Ford, Building Official Re: New manufactured building at East Coast Greenery, Inc. Dear Don: As you know, East Coast Greenery, Inc. has installed a new manufactured building at its farm located at 1589 Main Street in Atlantic Beach. As you also know from my previous correspondence with you on this subject, all non - residential buildings at East Coast Greenery, Inc. are exempt from all requirements of the City Of Atlantic Beach building code. Florida Statutes §604.50, copy enclosed, provides explicitly that 604.50. Nonresidential farm buildings Notwithstanding any other law to the contrary, any nonresidential farm building is exempt from the Florida Building Code and any county or municipal building code. For purposes of this section, the term "nonresidential farm building" means any building or support structure that is used for agricultural purposes, is located on a farm that is not used as a residential dwelling, and is located on land that is an integral part of a farm operation or is classified as agricultural land under s. 193.461. The term "farm" is as defined in s. 823.14. (emphasis added). As I pointed out in my previous letter to you, Florida Statutes §823.14(3)(a) defines a farm as follows: (a) "Farm" means the land, buildings, support facilities, machinery, and other appurtenances used in the production of farm or aquaculture products. Farm products are defined by '5823.14(3)(c) as (c) "Farm product" means any plant, as defined in s. 581.011, or animal useful to humans and includes, but is not limited to, any product derived therefrom. (emphasis added). Section 581.011(26) defines "plants" as follows: (26) "Plants and plant products" means trees, shrubs, vines, forage and cereal plants, and all other plants and plant parts, including cuttings, grafts, scions, buds, fruit, vegetables, roots, bulbs, seeds, wood, lumber, and all products made from them, unless specifically excluded by the rules of the department. (emphasis added). Therefore, it is quite clear that the non - residential buildings and structures located at East Coast Greenery, Inc. are absolutely exempt from all building code requirements, whether they be requirements of the Florida Building Code, any county building code, or Atlantic Beach's building code. Because all of its buildings and structures are exempt from all building code requirements, East Coast Greenery, Inc. does not have to submit plans for review by your department, meet wind load requirements, or do anything else required by the City Of Atlantic Beach, except meet setback and use requirements of the zoning code, which it obviously does. Notwithstanding the exemption of East Coast Greenery, Inc.'s buildings and structures from the building code(s) enforced by the City Of Atlantic Beach, one of your subordinates came onto my clients property while you were meeting with my client's president and business manager yesterday, and wrongfully nailed a "stop work" order to the side of the newly installed manufactured building. The "order" stated that work must cease because general construction is not accepted .... ", and East Coast Greenery, Inc. must "have plans for building reviewed" by your department. The "order" was signed by "L. Higgins ", who purported to be an agent of your department. In nailing the "order to the hardy -Board siding, your subordinate damaged my client's brand new building, and caused a penetration of the building's skin, which will allow entry of water, and impair the insulation provided by the formerly sealed space between the siding and the interior walls. I'm guessing that L. Higgins must have been acting without your knowledge or authorization, but, nonetheless, he was acting or purporting to act as a City employee. Don, neither East Coast Greenery, Inc. nor I want to have to take the City to task over this apparently on -going refusal by the City building department to recognize the fact that Florida statutory law clearly provides that the City's building department simply has no authority to require anything of East Coast Greenery, Inc. concerning its buildings and structures, other than compliance with the zoning code's use and setback requirements. However, enough is enough. Please firmly instruct all of the employees and agents of the City Of Atlantic Beach's building department that all building codes and all sub -parts of all building codes (excepting only the use and setback requirements of the zoning code) cannot be enforced concerning East Coast Greenery, Inc.'s buildings and structures. Please also instruct them that if they continue to harass my client in an attempt to bully it into complying with their erroneous position that the building codes apply, my client will have no alternative but to seek injunctive relief in the Courts. Because the law is so patently contrary to the City's position, East Coast Greenery, Inc. should be able to recover its attorneys fees under Florida Statutes §57.105. That statute provides for payment of attorneys fees by the losing party when it knew or should have known that neither the material facts nor the substantive law applicable to those facts supported the loser's position. If the harassment ceases, my client will not seek recompense for the damage to its building. PLEASE don't make East Coast Greenery, Inc. have to file suit. A. § 604.50 FL ST § 604.50 END OF DOCUMENT FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS Manufactured Buildings Program PERMITTING MANUFACTURED BUILDINGS GUIDELINES 1999 These guidelines only pertain to manufactured buildings under Chapter 553, Part IV, F.S. Portions of the Florida Manufactured Buildings Act of 1979 Applicable to Permitting: 1. - -- no manufactured building - -- shall be installed in Florida unless it bears a state insignia of approval or, it is a custom or one -of -a -kind [553.37(9)], or open construction. Under these provisions, the buildings are subject to the local codes of the area they are installed 2. All manufactured buildings issued and bearing insignias of approval - -- shall be deemed to comply with the requirements of all ordinances or rules enacted by any local government which governs construction [553.37(3) FS]. 