16. Rights and Obligations Not Transferable. Except as provided in this Agreement,
the rights and obligations of the parties hereunder are not assignable and may not be transferred
without the prior written consent of the other party hereto, which will not be unreasonably
withheld.
17. Effective Date of Agreement. This Agreement shall become effective upon
execution by both parties, by and through their respective autitorized representatives, pursuant to
such procedural requirements as are applicable to each of the respective parties.
18. Term. The terrtt of this Agreemem shall be from its effective date and continuing
for a period not less than the useful life of the parties' facilities, subject to this Agreement, and
any additions, alterations or modifications thereto.
19. Governing Law. Tttis Agreement shall be governed in all inspects by the laws of
the State of Florida.
20. Negotiated Agreement. The parties agree that they have had meaningful
discussion and/or negotiation of the provisions, terms and conditions contained in this Agreement.
Therefore doubtful or ambiguous provisions, if any, contained in this Agreement shall not be
construed against the party who physically prepared this Agreement. The rule commonly referred
to as "Forties Contra Proferrntum ".shall not be applied to this Agreement or any interpretation
thereof.
21. Entire Agreement. This Agreement constitutes the entire agreement by and
between the parties hereto. No statement, representation, writing, understanding, or agreement
made by either party, or any representative of either party, which are not expressed herein shall
be binding. All modifications of, changes, alterations, revisions, or amendments to this

11. Severability. Should any provision hereof for any mason be held illegal or invalid,
no other provision of this Agreement shall be affected; and this Agreement shall then be construed
and enforced as if such illegal or invalid provision had not been contained herein.
12. Headings. The headings in this Agreement are solely for convenience and shall
have no effect on the legal interpretation of any provision hereof.
13. Waiver. The failure of any party to insist upon strict performance of this
Agreement or of any of the terms or wnditions hereof shall not be construed as a waiver of any
of its rights hereunder.
14. Notice. Each notice when required hereunder shall be deemed to have been given
when mailed by U.S. Postal Service certified mail, postage prepaid; addressed as follows:

15. Attachments and Exhibits. All exhibits, attachments, appendices and schedules
which may, from time to time, be referred to in this Agreement or in any duly executed
amendment hereto are by such reference incorporated herein and shall be deemed a part of this
Agreemem as fully as if set forth herein. The Exhibits attached hereto to the extent not completed
a*. the time of execution hereof, shall confirm substantially to the description thereof contained on
each Exhibit page and may be supplied by the parties.

8. Fines. If any fines or other monetary penalties are imposed upon one party based
upon its ownership and operation of its collection system as a result of a violation of this
Agreement by the other party, such violating party shall indemnify and reimburse the nonviolating
pally for the amount therefor and any costs, including reasonable attorney's fees, related thereto,
provided that the nonviolating party shall have noted such violating party immediately upon
learning of any investigation or procceding which might result in such fines or penalties and allow
such violating party to join in the defense thereof at its cost and expense.
9. Indemnification. Subject to the provisions and limitations of Section 768.28,
Florida Statutes, each party hereto shall indemnify, hold harmless and defend the other party
hereto from and against any claim, action, loss, damage, injury, liability, cost and expense of
whatsoever kind or nature (including, but not by way of limitation, attorneys fees and court costs)
arising out of injury (whether mental or corporeal) to persons, including death or damage to
property, arising out of or incidental to any negligent act or omission of the indemnifying party
in the operation and maintenance of sewer collection and transmission systems and facilities, under
this Agreement.
10. Force Majeum. The performance by the parties of this Agreement is subject to
Force Majeure and is contingent upon strikes, accidents, acts of God, flood, regulations or
restrictions imposed by any government agency, breakdown of the collection system, or other
delays beyond the parties' control, provided, however that nothing in this Section shall be deemed
or construed to supersede or suspend payment obligations hereunder.

Fees and Reimbursements.
(a) As used in this Section 7, the term "Water Usage" means usage of all water
provided to JEA sewer users in Mayport, regardless of the source of said water, which water will
be discharged into the JEA Facilities and ultimately delivered to the City's Treatment Plant.
(b) In retum for the City's acceptance of sewage from the JEA Facilities, JEA
shall pay, to the City, a monthly usage fee not to exceed $3.90 per 1000 gallons of Water Usage
by JEA's sewer users in Mayport unless the rates are changed by the City's Governing Body as
required by law. JEA shall also pay, to the City, a monthly base fee for each of their customers,
regardless of the amount of Water Usage by JEA's sewer users in Mayport, as required by
Chapter 22 of the Atlantic Beach City Code as indicated in Exhibit D attached hereto and by
reference, made a part hereof. All such Water Usage, by JEA's sewer users in Mayport, shall be
metered by JEA and JEA shall submit certified statements of such Water Usage, to the City, on a
monthly basis.
(c) In return for JEA's performing metering, meter reading, customer service,
operation and maintenance of the JEA Facilities, the City agrees to reimburse JEA in the amount
at 20% of the cost per thousand gallons of water usage. The rate per 1000 gallons may change
based upon an annual review by JEA; provided, however, this rate will not, at any time, exceed
20% of the monthly water usage fee paid by JEA to the City.
(d) Each party agrees to pay all fees, rates and reimbursemems within thirty
(30) days of receipt of a bill from the City. Failure of either party to pay a fee or to make a
reimbursement within said time frame shall result in a late charge of 1.5 % of overdue payments
or reimbursements for each thirty (30) day period, or part hereof, that the paymem or
reimbursement is late.

