Pursuant to these conditions, the Applicant returns to the City Commission to request that the existing sign be permitted to remain for a period not to exceed four years at which time the hotel will be converted to a Quality Inn, with a new sign that will comply with the current sign regulations. This 4-year time period would still bring this sign into compliance sooner than the September 09, 2012 date when all nonconforming signs must be brought into compliance. BUDGET: No budget issues. RECOMMENDATION: Consider request to extend previously approved Sign Waiver for a period of time not to exceed four(4) years,which date shall be June 25, 2011. Our purpose is to propose an Agreement between the City of Atlantic Beach and the Comfort Inn-Mayport(the "Agreement") for a period of four years. In accordance with an existing contract with Choice Hotels International,the Comfort Inn—Mayport will be changing from a Comfort Inn to a Quality Inn no later than four years from now. In the Agreement with the City of Atlantic Beach,we would propose that the existing Comfort Inn sign be allowed to remain as it currently exists until the franchise is changed to a Quality Inn. That event will occur no later than four years from now. At such time, the existing Comfort Inn-Mayport hotel will be completely renovated and refurbished and will become a Quality Inn. The hotel will fully comply with all sign ordinances in existence at the time of conversion. Thank you for your assistance with this matter. SUBMITTEDBY: Sonya Doerr, AICD Community Development Director DATE: October 30,2006 BACKGROUND: Section 17-51 (3) iv. of the Sign regulations requires that non- conforming signs be brought into compliance with the current regulations when the alteration to a sign involves: Any change, which alters the material usedfor the Display Area or Face Area by more than twenty-five (25)percent. The Comfort Inn,located at 2401 Mayport Road, has requested a waiver to the above provision. to allow for face replacement after the existing sign face was damaged by hurricane winds two years ago. The owner of the Comfort Inn applied for a sign permit last summer to replace the sign faces, and was advised of this provision at that time. The owner was also aware that a corporate logo change was pending, and delayed any further immediate action related to the sign. The owner has informed staff that Choice Hotels, the corporate management for Comfort Inns, now requires that the damaged sign be repaired and replaced with the new corporate logo for the hotel chain, or risk revocation of the franchise. The only proposed changes to the existing Comfort Inn sign are replacement of the two acrylic faces (see attached), an upgrade to the lighting assembly which surrounds the internally illuminated sign, and repainting of the existing pole. Four waivers to the face replacement provision have been requested since the sign regulations were re-written in 2002. Requests from two fuel/convenience markets (the BP station located. at 1211 Mayport Road and the Valero at 1480 Mayport Road) requested full face replacement when those businesses changed ownership. Those requests were denied, and the two new signs were constructed to conform to the sign regulations. A third waiver was approved for Pan.Am Mini-Storage at 23$3 Mayport Road to permit face replacement after that sign face was damaged by a gunshot, with.notice to the business owner that all signs are required to comply with current sign regulations by September 09, 2012. Request from the Comfort Inn located at 2401 Mayport Road to allow for full sign face replacement on a nonconforming pylon sign Ms. Doerr referred to her staff report and explained the background on the item. John Shay,2401 Mayport Road, applicant(accompanied by Sarah Tafee, General Manager of Comfort Inn and his daughter,Anna Shea, Attorney from Rogers Towers)gave an overview of the background and explained his reasons for requesting a waiver. He pointed out the need to repair or replace the sign before December 31" in order to keep his current franchise. Commissioner Borno asked for clarification that his franchise will expire in four years and will change from Comfort Inn to a different hotel chain. Mr. Shea confirmed and explained he will then become a Quality Inn and the sign will be torn down and replaced with a conforming sign. Further discussion ensued. Motion: Grant a waiver from the Sign regulations to allow full replacement of the material used for the Sign Face Area on an existing Nonconforming Sign for the Comfort Inn located at 2401 Mayport Road to expire on December 1,2010. Motion by Borno MOTION DIED (due to a lack of a second). Motion: Deny the request for a waiver Moved by Waters, seconded by Fletcher Discussion ensued regarding whether the sign could be lowered to comply with the city ordinance and still satisfy the franchise requirements. It was determined that landscaping and structural changes would have to be done in order to bring the sign into compliance and be clearly visible from the street. Anna Shea explained the Quality Inn logo sign is square and the Comfort Inn sign is rectangular and would require a completely separate and different monumental sign. She reiterated Mr. Shea's hardship and lack of time being given to make major changes. City