3. No manufactured building bearing department insignia of approval - -- shall be in any way modified prior to (initial) installation [553.37(4) FS]. 4. Manufactured buildings which - -- bear the insignia of approval - -- shall not require an additional approval or insignia by a local government in which they are subsequently sold or installed [553.37(5)]. 5. The department shall enforce every provision of this part and the rules adopted pursuant hereto, except that local land use and zoning requirements, fire zones, building setback requirements, side and rear yard requirements, site development requirements, subdivision control, and on -site installation requirements, as well as the review and regulation of architectural and aesthetic requirements, are specifically and entirely reserved to local authorities. Such local requirements and rules which may be enacted by local authorities must be reasonable and uniformly applied, and enforced without any distinction as to whether a building is a conventionally constructed or manufactured building. A local government shall require fees only for those inspections actually performed by the local government for the installation of a factory-built structure. Such fees shall be equivalent to the amount charged for similar inspections on conventionally built housing [553.38(2) FS]. New Buildings: All Department of Community Affairs (DCA) approved manufactured buildings comply with the same building codes most local governments in Florida have adopted to regulate conventional construction. Building plans are approved and the construction is inspected by an independent inspection agency under contract with the DCA. The department approves building plans and issue insignias to the agency. The application for the installation of a new building must contain plans bearing the agency approval stamp, manufacture's approval letter and energy code form. Each building bears state insignia which is evident it is approved by the state and is safe, sanitary and structurally sound. Buildines Bearing Florida Insignia: If the building has not been modified or use occupancy has not changed, the local building department should request original plans bearing the listing agency approval stamp. Upon receipt of the plan number and/or audit control number prefixed by letters M.B. on the state insignia, DCA will provide the original plans for a fee if the department has them. As a last resort, if the original plans are not available As- Built plans must be prepared under scenario (a) or (b). (a) State Recertified Building: As -Built plans must contain a listing agency approval stamp along with the plans examiner's stamp. The plans must also bear a raised seal of a Florida registered engineer or architect. (b) On Site Modifications: As- Built plans must bear the raised seal of a Florida registered engineer or architect. All work is subject to the locally adopted codes and must be inspected accordingly. The State insignia shall be removed and returned to the Department (Rule 9B- 1.011(7) F.A.C. Modification of Buildines: Off -site modification of used buildings bearing State insignias must be approved by the department and recertification insignias must be affixed [Rule 9B- 1.011(6)]. On -site modifications must be inspected by the local building official or may delegate this authority to the department in writing [Rule 9B- 1.011(7)]. See sample letter attached. Modified portion must meet current codes. School Buildings Recertification of: Relocatable buildings used in the public school system being modified away from the installation site must be inspected by an inspection/plans review agency under contract with the DCA. Modification of these buildings on site may also be inspected by an agency under contract with the DCA or local government (Rule 9B- 1.011(7) Buildings not Bearing Florida Insignia: In order to certify a manufactured building off site for which no state insignia has been issued, a complete set of as -built plans prepared and sealed by a Florida professional engineer or architect, must be submitted to an inspection/plans review agency under contract with the DCA, the entire building must be brought into compliance with the applicable codes, and inspected by the agency. The department shall issue a recertification insignia upon approval [Rule 9B- 1.011(6)(C)]. As an option the building must comply with the locally adopted codes of the area it is installed. East Coast Greenery, Inc. is preparing to commence construction of a new, non - residential farm building on its properties on Main Street in Atlantic Beach in the immediate future. I am writing this letter as a "heads up" so that your department personnel will be aware of the construction, and will know why no building permit was obtained regarding same. Florida Statutes Section 604.50 (copy enclosed) exempts from all building codes' requirement non - residential farm buildings constructed on farms. East Coast