This facility has requested a Use -by- Exception to permit the storage of RV's and automobiles on their site. Inspection of the facility have found it to be well maintained and the proposed parking locations are already designated. RECOMMENDATION: The Community Development Board found that the conditions of the site and the requested use were similar to that of Pan Am Ministorage which was granted a Use -by- Exception several months ago. Application for Use -by- Exception filed by Mayport C & C Fisheries to store and rebuild pallets for use in shipping fresh seafood at property known as Lots 5, 6 and 7, Section H, on West 6th Street. Chip Glemstein, attorney for C & C Fisheries, introduced himself and the owner, Atillio Cerqueiro, to the board and stated that his client owned the three lots adjacent to his business and desired to use them to store and use wooden pallets in shipping his products. He stated that Mr. Cerqueiro would fence the property so the pallet storage would not be visible. After discussion Mrs. Gregg moved to recommend to the City Commission that the use -by- exception be granted for two of the vacant lots with the third lot to be used as a buffer zone for the residential area and the lots being used for storage be fenced in. Mrs. Pillmore seconded the motion and it passed by a vote of 3 - 2. II. Application for Variance filed by Jacqueline M. Moore to construct an addition to a residence that would encroach the front yard setback of property located at 1963 Colina Court. Bill Aldrich, introduced himself and the owner, Jacqueline Moore, to the board and stated they desired to construct an addition to the front of the existing garage that will encroach three feet in the front yard setback. He stated the addition would be used to park a third car and for a workshop area. After discussion Mrs. Pillmore moved to grant the variance. Mrs. Gregg seconded the motion and the variance was denied by a vote of 2 - 3. III. Application for Use -by- Exception filed by Janice M. Vrooman of Storage USA Realty, Inc., to allow storage and parking of boats, cars and RVs on property located at 1650 Mayport Road. Mrs. Vrooman introduced herself to the board and explained that the miniwarehouse had been storing vehicles on the site for a number of years and their company was notified by the City at the same time as Pan Am Mini Storage. She stated that the use -by- exception was needed to bring the property into compliance with City Codes. After discussion relating to the types of storage spaces being used, Ruth Gregg moved to recommend to the City Commission that the use -by- exception be granted subject to the same stipulations that applied to Pan Am. She added one item to the list and all of the stipulations are as follows: 1. The exception be granted to the present owners only and not to run with the land; 2. No storage of inoperable vehicles be permited at any time; 3. The exception be revoked upon the second conviction of the Code Enforcement Board; 4. That there be no outside repairs to vehicles. Mrs. Pillmore seconded the motion and the board voted unanimously to recommend to the City Commission that the use -by- exception be granted subject to the above stipulations. IV. Application for Use -by- Exception filed by Eugene W. Barnette, Sr., to allow the operation of an office for a building contractor at 447 Atlantic Boulevlard. Scott Barnette introduced himself to the Board and explained that the property would be used solely as a business office and there would be no outside storage of any kind. • After discussion Ms. Gregg moved to recommend to the City Commission that the use -by- exception be granted with the stipulation that there be no outside storage of construction materials, vehicles or equipment. Mrs. Pilimore seconded the motion and it passed unanimously. V. OLD BUSINESS: The board discussed the definition of the term "hardship" and its use in the granting or denying variances. Mr. Worley stated that in Section 24 -49 of the Zoning Code there is a list of findings of fact which describe the board's powers and duties. He stated that a possible definition existed by combining items 1, 2 and 4 of the findings of fact. The board also discussed amending the Application for Variance to better inform applicants of the rules by which they have to follow. VI. MISCELLANEOUS Mr. Worley told the board the the City Commission wanted to meet with the Community Developent Board on January 31, 1994. The general concensus was that the members present would attend the meeting. Mr. Worley asked that members McGowan and Simpkins contact the City Clerk before the end of the year regarding their intentions regarding reappointment to the board. The Chairmen reminded the Board that an election of officers would be necessary at the next regularly scheduled meeting and directed the Recording Secretary to place the item on the agenda. (a) Intent. The following additional standards and requirements shall apply to those lands within all Commercial Zoning Districts that are located along Arterial Street corridors within the City of Atlantic Beach. The intent of these additional requirements is to: enhance the aesthetic and physical appearance of these gateways into the City; enhance and retain property values; promote appropriate redevelopment of blighted areas; and