Dear Richard:
As a result of the passage of the above ordinance by [he City Commission
on November 10, 1986, Hr. Dagley will complete the following within a short
period of time, no longer than ninety (90) days from November 10, 1986, to wit:
1. Remove all junk vehicles or other junk items from to [s 5 and 6, block
162 Section H, and cease using those l0 [5 in aryform or fashion in connection
with his business.
2. Remove all junk vehicles or ocher junk Items from blocks 110, 139,
and 143, Section H, and cease using those blocks in aoy Form or fashion
1n connection with his business.
3. Construct approximately 200' of privacy fence on the south side of
West 6th Scree[, with approximately 100' going east from Begonia Street
and approximately 100' going west from 8egon is S[ree t.
Please le[ me know if [here are any additlolsi though [s you might have on
this matter regarding any actions to be taken by Hr. Dagley. He would like to
obtain an occupational license from the City, and I would appreciate you informing
me of when he will be able [o apply for and obtain such a license. Thank you
very much for your continued cooperation in this matter, avd I look forward to

Subject: Baatd Actions of November 18,1986 rlth Recommendations
Your Advisory Planning Board considered three applications for
Uev by Exception, tro epplicationa for relief from the septic
tank moratorlu m, one subdivision rapist, and establishment of
zoning dietriets for Seminole Beach at its regular meeting of
November 18, 1986, and makes the folloring recommendations.
1. The Board recommends approval of en amended application for
Uee by Exception by Tom beet far a contractor rith no outside
storage in a Commercial General zoning district. Tne property le
located at 61-63 Meet Second Street.
2. The Board recommends approval of an application for Use by
Exception by Mini Storage Associates, LTD. to expand the existing
Meyport Mini Storage facility at 1650 Mayport Road. The
recommendation is eub~ect to installation of a 6' chador box
fence frith the moat aesthetic aide out), rlth three-2' insets,
end rith trees 3• in diameter planted in each Snaet; and sub,jeet
to there being no ingress or egress on Levy Road.
3. The Board recommends approval of a use by exception for a
church in an RG1A zoning district by Johnson Properties, Inc.
The property is located 1n the east half of the Snug Harbor
subdivision and Se bordered by Orchid Street, the Neet Plaza
drainage ditch, and Snug Harbor Court.
4. The Board recommends denial of a request for relief from the
septic tank moratorium by Raymond C. Flott for property located
at Block 138, Section H. Mr. Flott presented a salsa contract
thst ras executed prior to the date of the resolution. The
contract ras contingent upon the buyer obtaining septic tank
permits. The Board recemmende denial of the request due to the
hardship being of economic character. The Board also expressed
concern regarding the elevation of the property.

1. The undersigned, the City of Atlantic Beach,
Florida hereby acknowledges and consents to the
transfer by Narragansett of the Securities to
Monarch-Narragansett Corporation, a wholly-owned
subsidiary of Monarch Capital Corporation.
2. The undersigned hereby roof icros that the
Franchisee is the party named in the Franchise
and that the Franchise is in full force and
effect as of the date hereof.

ACKNOWLEDGEMENT AND CONSENT
WHEREAS, the undersigned City of Atlantic Heach,
Florida has been informed by Rifkin/Jacksonville
Associates, Ltd. ("Franchisee') that Narragansett Capital
Corporation ("Narragansett") through controlled
subsidiaries or partnerships hold 258 of the voting stock
of the General partner of the General Partner of the
Franchisee; and
WHEREAS, the undersigned City of Atlantic Beach,
Plorida has been informed that Monroe M. Rifkin ("RLf kin°)
holds 508 of the voting stock of the General Partner of the
General Partner of the Franchisee, and that through a
management agreement, Rifkin 6 Associates, Inc. which is
wholly-owned by Honroe M. RiEkln controls the management of
the day-to-day operations of the Franchisee; and
WNE REAS, Narragansett has agreed to sell all of
its assets, including the stock and other securities of the
entitles which hold the ownership interest in the
Franchisee (collectively, the "Securities") to Monarch-
Narragansett corporation, a wholly-owned subsidiary of
Monarch Capital Corporation, a pu611c company ("Monarch");
and
WHEREAS, the franchise ordinance (the
"Franchise") authorizing Franchisee to operate a cable
television business in the City of Atlantic Beach, Florida
requires the acknowledgement or consen[ of certain changes
in control and/or the ownership of the Franchisee; and
WHEREAS, the transfer of Securities by
Narragansett to the subsidiary of Monarch may require such
acknowledgement or consent; and
WHEREAS, Franchisee has requested the
acknowledgement and consent of the undersigned, the City of
Atlantic Beach, Florida to the transfer of the Securities
by Narragansett to Monarch in order to make certain that
Franchisee maintains in strict compliance with the terms of
its Franchise; and
WHEREAS, Rifkin 6 Associates, Inc, will continue
to manage the day-to-day operations of Pranchisee's cable
television system pursuant to a management agreement; and
WHEREAS, the undersigned, City of Atlantic Beach,
Florida is willing to grant such consent.