Greenery, Inc. is a farm, as same is defined in Florida Statutes Section 823.14(3)(a), in that it is engaged in the production of farm products. Florida Statutes Section 823.14(3)(c) defines "farm product" to mean any plant, as defined in s. 581.011, and includes, but is not limited to, any product derived therefrom. Florida Statutes Section 581.011(26) defines "plants and plant products" to mean all plants and plant parts, including cuttings, grafts, scions, buds, fruit, vegetables, roots, bulbs, seeds, wood, lumber, and all products made therefrom. Therefore, East Coast Greenery, Inc. is clearly a farm as defined by law, since it is engaged primarily in the production of plants and plant products. As a result, Florida Statutes Page Two December 16, 2002 Section 604.50 exempts any non - residential farm building at East Coast Greenery, Inc. from the Florida Building Code and from any county or municipal building codes. I enclose a copy of this statute herewith. Florida's Attorney General, Bob Butterworth, has stated in an opinion found at 2001 WL 1194681 (Fla. A.G.) that the effect of the foregoing statutes is to not only exempt non - residential farm buildings from any requirement that they meet the Florida Building Code or municipal or county codes, but that in addition, building permits are not required for such buildings. I enclose a copy of the Attorney General's ruling for your convenience. Because of the aforesaid laws, East Coast Greenery, Inc. will not be applying for a building permit regarding the imminent construction of its new, non - residential farm building, since same is not required. Florida Right to Farm Act (1) Short title. - -This section shall be known and may be cited as the "Florida Right to Farm Act." (2) Legislative findings and purpose. - -The Legislature finds that agricultural production is a major contributor to the economy of the state; that agricultural lands constitute unique and irreplaceable resources of statewide importance; that the continuation of agricultural activities preserves the landscape and environmental resources of the state, contributes to the increase of tourism, and furthers the economic self - sufficiency of the people of the state; and that the encouragement, development, improvement, and preservation of agriculture will result in a general benefit to the health and welfare of the people of the state. The Legislature further finds that agricultural activities conducted on farm land in urbanizing areas are potentially subject to lawsuits based on the theory of nuisance and that these suits encourage and even force the premature removal of the farm land from agricultural use. It is the purpose of this act to protect reasonable agricultural activities conducted on farm land from nuisance suits. (3) Definitions. - -As used in this section: (a) "Farm" means the land, buildings, support facilities, machinery, and other appurtenances used in the production of farm or aquaculture products. (b) "Farm operation" means all conditions or activities by the owner, lessee, agent, independent contractor, and supplier which occur on a farm in connection with the production of farm products and includes, but is not limited to, the marketing of produce at roadside stands or farm markets; the operation of machinery and irrigation pumps; the generation of noise, odors, dust, and fumes; ground or aerial seeding and spraying; the application of chemical fertilizers, conditioners, insecticides, pesticides, and herbicides; and the employment and use of labor. (c) "Farm product" means any plant, as defined in s. 581.011, or animal useful to humans and includes, but is not limited to, any product derived therefrom. (d) "Established date of operation" means the date the farm operation commenced. If the farm operation is subsequently expanded within the original boundaries of the farm land, the established date of operation of the expansion shall also be considered as the date the original farm operation commenced. If the land boundaries of the farm are subsequently expanded, the established date of operation for each expansion is deemed to be a separate and independent established date of operation. The expanded operation shall not divest the farm operation of a previous established date of operation. (4) Farm operation not to be or become a nuisance.- - (a) No farm operation which has been in operation for 1 year or more since its established date of operation and which was not a nuisance at the time of its established date of operation shall be a public or private nuisance if the farm operation conforms to generally accepted agricultural and management practices, except that the following conditions shall constitute evidence of a nuisance: 1. The presence of untreated or improperly treated human waste, garbage, offal, dead animals, dangerous waste materials, or gases which are harmful to human or animal life. 2. The presence of improperly built or improperly maintained septic tanks, water closets, or privies. 3. The keeping of diseased animals which are dangerous to human health, unless such animals are kept in accordance with a current state or federal disease control program. 4. The presence of unsanitary places where animals are slaughtered, which may give rise to diseases which are harmful to human or animal life. (b) No farm operation shall become a public or private nuisance as a result of a change in ownership, a change in the type of farm product being produced, a change in conditions in or around the locality of the farm, or a change brought about to comply with Best Management Practices adopted by local, state, or federal agencies if such farm has been in operation for 1 year or more since its established date of operation and if it was not a nuisance at the time of its established date of operation. (5) When expansion of operation not permitted.