Manager Hanson suggested a shorter amount of time to comply be granted and allow Mr. Shea to replace the faces with the ones he already owns. Further discussion ensued. Mr. Shea was asked if eight months would be sufficient time for him to research the sign requirements of the City and of the hotel franchise and decide on a sign that would satisfy both. Mr. Shea believed eight months to be adequate time. Commissioner Fletcher withdrew his second. Motion: Grant a waiver to expire on July 1,2007 from the Sign regulations to allow full replacement of the material used for the Sign Face Area on an existing Nonconforming Sign for the Comfort Inn located at 2401 Mayport Road and that the applicant come back before the Commission to discuss what options he has to bring the sign into compliance. Moved by Borno, seconded by Waters Mayor Wolfson explained that if the temporary waiver is approved, it would expire on July 1, 2007,therefore, Mr. Shea would need to come back by June 1" to provide a new request. SUBMITTED BY: Sonya Doerr, AICP 'Idlo Community Development Director DATE: October 30,2006 BACKGROUND: Section 17-51 (3) iv. of the Sign regulations requires that non- conforming signs be brought into compliance with the current regulations when the alteration to a sign involves: Any change, which alters the material used for the Display Area or Face Area by more than twenty-five (25)percent. The Comfort Inn, located at 2401 Mayport Road, has requested a waiver to the above provision to allow for face replacement after the existing sign face was damaged by hurricane winds two years ago. The owner of the Comfort Inn applied for a sign permit last summer to replace the sign faces, and was advised of this provision at that time. The owner was also aware that a corporate logo change was pending, and delayed any further immediate action related to the sign. The owner has informed staff that Choice Hotels, the corporate management for Comfort Inns, now requires that the damaged sign be repaired and replaced with the new corporate logo for the hotel chain, or risk revocation of the franchise. The only proposed changes to the existing Comfort Inn sign are replacement of the two acrylic faces (see attached), an upgrade to the lighting assembly which surrounds the internally illuminated sign, and repainting of the existing pole. Four waivers to the face replacement provision have been requested since the sign regulations were re-written in 2002. Requests from two fuel/convenience markets (the BP station located at 1211 Mayport Road and the Valero at 1480 Mayport Road) requested full face replacement when those businesses changed ownership. Those requests were denied, and the two new signs were constructed to conform to the sign regulations. A third waiver was approved for PanAm Mini-Storage at 2383 Mayport Road to permit face replacement after that sign face was damaged by a gunshot, with notice to the business owner that all signs are required to comply with current sign regulations by September 09, 2012. BUDGET: No budget issues. RECOMMENDATION: Consider request for a Waiver from the Sign regulations to allow full replacement of the material used for the Sign Face Area on an existing Nonconforming Sign for the Comfort Inn located at 2401 Mayport Road. The Department finds and Respondent admits the following: 1 . The Department is the administrative agency of the State of Florida charged with the duty to enforce Chapter 403 , Florida Statutes, (F.S. ) and the rules promulgated thereunder, Florida Administrative Code (F.A.C. ) Title 17 . 2. Respondent is a Florida limited partnership in which the general partners are Frederick A. Adams and John W. Shea. Respondent is the owner of the wastewater collection system serving Comfort Inn, a 94-unit motel . This project . is located at 2401 Mayport Road, Atlantic Beach, Florida, Duval County, and is a part of Section 8, Township 2 South, Range 29 East, latitude 30020104" North, longitude 81024149" West, further described in Exhibit I attached and incorporated herein. 3. On November 22, 1985, Respondent informed the Department of Respondent' s failure to obtain a construction permit for the wastewater collection system to serve Comfort Inn Motel. 4 . The above-referenced incident constitutes violations of F.A.C. Rules 17-4 .26( 1 ) and 17-6 .140( 1 ) , which require an appropriate permit from the Department for construction of collection/transmission systems. Failure to comply with these rules constitutes a violation of Section 403 .161 ( l ) (b) , F.S. 5 . A meeting was held between the Department and Respondent on January 20 , 1986 to resolve the violations . As a result of that meeting a resolution was reached . THEREFORE, having met and reached a resolution of the matter, pursuant to F.A.C. Rule 17-103 .110( 3) , the Department and Respondent mutually agree, and it is ORDERED: 6. As reimbursement of the Department' s costs and expenses 4. of investigation and in further settlement of this matter, Respondent shall pay the Department the sum of $1 ,200. The payment shall be in the form of a cashiers check or money order, made payable to the Department of Environmental Regulation, and submitted to the Department of Environmental Regulation, Northeast District, 3426 Bills Road, Jacksonville, Florida 32207 , no later than 20 days from the effective date of this Consent Order. 