JEA reserves the right to discontinue use of City service at any time in the
future by giving the City 180 days advance written notice.
4. Industrial Pretreatment. JEA shall ensure that all users generating industrial
waste in Mayport, which waste will be transported to the Cit}~s Treatment Plant, by the JEA
Facilities, will have an approved industrial pretreatment program in place prior to connecting to those
JEA Facilities that transport sewage to the City's Treatment Plant. Said industrial pretreatment
program shall con.`orm to the requirements specified in Exhibit A attached hereto and, by this
reference, made a part hereof.
5. Payment of Impact Fee Charges. Before being allowed to deliver sewage from
the JEA Facilities to the Cit}~s Treatment Plant. JEA must pay all required impact fee charges
directly to the City. The City's City Manager will determine the classification for each business to
be charged an Impact Fee when they are not defined by Chapter 22 of the City's Code, as indicated
in Exhibit B attached hereto and by reference, made a part hereof. JEA shall not allow connection
of any user, in Mayport to said JEA Facilities delivering sewage to the Cit}~s Treatment Plant until
such impact fees are paid by JEA to the City.
6. Couuectiou PoinUQperatiou. The connection point at which the JEA Facilities will
be connected to the Cit}rs sewage utilities system is indicated in Exhibit C attached hereto and by
reference, made a part hereof. JEA shall provide all operation, maintenance metering, and meter
reading with respect to the JEA Facilities and system, located in Mayport or otherwise on JEA's side
of said connection point. The City shall provide all operation and maintenance on its facilities on the
City's side of said connection point, except for damage caused by the JEA facilities.

connect to a portion of the collection system of the City for eventual treatment in the Treatment
Plant; now, therefore
IN CONSIAII2ATION for the mutual covenants herein contained and for other good and
valuable consideration, the parties agree as follows:
1. Incorporation of Recitals. The above stated recitals are true and cornett and, by
this reference, are incorporated herein and made a part hereof.
2. Construction of Sewage System/Cooperation.
(a) JEA, az its own cost and expense, shall design and construct a sewer gravity
collection system and a sewage force main along the right of way of State Road AlA, to transport
sewage from its pumping station in Mayport to the City's Treatment Plant. Said gravity sewer
collection system, sewage force main and pumping station constricted by JEA for the purpose of
transporting sewage from Mayport to the City's Treatment Plant shall be hereinafter collectively
referred to as the "JEA Facilities."
(b) The parties, jointly and severally, agree to take every reasonable step to
assist each other in obtaining permits, access, and other necessary items as may be needed, from
time to time, in the design, construction and operation of the IEA Facilities.
3. Acceptance of Sewage/Capacity.
(a) The City agrees to accept said sewage from the JFA Facilities once the
connection of those JEA Facilities to the City's sewage system is approved by the City's Public
Works Director or his designee.

With regard to the above mentioned agreement, it is my opinion
the agreement captures the basic intent to provide sewer services
to the Village of Mayport by connecting the JEA facilities to the
City's Buccaneer Wastewater Treatment Plant.
The rates that JEA will be required to pay are similar to those
being paid by our current Buccaneer sewer customers. These
charges will be collected by JEA and remitted to the City
monthly. The impact fees will be remitted to the City prior to
the individual customers being connected to the JEA facility.
JEA will be responsible for all related customer services for
which the City will reimburse JEA. This amount is not to exceed
20% of the cost per 1000 .gallons water usage.
This agreement does give the City the ability to change the rates
to be consistent with existing city code as needed.
The residents and businesses located in the Village of Mayport
and The City of Atlantic Beach should both benefit from this
agreement should it be approved.

The Northeast Florida Regional Planning Council (NEPRPC) received the CB Universal Inc.
Day Cruise Development of Regional Impact (DRI) Application for Developtneat Approval on
January 30, 1998. The applicant has notified the NEFRPC that no further information will
formally be submitted, which is an option available to the applicant pursuant ro Paragraph
380.06(10)(b), Florida Statutes.
In order to meet the statutory requirements of Subsection 380.06 (10), F.S., the NEFRPC is
hereby notifying the City of Atlantic Beach to set the public hearing for the CB Universal Inc.
Day Cruise Development of Regional Impact as required in Subsection 380.06 (11), Florida
Statutes. Pursuant to Paragraph 380.06 (11)(b), F.S., the notice of public hearing shall be
published at least 60 days in advance of the public hearing and shall specify where the
information and repotu on the DRI application maybe reviewed. The fatal hearing shall be
sec no later than 90 days after issuance of this notice that the public hearing may beset, unless
an extension is requested by [he applicant, as requited by Pazagraph 380.06(11)(d), F.S.
Pursuant to Pazagraph 380.06(12)(a), F.S., within 50 days of written notice to the IvEFRPC
that the public hearing has been set, the NEFRPC will provide to the City of Atlantic Beach an
assessment of the project with recommendations to tttitigate all regional impacts identified
during the assessment. The NEFRPC assessment report will be based on the information
which has been provided in the Application for Development Approval, dated January 27.
1998. NEYRPC staff will not consider any formal submittal of addirional information unless
the applicant agues, in concurnace with the local government, to waive the 50-day '
asscssmep[ period, and by mutual cotueat the public hearing date is postponed by the local
government to allow adequate time for review of the additional infotration, if it is determined

BACKGROUND:
An application for a Development of Regional Impact has been submitted by
C.B. Universal, Inc. to operate a gambling ship from Johnston Island. The proposed
use is classified by the state as a Development of Regional Impact because it is
considered a marina. The applicants have submitted their application to the Northeast
Florida Regional Planning Council for a review and the Regional Planning Council has
found the application complete. The Regional Planning Council has forwarded the
application along with requests for information to the various federal, state and local
agencies having jurisdiction or impacted by the proposed use. Based upon the
information received from these agencies, and considering only regional issues, the
Regional Planning Council will submit to the City of Atlantic Beach a written
recommendation for denial, approval, or approval with conditions. The Regional
Plaiming Council must submit such recommendation to the City of Atlantic Beach within
50 days of the date on which the public hearing was set.
The next step in the process is for the City Commission to set a Public Hearing
which, according to Florida Statutes Chapter 380 must be at least 60 days and not
more than 90 days from the date of the finding that the application was complete
(February 5th). Following the public hearing the City Commission must place the
application on the next regular agenda for action. In the interim period, staff will
prepare a thorough report of its review of the application, including identification of any
areas of concern and methods to correct adverse impacts generated by the proposed
DRI. Following the public hearing staff will submit a recommendation for denial or
approval of the DRI based upon the information provided by the applicant, the Regional
Planning Council, and the public hearing.
RECOMMENDATION:
In compliance with the provisions of Florida Statutes Chapter 380, Staff
recommends setting a public hearing for April 13, 1998 to consider the proposed
operation of a gambling ship at Johnston Island, a Development of Regional Impact.

