The applicants own three 50-foot wide by 102-foot deep lots on Main Street within the Section H subdivision. They wish to reconfigure the existing three lots to create two lots: one lot that is 85-feet in width and 8670 square feet in lot area, and the second lot with a width of 65-feet and 6630 square feet in lot area. Because one of the proposed lots does not comply with the minimum width and lot area, Staff cannot approve the proposed lot division unless the Commission grants a waiver to the subdivision regulations. The proposed lot reconfiguration is consistent with the Comprehensive Plan, and the resultant two lots will be larger than the typical 50-foot by 100-foot platted lot within the Section H subdivision. Further, the proposed lot reconfiguration will decrease density in that the property now consists of three platted lots of record, and a single-family residence could be constructed upon each existing lot. Accordingly, staff recommends approval of the subdivision waiver, subject to the property owners providing a new survey to the Community Development Director for approval in accordance with Section 25-189 (a) (4). BUDGET: No budget issues involved in this request. Exemptions from the requirement for approval and recording of a Final Subdivision Plat or Replat. (a) Building Permits may be issued following divisions of Land without the need for approval of a Final Subdivision Plat or a Replat only in accordance with each the following provisions. (1)The division results in no more than two(2)contiguous Lots or Parcels. (2)The resultant new Lots, comply with the Minimum Lot Area,Width and Depth, and access requirements of the applicable Zoning District,the Comprehensive Plan and all other applicable requirements of these Land Development Regulations. (3) The division and the resultant new Lots shall not create any Nonconforming Structures or any other Nonconforming characteristic. (4) Approval by the designated Administrative Oficial of a Certified Survey depicting the proposed new lots verifying compliance with the above requirements. Such Certified Survey shall be submitted to the City and approved prior to recording of a deed for transfer of ownership of Lands, and shall be recorded as an addendum to the deed. It shall be the responsibility of the property owner(s)to provide evidence of the approved Certified Survey along with any application for Building Permits. (b) Townhouses and residential Dwellings held in Fee-Simple Ownership. Townhouses and Two-family Dwellings,when divided in ownership, shall not constitute a division of Lands requiring approval of a Final Subdivision Plat or a Replat,provided that such Dwellings are otherwise in compliance with these Land Development Regulations and the Comprehensive Plan. Sec. 24-190. Multiple Lots and Parcels treated as a single Development Parcel. In the case where more than one Parcel, Platted Lot or Lot of Record has been combined and developed as a single Development Parcel, such Lots shall not later be developed as a single Lot, unless all requirements for Development as a single Lot shall be met, including but not limited to Impervious Surface Area limitations and provision of all Required Yards for all Structures. Sec. 24-191. Waiver. (a) General. Where the City Commission finds that undue hardship due to unreasonable practical difficulties may result from strict compliance with this Article, the City Commission may approve a waiver to the requirements of this Article if the waiver serves the public interest. (b) Conditions of waiver. An Applicant seeking a waiver shall submit to the City Commission a written request for the waiver stating the reasons for the waiver and the facts, which support the waiver. The City Commission shall not approve a waiver unless it determines as follows. (1) The particular physical conditions, shape or topography of the specific property involved causes an undue hardship to the Applicant if the strict letter of the Article is carried out. (2) The granting of the waiver will not be injurious to the other adjacent property. Courtesy of Floor to Visitors: • The Mayor appointed Commissioner Borno to head a committee to study the parking in the Town Center area and suggested he ask Councilman Graham,Neptune Beach officials and business owners to participate in the committee • Carolyn Ettlinger of Oceanside Rotary, said that the Rotary Club had volunteered to coordinate the fundraising for the skate park and hoped to raise $50,000 • Dorothy Kerber reported on an incident wherein two cats were killed by dogs and suggested that stiffer penalties be approved for such incidents; was opposed to a donation to the Beaches Resource Center Foundation(Agenda Item 9F); commented on an illegal campaign sign of Commissioner Waters • Stephen Kuti inquired whether Ordinance No. 90-03-183 (Agenda Item 8C) would have any impact on the number of parking space requirements and was advised that it would not •� Alan Potter commented on the recent death of Raymond Dagley and suggested the city recognize his involvement in the community,particularly with the Boy Scouts; complimented the Petticoat Company construction crews as being very courteous and considerate but noted that the catch basin at 386 2nd Street was higher than the street right-of-way; said he had made several comments in the past indicating that the culvert at Publix was too small, and the purchase of land for a retention pond would not be required if the culvert was enlarged. He said he had received no response from the City regarding his comments; noted that the Buccaneer water and sewer system was making a profit and did not think that utility rate increases were necessary. • J.P. Marchioli asked if the waiver of late fees proposed in ordinance No. 80-03-67 (Agenda Item 8D)would be a one time only or a once-a-year waiver; thought that many sidewalks were too narrow for two people to walk side-by-side comfortably; said he would like to see the drawings of the proposed expansion of City Hall as soon as they are available. • Bill Paulk, whose cat was one of the animals killed by the dogs, said he was not satisfied with the way the Police Department had handled the incident; commended the construction workers on Second Street and reported that they had assisted his elderly uncle when he was stung by yellow jackets • Brian Christy, said he was concerned for the safety of children waiting for the school bus in the vicinity of his business on Mayport Road and asked that the city contact the school board to see if the bus could be routed to pick the children up near Donner Park; noted that his property tax had increased and, in addition, it was expensive to comply with the upgrades required in the beautification of Mayport Road • Sylvia Simmons inquired regarding the status of the dogs that were involved in the attack and was advised that they had been picked up by Animal Control • Lincoln Price, owner of the dogs that had killed the cats, apologized for the incident and said he had taken the dogs as a favor to his aunt when his uncle passed away. He was trying to find homes for the dogs but had been unable to do so at the time the incidents occurred. He said the dogs had escaped from his back yard that had a six-foot fence. It was ` pointed out that the planning, designing and permitting was a lengthy process and the City Commission agreed that it would be advisable to keep someone like Kevin Bodge involved in the local beach renourishment projects • Bob Kosoy presented a status report on the Core City project and said the project was 90% complete and he expected it to be completed on schedule and within budget Commissioner Beaver: • Reported he had written letters to property owners who had experienced flooding before the Core City project and, so far,had received positive responses Commissioner Waters: • Commended the Police Department on the arrest of the suspect in the recent attempted abduction • Commended the Richardson family for their patience with the Core City project • Inquired regarding the decorative crosswalks and was advised they would be installed after the final paving 3 • Requested that business owners be involved in the solution to the Town Center parking problems The Mayor; • Reported he frequently sees unleashed dogs when he walks on the beach and thought the City Commission may wish to review the animal control ordinance.
