds will be on
hand to answer questions regarding different methods of financing these
improvements, and in addition, for your study, we are sending along a
copy of Claude Mullis' in depth examination of [he authority. history and
general issues in the matter of special assessments.
Since ve have already called a special meeting for Monday, I discussed
with Mayor Howell the possibility of covering a[ leas[ one of the three
major concerns in the proposed budge[ for next year. If i[ ±s agreeable
with all parties, and [he Section H discussion does not last too long,
we will plan Co include a discussion of the operating expenses of [he
proposed City budge[ for next year on Monday night.
Cperating expenses include lights, beat, air conditioning, telephone,
postage, stationery, and other operating supplies such as gas and oil,
Cares, batteries, and accessories.
On Tuesday evening we could then take a look at the second phase of [he
proposed budge[ which is the list of proposed capital improvements.
Once ve have resolved which of these items the Ci[y feels should be
undertaken, we can then ge into [he third and final phase of the budget
process and consSder additional personnel and current salaries.
If additional workshops are required, these can be scheduled a[ the
close of [he meeting on Tuesday night.