Every state dollar spent preserving Florda's beaches is equally matched
by local government (the 1996 Legislature increased the local cost-share
from 25% to 50%). For the vast majority of beach restoration projects, the
federal government currently pays between 50-60°k of the total project
cost, thus providing a $2 match for every state dollar spent. However, with
the current budget climate in Washington, it is no longer reasonable to
assume that the federal government will indefinitely continue to pay over
Aalf of the cost of beach nourishment in Florida. Without increased and
consistent state funding, the health of our beaches will only further
deteriorate.
FLORIDA'S REACHES MUST SURVIVE
• Beaches remain Florida's number 1 tourist attraction. According to
Florida's tourism agency, some 43 million tourists visited Florida in 1996.
Over 1/2 of these tourists spent at least part of their vacation at the beach.
• The estimated economic impact (spending & ripple effect) of beach-
oriented tourists in 1996 was $18.9 billion; creating over 442,000 beach-
related jobs.
• Florida's beaches produced state sales tax revenues in excess of $500
million in 1996.
• There is no better example of the economic benefits of beach nourishment
than the restoration of Miami Beach. Beach attendance before restoration
was 8 million (1978) but increased to 21 million by 1983, after nourishment.
The capitalized cost of the beach project just over its current life is about
53 million a year (federal/state/tocal dollars). Just in terms of foreign
revenue of $2 billion a year, every dollar invested to nourish Miami Beach
returns $700 annually in foreign exchange (1995, Houston).
A recently completed year-long economic survey of beach-oriented tourists
in Broward County found that 61% of these tourists said they would not
return if tt:ere were no beaches, while another 12% said they would not
come as often.

renewal. Their health warrants national concern."
• Another major benefit of an effective beach preservation program is storm
protection. The presence of a 100-foot wide strip of beach may reduce
storm damage to coastal properties by more than 50%.
Florida's beaches and dunes are the Tirst line of protection from storms and
hurricanes. In Florida, they protect over $150 billion in upland coastal
buildings. If we allow our beaches to erode ,the state and federal
governments will have ever-increasing post-storm recovery costs. The
Corps of Engineers estimated that structural damage from Hurricane Opal
at Panama City Beach would have been reduced by up to 70°/. H the
pending beach restoration project had been in place.
THE BOTTOM LINE
We can no longer assume Florida's beaches will always be there,
without a comprehensive, adequately-funded, statewide beach
management strategy.

THE PROBLEM _..
• The Department of Environmental Protection estimates that
over 300 miles of Florida's 787 miles of sandy beach are in a
state of critical erosion. One-third of the remaining miles
are experiencing erosion to a lesser degree.
.Only 105 miles of Florida's beachfront are part of a
restoration/nourishment or other type of beach erosion

• Florida's beaches are virtually starving to death because of
human intervention and natural forces. Hurricane Opal alone
caused the loss of over 10 million cubic yards of sand along
the Panhandle shoreline. Navigation interests -- -specifically
inlets and ports, - - -have interrupted the natural flow of sand
along Florida's coasts, starving downdrift beaches.
• Inlets may account for up to 80% of the erosion on Florida's
East Coast. A 1985 University of Florida study calculated a
cumulative loss of approximately 110 million cubic yards of
sand from Florida's beach system as a result of inlet
navigation structures and channel dredging. That is enough
sand to create a 50-foot wide beach along Florida's entire
400-mile East Coast.
• To reverse the effects of erosion requires a natural remedy
- the massive infusion of sand. To maintain our beaches
thereafter will require ongoing inlet sand by-passing and less
frequent renourishment.
• As part of the 1986 Beach Management Act, the Legislature
expressed it's intent to appropriate at least $35 million
annually to manage Florida's beaches. The DEP feels that
this is still the amount needed to address the problem. The
average state appropriation since passage of the Beach
Management Act over a decade ago has been less than $10
million, making it impossible to reverse the critical condition
of Florida's beaches.

• Beach nourishment and inlet by-passing can solve 90% of
the critical erosion problems in Florida. A surgical use of
structures 8 innovative erosion control methods can address
the rest. We have the technology and the know how to
restore and preserve Florida's beaches. We need an
aggressive management strategy and adequate funding to
make it happen.
• The only solution is a long-term state commitment, in
partnership with local government, to save Florida's
beaches. To insure a coordinated and effective statewide
beach management program will require a DEDICATED
FUNDING SOURCE which produces, at a minimum, $30
million annually.

