[o increase [he retainer fee to $20,000 and relieve [he city and himself of

before, he agreed with [he proposal. Discussion followed on some of Nr. Nullis'
travel concerning the Fla. League of Cities meetings. Corn issioner '.4orris asked

more than one interest was represented. Mr. Mullis rssured Coruoissioner Morris

In reference to an article in the Tines Gn ion regarding [he budge[, Co!nissioner
Gul liford asked iE [he Police and Fire Departments would have impaired morale
if the proposed budge[ vas adopted. Chief Thompson said he did no[ feel his
department would have impaired morale whether [hey received [he additional
person or noc. He felt [he other items the Lordscion had approved for his
budge[ would cerca inly bolster their morale. Chief Royal said there would be
no impaired morale in his deoartmen[.

to use all Gorman-Rupp pumps. The original plans for the plant called
for Aurora type pumps which are generally used in eater plants. To [al

asked why he van [ed to change pumps. Mr. Fellows explained Aurota pump:
are typically used in a yell [o pump water and not necessarily waste
water. In waste water, you have a tendency [o get sand, grit, and mate-
rials you would not normally get ouc of a water yell. He said Gorman-
Rupp pumps would serve [he purpose better and would standardize [o havt
all Che same type of pumps.
Motion: Move to approve a change order for furnishing and
installing three (3) Gorman-Rupp pumps at [he effluent
pump station [reatmen[ plan[ in [he amount of $4,543.00.

present [heir proposed change order on [he 24" sewer ou[fall line.
Hr. Armentrou[ suemarized their proposed change order No. 1 [o install
class 50 Ductile Iron pipe in lieu of SDR 26 PVC pipe for [he Was[e-
vater facilities ou[fall force main. The to [al estimate of proposed
change order vas $183,629.50. He referred to Table III that summarized
changes and estimates of cos[(attached hereto and r..ade a part [hereof)
and said item 2 in [he anoun[ of $62,044.00 and item 3 in t}~e amount o
$1,800.00 were items representing changes [hat must be Lone regardless
of the change of materials based on the way [he contract was initial-
ly issued. Item 4. represented savings from using the existing pile
structures [he d[y recently acquired from 9uccaneer Service Company.
The credit vas fn [he amount of $27,159.00. Item 5 in the amount of
$146,944.50 vas the additional cos[ associated with the change of
materials. The contract vas initially awarded on [he basis of using
SDR 26 PVC pipe. }Ir. Armentrou[ recommend cd [he City Co _~ission approv
the use of Class 50 Ductile Iron pipe based on [he fact the internal
d iaret er of Che Ductile Iron pipe is larger than [he internal diameter

charges for all calls, etc. Mr. Fellows said he had prepared a letter of under-
standing with the City Attorney relative [o what the retainer would cover, and
he listed [he legal activ i[ies as follows: 1.) All regular and special meetings
of the City Commission including out of [own meetings as yell as all boards of
the CS[y reaues[ed by [he Commission, rfa yor and City !tanager; 2.) A11 phone
calls relating [o Ci [y business trom officials, depa rt men[ heads or citizens;
3.) The drafting of routine contracts, Ordinances and Resolutions; and 4.)
All legal opinions no[ requiring detailed research. Mr. Fellows expressed [he
opinion in [he long run the Ci [y would benefit from Che proposed new arrange-
ment and total budget was only $2,000 more in 85/86 Chan 84/85. He reminded [he
Commission, however, they had, the nigh[ before, voted to appeal the JE4 case
which could create some un-anticipated additional expenses.
Commissioner rb rris said he had requested from Mr. Mullis a detail of his ex-
penses over the last few months, as they were drastically increased over [he
last year. Mr. rtu llis detailed his travel and said rfr. Royal could furnish
detailed expenses. Discussion followed.

under the provisions of The Fla. League of Cities Municipal Loan Program. The
short term loan would be made in order Co not have to raise [he [axes, and could
be distributed over a period of time. 7'he ]0-year loan, in Che ar_ount of about
$700,000 would be to finance some of [he originally budgeted Capital I;.prove-
eents, including major construction improvements to the Public Safety Building.

thousand that vas charged in 84/85 to $1.9135 fiscal 85/86 which is the rolled

o Smith B Gillespie has asked for a position on the agenda Monday
nigh[ to discuss with the City Commission their proposal to change the
proposed regional outfall pipe from PVC to ductile iron. This will be
scheduled early on.
o At the last budget meeting, we learned [hat an additional police
officer had been included inadvertently in the proposed budget for the
upcoming year, and we have revised the budget to delete that personnel
request. A new Police Department budget is included therewith. This
should be inserted in your budget book. h~e are al=_o including a
breakout of Account No. 49, Other Current Charges, so the Commissioners
may determine what funds are included in this category. Please contact
me if you have ary questions about this.

