Dear Mr. Moss:
As requested, we have reviewed the revised site plan and drainage design
for the above referenced project and again recommend disapproval for
the following reasons:
a. Soil borings should be submitted in the pond area to verify
groundwater elevations and anticipated percolation rates.
b. The pond discharge control structure should be either a
City of Jacksonville "Type C" of "Type E" grate inlet
modified with a slot in one side.
c. The existing concrete flume from the parking lot to the
ditch should be removed.
d. The area directly behind the curb should be grassed, not
paved as called for on the plans.
e. The bottom of the retention pond should be located either
12" above the ground water elevation or 6' below the ground
water elevation, not 1' below the water table as shown.
f. The entire pond area including all side slopes and bottom
area should be solid sodded.
Also, we are returning the D.E.R. application to the engineer since the
City is not responsible for making application and since the applica-
tions must be signed and sealed by the engineer.

This letter acknowledges your Notice and attachments received
on August 21 , 1984 for a proposed stormwater disposal system
for the subject project.
Since the proposed stormwater disposal system will provide for
retention of the first one-half inch of runoff for a project of
2 . 6 acres , it appears that Auto Storage Center Expansion , 1768
Mayport Road, Atlantic Beach, is exempt from this Department' s
stormwater permitting requirements in accordance with Florida
Administrative Code (FAC) Rule 17-25 . 03 ( 2 ) (b) provided there
will be an entity responsible for maintenance of the system.
Any modification to the plans for this stormwater system should
be submitted to this office for review. Future permitting may
be required should the current proposal for this system be
significantly modified.
Special consideration must be given to the control of
sediment-laden runoff resulting from storm events during the
construction phase. Best management practices erosion controls
should be installed early during the construction period so as
to prevent the transport of sediment into surface waters which
could result in water quality violations and Departmental
enforcement action. Revegetation and stabilization of
disturbed areas should be accomplished as soon as possible to
reduce the potential for further soil erosion . Should
construction phase runoff pose a threat to the water quality of
state waters , additional measures such as treatment of
impounded runoff or the use of turbidity curtains ( screens ) in
on-site impoundments shall be immediately implemented with any
releases to state waters to be controlled.

In accordance with FAC Rule 17-25 . 03 (2) , an engineer must
provide the Department with certification that the completed
new facility has been built to meet the appropriate exemption
criteria. Page 4 of the Notice form should be returned to
this office within 14 days after construction is completed.
An exemption from this Department' s stormwater permitting
requirements does not in any way preclude this project from
any county, municipal, federal or other state regulation prior
to construction .
It is suggested that the St. Johns River Water Management
District be contacted concerning this project in view of the
adoption of their Rule 40C-4 , Management and Storage of
Surface Waters .
The Department retains authority under Chapter 403, Florida
Statutes, to take appropriate legal action when necessary to
prevent a violation of Department standards and rules .

above referenced project. We recommend the plans be dissapproved for
the following reasons:
a. The design high water level in the retention pond requires
approximately 40% of the parking area to be under water
before discharge occurs.
b. A piped outfall should be installed in place of the existing
spillway.
c. The retention pond should be designed with 12" of freeboard
between the design high water and the top of bank.
d. Soil borings should be submitted in the pond area to determine
existing groundwater elevations and anticipated percolation
rates.
Also, we are returning the DER application to the engineer since the
City is not responsible for making application and since they must be
signed and sealed by the engineer.
