On December 10, 2001, the City of Atlantic Beach's City Commission amended the Sign Ordinance to allow all non-conforming signs that were previously permitted to remain in accordance with the adopted conditions. This amendment was the result of investigations related to numerous complaints about nonconforming advertising structures. Upon close examination, numerous business signs throughout Atlantic Beach, though previously permitted were found to be in violation of the City's existing sign ordinance. In fairness to those businesses whose signs were properly permitted, and maintained, and posed no risk to public safety, the Sign Ordinance was amended. A copy of this amendment has been included for your edification. Upon the terns and conditions herein contained, the City agrees to provide potable water and domestic sewer services to the User's Property. The term "domestic sewage" used in this paragraph and referred to throughout this Agreement is defined as follows: Human waste including liquids and solid matter carried from plumbing fixtures normally carried off by drains and sewers, and except where specifically excluded bath and toilet wastes, laundry wastes, kitchen wastes and other similar wastes. It does not include commercial or industrial waste, 2. City agrees that after User has connected to the system, thereafter City will provide, at its costs and expense, but in accordance with other provisions of this Agreement, including rules and regulations and rate schedules, sewer service and water service to User's Property in a manner conforming to reasonable requirements of public governmental agencies having jurisdiction over City's water and sewer operations. 3. User shall, at its costs and expense, install all of the potable water distribution and domestic sewage collection lines which may be required on User's property, including engineering cost, to connect City's plant to; the User's property, and all other facilities necessary to make it possible for the City to provide adequate potable water and domestic sewage service. If buildings more than two stories in height are constructed on the User's property, the User, at its own expense, agrees to furnish to the City any equipment which may be necessary for pumping potable water to the additional height with associated back-flow preventers. (3) At all times during the construction of the potable water and domestic sewer lines and related equipment, the City shall have access to the construction and the right to inspect the construction to insure that the lines and related equipment are being installed in accordance with the plans and specifications approved by the City. User shall construct the domestic sewage disposal lines in such a manner as to insure that no water from air conditioning systems, ice machines, swimming pools or any other form of condensate water shall flow into the domestic sewage disposal lines of the City and nothing other than sewage in its strictest sense shall be discharged into the domestic sewage disposal system of the City. City shall inspect all connections made by contractors, plumbers, builders, etc. to any portion of the sewer system that discharges into the sewage collection system owned or operated by City or contemplated to be owned and operated by City under the terms and conditions of this Agreement prior to being covered up. City shall only be obligated and will only provide water and sewer service to User's property upon 100% completion of all terms and conditions of this Agreement. 4. User shall pay a planning and inspection fee in order to defray all actual costs to City of preparing and executing this Agreement, including any attorney's fees; and conducting the inspection and testing of the installation of the User's Extension; and all other administrative costs incident to accepting the User's extension, Said fee shall be equal to one half of building permit fee. 5. User shall pay City a "Sewer Impact Fee" of $1,035.00 per residential unit and a water impact fee of $10.00 per fixture unit/or as otherwise (4) provided in the City's Code of Ordinances, 6. The City shall provide water and sewer service to User's property upon payment to City of the standard meter charges as provided in the City's Code of Ordinances ($85.00/ 5/8 x 3/4 inch meter) , 7. Payment of the Sewer Inpact Fee, Water Impact Fee, Planning/ Inspection Fee and Water Peter Charges, shall be made in full at the time- City imeCity approves the plans. 8. In the event, at a future date, City's charges, rate schedules or fees are revised, subject to the operating rules and regulations and approval of governmental authorities having jurisdiction, then in that event, User and/or assigns shall pay the charges, rates or fees then in effect on date of payment. 