During that phone conversa- tion, I brought to your attention that Bud's Auto was also un- loading cars at the same location after 11:00 p.m.. M S Y N She asked for clarification on the use by exception. Mayor Howell said "suppose someone owned a going business on Mayport Road that was legal when he first opened the business. Then the zoning change was passed and made the business in that area illegal, but "grandfathered in ". If both Ordinances passed, that person would still be "grandfathered in" and could continue to operate. But if he applied for an exception, which would be allowed under the new Ordinance if it passed, then he would be totally "legal" and could improve his property, etc. If the person applied for the use by exception within 30 to 60 days, and the type of business he had was eligible for a use by exception, there would be no charge. Beyond that time, then you can still apply for an exception but a fee of approximately $200 will be charged. Mr. Mullis commented if those persons did not apply for an exception ' now,then five years down the road someone might challenge their right to continue the business because he never bothered to get an exception. He said if a person was "grandfathered in" and his business was 60% destroyed he could not rebuild, as the "grandfathered in" was a non - conforming use. This was another reason for applying for the exception. Mrs. Bratcher asked what the status of her home would be if the Ordinanze passed. Mayor Howell said single family residences would not be allowed a an exception under the new proposed zoning. There was a brief discussion between the Board members. There was no one present to object to the regiPst. Ron Gray motioned to reoanmend approval of the request. Guy Jennings seconded the motion which carried unanimously. �. C. Request for Use by Exception - 40 Mayport Road, Blocks 22A and 23, Section H; for used automobile sales in a CG district, by Larry Wilson. Mr. Wilson stated that he has already leased the property and that he was ready to open for business when he discovered the need to obtain a Use by Exception. He stated that he had cleaned -up the beer bottles from the lounge next door and that they were painting the building; he felt he could make the corner more attractive. Ron Gray felt Mr. Wilson should have written authorization from the owner of the property in order to regw st a Use by Exception. He motioned to recommend approval of the request subject to a letter of authorization from the owner being submitted. Chairman McCaulie addressed the items to be considered when reviewing a Use by Exception listed in Section 24 -63 of the Code. The Board had some concern regarding section 24 -63 of the Code and recommend- ed the Commission consider changing the section to provide some- thing for the landlord to agree to before the tenant was allowed to apply for a Use by Exception. The City Attorney said that any- -' thing affecting the use of a piece of property the city should make sure the request was applied for by the owner or an authori- zed agent if the Use by Exception was going to run with the land. On rezoning, the city requires the owner to apply. It was the consensus of the Commission the Ordinance should be amended to require the owner of the property or an authorized agent shall apply in writing for a Use by Exception. /"'' 3. Substitute Motion: The three recommendations by the Advisory Cook Planning Board of items 1, 2, and 3 be set for a Public Edwards Hearing on December 9, 1985 and acted on the same day. Gulliford x Commissioner Morris asked that item 2 be subject to receipt of Mr. Demetree's approval of the Use by Exception. Commissioner Gulliford changed his substitute motion to omit item 2 from the Public Hearing. Commissioner Morris then withdrew his original motion and Commissioner Gulliford withdrew his second to the motion. The substitute motion died for lack of a second. Mr. Taylor Bush, representing Stokes O'Steen, requesting an amend- ment to the planned unit development for Land Harbor. Mr. Taylor Bush, representing Stokes O'Steen, developers of Land Harbor offered copies of their revised layout necessitated after they discover- ed a large telephone easement running diagonally across the property that was missed on the title search. The Commission expressed concern of easements on lots 15 and 27. Mr. Bush explained they were maintaining minimum front and side yard set backs on all corner lots. Mr. Bush also proposed to reduce the easement of the 80' right -of -way to 50' and still maintain the 80' easement at the Mayport Road intersection. Commissioner Morris expressed concern over reducing the easement as children had to cross the bridge to go to school at the same time traffic would be heav, He also stated he wanted a sidewalk constructed as had been discussed with Mr. Bush during Advisory Planning Board meetings. Commissioner Morris reported the Advisory Planning Board recommended approval of the PUD plans subject to an 80' right -of -way at entrance and reminded the Commission there was only one ingress and egress to the property and that was the proposed bridge. Access to the weir was discussed at length as the city has to clean it out and control the drainage of the lagoon. Following discussion, Commissioner Gulliford moved for the following: Motion: Approve the plans subject to Stokes O'Steen resubmitting a Cook x x completed plan with sufficient identification to show the Edwards x 80'right of way carried east to the west bank of the creek, Gulliford x x and the .transition to 50' to take place at the west side of Morris x the creek and continue easterly into the development, and Howell x construction by the developer of a sidewalk on the side of the entrance road opposite to the side on which the weir is to be constructed. Footings shall be continuous monolithic concrete under exterior walls, reinforced with two 5/8" deformed reinforcing rods for one -story buildings and three 5/8" deformed reinforcing rods for two-story buildings. Reinforcing rods shall be placed in the lower one -third of the footings, properly placed and fastened on metal cables with wire.