to create an environment that is visually appealing and safe for pedestrians, bicycles and vehicular traffic. (b) Delineation of Commercial Corridors. Within the City of Atlantic Beach, Commercial Corridors shall be defined as the lands extending a depth of one hundred (100) feet from the outer edges of the right -of -ways along Mayport Road and Atlantic Boulevard, in those Zoning Districts designated as Commercial General (CG), Commercial Limited (CL) and Commercial, Professional Office (CPO). The Commercial Corridors shall also include the right -of -ways, and in the case of a single Development Project within the Commercial Corridor, which involves parcels contiguous to the defined Commercial Corridors, these requirements shall apply to all land that is part of such Development Project. (c) Building Form and Finish Materials. The following general provisions shall apply to all Development in the Commercial Corridors. (1) Roofs, which give the appearance of a flat roof from any street side of the building, are prohibited. Roofs may be gabled, hipped, mansard or otherwise designed so as to avoid the appearance of a flat roof from the adjoining street. (2) Open bay doors and other similar large doors providing access to work areas and storage areas shall not open towards or face the Commercial Corridors. (3) The exterior finish of new Buildings, and also exterior finish alterations and additions to the front and any street side, or any side visible from adjoining residential properties, of existing buildings shall be of brick, wood, stucco, decorative masonry, exterior insulation and finish systems (EIFS), architectural or split -face type block, or other finish materials with similar appearance and texture. Metal clad, corrugated metal, plywood or Oriented Strand Board (OSB), and exposed plain concrete block shall not be permitted as exterior finish materials on the front and any street side of a Building. (4) Blank exterior walls facing the Commercial Corridors, which are unrelieved by doors, windows and architectural detail, shall not be permitted. (d) Signs. Signs shall be regulated as set forth within Chapter 17 of this Code, except that externally illuminated Monument Signs are encouraged. To encourage the use of such Signs, those Signs constructed of a solid material such as wood, masonry or high - density urethane, and externally- illuminated in a manner that washes the Sign in indirect light from a fluorescent ground source shall be entitled to a fifty percent (50 %) reduction in Sign Permit fees. (e) Lighting. Exterior lighting shall be the minimum necessary to provide security and safety. Direct lighting sources shall be shielded or recessed so that excessive light does not illuminate adjacent properties. Light poles with luminaire that automatically cut -off after normal business hours is encouraged. Light poles without cut -off luminaire shall not exceed fifteen (15) feet in height. Light poles with cut -off luminaire shall not exceed twenty (20) feet in height. Proposed lighting shall be shown on all plans submitted for review. Ordinance Number: 90 -01 -172 Effective Date: January 01, 2002 Adopted: November 26, 2001 80 with Amendments through March 24, 2003 (f) Fences. The use of chain link, barbed wire, razor or concertina wire, and like fencing shall be prohibited in any Required Front Yard and in any Required Yard adjoining a Street. Where such fencing is otherwise placed on a Parcel, but remains visible from the Commercial Corridor, landscaping shall be installed which substantially conceals such fencing. Where such fencing, as described above is lawfully pre- existing, a period of four (4) years from the effective date of these regulations shall be extended during which all fencing shall be made consistent with the above provisions. (g) Landscaping and Required Buffers. The requirements of Division 8 of this Chapter shall apply, except that the following additional requirements shall also apply to new Development and to redevelopment that is subject to the requirements of Division 8. Required buffers and landscape materials shall be depicted on all plans submitted for review. (1) A ten (10) foot wide Buffer shall be required along the entire Parcel frontage of the Commercial Corridors, except for driveways. This buffer shall consist of Trees as required by Division 8 and shall also contain a continuous curvilinear row of evergreen shrubs not less than two (2) feet in height at installation. Buffers shall be kept free of debris and litter and shall be maintained in a healthy condition. (2) Along the front of the Principal Building, a six (6) foot wide area shall be maintained between the Building and the parking area or any walkway. This area shall be use for landscaping. (3) Sod or ground cover shall be installed and maintained in a healthy condition. Only organic mulch shall be used, and the excessive use of mulch is discouraged. (4) Because of the harsh environment of the Commercial Corridors, the use of landscape materials that are drought and heat resistant is strongly encouraged. Unhealthy or dead landscape materials, including sod and ground covers shall be replaced within thirty (30) days of written notification from the City to the property owner. Sec. 17 - 6. Signs permitted within Commercial and Industrial Zoning