BE IT ORDAINED BY THE CITY COl411 SSION OF TI1E CITY OF ATLANTIC
BEACH, FLORIDA:
Section 1. That the attached budget, incorporated and adopted
herein and made a part hereof as Ezhibit A, be and it is tiercby adopted
and approved by the City Commission of the City of Atlantic Beach,
Florida, as the budget for the City of Atlantic Beach for the fiscal
year 1985/86.
Section 2. That an ad valorem tax of $1.9535 per thousand
dollar valuation on all real and persona] property be levied within the
corporate limits of said City, provided however that said tax shall not
be levied upon property in the City of Atlantic Beach claimed and
allowed as homestead under the general laws of the State of Florida.
The millage approved herewith is the rolled back rate.
Section 3. That a tax of $.38 per thousand dollar valuation be
levied on all real and personal property within xhe corporate limits of
the City of Atlanric Beach including homesteads and the funds raised
therefrom used to pay interest and principal on general obligation bonds
maturing during the fiscal year, such levy to be collected in cash and
kept in separate accounts for the purposes designated in the bond
indenture.
Section 4. This ordinance is proposed; considered and adopted
under the provisions of Chapter 166 and 200.065 Florida Statutes.
Section S. This ordinance shall become effective October 1,
1965.

51 Nest 7th St. that was discussed aC [he last meeting. The City Manage
said he had asked [he Code Enforcement Officer Co check i[ out specifi-
cally. He found [he business is properly licensed and is operating
legally under the "grandfather' clawe of [he City Code.
Commmissioner Gulliford con,:.en ced he understood the sign a[ the Dough-
nut shop on Atlantic Blvd. had been knocked down due to an accident. Th
owner of [he shop told him the Building Inspuc [or had advised [hem [hey
could no[ rebuild the sign in its original Eorm according [o [he sign
Ordinance. Commissioner Cui lifo rd e::p ress ed the opinion [he original si ~n
looked better than the pile of rubble Lha[ was there now, and found i[
hard to believe the owners of the shop could not replace what [hey had
up with a sign of similar nature. The Ci[y :;a pager advised he was not

"I[ sounds discriminatory" Commissioner Cook said and added the Sea
Turtle Inn and Restaurant has served liquor and provided music by its
outdoor pool for years. Mayor Nowell agreed and said it smacks of being
extremely uncons[i[u[ional and discriminatory.
Fire Chief kayne Royal, also the Code Enforcement Officer said he and
[he Building Inspector had me[ with Mr. Baldwin on [he request by [he
City Clerk after he applied Eor his occupational license. After inspect
ing the building and patio, they told him [he patio was in violation of
the city's building and fire codes. He was instructed to close [he pa[i
until it was in compliance with the Codes. Mr. Baldwin s[a [ed when he
leased [he property, he assumed the structure me[ all city codes, and
had turned [he matter over [o his attorney. He added [hat an achi[ect
was drawing up plans [o enclose the outdoor patio and it should be
completed within six to seven weeks. He was asked if he planned [o
serve in the patio while i[ was under construe Lion, and ilr. ealdvin
said "he didn't know if he could of Co rd [o have i[ any other way. To
generate a winter business you must thrive during the suvmer, and that'
what I'm proposing to do. Quite honestly, 1 don't know if we would ^ake
i[ without the patio area."
Following discussion, Mayor Howell [old Mr. Ba ldvin that section 7-19
of [he Code provides [ha[ you may appeal any action taken by the Chief
of the Fire Department [o the City Commission within thirty (30) days

Mayor Novell also said [here were two conflicting Ordinances, one said
if you have an alcoholic beverage license you cannot provide musical

