remaining portion hereof.
SECTION 5: CONPLICT.
All ordinances and parts of ordinances in conflict herewith
shall be and the same are hereby repealed. If any part of this
Ordinance conflicts with any other part, it shall be severed and
the cemaindec shall have the full force and effect and be
liberally construed.
This Ordinance shall be published in accordance with Florida
Statutes, Section 166.041(3)(c)2. The City Commission shall hold
two (2) advertised public hearings, both of which shall be held
after 5:00 p.m. on a weekday and the first shall be approximately
seven (7) days after the day that the first advertisement is
published. The second hearing shall be held approximately two
(2) weeks after the first hearing and shall be advertised
approximately five (6) days prior to the public hearing. The
date, time, and place at which the second public hearing will be
held shall be announced at the firs public hearing.
SECTION 7•
This Ordinance shall take effect immediately upon its passed
its period.

SECTION 2: This moratorium shall continue for not more than six
months or until such time as all relevant studies are complete
and the City Commission of the City of Atlantic Beach has had the
opportunity to decide the question of extension of public
utility services into Section H.
i SECTION 3: Provision is hereby made for obtaining relief from
i
j this moratorium by an applicant submitting to the City Manager or
his designee a written statement demonstrating the untenable
~ hardship shall inure to the applicant in the event that said
applicant cannot obtain a permit. The City Manager or his
a
designee shall promptly transmit [he application for relief to
the Planning Commission which shall [eview the application and
make a recommendation to the City Commission. The Commission may
I then determine whether untenable hardship exists and either deny
s
' the application or grant leave to apply Eoc the appropriate
i
permits pursuant to the requirements of the City of Atlantic
Beach Comprehensive Land Use Plan and all other applicable Codes
and Ordinances.
For the purposes of this Ordinance, untenable hardship is
defined to mean a hardship unique to the property involved in [he
application and must be peculiar to that particular property, not
general in cha[acter. Economic or self-imposed hardship shall
not be grounds for relief.
J Further development of existing buildings which conform to
the current provisions and performance standards of the City of
Atlantic Beach Comprehensive Land Use Plan may be approved by the

City Commission upon a finding of fact at public hearing that the
i
amount, rate, type and intensity of such commercial expansion
will be advantageous to the Community Public Interest and will

not confound the intents and purposes of the study on the
7 provision of public utility services to Section H.

If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is, for any reason, held invalid or
unconstitutional by any Court of competent jurisdiction, such

A PROCEDURE FOR OBTAINING RELEASE FROM THE MORATORIUM; PROVIDING
FOR SEVERANCE; PROVIDING FOR CONFLICT; PROVIDING AN EFFECTIVE
DATE.
WBEREAS, the intent and purpose of the City of Atlantic
Beach Comprehensive Land Use Plan is the orderly control of
growth and development of the City of Atlantic Beach in such a
fashion that the unique and natural characteristics of the City
oc preserves; and
WBEREAS, it is further the intent and purpose of the Land
Use plan that residential development of the Ci[y of Atlantic
Beach not jeopardize the health safety or welfare of existing
residence; and
NBEREAS, within the past several years there has been a
rapid expansion of development within Section H of the City of
Atlantic Beach, an area now presently served by public utilities;
and
WBEREAS, much of the development has therefore been
accompanied by the installation of septic tanks and water wells;
and
NBEREAS, concerns have been expressed over the possible
contamination of groundwater and deep-water wells by faulty
septic tanks within Section H; and
NBEREAS, the City of Atlantic Beach continues to diligently
pursue appropriate and in depth analysis of the legitimate :
planning question derived from the extension of public utility
Se[vices into Section H;
NOW, THEREFORE, BE IT ORDAINED BY TP,E COMMISSION OF THE CITY
OF ATLANTIC BEACH, DWAL COUNTY, FLORIDA:
SECTION I: Therr_ is hereby declared to be established a
moratorium on the issuance of any further building permits within
Section H of the City of Atlantic Beach effective imrt~ediately
upon the date of passage of this ordinance.

Dispatcher Jeanie Brown advises me that a woman called Ci[y Fiall and
talked to Renee Mgers. The woman vas threatening suicide.
Ms. Mgers kept [he woman on one line and con[ac ted the A[lan[it Beach
Police Depar tmen[ on another line. Ms. Mgers go[ [he woman's address
and phone number and relayed i[ to ABPD. Cbe Neptune Beath Police
Department was contacted to respond [o the call originating in Neptune
Beach, and [he woman was located unharmed.
IG is apparent that Ns. Mgers handled the situation very yell, especially
considering thac she lus no training in responding to such situations'.
Ms. Brown and the Police Department hope chat [he City will recognize
[he quick Chinking and appropriate actions taken by Tfs. Mgers under such
stressful cond iG ions.