Districts. (a) Subject to the provisions as set forth within this Section, the following Signs shall be permitted within Commercial Professional Office (CPO), Commercial Limited (CL), Commercial General (CG), Central Business District (CDB) and Industrial, Light and Warehousing (ILW) Zoning Districts. Except as specifically exempted in Section 17 -3, and further subject to issuance of a Sign Permit, no other Sign or advertising device shall be displayed or erected within the City of Atlantic Beach. (1) Fascia Signs for Buildings with a single business or occupant. i. Size permitted: One (1) square foot of Sign Face Area for each linear foot of the Building width that faces the front of the Lot, as defined Section 24 -17 of this Code, provided that no single Fascia Sign on any one side of a 9 Building shall exceed sixty (60) square feet of Sign Face Area. (For example, if the width of the Building facing the front of the Lot is fifty (50) feet wide, the maximum total Sign Face Area for all Fascia Signs is fifty (50) square feet.) ii. Number of Fascia Signs permitted: Not more than three (3) Fascia Signs shall be allowed on any one side of a Building. Where Fascia Signs are placed upon more than one side of the Building, the combined Sign Face Area, shall not exceed the amount permitted by subparagraph (1)i. above. (2) Fascia Signs for Buildings with multiple businesses or occupants. i. Size permitted: One (1) square foot of Sign Face Area for each linear foot of the unit(s) occupied by one business or occupant, provided that no such Fascia Sign shall exceed forty -eight (48) square feet of Sign Face Area for any one business. (For example, if the width of a unit or several units, occupied by one business is twenty -four feet, then one Sign, a maximum of twenty -four square feet of Sign Face Area is permitted.) ii. Required spacing between Signs on Buildings with multiple occupants. Fascia Signs for different occupants shall be separated by a minimum distance or thirty-six (36) inches. (3) In lieu of the above - described Fascia Signs, a business or authorized Use may install a single Bracket Sign or a single Marquee Sign in accordance with the following provisions. i. Size permitted: The maximum size of a Bracket Sign or a Marquee Sign shall be determined in the same manner as a Fascia Sign, provided that no such Sign shall have more than sixty (60) square feet of projected Sign Face Area. ii. There shall be not more than twelve (12) inches of clear space adjacent to the Building wall, and such Signs shall not extend or project from the face of the Building more than ten (10) feet. iii. No portion of such Sign shall extend above the height of the roof. iv. No portion of such Sign shall be closer than eight (8) feet to any sidewalk or pedestrian walkway, and no closer than five (5) feet from any Street side property line. All such Signs shall be securely anchored to a wall and shall in no manner be connected to or suspended from the roof of any Building. (4) Freestanding Signs. In addition to the above Signs, Freestanding Signs may be erected as set forth below: 10 i. Size Permitted: Freestanding Signs, including Pole, Pylon and Monument and Ground type Signs shall be limited to one (1) square foot of Sign Face Area for each linear foot of frontage of the Development Parcel on which the Sign(s) are placed, provided no such Sign shall exceed eighty (80) square feet of Sign Face Area. ii. Permitted Height of Freestanding Signs. For the following Zoning Districts the maximum Height of Freestanding Signs shall be: a. Commercial Professional Office (CPO): Eight (8) feet. b. Commercial Limited (CL): Eight (8) feet. c. Central Business District (CDB): Eight (8) feet. d. Commercial General (CG): Eight (8) feet. e. Industrial, Light and Warehousing (ILW): Eight (8) feet. iii. Permitted Width of Freestanding Signs. The maximum width of Freestanding Signs in any Zoning Districts shall be ten (10 Feet). iv. Number of Freestanding Signs Permitted: a. On a Development Parcel with frontage upon a single Street, one Freestanding Sign shall be permitted. b. On a Development Parcel that has frontage upon more than one Street, one Freestanding Sign shall be permitted on each street side of the Development Parcel, provided that such secondary Freestanding Signs shall be limited to fifty percent (50 %) of the maximum size and height as allowed by paragraphs i. and ii. above. v. Required distance from property lines: No portion of any Freestanding Sign shall be located closer to the property line than five (5) feet. Freestanding Signs shall not be located so as to interfere with clear vehicular or pedestrian sight distance. Signs determined by the Director of Public Works to interfere with safe sight distance for pedestrians or vehicles shall be immediately removed. (b) Requirement for a Unified Sign Plan. After the initial effective date of these regulations, all new non - residential Development, which shall contain space or units for more than one business or occupant, shall provide a Unified Sign Plan with the application Building Permits. All subsequent applications for Sign Permits shall comply with the approved Unified Sign Plan. The Unified Sign Plan shall comply with the provisions of this Chapter and shall also demonstrate a consistent theme and design with respect to each of the following: (1) Manner and type of construction, including materials to be used, installation method and mounting details; (2) Means of illumination, if any, and hours of illumination. (3) Size, color, lettering and graphic style. 