Mr. Louis MacDonell, 241 A[lan[ic Blvd.,Ne p[une Beach, representing
Harcourt Bull, III and William Bull, made a preliminary request con-
cerning a Planned Unit Deveiopr..ent project along Che I[h and 8th fair-
way on [he golf course. The PUD request was initiated in Ju 1}•, 1984. H

oriented with city affairs; identified the new transactions and grants
personnel and equipment. We will keep you advised
o The City Clerk has submitted for your consideration and approval a
list of Poll Workers for [he Municipal Election to be held on October 1,
1955.
o At your request, we have had prepared an ordinance to eliminate the
provision of the Code which prohibits music outside establishments
serving "booze". if in order, it may be introduced and set for public
hearing September 23.
o A copy of the proposed budget ordinance is included. We will
introduce this on Tuesday night if approved by the Commission.

o Don't forget we have a special meeting on Tuesday night, September
lU, 1985, at 7:15 PM, for purposes of holding our required public
hearing and adopting a tentative budget and proposed millage. This is
in accordance with the requirements of Chapter 200 Florida Statutes that
the public hearing be held on a Jate different than that of other Lazing
authorities, specifically the Duval County School System and the
Consolidated City of Jacksonville. Following the hearing, we will
introduce on firs[ reading the budget ordinance and set the final
hearing and adoption of the budget for the next regular meeting of the
City Commission which will he September 23.
Along that line, we arc including a copy of the revised budget
which incorporates changes which were discussed during the workshops.
These are:
Breaking out the proposed capital expenditures into
those proposed for acquisition through long term
financing and those proposed to be acquired through
operations. Two changes have been made in the
General Fund where we have eliminated resurfacing
of the tennis courts and have deleted for this
fiscal year the purchase of any computers for City
Ila ll. Ke have included the computer for the Police
Department.
Long Fi Associates of Ft. Lauderdale have completed their pay and
classification study for the City and we arc i,u hiding a copy for your
i nfotmat ion. On page 14, you will note the consultants recommend the
plan be implemented in two steps. In the revised budget we have
included sufficient monies to cover [he costs of this implementation
should the City Commission approve the budget as submitted. The total
cost to the City is approximately 7$, and this is possible since the
plan is being implemented throughout :hc budge: year instead of a total
impact on October I.
In accordance with other discussions at the workshops, we have also
revised the millage downward so that it is now set at 1.9535 which is
the rolled back millage. The only new money the City will receive,
therefore, is the $15,000 or so from new construction, renovations,
additions, etc. The entire budget will be up for discussion on Tuesday
night, September 10, 1985.
o It soon will be time for the City to consider undertaking the
construction of the westside force main and effluent pumps for Buccaneer
Water and Sewer District. Naitz F, Frye have completed the plans for
this project and we are currently working with the Buccaneer Management
Partnership to obtain these plans and present them to [he Commission for
their consideration in regards to advertising this project for
ronsLTUCLlen.
o Shortly after the Audget year gets going, we plan to begin
evaluating methods to be utilized in switching over to a Alen of cycle
billing for our water, sewer and sanitation bills. We think this will
provide a much more even cash flow and better utilization of our

o Five engineering firms indicated an interest in Acing considered by
the City for selection as project engineers in connection with the
dev clopment of a master plan for Section H. W'e arc submitting the
resumes of the three firms the admini st rativc staff determined to be
best qualified for this particular job. Each of the firms have been
asked to have a representative appear so [hc Commission will have an
opportunity to evaluate the personalities and capabilities of the
principals involved. Following presentation, it is my understanding the
City Commissioners will rank the three firms in order of priority and
proceed to negotiate a basis tior fee for the development of the master
plan.
o Everything is set for the City auction to be held at the Public
Works yard on Saturday morning, September 7th. I pass this along in
case any members of the City Commission wish to go down and observe the
activities.
o N'e will be asking the City Commission to approve the draft utility
service agreement submitted at the last meeting. N'e have attempted to
make corrections on the document wherever we had overlooked
typographical errors and unless someone has objections the agreement
should be approved so we can move on to provide a completed agreement to
the the Navy for furnishing water to the offbasc Mayport housing.
o This week the City received a rebate check in the amount of $2,578
from W'orkers' Compensation coverage under the Florida League of Cities
rebate plan. This rebate comes about as the result of the good loss
experience which is a result of very few worker injuries.
o Jay Bach, Jr., Vice President of Adjustco, and the person who
handles their casualty claims, has informed me the Federal District
Court suit regarding Frederick Lewis is not covered under the Adjustco
policy. He stated the actions occurred prior to the inception date of
the contract with the F1oriJa Municipal Liability Program and,
therefore, no coverage can be afforded.