7 . Within 15 days from the effective date of this Consent Order, Respondent shall submit to the Department a "Certificate of Completion of Construction, " DER form 17-1 .205( 8) ( 07-31-83) for said system, demonstrating that the system has been constructed according to best engineering practices. 8 . Respondent is authorized to connect and operate the constructed wastewater collection/transmission system upon the following conditions: (a ) The system will not transmit wastewater to the City of Atlantic Beach' s wastewater treatment facility in excess of 9,800 gallons per day. Respondent shall not increase the amount until Respondent petitions the Department in writing, and is notified by the Department in writing that an increase is allowed and the quantity of that increase. (b) Wastewater treatment, disposal , collection and transmission shall comply with all applicable regulation of the Department. (c ) The "Certificate of Completion of Construction" referred to in paragraph 7 has been submitted to the Department, and it demonstrates to the satisfaction of the Department that the system as constructed meets the requirements of F.A.C. Chapter 17-6 . -2- 9. Respondent shall allow authorized representatives of the Department access to the property at reasonable times for purposes of determining compliance with this Order and the rules and regulations of the Department. 10 . The Department hereby expressly reserves the right to initiate appropriate legal action to prevent or prohibit the future violation of applicable statutes, or the rules promulgated thereunder. 11 . The Department, for and in consideration of the complete and timely performance by Respondent of the obligations agreed to in this Consent Order, hereby waives its right to seek judicial imposition of damages, or civil or criminal penalties for violations outlined in this Consent Order. The Board, recognizing the good reputation of the establishment, recommends approval of the application provided that the exception be issued to the current owners and not the property. The Board granted a zoning variance to Hardman/Weeks Construction Company which allows a 3'8" encroachment over the rear building line. Hardman/Weeks' footing company angled the foundation in order to save a large tree, not realizing that it pushed the house into the rear yard. " By a 4 to 3 vote the Board granted a zoning variance to Seds Construction Company to build a single family dwelling in Beachside with a 10' rear yard. The applicant felt he should be granted relief because he purchased the property prior to annexation, under City of Jacksonville Jurisdiction, which provided for 10' rear yards. W I T N C S S C T I1 WHEREAS, Developer owns land in Duval County, Florida, more particularly described as refer to acreage, plat engineering drawings, or legal description as LXrlibit A Co to them and to their occupants water and sewer service subject to all terms and conditions of this Agreement; and WHEREAS, in order to provide water and sewer services to Developer it has been or will be necessary for City to enlarge and expand its offsite water and sewer plants and facilities and it is the desire and intent of Developer to contribute financially to the costs of building such additional offsite water and sewer plants and facilities and to reserve capacity in City's water and sewage treatment plants so that City can provide service to the Development without imposing a burden on its existing customers; NOW, THEREFORE, in consideration of the premises and other good and valuable considerations and in consideration of the mutual covenants and conditions hereinafter contained, subject to any necessary approval by other governmental agencies having jurisdiction, it is agreed by the parties hereto as follows: 1. Neither Developer nor any of its successors or purchasers shall discharge into the sanitary sewer system water from "non-domestic" drains including without limitation swimming pools, air conditioning condensation lines, cooling lines or other discharge from any type of equipment. City shall not be obligated to furnish any water or sewer service to any building which is built, on Developer's property to which the City does not have access. The Developer hereby agrees and warrants that the City will not be held responsible for flooding problems which may result from the failure of sewer line back flow preventor valves on Developer's property. The Developer shall pay all additional contributions and fees as may be authorized by the City's service availability policy which is in effect on the date said new agreement is executed. B. In addition to paragraph 9A above, any other change order between Developer and its utility contractor issued after City approval of original plans must be approved by the City before the change order is put into effect. C. City shall have the right to review the systems design drawing and specifications to ensure that they meet the requirements of the City. B. A representative of City or its engineers will be the inspector of the project along with the Developer's engineer, but City reserves the right to final acceptance of the work and materials. All water mains, pipes, valves and fittings and appurtenances