11 (c) Pre - Development Signs. Signs for the purposes of announcing a coming Development project may be placed within Commercial and Industrial Zoning Districts subject to the following provisions. (1) Issuance of a Sign Permit shall be required, and no such Sign shall remain on any Development Parcel for a period of time exceeding one year from the issuance date of the Sign Permit. (2) Complete and proper applications for Building Permits for the related Development project must be submitted within sixty (60) days of the placement of any such Sign, or the Sign shall be removed. In the case that the Sign is not removed, the Sign shall be considered an Abandoned Sign, subject to the provisions of Sec. 17 -10 (c). (3) Such Sign shall be removed within thirty (30) days of the issuance of any Certificate of Occupancy, or at any time when construction ceases for a period of time longer than thirty (30) consecutive days. In the case that the Sign is not removed within these periods of time, the Sign shall be considered an Abandoned Sign, subject to the provisions of Sec. 17 -10 (c). (4) Only one such Sign shall be placed upon the Development Parcel and shall not exceed the height or size as permitted by preceding paragraph (a). (d) Within non - residential Zoning Districts, one (1) Sign per Lot or Development Parcel advertising the sale or lease or the property limited to eight (8) feet in height and a maximum of twenty - four (24) square feet of Sign Face Area. A Sign Permit shall be required for such Signs, and these Signs shall be removed within ten (10) days of sale or lease of the property. (e) Requirement to display Street number. All business and activities regulated by the requirements of Section 17 -6 shall display the Street number in a manner that is prominent and clearly readable to vehicular and pedestrian traffic, as appropriate. Street numbers shall be displayed on all Freestanding Signs and over front doors or primary entryways. Sec. 17 -7. Signs within Special Purpose (SP) and Planned Unit Development (PUD) Zoning Districts. The size, height, width and number of Signs permitted within Special Purpose Districts and Planned Unit Development Districts shall be established within the ordinance creating such District as determined by the City Commission to be appropriate for the nature and character of the use within these Districts. 12 Sec. 17 -12. Prohibited Signs and Devices. The following Signs and devices shall be prohibited within the City of Atlantic Beach. In the case of any conflict with other provisions of this Code, the prohibitions set forth below shall supersede such other conflicting provisions. (1) Animated Signs. (2) Automatic Changeable Message Device Signs, except for Signs depicting time and temperature. (3) Flashing Signs. (4) Signs containing beacon or tracker lights or similar lighting components. (5) Signs containing fluorescent colors or materials designed to be mirror -like or reflective. (6) Obscene Signs. (7) Roof Signs. (8) Snipe Signs. (9) Portable and mobile Signs. (10) Temporary Signs, except as otherwise authorized herein. (11) Pennants, ribbons, balloons, streamers, wind - operated devices and similar elements that are intended to draw attention to a business or activity, either when used alone or incorporated into a Sign. (12) Vehicle Signs. (Bumper stickers, decorative decals and the like, customary and registered logos, trademarks or service marks that are attached to a motorized vehicle shall not be considered as Vehicle Signs; however, such vehicles shall not be parked off of the property from where a business is located or in the Required Front Yard of any property for the sole purpose of advertising.) (13) Private Signs on any public property, other than as specifically approved by the City Commission. (14) All Signs prohibited by Chapter 479.11, Florida Statutes. (15) Signs not in compliance with all applicable provisions of this Chapter and this Code. Sec. 17-13. Reserved. ARTICLE V. NONCONFORMING SIGNS AND WAIVER TO CERTAIN PROVISIONS Sec. 17 -14. Nonconforming Signs. All Signs, which were lawfully in existence and constructed or installed with properly issued Sign Permits as of the effective date of these amended regulations, and which are made nonconforming by the provisions herein shall be allowed to remain in accordance with the following conditions: 15 (1) Freestanding Signs, permitted pursuant to Section 17 -6, made nonconforming upon the initial effective date of these amended regulations, which are not in compliance only with respect to the minimum required distance of five (5) feet from any property lines shall be allowed to remain in the existing location provided that no portion of the Sign is located within any publicly owned right -of -way or utility easement and that no interference with clear sight distance exists, and further provided that such Signs are otherwise in compliance with the terms of this Chapter. (2) Freestanding Signs, permitted pursuant to Section 17 -6, made nonconforming upon the initial effective date of these amended