Mayor Howell called Che meeting to order at 6:00 p. m. for Che purpose of
considering Change Order No. 1 on [he Street Resurfacing project in Atlantic
Beach [o authorize an increase in price of $13,225.63.
Those present were Mayor William S. Howell, Commissioners Robert B. Cook,
Glenn A. Edwards, and John W. Flo rris; Ci [y Manager Richard C. Fellows; City
Clerk Adelaide R. Tucker, and Public Services Direc [or Robert Braid.
Mr. Fellovs reported [he change order included three access drives [o pumping
stations and in addition included t}ie paving of a 40' x 80' section of pumping
Station "E" vhith vas agreed Co by [be city when [hey negot Sated [he easement
with Kelly Amber for [he property on Maypor[ Road Eor "E" station. In
addition, [he change order included a 50' extension m Church Road Eas[ which
was requested by Che Department of Transportation. They are preparing [o
Snstall a traffic signal at Church and lfayport Rd. and Che paved area vas
required. Total change order would be in [he amount of $13,225.63. Conditions
and specifications of the base agreement applied except [hat a 4" [hick
asphalt layer over stabilized sub Krade would be substituted for standard City
of Jacksonville specifications for asphalt roads with 6" limerock base. All
other Ci[y of Jacksonville specifications would apply.

During discussion, Mr. Fellows advised [he access drives for [he pumping
stations would come from Renewal S P.eplacement Sewer Fund Account, and Che
50' extension [n Church Road Eas[ would be funded from the General Fund
Capital Improvements Account. Funds would be Paid from this years budge[. The
Commission expressed considerable concern over [he paving of Pumping S[a Cion
"E" with a 4" [hick asphalt layer over s[abil Seed subgrade in lieu of [he
normal 6" limerock base with 1" to lip" asphalt paving. Mr. Fellovs assured Che
Commission the con[rac [or was satisfied the 4" chick asphalt layer would last
a long time without a limerock base, and he would guarantee the surface for
one year.

year, he felt they could expedite riat[ers if the Commission had no obj~
ions to open the bids during the day. They could appoint a Committee u

$732,000, and interest earnings of $Si,500. Commissioner Gulliford
said if you took the total revenues, and excluded [hose items considers

$3,201,232 plus vhacever unrescr is [ed revenues from the encerprise fund
might be. When you go down to expenditures and take out sever plan[ cor
s[ruc[ion and leave operating expenditures, you would be looking at
$6,188,400. He expressed concern on the last figure before the ending
balance: Sources 5 Uses of Working Capital shoued a nega [ive figure of
($286,020) which he felt was really deficit spending. He expressed the
opinion "when you compare opera Clog revenues and operating expenditure:
that [hey are out of balance, and at some point in the future, ve will
have [o bring [hose into balance by either cutting expenditures or by
increasing [axes, which I am very much opposed to. A[ firs[ glance,
everything looks rosy, buc if you look at it from [Ire standpoint of
operations, I'm a little concerned, and would appreciate vi[Lin [he
next month or so, you would analyze that and compare what our actual
operating revenues versus our operating expenditures were, excluding
capital expenditures, and let's see where we are as a City". The

INVITATION TO BID
Sealed proposals, submitted in duplicate, will be re<aived by the
Office of the City Manager of [he City of Atlantic Beach, at City Hall,
Atlantic Beach, Florida 32233, until 11:00 a.m., local time, September 22,
1986, at which time bids vill be opened and public reed £or the Clean,
Televise and Sealing Program, Sewer System Rehabilitation, SAC Project
No. 8505-04-02, in the City of Atlantic Beach, Florida. '
The work consists of furnishing all labor, materials and equipment
necessary co rehabilitate selected portions of the sanitary sewer system in
Atlantic Beach, Florida. She me [hods to be used include cleaning and televising
up to 32,000 feet, sealing 3,800 pipe joints and sealing 45 manholes, all
vithin the existing sanitary sever system, of which the pipe sizes may vary
from 6-inch through 12•in<h in diameter.
Plans, specifications and contract documents will be open co public
inspection ac the Office of the Ci[y Manager, City Hall, City of Atlantic
Beach, Florida, or may be purchased from Smith and Gillespie Engineers,
Znc., Post Office Box 53138, Jacksonville, Florida 32201, upon payment of
$31.50, which amount constitutes the cos[ of reproduction and handling and
includes $1.50 sales tax. This payment will not be refunded. Only complete
sets of plans and specifications will be distributed.
Each bid shall be submitted on the forms provided therefor and shall be
accompanied by a certified check or bid bond in the amount not Less than
five percent of the bid.
Work must commence no later than October 1, 1986. Television inspection
of the Base Bid scope of work must be completed by October 20, 1986. Remaining
work must be completed by March 1, 1987.
No bid may be withdrawn for a period of sixty (60) days after the
scheduled time for receiving bids.
The Ciry of Atlantic Beach, Florida reserves the right to rej a<t any
and all bids and to waive informalities.