up to and including all meters shall be dedicated to and will be owned, operated and maintained by City. All water pipes on the customer's side of the meter shall be owned, operated and maintained by the customer or its assigns. B. All sewer mains, manholes, pumping stations, force mains and appurtenances, including service pipes in public right of ways and dedicated easements, shall be owned, operated and maintained by the City. Except as provided in paragraph 9C, all sewer lines on the customer's side of the property line shall be owned, operated and maintained by the customer or its assigns. C. With reference to any blanket easements for multi-family projects such as apartments, mobile home developments, condominiums and PUD's or for commercial developments, all water mains to and including the water meter, all sewer mains, force mains and manholes in such blanket easements over private property allowing utility operations shall be dedicated to and shall be owned, operated and maintained by the City except that the full length of sewer services from the sewer main or manhole shall be owned and maintained by the customer. A sewer plant capacity charge for any commercial customers on the land as described above at the rate of four hundred, seventy five dollars per unit ($ 475.00 Such charges shall be due and payable as provided in paragraph 12. i -7- D. A meter installation fee to cover meter cost and meter installation (but not including curb stop or meter box) according to the City's service availability policy at the time of installation which currently is $85.00 per 3/4" x 5/8" water meter E. If available, construction water will be charged to building based on metered usage in accordance with current rates. F. Hydraulic share of main extensions - payment or refund. 1. Developer recognizes that water or sewer utility service to the Developer's property is provided by the use of a main extension and other improvements constructed by a prior developer and that Developer is obligated to refund a said prior developer Developer's share of the cost of said main extension or other improvements. Accordingly, Developer shall pay its pro rata share of the cost of said main extension or other improvements to City. Said pro rata share shall be based on Developer's percentage of the hydraulic capacity of said extension or other improvements. For the purpose of this Agreement, the cost of Developer's said hydraulic share shall be $ N/A payable upon execution of this Agreement. 2. With respect to utility facilities installed by Developer to which future developers connect directly, and in consideration for monies expended by Developer toward said facilities, City shall refund to Developer, or Developer's successors or assigns, solely from monies collected from said future developers, said future developer's pro rata share of the cost of said facilities. Said refunds shall be calculated on the basis of the hydraulic capacity and demand of said future developer whenever feasible. The refund obligation of City hereunder and the benefits to Developer related thereto shall expire five (5) years from the date of execution of this Agreement. Said refund shall be made to Developer within sixty (60) days of the receipt of payment by City from a future developer. Refer to addendum if appl H.cabl C. G. Any plant capacity charges, fees, or other charges due to City are intended to assist in defraying costs as to offsite facilities and in no way are to be considered a payment toward the cost of onsite water distribution and onsite sewage collection systems which costs are to be borne by Developer. -9- 13. City agrees to connect individual buildings and structures on the developed property upon application by the builders, plumbers or individual owners subject to the operating rules and regulations of the City and payment of all fees and charges in effect on date of application and compliance by Developer with all provisions of this Agreement. 14. The charges, costs and fees for any separate emergency fire protection water systems for subject project will be subject to negotiations between City and Developer. If buildings of more than two stories are a part of the project, Developer shall furnish at its expense water pumps and other appurtenances as necessary for pumping - water above. 15. All plant capacity and service availability charges, fees and other charges as outlined above are based on normal . domestic sewage defined herein as containing not more than three hundred (300) parts per million biochemical oxygen demand or three hundred (300) parts per million suspended solids. Whenever water which contains more than these amounts is to be admitted to the sewers, both the City and the pollution control agencies must specifically agree to the connection. An additional charge will be calculated in direct proportion to strength at seventy-five cents ($0.75) for each part 'per million of either biochemical oxygen demand or suspended solids over three hundred (300) parts per million. All such connections shall provide for a suitable point for the waste to be sampled by the City or the regulatory agencies. An additional charge equal to the pro rata share of any additional sewage treatment plant costs above ninety percent (90%) treatment, and of the cost of any additional required outfall pipes to N/A may . be required by City. Developer shall have the right at all reasonable times to inspect the invoices of the City in order to determine that said funds have been properly expended by City pursuant to this paragraph. 