25 this chapter. The percentage of such costs which may be
26 .assessed against a trust fund is a ratio, the numerator of
27 which is payments credited to that trust fund under this
26 section and the denominator of which is the sum of payments

26 .remaining taxes collected under this chapter shall be paid
27 info the State Treasury to the credit of the Land Acquisition
28 Trust Fund. Moneys deposited in the trust fund pursuant to
29 this section shall be used for the following purposes:

20 paragraph and paragraph (2)(b) equals 70 percent of the
21 current official forecast for distributions of taxes collected
22 under this chapter pursuant to subsection (2). As used in
23 this paragraph, the term "current official forecast" means the
25 most recent forecast as determined by the Revenue Estimating
25 Conference. If the current official forecast for a fiscal
26 ..year changes after payments under this paragraph have ended

28 under this paragraph during the fiscal year.
29 (c) The remainder of the moneys distributed under this
30 subsection, after the required payments under paragraphs (a)

12 Section 2. Section 201.15, Florida Statutes, is
13 amended to read:
14 201.15 Distribution of taxes collected.--All taxes
15 collected under this chapter shall be subject to the service
16 charge imposed in s_ 215.20(1) and shall be distributed as
17 follows:
19 (1) Sixty-two and sixty-three hundredths percent of
19 the remaining taxes collected under this chapter shall be used
20 for the following purposes:
21 (a) Subject to the maximum amount limitations set
22 forth in this paragraph, an amount as shall be necessary to
23 pay the debt service on, or fund debt service reserve funds,
24 rebate obligations, oz other amounts with respect to bonds
25 issued pursuant to s. 375.051 and payable from moneys
26 transferred to the Land Acquisition Trust Fund pursuant to
27 this paragraph shall be paid into the State Treasury to the
29 credit of the Land Acquisition Trust Fund to be used for such
29 purposes. The amount transferred to the Land Acquisition Trust
30 Fund shall not exceed S90 million in fiscal year 1992-1993,
31 5120 million in fiscal year 1993-1994, 5150 million in fiscal

(1) Subject to such appropriations as the Legislature
may make therefor from time to time, disbursements from the
Ecosystem Management and Restoration Trust

responsibilities in a comprehensive, long-range, statewide
beach management plan for erosion control; beach preservation,
beach restoration, and beaux renourishment; and storm and

16 problem and declares its intent to fund a comprehensive,

23 portion of the excise tax on dor_uments for beach acquisition

WHEREAS, Florida's number one tourist attraction is its
beaches, and
WHEREAS, according to the Office of Tourism, Trade, and
Economic Development, some 93 million tourists visited Florida
in 1996, spending $37.9 billion in taxable sales and creating
781,900 travel-related jobs, and
WHEREAS, more than half of all tourists coming to
Florida spend at least part of their vacation on its beaches,
and
WHEREAS, in a recent study over 60 percent of the beach
tsarists in Broward County said they would not return if there
were no beaches, and
WHEREAS, Florida's beaches produce additional state
sales and use tax revenues in excess of 5500 million in 1996,

Dedicated Funding for Beach Management
What the Bill Does:
1. Phases in over three years an allocation of $30 million annually to fully fund the state
shaze of Florida's Beach Management Plan.
2. The funding would come from an unallocated portion of the doctunentary stamp tax
on real estate transactions that currently goes to general revenue. Thus, no new taxes
aze required.
3. The money would be transferred to DEP's Ecosystem Management and Restoration
Trust Fund.
4. The bill provides that allocations to the trust fund be phases in as follows:
• $10 million in FY 1998-99
• $20 million in FY 1999-2000
$30 million in FY 2000-01 and each fiscal yeaz thereafter
(Note: This phase-in approach does not preclude the Legislature from appropriating
from other sources money for the beach management program in FY 1998-99 and FY
2000-01.)
5. The bill also includes important language of a legislative "finding" that "erosion of
the beaches of this state is detrimental to tourism, that state's major industry, further
exposes the state's highly developed coastline to severe storm damage, and threatens
beach-related jobs, which if not stopped, could significantly reduce state sales tax
revenues..."

I am pleased to report that bills have been introduced in the House and Senate to
provide a state dedicated funding source of $30 million annually for beach
management projects. Source of the funding is the unallocated portion of the
documentary stamp tax that now goes to general revenue.
Enactment of this legislation is of vital concern to all of Florida's coastal cities and
counties. It would benefit you in two ways:
" State matching money would be available for your local beach project
when you need it, avoiding long delays we have seen in the past.
It would lower cost of projects by allowing DEP to schedule beach
repairs in an orderly five-year work program, like DOT builds roads.

URGING THE 1998 FLORIDA LEGISLATURE TO PASS HB 3427 AND SB 882
WHICH PROVIDES A DEDICATED FUNDING SOURCE FOR
STATEWIDE BEACH MANAGEMENT; AND PROVIDING FOR AN

WHEREAS, Beaches aze Florida s number one tourist attraction, in 1996 generating
$18.9 billion for the State's economy, 442,000 jobs, and more than $500 million in State
sales and use taxes; and
WHEREAS, Florida's beaches protect over $150 billion in upland coastal property
against humcane and storm waves, and healthy beaches can reduce damages to coastal
development by as much as 50%; and,
WHEREAS, The Florida Department ofEnduonmental Protection estimates that more
than 300 miles of Florida's beaches are experiencing a state of critical erosion; and,
WHEREAS, when legislation authorizing the State's beach management program was
enacted in 1986, the Legislature declazed an intent to "appropriate at least $35 million
annually" to implement this program; and
WHEREAS, appropriations over the past decade have fallen faz short of the amount
needed to repair the State's eroding beaches; and
WHEREAS, Legislation, designated HB 3427 and SB 882, has been introduced in
the 1998 Legislature, which provides for a stable, designated funding. source for Florida's
Beach Management Progam.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF ATLANTIC BEACH,
FLORIDA THAT:

We have been asked by the Florida Shore & Beach Preservation Association to pass a
Resolution supporting legislation which is of vital concern to Florida's coastal cities and
counties. The legislation has been introduced in the House and Senate, and we are
attaching herewith information which explains more fully how the legislation will benefit
cities and counties by providing funding for local beach projects and lowering cost of
projects.

with the provision that there be no more than 14 residents and iVirs. Walker seconded
the motion. The boazd requested that the applicant aitach a site plan to the application
to complete the records for the Citv. On vote the motion passed unanimously.
Ivir. Worley informed the board that a variance was granted to construct an
addition to an ecisting nonconforming residence at a past meeting and subsequent review
of the matter revealed that improper permitting procedures had occvrced. He stated that
the matter has been referred to the building offidal and that no ne~v building permit will
be issued until the matter is resolved.