- -This act shall not be construed to permit an existing farm operation to change to a more excessive farm operation with regard to noise, odor, dust, or fumes where the existing farm operation is adjacent to an established homestead or business on March 15, 1982. (6) Limitation on duplication of government regulation. - -It is the intent of the Legislature to eliminate duplication of regulatory authority over farm operations as expressed in this subsection. Except as otherwise provided for in this section and s. 487.051(2), and notwithstanding any other provision of law, a local government may not adopt any ordinance, regulation, rule, or policy to prohibit, restrict, regulate, or otherwise limit an activity of a bona fide farm operation on land classified as agricultural land pursuant to s. 193.461, where such activity is regulated through implemented best - management practices or interim measures developed by the Department of Environmental Protection, the Department of Agriculture and Consumer Services, or water management districts and adopted under chapter 120 as part of a statewide or regional program. When an activity of a farm operation takes place within a wellfield protection area as defined in any wellfield protection ordinance adopted by a local government, and the adopted best - management practice or interim measure does not specifically address wellfield protection, a local government may regulate that activity pursuant to such ordinance. This subsection does not limit the powers and duties provided for in s. 373.4592 or limit the powers and duties of any local government to address an emergency as provided for in chapter 252. (2) "Aquatic plant" means any plant, including a floating, immersed, submersed, or ditch bank species, growing in or closely associated with an aquatic environment, and includes any part or seed of such plant. (3) "Arthropod" means any segmented invertebrate animal having jointed appendages and an exoskeleton, including insects, spiders, ticks, mites, and scorpions, but excluding crustaceans for the purpose of this chapter. (4) "Authorized representative" means any designated employee, inspector, or collaborator of the division or the United States Department of Agriculture. (5) "Certificate of inspection" means an official document stipulating compliance with the requirements of this chapter. The term "certificate" includes label, rubber stamp imprint, tag, permit, written statement, or any form of inspection and certification document which accompanies the movement of inspected and certified plant material and plant products. (6) "Certificate of registration" means an official document issued by the division to nurseries, stock dealers, agents, and plant brokers as evidence of being properly registered with the division in compliance with the requirements of this chapter and of any of the rules promulgated hereunder. (7) "Citrus" means all plants, plant parts, and plant products, including seed and fruit, of all genera, species, and varieties of the Rutaceous subfamilies Aurantioideae, Rutoideae, and Toddalioideae, unless specifically excluded by the rules of the department. (8) "Collaborator" means a person cooperating with the division in some capacity, who has been officially designated to perform certain duties for the division. (9) "Compliance agreement" means a written agreement between the department and any person engaged in growing, handling, or moving articles, plants, or plant products regulated under this chapter, wherein the person agrees to comply with stipulated requirements. (10) "Department" means the Department of Agriculture and Consumer Services of the state or its authorized representative. (11) "Director" means the director of the Division of Plant Industry. (12) "Distribution" means the movement of nursery stock from the property where it is grown or kept to any other noncontiguous property, regardless of the ownership of the properties concerned. (13) "Division" means the Division of Plant Industry of the Department of Agriculture and Consumer Services. (14) "Genetically engineered organism" means an organism altered or produced through genetic modification from a donor, vector, or recipient organism using recombinant DNA techniques. (15) "Move" means to ship, offer for shipment, receive for transportation, carry, or otherwise transport. (16) "Museum" means the Florida State Collection of Arthropods. (17) "Noxious aquatic plant" means any part, including, but not limited to, seeds or reproductive parts, of an aquatic plant that has the potential to hinder the growth of beneficial plants, interfere with irrigation or navigation, or adversely affect the public welfare or the natural resources of this state. (18) "Noxious weed" means any living stage, including, but not limited to, seeds and productive parts, of a parasitic or other plant of a kind, or subdivision of a kind, which may be a serious agricultural threat in Florida or have a negative impact on the plant species protected under s. 581.185. (19) "Nursery" means any grounds or premises on or in which nursery stock is grown, propagated, or held for sale or distribution, except where aquatic plant species are tended for harvest in the natural environment. (20) "Nurseryman" means any person engaged