16. Developer warrants that it is the owner of or the holder of a binding contract to purchase the fee simple title of the real estate described herein and further agrees to have all mortgages or other liens -10- subordinated to the terms of the Agreement and easements required herein prior to any acceptance of the facilities by the City. 17. Upon application by owners, builders or their authorized representatives, the City agrees to connect the requested dwellings or structures on the said property at no additional connection fee (i.e. , in addition to those provided for above in this Agreement) , but subject to the continuing operating rules and regulations of the City including, without limitation, the periodic payment of the water usage and sewer usage charges in effect on the date of such application or thereafter reflected in the City's rate schedule. - 18. This Agreement shall be binding upon and shall inure to the benefit of the Developer, City and their successors and assigns. However, in the event the Developer has not paid and delivered to the City the plant capacity and service availability charges, fees and other charges provided to be paid to the City by Developer under the terms of this Agreement, and all easement and conveyances required by this Agreement, then this Agreement shall not inure to the benefit of the successors or assigns of the Developer. 19. It shall be the responsibility of Developer to locate for builders any water and sewer taps or lines ned-essary in conjunction with residential or commercial construction: 20. Unless the damage to any onsite improvements are the result of the negligence or willful act of the City, its officers, or employees or authorized agents, the owner or Developer of such property upon which the damage occurs shall be responsible for the payment to the City of such damage to City's property including all necessary and reasonable repairs which must be made by the City or independent contractors engaged by the City to effect such repairs. If the owner or developer of the real property shall fail or refuse to pay costs of such necessary and reasonable repairs to cure said damage within thirty (30) days from the submission to the owner of a statement for such charges, the City shall have a lien against such owner's or Developer's property subordinate to those liens created by or under agreements of record prior hereto, for the payment of such necessary and reasonable costs and expenses for effecting such repairs and restoration to such onsite facilities located upon the owner's or Developer's property. Notice of such lien or claim on lien describing the real property and the amount owed may be filed within ninety (90) days of the date from the last date Upon which any such repairs or restoration were made by the City or its authorized representatives. Thereafter, the City shall be entitled to bring an action for the foreclosed under the- laws of Florida. 21. Prior to final acceptance of the utility and other public facilities improvements by the City the following requirements must be met at Developer's expense: A. Developer's contractor is required to install curb stop, meter box and valve box on each water service and valve as shown on design drawings. D. All water and sewer services and valves shall be marked on: the street curb by etching into the concrete or if no curbing is available, a two (2) inch square metal tag is to be nailed to the street's pavement and painted as specified on design drawings. Said tests may be performed at least three (3) times: the first test upon completion . of the system; the second test upon completion of all building, roads, paving, drainage, and all construction within the right-of-way easement area of adjacent areas. A third test shall be required if the City deems it necessary within a one (1) year period after acceptance. L. Letters of acceptance from the appropriate regulatory agency for the water and/or sewer system are required prior to final inspection. M. Thus, it should be inspected to verify that all structural components are constructed according to the Contract Documents. The following minimum inspection plan is a guideline and is not intended to limit the quantity of items that need to be inspected, as there are many specific procedures or techniques that would normally be observed during the normal inspection procedures. INSPECTION PLAN: 1 . Confirm that a Soils Testing Lab is retained to confirm soil compaction as required in soils report. 2. Confirm that a Testing Lab is retained and present at the jobsite to take slump tests and cylinders for concrete prior to being placed in forms. 3. Inspect all footing, beam and slab reinforcing placement prior to pouring concrete. 4. Make periodic inspections of masonry construction including placement of reinforcing in filled cells and filling of cells. 5. Observe the placement of at least 67% of the concrete being placed. 6. Observe that shoring and reshoring procedures are in accordance with plans submitted by the Contractor. 7.