regulations, which are not in compliance with respect only to maximum width, height or size shall be allowed to remain, provided that such Signs are otherwise in compliance with the terms of this Chapter. (3) Nonconforming Signs, including those as described in preceding paragraphs (1) and (2) shall be made conforming with all provisions of this Chapter when any of the following changes are made: i. Any change to the structural supports or structural materials, including temporary relocation associated with routine maintenance of a property. ii. Any change which increases the illumination. iii. Any change which increases the height of a Sign. iv. Any change, which alters the material used for the Display Area or Face Area by more than twenty -five (25) percent. v. Any replacement required as the result of an accidental act or a weather related act. vi. Any replacement of an Abandoned Sign. vii. Any change necessary for compliance with Florida Building Code requirements. (4) The provisions of this Section shall not be construed to apply to Signs that are abandoned, deteriorated, dilapidated, or in a general state of disrepair, or which are determined to create a hazard to public safety. Such Signs shall be subject to the provisions of Section 17 -10. (5) Notwithstanding the preceding provisions of paragraphs (1) through (4), all Signs permitted within Commercial and Industrial Zoning Districts, pursuant to Section 17 -6 of this Chapter, shall be made to conform with the provisions of this Chapter, as may be amended, within ten (10) years of the initial effective date of these regulations as enacted by Ordinance Number 60- 02 -12, which date shall be September 09, 2012. Sec. 17 -15. Requests to waive certain terms of this Chapter. Requests to waive terms of this Chapter may be made upon specific application to the City Commission, with proper public notice required, provided that no waiver shall be requested that would allow a Prohibited Sign, or any otherwise unlawful Sign. The applicant requesting such waiver shall have the burden of demonstrating the need for the requested waiver, and that the waiver is not in conflict with the Intent of this Chapter. Request for Plat Approval - Sam Waters Mr. Waters, 1202 North 21st Street, Jacksonville Beach, stated that he wished to plat the property into 6 duplex lots, each 75' x 100', with an 80' x 225' tract in the center for drainage /retention. The property is located in the Lewis Subdivision between Church and Stewart Streets. Mr. Waters stated that he would maintain ownership of the lots and the retention area. The Board expressed concern over maintenance of the retention area. Ron Gray motioned to defer action on the request and refer it back to City Hall for additional concept review. Ruth Gregg seconded the motion. Mr. Johnny Tucker, 42 Eleventh Street, spoke on behalf of Mr. Waters. The Board recommends approval of an amended application for Use by Exception by Tom West for a contractor with no outside storage in a Commercial General zoning district. The property is located at 61 -63 West Second Street. 2. The Board recommends approval of an application for Use by Exception by Mini Storage Associates, LTD. to expand the existing Mayport Mini Storage facility at 1650 Mayport Road. The recommendation is subject to installation of a 6' shadow box fence (with the most aesthetic side out), with three -2' insets, and with trees 3" in diameter planted in each inset; and subject to there being no ingress or egress on Levy Road. 3. The Board recommends approval of a use by exception for a church in an RG1A zoning district by Johnson Properties, Inc. The property is located in the east half of the Snug Harbor subdivision and is bordered by Orchid Street, the West Plaza drainage ditch, and Snug Harbor Court. 4. The Board recommends denial of a request for relief from the septic tank moratorium by Raymond C. Flott for property located at Block 138, Section H. Mr. Flott presented a sales contract that was executed prior to the date of the resolution. The contract was contingent upon the buyer obtaining septic tank permits. The Board recommends denial of the request due to the hardship being of economic character. The Board also expressed concern regarding the elevation of the property. • 5. The Board recommends approval of a request for relief from the septic tank moratorium by Terry Norton for property located at Block 217, Section H. Although living in another state, the Norton's had owned the property for several years. They recently (within 15 days) moved back to the area to build their home on the property when they learned of the moratorium. They had made arrangements to live with local family members until they completed construction of their home. The Board felt the Nortons are suffering a hardship and recommends approval subject to them tying into city sewer when it becomes available and complying with all rules and regulations in effect at the time; and that the well and septic tank be for the Norton's private use only. 6. The Board studied the proposed zoning classifications of the Seminole Beach area and determined that the plan was consistent with the Land Development Code and the Comprehensive Plan. The Board recommends that the proposed zoning classifications be adopted for the Seminole Beach area.
