This Ordinance will be up For introduction at the meeting on Monday night so thaC a public hearing may be held on December 9, and if in line with the Commission's wishes, be adopted so as to be effective on January 1, which is anticipated in the budget. o Nhen the city approved an exception For an automobile repair garage for Alvin an3 Frances Masters several weeks ago, we discovered an error in the legal description. If you will refer to the application attached you will see that they defined the area as being on Levy Road, Lot 3, Block 53, Section H. Reference to the survey shows that in addition to Lot 3, they are utilizing a portion of Lot 2. If the matter is in order, the Commission should approve the new legal definition enclosed. o Senator Lawton Chiles' assistant, Oean Finn, will be at the City Hall December 5, between 10:00 a.m. to 12:00 noon in the event any member of the City Commission wishes to discuss a federal question with him. o We have prepared specifications and are planning to seek sealed bids for construction of the westside force main which was anticipated when we recently purchased the plans for same from the Buccaneer Management Partnership. Funds for the construction will come from impact fees in the Buccaneer Water and Sewer District. Specifications have also been prepared for the T.V. inspection of approximately 32,000 feet of sewer line in the city. The television inspection of the lines will provide the city with the information which will be needed to include with our application to the state for sewer rehab grant money under the 201 Plan. Both of these bids will tome in for consideration by the City Commission at their meeting of Uecember 9. o We have received several calls expressing concern about the intersection of Church Street and Mayport Road relative to traffic flow. If you are familiar with this intersection you will recall driving north toward the Mayport Naval Station the highway transitions from six lanes with a turn lane into four lanes with a turn lane at Church, and there has been some fear of accidents at this particular area involving school buses etc. because of the tremendous amount of traffic in the morning. If the City Commission agrees, we could adopt a resolution asking the City of Jacksonville or the Department of Transportation, whichever is appropriate, to do a traffic light study to determine whether or not a light would be warranted at this location. If the Commission decides to do it, they should ask that the lights be synchronized with those at Donner and Plaza. o We have accumulated a great deal of scrap metal of various kinds, broken valves etc. which need to be disposed of and we would like the authority of the City Commission to sell these to a scrap iron company and deposit the funds received therefrom into the general fund of the city. which requires you to have ten years to have vested interest in the system. The cost to the city to include the City Commissioners under the plan would amount to approximately $125.00 per month at the present rate of pay. The ICMA plan is a deferred compensation plan and does not require any vesting in order to have your pension rights protected. The contribution to ICMA would be identical to that required by the city plan. The city plan would have to be amended to eliminate the requirement that to belong to the plan, persons must work at least one thousand hours per year. This will be an agenda item Eor Monday night. o The Advisory Planning Board met on Tuesday and Commissioner Morris will have a report on a number of items that came before the board and, in addition, we are including a letter of transmittal regarding the actions of the board in regards to requests for rezoning and exceptions. o We are enclosing a proposed Ordinance for your consideration. The Ordinance amends the Ordinance Code relating to the Advisory Planning Board to provide a five-member board. This would necessitate changing the requirement that a City' Commissioner serve on the board and that the City Manager serve as ex officio member of the board. The Ordinance provides no members of the Advisory Planning Board shall hold any other public office or position in the city. This would seem to prohibit a City Commissioner or any employee of the city serv tug on the board in any kind of a capacity. If the city adopts the Ordinance they will then need to consider, in addition to the possible reappointment of Guy Jennings, the appointment of another person who is not a public official or holds any other position with [he city. Ne shall await your pleasure. o Taylor Bush, representing Stokes O'Steen, developers of Land Harbor, is requesting permission to appear before the City Commission on Monday night. After approval of the Land Harbor PUD, the developers discovered a large telephone easement running diagonally across the property which has created a need to realign some of the roads and pieces of property. In order to do this the PUD Ordinance will need to be amended and approved by the City Commission. o As of the preparation of the status report we have not been able [o contact Barker, Daniels and Associates who have requested rezoning of property near the corner of Mayport Road and Plaza for a shopping center. IC is my understanding they may get their documentation together in time for the meeting on Monday night but since we have not heard from them we are not placing the item on the agenda at the present time. o The budget adopted for this fiscal year anticipated a change in Chapter 16 on Refuse and Garbage to bring refuse collection rates up to a figure that would not require any further subsidizing from the general fund. Xe are enclosing a proposed Ordinance to accomplish this for your study. The Ordinance raises the residential collection rate from $14.00 per quarter to 521.00 per quarter which is well in line with what surrounding communities are charging, and it also provides a more flexible commercial pick-up charge based on number of yards picked up. Fellows, City Manager SUBJECT: STATUS REPORT o On Monday night, the City Commission will be interviewing the number one architect to establish a basis of fee for design work in connection with the Public Safety building. Gee and Jenson, represented by Bill Bryant and Melody Linger, were assigned rwober one priority, followed by Fleet and Associates and [hen Clements/Rumple/GOOdwin. o Qonaar Security Systems has begun its initial work to install security at 'the No. 1 Water Plant. Following completion of the water plant we will equip the Public Works yard, followed by Water Plant No. 2. I[ was felt Water Plant No. 2 should be last on the list since we have a great deal of construction activity in and out of that area in connection with the McDonald outfall construction. o We will have an agenda item lfonday night for approval of the committee report on computer hardware for the Public Safety Department. o Previously we had sent to the members of the City Commission a modified pay grid for consideration in connection with the existing pay plan. We