in the production of nursery stock for sale or distribution. (21) "Nursery stock" means all plants, trees, shrubs, vines, bulbs, cuttings, grafts, scions, or buds grown or kept for or capable of propagation or distribution, unless specifically excluded by the rules of the department. (22) "Official organ" means a printed document published by the division for notification to the public and industries in matters relating to division activities and in which official announcements may be made. (23) "Places" means vessels, railroad cars, automobiles, aircraft, and other vehicles; buildings; docks; nurseries; orchards; and other premises where plants or plant products are grown, kept, or handled. (24) "Plant broker" means a person who transacts the transfer of plants from a seller to a buyer and who may or may not be in actual physical possession of the plants. (25) "Plant pest" means any living stage of any insects, mites, nematodes, slugs, snails, protozoa, or other invertebrate animals, bacteria, fungi, other parasitic plants or their reproductive parts, or viruses, or any organisms similar to or allied with any of the foregoing, including any genetically engineered organisms, or any infectious substances which can directly or indirectly injure or cause disease or damage in any plants or plant parts or any processed, manufactured, or other plant products. (26) "Plants and plant products" means trees, shrubs, vines, forage and cereal plants, and all other plants and plant parts, including cuttings, grafts, scions, buds, fruit, vegetables, roots, bulbs, seeds, wood, lumber, and all products made from them, unless specifically excluded by the rules of the department. (27) "Quarantine" means an official order issued by the department that regulates the movement of articles, plants, or plant products to prevent the spread of disease or pests. (28) "Stock dealer" means any person not a grower of nursery stock in this state who buys or otherwise acquires nursery stock for the purpose of reselling independently of any control of a nurseryman, agent, or plant broker, and who at any time maintains physical possession of such nursery stock. Are building permits required for nonresidential farm buildings in light of section 604.50, Florida Statutes? 2. May the county require a zoning compliance permit under its land development regulations for nonresidential farm buildings? In sum: 1. Sections 553.73(7)(c) [FN1] and 604.50, Florida Statutes, exempt nonresidential farm buildings located on a farm from the Florida Building Code and any county or municipal building code, making building permits unnecessary for such buildings. 2. There is no statutory provision exempting non - residential farm buildings from compliance with county land development regulations; however, local governments are prohibited from adopting any ordinance, regulation, rule, or policy to prohibit, restrict, regulate, or otherwise limit the continuing agricultural use of any land currently engaged in bona fide production of a farm product. Question One Prior to the 1970's, promulgation and enforcement of building codes and standards were the responsibility of local governments. [FN2] In 1974, the Legislature established statewide standards known as the State Minimum Building Codes. [FN3] In 1998, as a result of a building codes study commission report suggesting the development of a single statewide building code, the Legislature created a statewide unified building code. [FN4] Part of the newly unified building code specifically addressed the exemption of certain buildings and structures from the code. Section 553.73(8), Florida Statutes (1998), stated: The following buildings, structures, and facilities may be exempted from the Florida Building Code as provided by law .. . * ** (c) Nonresidential farm buildings on farms." [FN5] During the same legislative session, section 604.50, Florida Statutes, was created to provide: 'Notwithstanding any other law to the contrary, any nonresidential farm building located on a farm is exempt from the Florida Building Code and any county or municipal building code. For purposes of this section "nonresidential farm building" means any building or structure located on a farm that is not used as a residential dwelling. Farm is as defined in s. 823.14." [FN6] Changes to section 553.73, Florida Statutes, during the 2000 legislative session, effective July 1, 2001, substituted "are exempt" for "may be exempt" for the enumerated buildings, structures and facilities exempted from the Florida Building Code. [FN7] The exemption for nonresidential farm buildings on farms remained intact. The Department of Agriculture and Consumer Services, however, was granted exclusive authority to adopt rules, pursuant to Chapter 120, Florida Statutes, providing "exceptions to nonresidential farm buildings exempted in paragraph (c) when reasonably necessary to preserve public health, safety, and welfare." [FN8] This office has been advised that no such rules have been adopted to date. *2 The exemption for nonresidential farm buildings from the Florida Building Code and any county or municipal building code in section 604.50, Florida Statutes, has been in existence since 1998. The amendments to section 553.73, Florida Statutes, during the 2000 legislative session, reiterated that such buildings are not subject to the Florida Building Code. Legislative intent controls the construction of statutes. That intent, however, is determined primarily from the language of the statute; thus, the plain meaning of the language used in the