The board unanimously reelected Don Wolfson as Chairman and Robert
Froh~vein as Vice Chairman.

• iVir. Gerald Kaufman introduced himself and stated that he is the owner of the
adjacent residential lots and voiced his objection to the application. He stated that the
applicants previously applied to the City Commission and were denied.
lvlr. Worley e.plained to the board that the applicant had previously been denied
a rezoning of the property and this vas not the same request.
IVIr. Grunthal pointed out to the applicant that the use by exception requested is
not a permitted use by exception in the code of ordinances or in a home occupation.
The Chairman e.~cplained to the applicant that the code is very specific as to what
is allowed as a home occupation and the la~v vas very explicit as to what the board can
approve. He further e.plained to the applicant that the board members are volunteers
and did their best to serve the well being of the community.
After discussion, ivk. Gtunthal moved to recommend denial of the request to the
City Commission and iVir. Waters seconded the motion.
After further discussion, the board voted unanimously to recommend denial of the
application with the suggestion that the application fee be refunded to the applicant.
II. Application for Use-by-Exception filed by Watch Care, Inc. to operate an
assisted living factlirv with 24-hour residential care for elderly persons at property located
at 100 West I st Street.
Jamie Glavich, agent for Watch Care, Incorporated, introduced herself to the
board and e~cplained that the applicants own and operate an existing day care facility at
the location permitted by exception in 1992. She explained that the applicant desires
to expand the use previously granted to include an assisted living facility with 24-hour
care for Alzheimer patients. She stated that the facility would remain small with no
more than 14 residents.
ivls. Glavich explained that there is room to accommodate the required 21
additional parking spaces on the property but indicated that marking the spaces with
stripes would take away from the residential environment they desired to create. She
also indicated that they would like to reduce the number of required parking spaces.
The board pointed out that the applicant would be required to meet all
requirements regarding parking and landscape unless separate variances were granted

minutes from the meeting of December 16, 1997. Upon motion made and seconded the
minutes were approved.
The Chairman recognized and welcomed the newly appointed member Dezmond
Waters.

~Vlr. Bennett introduced himself to the board. He explained that he and his wife
o~vn and reside at the subject property and desire to operate a retail flower shop out of
a portion of the residence. He explained that he had reduced the size of the proposed
addition considerably after his application vas submitted. He stated that by reducing
the size of the construction it would save several large trees and reduce parking
requirements. He explained that the property is adjacent to several commercial
businesses and that traffic from deliverv trucks vas extensive.

The applicants owns and resides at the above location. They desire to operate
a retail flower shop out of a portion of the residence. The proposed use is not
compatible with the limitations on Home Occupations provided for in Section 24-159
because of the intended advertising, and the expectations of customers visiting the
business location. The applicants propose to construct an addition onto the existing
residence to accommodate the shop and to provide five on-site parking spaces
accessible from alley bordering the south side of their lot.
This property is zoned RG-2, Residential General. The proposed use is clearly
a commercial use. The applicants have been advised of the provisions of Section 24-
159 and specifically advised that the use they seek is not an acceptable residential use
and that it does not constitute a "Home Occupation". The applicants cite the proximity
of commercial general businesses across the alley to the south of their property and to
the west. This situation exists throughout the city where ever commercial and
residential districts abut. The fact that commercial uses are permitted across the street
or alley from a residential lot does not, in itself, constitute grounds for the expansion of
those uses onto the subject property. The expressed intent of placing medium density
residential zoning adjacent to commercial zoning is to buffer the adverse impacts of the
commercial zoning.
The applicants also assert that their proposed use is the highest and best use
for the property. By state and federal court interpretation, the applicants are not
guaranteed the highest and best use for their property, but merely reasonable uses
permitted by the zoning district in which their property lies. With the exception of uses
permitted by Section 24-159, Staff opposes the encroachment of commercial uses into
residential districts. Staff recommends denial of this request.

No More Smiles
The timing couldn't have been worse for Florida's trial

business lobby, which is seeking sweeping changes in [he
state's tort laws. 7-hen, just when the Bar most needed to
close ranks, a slugfest erupted among [he I 1 trial lax}'ers
who handled Florida's SI 1 hillion tobacco settlement .
In one month, the team went from smiling happily
at aself-congratulatory photo opportunity with the
governor to duking it out in a nasn• internecine war.
The reason for the fight lies in the difference benceen
the cenns of the contrec[ that the law~~ers a¢reed to
with the state and the terms of the settlement the state
signed with [he tobacco companies. The law}~ers'
contract calls for them to receive ?i% of whatever the
state recovered. The settlement dicwtes that fees are
to be determined through arbitration.
Highlights of the feud:
• Five of the trial team members and P Timoths•
Howard, the former stare lau}•er employed by the trial
team, filed liens against the state demanding to be paid
2i% of the settlement, S?.8 billion, as dictated in their
contract. A Patin Beach County judge ruled the dissident
group's demand "patently ridiculous" because of the size
of the settlement and ordered them into arbittation.
• Trial team members ACC. Gentry, \1 acne Hogan
and C. Das~d Foncielle sued the dissident law}'ers,osk-
ingthe court to force them to follow the teens of the
settlement or dismantle the team.
• Palm Beach trial law}'er Bob \iontgomerv, one of
the dissidents, sued trial team Chairman \iichael Maher
of Orlando. ~1ontgomery alleges Jtaher schemed with
the ns~o out-of--state members to persuade the trial team
m abandon the contratt in favor of the settlement. He
claims the two law firms, which negotiated the national
tobacco settlement, do not want Florida law}'ers toget -
their fens before a national deal is dune.