are scheduling this as an agenda item on llonday night so that we may discuss further the wishes of the City Commission. As you recall, the existing pay plan has eight steps with a 5$ increase between each step. The alternative grid has fifteen steps with 2~$ between each step. We shall await the decision of the City Commission as to what they wish. o At the last meeting we proposed adding the City Commissioners to either the City's existing pension plan or [he deferred compensation plan through the International City Flaragement Association. A question was raised as to why the matter was brought up and I quote Florida Statutes, Chapter 112.048 "The intent of the legislature is to authorize and direct each city and town to provide a system of retirement for elected ~ficials, but it is further the intent that each city or town may determine whether the system shall be contributory or non- contributory." A review of the tabulation will show that only the bids of NCR and Computerland meet the specifications as advertised. After thoroughly considering the proposal of NCR to furnish a PC8, we recommend the rejection of that proposal on the basis the PC8 does not have a track record as it is a new piece of equipment and, further, there is obviously going to be a problem between purchasing from a dealer in Pensacola and receiving service in Jacksonville. As to the bid and alternate bid furnished by Computerland, both the IBM-AT and the Compaq meet the bid specifications for the hardware and support instrumentation. The Compaq costs 3108.15 more but has an additional ten megabytes of storage. On either piece of equipment Computerland will provide setup, training and maintenance. They are also an authorized repair center for IBM and Compaq and they will modify any necessary agreements to comply with our specifications. 'Therefore, it can be seen that Computerland will be both the vendor and the service center for the equipment. The software supplier, IPTM, has installed their software on a number of IBM-AT's and the Compaq Deskpro 286 and indicate they would vary highly recommend either of these units. While it was initially the thought of the committee, the name of IBl1 more or less connoted reliability, it has c ome to our attention through recent reports in computer journals the disk drives on the IBM-AT suffer from serious deficiencies and therefore it is the recolmaendation of the i committee that the bid of Computerland fora Compaq Deskpro 286 with 30 i megabytes hard disk storage be accepted and a purchase order issued therefore. i 1 { A >. The petitioner requesting the rezoning of Lot 6, Block 9 on Seventh Street has requested the action of the Advisory Planning Board and its recommendations not be referred to the City Commission until a later date. We anticipate the matter will be presented to the City Commission at its regularly scheduled meeting December 9. In regards to the requests for Use by Exception, the Advisory Planning Board makes the following rocommendations: 1. The Advisory Planning Board recommends the approval of the application of Harry Gross for a Use by Exception in a C-G zoned area for auto used car sales and repairs. Mr. Gross' business property was grandfathered in under the old zoning ordinance, but once the Mayport corridor rezoning was approved, his business activities were allowed by exception. Mr. Gross has demonstrated sufficient ingress/egress to the property without additional traffic flow hazards and sufficient off street parking and loading. In the matters of collection of refuse, furnishing of utilities and signs, no changes in these areas are anticipated or approved. 2. The Advisory Planning Board recommends approval of a Use by Exception for property located at 40 Mayport Road for use as used tar sales in a C-G zoned are. Recommendation for approval of [his exception is contingent upon the tenant providing a letter from the owner agreeing to the use of the property under the terms of the ezception recommended. Joseph and Janet Lambert rc-questing permission to build an outside stairway on their property lot ated at 420 Beach Avenue. This is a two family apartment and the upstairs apartment can only be reached through a stairway inside the building, that passes through one of the bedrooms. The Lamberts plan to remove the inside stairway and construct stairs on the outside and we are requesting a variance on the side setback. The request uas granted. C. Ronald and Diana Moore at 525 Beach Avenue were requesting a vxri ante to locate a swinming pool in the front yard setback. The swi euni ng pool is also totally seaward of the coastal const action setback line and therefore the variance was granted contingent upon the State Department of Ratrual Resources issuing a construction permit to build seaward of the coastal const n+ction line. o iYe have had a lot of complaints regarding the appearance of the lawn and shrubbery at City Hall. I.a st year's January freeze caused a lot of damage to our shrubs and we have asked Doug Akins of Akins Landscape Service to come to City Hall and evaluate what needs to be done to put the lawn and shrubs back in first class condition. Ke also will discuss with him what type of xeed killer we should use to get rid of the dollar weeds that make the area look so bad as you cane into the building. ~- o There will be a pubiic hc•a ring on Monday night rcga rding the adoption of a new Ordinance setting forth a new rate structure on the City sewer system. &ssic al ly there will be a base charge and a volume charge. This Ordinance also provides the wording which the State r cyuires in regards to the revenue generation. Ke need to make sure that during the public hearing that the minutes show the Ordinance provides a 50$ surcharge outside of the City limits. If the Ordinance is adopted, we shall send copies to the State Department of Environmental Regulation and we should then get approval of our revenue generation system which, in turn, will release our State grant funds. If you have any questions regarding this Ordinance, plc:+se call me. o As announced by the Hayor on Tuesday evening, we have received our Coastal Construction Ferm it which will nor allow us to construct thirteen sets of ner stairs to the beach as well as ramps for the handicapped at 5th Street and 11th St rect. Copies of the Coas[al Construction Pc•n~it have been sent to the grant offices of Killiam Khitf field, and we anticipate the money being released shortly. We plan to advertise the project for bids as soon as the necessary coot ractu cal forms are available for the grant funds from the State. o Bids will be received on hlonday night for the computer for the Atlantic Reach Police Department. If the City Commission concurs we would like to suggest the bids be turned Deer to a committee compcsed of the City +tanager and Police ChieF. We might also solicit the assistance of Commissioner Gulliford with his knowledge of co-paters. o I[ is my understanding the Fraternal Order of Folice have come to a tentative agreement with the City of Atlantic Beach.