SUBJECT: STATUS REPORT
o Bids will be received and opened a[ 11:00 AM, Monday, September 22,
1986, on televising and sealing of [he City's older sewer collection
system. The committee appointed by the City Commission a[ the last
meeting will have reviewed [he bids and will be in a position to make a
recommendation to Che City in time for [he meeting on Monday nigh[.
o The Resolution adopted at the last meeting setting the boundaries
of [he moratorium in Section N described Che area encompassed by Church
Road on Che north, Maypor[ Road on the east, Atlantic Boulevard on Che
Sou [h and Che saltwater marsb on [he west I[ appears [he Ci[y Commis-
sion may have intended the moratorium apply only [o [ile area south of
Levy Road, north of Atlantic Boulevard, and everything east of the
western tier of lots on Jasminr Street. If this vas [he intent, the
boundaries need to be corrected so the City building department will he
clear on the boundaries covered by [he moratorium.
o A goodly number of Ci[y projects are under way and coming near to
completion. The new playground equipment has arrived and been installed
Sn Russell Park. TIIis is a really nice addition and tl~e youngsters ve
have observed playing on i[ seem to really enjoy i[. Work has begun on
the nev tennis court lights a[ Russell Fark and the resurfacing project
has just about been completed. Sidewalk construction has begun on Royal
Palm and Sailfish, and this will take a bit more time Lut should be
completed Coward the end of [he month.
o Don'C forget [he Raymond Dagley Ordinance comes up for final
reading on Monday nigh[. The public hearing has been concluded bur [he
City Con®ission decided a[ the last meeting [o wait until Commissioner
~: Morris returned so [here you ld to a full Commission to vote on the
disposition of the matter.
n Las[ month an unidentified woman called Ci[y hall and the call cos
taken by Rene' Angers. The woman was threatening suicide and Rene',
exercising extreme coolness and good judgement, held [he woman on [he
- line and kept her [al king until contact could be made with [he Atlantic
Beach Police Department on another line, and efforts made [n find [he
location of the woman. It final'_y turned out the woman was located in
Neptune Beach and [he Police Department was able to get there before she
could do herself any harm. Rene' hand leJ [he situation very well,
especially considering she had no [raining, and I would like [o ask the
City Conmii ssi on to re rogn ize [his fact in our ner.t mcecing as I [Link. it
would be a nice gesture.

AN ORDINANCE ADOPTING AN OPERATING BUDGET FOR THE
CITY OF ATLANTIC BEACH, FLORIDA, FOR THE FISCAI.
YEAR BEGINNING OCTOBER 1, 1986, AND ENDING SEPTEM-
BER 30, 1987; PROVIDING FOR Tl1E LEVY OF AD
VALOREM TAXES; PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC
BEACH, FLORIDA:
Section 1. That [he attached budget, incorporated and adopted
herein and made a par[ hereof as Exhibit A, be and it is hereby adopted
and approved by [he City Commission of the Ci[y of Atlantic Beach,
Florida, as [he budget for the City of Atlantic Beach for Che fiscal
year 1986-87.
Section 2. That an ad valorem tax of $1.8892 per thousand
dollar valuatlon on all real and personal property be levied within the
corporate limits of said Ci[y, provided however, [hat said tax shall no[
be levied upon property in [he Ci[y of Atlantic Beach claimed and
allowed as homestead under [he general laws of [he State of Florida.
The millage approved herein is the rolled-back rate.
Section 3. That a tax of $.35 per thousand dollar valuation be
levied on all real and personal properly within the corporate limits of
the City of At lancic Beach including homesteads, and the funds raised
therefrom used to pay interest and principal on general obligation bonds
maturing during [he fiscal year, such levy [o be collected in cash and
kept in separate accounts for the purposes designed in [he bond inden-
ture.
Section 4. This Ordinance is proposed, considered and adopted
under the provisions of Chapter 166 and 200.065 Florida S[a[utes.
Section 5. This Ordinance shall become effective October 1,
1986.

if this proposal passes will my lot be cut off or surrounded with junk or
a salvage yard?

removing dead or diseased parts of plants, or (2) pruning such i

that fall below original project standards. All plants removed for
whatever reason shall be replaced by planes of the same grade as

