BACKGROUND: Attached is a proposed amendment (Ord. 25-04-36) adding
section (d) to ARTICLE III SECTION 8.33. This requirement
is a suggested change from FEMA to better protect flood prone
properties and to add additional points to the cities CRS
classification.
• The Building Department has been requiring this elevation
since 1994 as a policy.
BUDGET: No budget issues.

BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF THE PEOPLE OF
THE CITY OF ATLANTIC BEACH, FLORIDA:
~. SECTION 1. Chapter 8, Flood Hazard Areas, Article III, Flood Hazard Reduction Standards,
Sec. 8-33, of the Code of Ordinances of the City of Atlantic Beach, Florida, is hereby amended
to read as follows:
Section 8-33. Standards for streams without established base flood elevations and/or floodways
(a) When base flood elevation data or floodway data have not been provided in
accordance with Article 1, Section 8-7, then the local administrator shall obtain,
review, and reasonably utilize any base flood elevation and floodway data
available from a federal, state, or other source in order to administer the
provisions of Article III.
(b) In special flood hazazd azeas with base flood elevations (Zones AE) but without
floodways, no encroachments, including fill material or structures, shall be
permitted unless certification by a registered professional engineer is provided
demonstrating that the cumulative effect of the proposed development, will not
increase the water surface elevation of the base flood more than one foot at any
point within the community. The engineering certification should be supported by
technical data that conforms to standard hydraulic engineering principles.
(c) In special flood hazard areas without base flood elevation and floodway data, new
construction and substantial improvements of existing structures shall have the
lowest floor of the lowest enclosed area (including basement) elevated no less
than two (2) feet above the highest adjacent grade at the building site.
(d) A minimum finished floor elevation of one (1) foot above the crown of the
road of the nearest adiacent roadway shall be maintained in all flood zones
Section 2. This ordinance shall become effective immediately upon its final passage and
adoption.