Les LeSlege, System Manager for Heaches Cable. The existing City
Ordinance granting [he non-exclusive franchise [o Beaches Cable provides
that transfer of ownership and control requires approval of [he CS[y of
Atlantic Beach, and the Ordinance further provides as you will note in
[iie letter, [ha[ ownership control includes the acquisition of more than
[en percent interest in [he grantee's voting stock. The letter is
self-explanatory, although somewhat confusing relative [o limited
partnerships and general partners, I believe 1[ will suffice to indicate
who[ [he cable company wishes [o have, and [hat Ss an acknowledgement
and ronsen[ [o [he assignment of the transfer of stock by a subsidiary of
Narragansett Capital Corporation to the subsidiary of Monarch Capital
Corporation. The annual report from Monarch was much too lengthy to
send along, but [here will be a copy of i[ aC the Nonday nigh[ meeting
if you wish [o take a look at it.
o The Advisory Planning Board met last Tuesday and makes the follow-
ing recoamendations [o the Ci[y Commission:
1. Approve application for exception from Tom Wes[ for a contractor's

Section H;
2. Approval of an application for exception filed by Ben Aronson for
mini warehouses in Section H directly vest of Hardee's, with the
provision [hat a six-foot shadow box fence be Constructed along
Levy Road with a five-foot buffer, and that trees be planted every
sixty fee[ along said fence;
3. Approve application for exception by Oceanside Church of Chris[ for
use of 50,000 square feet of property at the foot of West Eleventh
Street in Section li for a church;
4. Deny an application from Raymond Flot[ for approval of septic tanks
in Section N on a hardship basis;
5. Approve application of Mr. and Mrs. Terry Norton for septic tanks
in Section H, based on hardship;
(The Advisory Planning Board felt [he application of Mr. Flott
should be denied because it vas an eronomic hardship which is not
allowed under the Ordinance. They further felt the Norton applica-
tion should be approved because Mr. and Mrs. Norton were in
Louisiana working and had no knowledge of the moratorium Ordinance
byi~g under consideration. The Norton approval is subj ec[ to [hem
agreeing [a Cfe into [he sewer line when i[ becomes available and
abandoning the use of the septic tank).

o I[ appears [he Pension Board of Trustees may have [o be reorganized
under [he new statutes passed this year. City Attorney Mullis reported
[o the board a[ its last meeting and will 6e prepared [o inform the City
Commission Monday night. During [he last Pension Board meeting Tuesday
a week ago, discussion took place relative to a recommendation from the
board q~at pension benefits be increased. An impact statement using
1984 va lua[fon figures showed [tie cos[ of increasing pension benefits
from 2X to 2~ of salary would cos[ the City another $38,000 to $40,000
a year. Sfnce [he figures for this impact statement are almost three
years old, we would recommend that Gabriel, Roeder and Smith be
au[borized to update [he impact statement based on current valuation
figures before caking any action. We should be able to hear back from
[hem in time for the December 8 meeting. We await your pleasure.
o Please find enclosed a letter from Alan Jensen regarding Raymond
Dagley and the Special Use Ordinance adopted at the last meeting.
Please advise me if anyone sees anything in [his letter which is not in
accordance with the discussions.

The members of the board of directcrs of the Cloister
Condominium are wanting to change the entrance to the
complex from 10th street to Club Dr.
This was suggested to us for security purposes by the
Atlantic Beach Police officers who helped us with
security throughout the summer.
l'!e feel that changing the entrance would also im-
prove the aesthetics of the entire complex. We are
planning to begin major improvements in landscaping
and would like to include the entrance change into
them.
Please let us i.now what is necessary for this change
to take place.

Bobby Sturgen, Tom Meet Homes, Inc., stated that they were
requesting a use by exception for an automotive service garage
and a contractor with no outside storage in a CG zone et 61-63
Meet Second Street. The Board determined from visual inspection
of the premises that an automotive service garage is already in
business end that several abandoned/junked care were being
stared on the premises. After discussion, Ron Gray motioned to
defer the request end refer the matter to the proper department
for codes enforcement. Ruth Gregg seconded the motion which

public hearing.
o We are enclosing a proposed Ordinance closing and vacating Violet
S[ree[ running from the West Plaza drainage ditch south a des cauce of
320 feet. This is a dead-end street [o which no access could be ob-
tained, and vas a part of the Snug Harbor subdivision plat. The City
neglected [o close [he street in exchange for [he creation of the new
street which is a part of the subdivision plat. If you leave any
questions about this, call me.
o Our program to clean, televise, and seal same sections of sewer
collection lines in the older part of [he City is nearing completion.
Smith and Gillespie have submitted a proposed change order to add to [he
contract Additive Alternate No. 2 in fhe amount of $16,800.00, which
will provide for the sealing of the manhole walls in connection with [he
prof ec[. This item was anticipated in [he original bid and monies are
provided in the budget for same. We recommend its approval.
o We are enclosing a proposed Ordinance closing and vaca[in~ a
portion of Belvedere Street approximately 150 fee[ long, dead-ending
into [he shopping center containing [he J.E.A. and Tax Collector's
branch offices. We discussed [his at the last meeting and with your
concurrence, ve can incroduce tiles Ordinance and set it for public
hearing.