THIS AGREEMENT, made and entered into this day of

TRANSPORTATION, a component Agency of [he S[a[e of Florida, hereinafter
called [he "Department", and Nye CITY OF ATLANTIC BEACH, a municipal
corporation in Duval County, Florida, ezis[ing under the lays of
Florida, hereinafter called the "City'.
W I T N E S SET H:
WHEREAS, as a par[ of [be continual updating of [he Stale of
Florida Highway System, the Department, for the purpose o[ safety, has
created a sedian strip dividing [he traffic lanes on that par[ of
ATLANTIC BOULEVARD BEC CINING APPROXIMATELY TWO HUNDRED (200) FEET WEST
OF BEGONIA STREET within the corporate limits of [he City; and DUVAL
COUNTY.
WHEREAS, [he entire length of [his above-mentioned project is
within the corporate limits oC the city; and DUVAL COUNTY.
WHEREAS, the parties hereto are of the opinion that said median
strip shall be alt rac lively landscaped with various flora; and
WHEREAS, [he Ci[y, by Resolution No. 86-17 dated September 8, 1986,
attached hereto and by this reference made a part hereof, desires to
enter into [his Agreement and authorizes its officers [o do so.
NOW, THEREFORE, for and in consideration of [he mutual benefits to
flow each to [he other, [he parties covenant and agree as follows:

Commissioner Gulliford asked if he was to assume that everyone on the
new listing furnished [he Commission of Commissioners, employees, and
boards fell under the S[a [e requirement [o file financial disclosure.
The City Manager responded in [ire affirma [ive. Connnissioner Gulliford
asked iF [he list classified [host that were no[ appointed or elected,
but were full time employees of [he city, as officers of the city.
Mr. Fellows said they were classed as local offlc ers, but subject [o tl
financial disclosure law. The definition by the F1 S[a Cures would dif fi

specified employees were alsc required [o file.
The City Handger no [ed in evaluation of [he intersection of llayport any
Plaza indicated a need for lengthening [he storage lane because of [he
backup of traffic. The lane could be lengthened to get [he additional
storage needed without widening the intersection. Mr. Fellows had re-
ceived two quotations for [he engineering work: Smith S Gillespie,
$6,400. and Connelly b Wicker for $3,500. Ile requested guidance from
[he Cou®ission. Ic was pointed out the reason for hiring an engineer
vas a drainage problem at [hat location.

Mayor declared the Public Hearing closed.
Motion: Passage of Ordinance No. 65-86-11 on second and final

Mr. Fellows advised [he agenda listed the number of the Ordinance as

The Chair recognized Mr. Jerry Randall Salis, Jr., 10557 lbncrief-
Dinsmore Extension Rd. who informed the Commission [hat a group of
Dinsmore citizens had signed petitions for secession of the people ai
[heir properties within [he ou[l ine of the area called Dinsmore from
Consolidated City of Jacksonville, to be known as the Ci[y of Dinsmoi
and incorporated by Charter as such. He hoped all of their surround ii
Cities would join in Co fight consolidation. Following discussion, CI
Mayor thanked Hr. Salis for coming.
3. Appearances
Nr. Robert Hill, of Bessent, Hammack and Ruc kman, for further discus
relative [o public improvements in Section H.
Mr. Hill reported they had made the modifications necessary [o refle
the project area which would be 2'i blocks west of ltain s[. To [al cos
of the prof ec[ was 3.2 million dollars. The city's cost would be 2.6
million for Area I, and $358,000 for Area II. Cost for Area I was $4

operation. We have received one reply to our certified letter announc-
ing [he public hearing, and I am enclosing a copy of it for your infor-
mation.
o There will be one o[f~er public hearing on Monday night having to do
vi th providing for cabinet shops as a use by exception in CC districts.
This was passed on firs[ reading last month and has the approval of the
Advisory Planning Bnard.
o At this writing, we do no[ yet have the documents from City Attor-
ney Mullis in connection with the moratorium in Section H. However,

have received our money from the Firs[ Municipal Loan program, we have
authorized the Lillard Croup [o proceed with the street resurfacing
program beginning September 15, 1986. They probably will finish by
September 30. Brian Feltis, who vas awarded the contract for con-
struction of new sidewalks, will also start his sidewalk ronstruc[ion on
September 15, and probably will complete the work on or before October
30.
o AC [he last meeting, [he City Conmiission asked [ha[ a Memorandum of
Agreement be prepared relative to highway landscaping in connection with
the proposal of the Beaches Chamber of Con®erce [o place palm trees
along Atlantic Boulevard. We have prepared [he agreement and enclose a
copy of i[ for your information.
o Public hearings have been called on three applications for ex-
ceptions. They are as follows:
1. An application from Brian Feltis General Contractor to open a
con[raccor's office only, with no outside storage, in a CG
zone at 535 Atlantic Boulevard.
2. An application from Ashland Investments covering property at
1089, 1091 and 1095 Atlantic Boulevard for exceptions for a
number of businesses Sn accordance with [he list enclosed.
3. Application by Karl and So-Ann Grunevald [o alloy [he opera-
tion of a cabinet shop in a CG zone at 92 West Eighth Street.