A RESOLUTION OF THE CITY COMMISSION

URGING THE LEGISLATURE TO DEVELOP A REPLACEMENT PROGRAM
WHEN THE PRESERVATION 2000 PROGRAM TERMINATES
WHEREAS, Preservation 2000 has been an effective program for protecting the sensitive
environmental sites in and around Duval County; and
WHEREAS, The City of Atlantic Beach has benefitted directly from two Preservation
2000 grants for land acquisition; and
WHEREAS, the Preservation 2000 Program will terminate at the end of fiscal year
1999/2000; and
WHEREAS, Initial development expenses are often 50 percent or more of the acquisition
costs for properties because of the necessity to provide some public amenities, such as restrooms,
and to make the site in compliance with ADA.; and
WHEREAS, the expenses of operation and maintenance of acquired properties place a
great burden on small local governments; and
WHEREAS, The City of Atlantic Beach believes that supporting local governments in the
acquisition of environmentally sensitive lands should be followed by supporting those same local
governments in the development and operation of the facilities and amenities required by the
acquisition grants.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF ATLANTIC BEACH,
FLORIDA THAT:
Section 1. This Commission strongly urges the Florida Legislature to enact the necessary
legislature to replace the Preservation 2000 program with a program that includes operation and
maintenance as well as acquisition funding grants for local governments..
Section 2. A copy of this Resolution shall be provided to all members of the Duval
Delegation in the Florida Legislature.

A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA
RECOGNIZING ED MARTIN FOR SERVING ON THE
CODE ENFORCEMENT AND PENSION BOARDS
WHEREAS, Ed Martin was appointed to the Code Enforcement Boazd on May 8, 1989 and
he was elected as Chairman on November 9, 1993; and
WHEREAS, during his tenure on the Code Enforcement Board Ed Martin presided at over
190 Code Enforcement cases. He participated in Florida Association of Code Enforcement Board
seminars, and visited other cities to observe code enforcement functions. He revised the hearing
process to provide for faster adjudication of violators. He always acted in a firm but compassionate
manner, and he always showed a sense of respect for all individuals. Code meetings, under his
chairmanship, were conducted in a professional and efficient manner; and
WHEREAS, Ed Martin was appointed to the Pension Board of Trustees on January 13, 1997
and was elected as Chairman on February 12, 1997. During his tenure on the Pension Board of
Trustees Ed Martin provided leadership in rewriting the Pension Code. He provided practical and
logical review of pension issues facing the city and the employees, and he created a good working
relationship among both Pension Members and staff. He gave employees a sense that the Pension
Board was in good hands. He pursued gaining knowledge and education so that he was up-to-date
concerning pension issues; and
WHEREAS, Ed Martin has announced his resignation from the Code Enforcement Board
effective February 28, 1998, and his resignation from the Pension Boazd of Trustees effective
February 15, 1998, to relocate to North Carolina.
NOW, THEREFORE, BE IT RESOLVED that the City Commission of the City of Atlantic
Beach:
(1) Publicly goes on record as commending Ed Martin for his outstanding efforts and voicing
our appreciation for his leadership in all azeas of community improvement. His outstanding and
continuous volunteering has served as an example to our citizens.
(2) The City Commission hereby presents a Key to the City to Ed Martin so that the City will
always be open to him in the future, and extends best wishes for his future happiness..

I sincerely regret that I roust resign my appointment on the Cultural Arts Board.
I have enjoyed serving on the hoard very much and truly appreciate the fact that our
community values the important contribution that ttte arts maize to the quality of
life. It has been very rewarding io serve in a capacity that has been so tremendously
supported by our staff liaison, Carl Waltzer, city manager Jun jarbce, former mayor
Lyman Fletcher, both past and present city commissioners (especially Desmond Waters
who first proposed this hoard), George Worley , fianciat director Ann Meuse, pariza f~
rec liaison Timmy Johnson, Police Chief Thompson and his staff, the fire chief and his
staff, the city ltatl clerizs who sold First Night buttons and especially all the other cultural arts
beard members and First Nigltt steering commilte members who }rave wor}zed so ver; hard
to maize all of the projects successful. I met so many incredibly }ziirtd and competent people.
Never did I dream that so many good people could wort: together so very well- although of
course I should have since t}us is very special Atlantic Beach! I will miss being so involved
at the board level though all of my family and I will continue to serve as Fast Night
volunteer. And I was especially loolzing forward to wor}zing closely with you, Suzanne, far
I believe in the vision you have for our community and know you will continue the goad
work that has already been done. Alas, it seems that rite time left with my children suddenly
seems very short and my ability to be with them when they need me and be available to them and
for them'ie my first priority. In just three years, my nest will be empty eo perhaps at that

NOTICE is hereby given that the City of Atlantic Beach, Florida, will
receive sealed bids, IN TRIPLICATE, in the Office of the Purchasing
Agent, 1200 Sandpiper Lane, Atlantic Beach, Florida 32233, until 2:30 PM,
Wednesday, January 7, 1998, for DEMOLITION OF THREE (3) HOUSES IN
ATLANTIC BEACH (117 ARDELLA ROAD, 121 ARDELLA ROAD, AND 1970 PARK STREET).
Thereafter, at 3:00 PM, the bids will be opened in the City Hall Commission
Chamber, 800 Seminole Road, Atlantic Beach, Florida.
The successful bidder will demolish, haul and dispose of structures,
including foundation, at the above addresses, leaving site free and clear
of debris, and finish by grading the properties.
Bids shall be enclosed in an envelope endorsed "BID N0. 9798-11 -
D~OLITION OF THREE (3) HOUSES IN ATLANTIC BEACH, TO BE OPENED AT 3:00 PM,
WEDNESDAY, JANUARY 7, 1997."
Bid Forms, and information regarding the bid, may be obtained from the
Office of the Purchasing Agent, 1200 Sandpiper Lane, Atlantic Beach, Florida,