9. Hydraulic share of main extensions--payment or refund; User recognizes that water or sewer utility service to th User's property is provided by the use of a main extension and other improvements constructed by a prior developer and that User is obligated to refund to said prior developer User's share of the cost of said main extension or other improvements. Accordingly, User shall pay its pro rata share of the cost of said main extension or other improvements to City. Said pro rata share shall be based on Developer's percentage of the hydraulic capacity of said extension or other improvements. For the purpose of this Agreement, the cost of Developer's said hydraulic share shall be $ With respect to utility facilities installed by User to which !future developers connect directly, and in consideration for monies expended by User toward said facilites, City shall refund to User, or User's successors or assigns, solely from monies collected from said future developers, said (5). future developer's pro rata share of the cost of said facilities, Said refunds shall be calculated on the basis of the hydraulic capacity and demand of said future developer whenever feasible, The refund obligation of City hereunder and the benefits to User related thereto shall expire five (5) years from the date of execution of this Agreement, Said refund shall beTade to User within sixty (60) days of the receipt of payment by City from a future developer, 10, If any damage is done by User, its agents G or employees, to the existing potablO water lines or domestic sewer lines of City or other utilities CATV, electric, phone, or the potable water lines or domestic sewer lines installed pursuant to this Agreement, during or after the installation thereof and by reason of construction work, User shall at his expense, make such repairs as are required to restore said potable water or domestic sewer lines to the condition which existed before such damage occurred, but in the event User does not restore said potable water or domestic sewer lines (but this clause shall not be construed as to require the City to make such reparis or restoration) , User shall provide the City and its agents adequate access and facilities for the making of said repairs. All costs incurred by the City in making such repairs shall become immediately due and payable and shall be considered in all respects the same as if said charge had arisen in connection with the rendition of the regular services of the City, 11. Notwithstanding any provision of this Agreement, the City shall have no obligation to provide sewer services to any customer producing sewage which is unusually burdensome, unusually costly to process or substantially detrimental to the sewage system, 12. This Agreement shall be beinding upon the parties hereto, their successors in interest, grantees, transferees and assigns. In the event User transfers any part of the User's property, it will cause its transferee to comply in all respects with the provisions of this Agreement. 13. In the event the City sells either its sewer treatment plant or collection system or its water treatment plant or water distribution system to any governmental body or any other purchaser, then, in such events, this Agreement shall terminate as to the City on any protion sold and all of its obligations or liabilities hereunder shall cease and determine for that portion sold. 14. The City may shut off the water to the User or any other person and refuse to accept sewage from the User or any other person if the User or any other persons shall fail to pay any suns due hereunder when the same becaue due and payable. Nothing herein contained, however, not any action taken by the City in pursuance hereof shall impair any other remedy which the City might have, at law or equity, for breach of this Agreement by Owner or any other person. 15. City does not guarantee an uninterrupted supply of water for any purpose or water at any particular pressure for any purpose and reserves and shall have the right to shut off the water in its main at any time for the purpose of making repairs or extensions or for other purposes incidental to its water supply and will not be responsible for any damage caused by low pressure. City shall have the right to turn off water service at the main where the User has been found to be useing water illegally, and to assess a fee for restoration of service. 16. The City shall have the right to assign and transfer this Agreement at any time provided, however, that no such assignment or transfer shall impair the rights or increase the obligations to the User or any other person pursuant to this Agreement. (7) 17. Unless sooner terminated as provided herein, the initial term of this Agreement shall be 15 years. After the initial term of 15 years from the date of the execution of this Agreement, the terms of this Agreement shall automatically be renewed for successive terms of five (5) years each, unless written notice of termination of this Agreement is provided by either party hereto, not less than ninety (90) days prior to the commencement of any such renewal period. 