statute is the first consideration in the interpretation of a statute. [FN9] The plain language of sections 553.73(7)(c) and 604.50, Florida Statutes, exempts all nonresidential buildings located on a farm from state and local building codes. Thus, to the extent that the State Minimum Building Codes require an individual to obtain a permit for the construction, alteration, repair, or demolition of a building or structure, no such permits are required for nonresidential buildings located on a farm. [FN10] Question Two Section 823.14, Florida Statutes, the "Florida Right to Farm Act (act),' [FN111 recognizes the importance of agricultural production to this state's economy and that the "encouragement, development, improvement, and preservation of agriculture will result in a general benefit to the health and welfare of the people of the state.' [FN12] The Legislature also recognizes that agricultural activities conducted on farmland in areas that are becoming urbanized are potentially subject to nuisance lawsuits and that such suits may encourage or force the premature removal of farm land from agricultural use. The purpose of the act, therefore, is "to protect reasonable agricultural activities conducted on farm land from nuisance suits." [FN13] The act generally provides that a farm operation which has been in operation for at least one year and which was not a nuisance at the time of its established date of operation shall not be a public or private nuisance if the farm operation conforms to generally accepted agricultural and management practices. [FN14] However, an existing farm operation may not expand to a more excessive operation with regard to noise, odor, dust, or fumes, if it is adjacent to an established homestead or business. [FN15] Pertinent to your inquiry, section 823.14(6), Florida Statutes, provides: 'It is the intent of the Legislature to eliminate duplication of regulatory authority over farm operations as expressed in this subsection. Except as otherwise provided for in this section and s. 487.051(2), and notwithstanding any other provision of law, a local government may not adopt any ordinance, regulation, rule, or policy to prohibit, restrict, regulate, or otherwise limit an activity of a bona fide farm operation on land classified as agricultural land pursuant to s. 193.461, where such activity is regulated through implemented best - management practices or interim measures developed by the Department of Environmental Protection, the Department of Agriculture and Consumer Services, or water management districts and adopted under chapter 120 as part of a statewide or regional program.... " *3 The legislative history of this subsection states that the amendment to section 823.14, Florida Statutes, was to preclude a local government from adopting laws, ordinances, regulations, rules or policies to prohibit, restrict, regulate, or otherwise limit any continuing farm operation on any land currently engaged in bona fide production of a farm product. [FN16] Thus, a farming operation that falls within the coverage of section 823.14, Florida Statutes, would necessarily comply with the agricultural zoning classification of the land and would not be subject to county regulations or restrictions that attempt to limit such an operation. Zoning is intended to control development and land use, going beyond mere standards for the construction of buildings otherwise permitted under an existing zoning classification. [FN17] Encompassed in zoning are restrictions on the density of development and such simple restrictions as set- back lines for construction. Such ordinances, however, must be reasonable, uniform, certain and must supply sufficient standards. [FN18] Moreover, an ordinance establishing setback lines without regard to public health, safety, and general welfare would be an unreasonable exercise of police power. [FN19] You have advised this office that one of the primary concerns in determining whether a zoning compliance permit is required for nonresidential farm buildings is to assure that such construction complies with setback lines under the county's zoning plan. It would appear that a setback requirement would not necessarily limit a farm's operation and would, therefore, apply to such construction. In Attorney General Opinion 99 -18, this office was asked whether a county could enact zoning regulations affecting the placement of migrant farm worker facilities in residential areas, given section 381.00896, Florida Statutes, prohibiting discrimination in the development and use of such facilities. While this office recognized that the prohibition must be interpreted in a manner to carry out the Legislature's intent, it was found that the plain language of the statute would not preclude a county from lawfully exercising its zoning authority and enforcing its zoning regulations to limit migrant farm worker housing facilities to areas in which such use is permitted. The Legislature had not chosen to grant a blanket exemption for migrant farm worker housing when it could have easily done so. [FN20] Likewise, the prohibition against local ordinances that limit or restrict an activity of a bona fide farm operation on land that is classified as agricultural would not preclude application of zoning regulations that do not have such an intent or effect. Accordingly, it is my opinion that a nonresidential farm building would be subject to a zoning compliance permit to the extent such a permitting requirement does not prohibit, restrict, regulate or otherwise limit an activity of the farm.