DOCUMENTS REQUIRED TO BE SUBMITTED IN BID PACKAGE AT BID OPENING:
1. Bid Bond in the amount of SZ of the bid.
2. ORIGINAL Insurance Certificates (copies, Xeroxes, and facsimiles
are UNACCEPTABLE), naming the City of Atlantic Beach as Certificate
Holder, showing they have obtained and will continue to carry
Workers' Compensation, public and private liability, and property
damage insurance during the life of the contract.
3. Three (3) references from companies or individuals for whom the
bidder has completed work during the past 12 months, of a comparable
size and nature as this project. However, naming the City of Atlantic
Beach as a reference on past completed projects is UNACCEPTABLE.
4. Proof of Occupational Licenses (copies ARE acceptable).
5. Signed copy of Documents Requirements Checklist.
Bid prices shall remain valid for sixty (60) days after the public opening
of the bids. Goods and services proposed shall meet all requirements of

AGENDA ITEM: Award of building demolition bids for CDBG

BACKGROUND:
Three abandoned homes in the Donner CDBG target area were condemned by
the Building Official after notice to the owners. As no action was taken by the owners
to remove these structures, the Building Official, coordinated with the Community
Development Department to bid out the demolition of the three houses. Demolition of
abandoned structures is a permitted use of CDBG funds and funding was budgeted in
the current CDBG contract far that purpose.
During the bid process one of the property owners arranged to demolish his
abandoned structure leaving only two buildings for the city to demolish. Bids were
received, but because the CDBG contract had not yet been returned from the City of
Jacksonville, the recommendation for award was not fonnrarded to the City Commission
for action.
RECOMMENDATION:
The approved contract from the City of Jacksonville has been received and
attached hereto are the bids for building demolition for 117 Ardella Road and 1970
Park Street. The building at 121 Ardella Road was demolished by the owner.
Based uoon the bids received Staff recommends award of the demolition of the
two houses to Southland Waste of Jacksonville in the amount of 31,369.00 for each

• Read a brief article from the February issue of Florida Trend
magazine concerning replacement of the successful Preservation 20
land acquisition program with a plan to allow the money to be used t
manage state-acquired lands as well as to buy new property.
Mayor Shaughnessy requested that a letter be sent to the Duval Coun
Delegation supporting the proposal.
• Commented the flowers at City Hall looked nice.
• Requested that citizens using the Commission Chambers be allowed
access to the Chambers through the walkway at City Hall.
City Manager Jazboe stated he would look into this.
Stephen Kuti of 1132 Linkside Drive commented that newly planted trees
need additional water and inquired if the city could provide water to the ne
palms at Town Center
City Manager Jarboe stated he would contact Kelly Elmore of the Genesis
Group, since he believed the contractors are responsible for watering the tree
J.P. Marchioli of 414 Sherry Drive inquired concerning the bottleneck for
traffic at the comer of Ocean Boulevazd and East Coast Drive. Mr. Marchiol
felt there should be four lanes in that area.
This matter was referred to the City Manager who will report his findings at
next Commission Meeting.
Mayor Shaughnessy suggested that the traffic light at the comer of Atlantic
and Ocean Boulevards (Town Center) be removed. She requested the City
Manager investigate this and report his findings at the next Convnission
Meeting.
Commissioner Beaver stated that there needed to be a permanent "Stop" si
by AI's Pizza. City Manager Jazboe stated that for liability purposes the sign
needed to be placed behind the crosswalk and the city was looking into this
matter.

• Reported the Cold Night Shelter Program has been in operation at the
local churches, with average attendance being 25 - 35 people per ni

Stated that Ray Coleman of Beaches Athletic Association had
approached him concerning funding for safety nets by the concession
stand and bleachers. It was reported that the nets would cost
approximately $3,000 and $2,300 had been raised. He inquired if the
city could donate the $700 still needed to buy the neu.
City Manager Jarboe stated he believed the $700 had already been
obtained.
Mayor Shaughnessy stated that if that was not the case, she would lik
this matter to be placed on the next agenda.

Mayor Shaughnessy asked City Attomey Jensen to explain the Public Record
Law. City Attomey Jensen stated that all public records must be made
available to the public.
It was also explained that any committee meeting, if it only has one member <
the appointed or elected boazd in attendance may not necessarily fall under
the requirements of the Sunshine Law. However, if two members of the same
board are on a committee, then they would have to comply with the law.
Application of the law to advisory boards, committees, ad hoc committees
and quasi judicial boazds was briefly discussed by Mayor Shaughnessy.
Mayor Shaughnessy encouraged the Commissioners to call City Attorney
Jensen should they have any questions concerning the law.
COMMISSIONER MESERVE
• Stated he would like to set a date now, if possible, for the Saturday go
setting session.
It was the consensus of the Commission to hold the meeting on
Saturday, Mazch 14, 1998.
• Reported that the next meeting of the Mayport Waterfront Partnership
would take place on Wednesday, February 18, 1998 at 8:00 a.m.
Reported air conditioning had been installed in the building and
painting and signage for the building would be put out to bid in the ne
future. It was also reported that the Village of Mayport Sewer Project
would be going out to bid soon.
COMMISSIONER MITCHELSON
As liaison to the Beaches Homeless Coalition, reported on the City of
Jacksonville Beach proposed ordinance to prohibit homeless people
from sleeping in public places within a described boundary. It was
further reported that if a person was found sleeping in the azea, they
would either have to voluntarily leave or accept transport to a shelter.
If they refuse, they could be arrested. He pointed out that there could
be problems with enforcement of the ordinance if the shelters are full
which could result in an influx of homeless to neighboring
communities.

A brief discussion concerning the options ensued, and Mayor Shaughnessy
requested the Commissioners submit their preference in writing to the City
Manager by one week from Tuesday morning (February 17, 1998).
B. Town Center Trees
City Manager Jazboe reported that four palm trees, like those on Atlantic
Boulevazd, had been planted in Town Center. It was reported that Saturday,
February 21, 1998 would be volunteer day to do other plantings in the azea.
C. Mayport Road -Force Main Emergency
A force main emergency was reported with initial findings indicating a
collapse on Mayport Road, just south of the Post Office. City Manager Jazbol
indicated the DEP had been notified and the appropriate action taken to stop
the problem, and he would report back to the Commission as more
information becomes available.
ll. Interim Finance Director
City Manager Jazboe and Mayor Shaughnessy recognized the outstanding
work of Jeri Benjamin who is acting as interim Finance Director until Nelson
Van Liere begins work with the City.

A. Overview of Florida's Government in the Sunshine Law (City
Attorney)
City Attorney Jensen provided a brief overview of the following to the
Commission: City Manager Form of Government, the role of the
Commission as the legislative and policy making body, and the Government i.
the Sunshine Law (Chapter 286.011 of the Florida Statutes), which requires a
meetings of a public boazd to be open to the public, that reasonable notice be
given of the meeting, and that minutes ofthe meeting be kept
City Attorney Jensen stated he would be happy to answer any questions the
Commissioners might have.

advertising.
Commissioner Meserve indicated he wanted to keep the newsletter going and
believed the volume of advertising should continue because it picks up two-
thirds of the cost of publishing.
Motion: Find a person, hopefulley a citizen of Atlantic Beach to
the editor, and continue to publish the newsletter using the same
format and arrangement.
Commissioner Mitchelson inquired as to the profit mazgin for the publisher
and City Manager Jarboe explained the arrangement. Mayor Shaughnessy
explained the content of the newsletter and stated its publication was a perfe
example of a private -public partnership.
Commissioner Bomo inquired if someone from the City reviewed the conten
of the newsletter before it was published and City Manager Jarboe stated he
reviewed the newsletter. Commission Bomo further stated he would like the
format and arrangement for the newsletter to remain as it is.
J.P. Mazchioli commented he would like to see a monthly newsletter
published. Mayor Shaughnessy asked Mr. Mazchioli to bring this idea up aga
during the Goal Setting Meeting.
Commissioner Bomo then inquired how the city was going to solicit
this business.
City Manager Jarboe indicated interest in publishing the newsletter had alrea
been expressed by Andrea Pennell. Mayor Shauglutessy stated that Pam
Bushnell, who did publicity for First Night, had also expressed an interest.

A. Presentation relative to proposed goal setting session(s)
City Manager Jarboe passed out information giving the Commission two
suggested methods for conducting goal setting sessions. The first, supplied
by the University of North Florida, offered their suggestions for conducting
the session and included fees. The second, supplied by City Manager Jarboe
suggested an in-house format using the City Manager or local citizen as

City Clerk Maureen King explained that the Public Relations firm of CPM
which published the city's newsletter had dissolved their company and advise
the city they would not be publishing any future newsletters. Mrs. King forth
explained the city was now at a position to take a look at the entire process
see if any changes needed to be made. Mrs. King referenced the questions at
the bottom of her memo dated February 3, 1998, which is attached and made
part of this official record as Attachment D, and asked Commission directio
concerning publication of future newsletters.

operate an assisted living facility at 100 West First Street as
recommended by the Community Development Board and Staff.

Mayor Shaughnessy opened the public hearing. No one spoke concerning the

B. William McGee of 1831 Selva Marina Drive passed out fourteen (1~
photographs (copies of which aze attached and made part of this official recor
as Attachment A) of ductile iron pipes showing external corrosion which we.
removed from the lift station located at Saturiba and Selva Marina Drives. M
McGee suggested the city consider utilizing stainless steel pipes when making
replacements, which would save money in the long run.
Mayor.Shaughnessy referred the matter to City Manager Jazboe and Staff for
review and asked that he report back his findings at the next meeting.
C. Alan Potter of 374 Second Street read from a letter dated February 9
1998 addressed to the Commission, which is attached and made part of this
official record as Attachment B. The letter expressed concern that the
Buccaneer Wastewater Treatment Plant expansion will require increased stag
to operate the plant resulting in higher operating costs.
City Manager Jazboe was directed to look into this matter and report back at
the next meeting.
D. J.P. Marchioli of 414 Sherry Drive inquired as to Col. Rice's
schedule for reviewing the Core City Stormwater Improvements.
City Manager Jazboe stated the schedule should be available in approximate)
one week.
E. Presentation of the Audit Report for FY 1996/97
Joe Welch, a partner with Purvis Gray and Company, presented the audit
report for FY 1996/97 to the Commission.
Mr. Welch indicated the report complied with all federal, state and local
accounting requirements and he found no weaknesses in the internal controls.
Mr. Welch stated it was a good audit report and then presented a brief
overview of several areas of the report.
Mr. Welch offered to conduct a workshop for new Commissioners, if
necessary.
Commissioner Bomo inquired if a summary of the highlights of the audit w.
available.

The meeting was called to order by Mayor Shaughnessy. The invocation was
given by Karl Grunewald followed by the Pledge of Allegiance to the Flag.

A. City Manager Jarboe introduced Nelson Van Liere, the City's new Financ
Director, and stated that Mr. Van Liere is a CPA who came highly recommendu
from the City of Jacksonville Beach where he has been Budget Director for the
past nine yeazs.
On behalf of the citizens and Commission, Mayor Shaughnessy welcomed Mr.
Van Liere to the City.