18. It is expressly agreed and understood between User and City that there are no other written or verbal agreements applicable herein between User and City. 19. This Agreement may be amended and modified from time to time as necessary by mutual written agreement of the parties hereto. These general conditions shall govern all general contracts , subcontracts , specialty contracts , and purchase orders for all crafts , vendors , and suppliers on this project . All contractors shall include these conditions in all subcontracts or purchase orders for materials included in the job . B . The contractor assumes all risks , hazards and conditions in connection with the performance of the contract . If the performance of the contract involves a greater expenditure of money than the contractor expected at the time of bidding , no allowance will be made on account thereof , and the contractor shall continue with and complete the work . C. This specification and the accompanying drawings are intended to describe and provide a finished piece of work . They are intended to be cooperative , and what is called for by either plans or specifications shall be as binding as if called for by both . The contractor shall understand that the work herein described shall be complete in every detail . He shall provide all labor and materials necessary for the entire completion of the work . He shall not avail himself of any unintentional error of omission . Should any error or inconsistency appear in the drawings or specifications , the contractor , before pro- ceeding with the work , shall notify the owner ' s representative , in writing , for proper adjustment . In no case shall the con- tractor proceed with the work when uncertainty exists . D . Should any dispute arise as to the quality , fitness of materials , workmanship or interpretation of the plans and specifications , the decision shall rest with the owner or his representative . This decision shall be based on the requirements that all work done and materials furnished shall be in strict accordance with the plans and specifications and the standard construction practices in erecting buildings of a similar type . E _ Where interpretation of plans and specifications is needed , the contractor shall submit with such promptness as to cause no delay in his or any other contractor ' s work , three copies of amplified details and schedules for the approval of the owner ' s representative . One is to be returned to the contractor approved , and two to remain in the owner ' s file . F . Titles to chapters and paragraphs in these specifications are indicated merely for convenience . They shall not be construed as a correct or complete segregation of the units of material or labor . No responsibility is assumed by the owner for omissions or duplications by the contractor or his subcontractors , due to real or alleged error in arrangement of matter in these speci - fications . pg . 2 G . It shall be the duty of the contractor to verify all dimensions given on the drawings and to report any errors or inconsistencies to the owner ' s representative . In submitting a proposal , the owner assumes that bidder has examined and familiarized himself with the site and has carefully checked all the details and assured himself that they conform in every respect with the local and state requirements . ignorance or failure of the contractor or subcon- tractor to examine or familiarize themselves with the site will not be accepted as an excuse for claims to extras or additional payment above the negotiated contract price . H . The owner ' s representative shall , within a reasonable time , make decisions on all points brought up by the contractor , on matters relating to the interpretation of the plans , specifications , and execution of work . I . It shall be the duty of the general contractor to see that all subcontractors are fully informed in regard to the general con- ditions and preliminary specifications . J . All materials shall be new and of the best quality . Workmanship shall be the best . The contractor will furnish satisfactory evidence as to the kind and quality of materials , if required . Each sub-part of this document provides further detail . 1 : 2 PERMITS AND REGULATIONS A . The owner has obtained the general building permit , paid other associated tap fees , and obtained permits required to begin work . The owner will furnish same to the contractor . B . The contractor is to obtain all other necessary permits , certi - ficates and inspections , licenses and bonds required by the owner or local code . He is to observe all Federal , State , local laws , ordinances , rules and regulations in carrying on the work , par- ticularly in the use of streets , alleys , sidewalks , and neighbor- ing property . The preservation of the public health safety and sanitation are required . C. If the drawings and specifications are at variance with any Federal , State or local law, ordinance , rule or regulation , the contractor shall notify the owner ' s representative , in writing , before work is performed . The value of necessary changes shall be adjusted before proceeding with that work . If any of the con- tractor ' s work is done contrary without such notice , he will bear all cost arising therefrom. D. The contractor shall obtain an occupancy permit and deliver the same to the owner at the completion of the work . Owner shall pay necessary fees and obtain Health Department permit . - t pg . 3 1 : 3 THE OWNER' S REPRESENTATIVE STATUS A. The owner ' s representative shall be responsible for general super- vision of the work . He is the agent of the owner . He has author- ity to stop the work whenever , in his opinion , such stoppage may be necessary to insure the proper execution of the contract . B. The owner ' s representative shall within reasonable time make de- cisions on matters relating to the interpretation of the plans , specifications and the execution and progress of the work . C. Communication delivered to the foreman by the owner ' s repre- sentative shall be as binding as delivered to the contractor . D . The owner ' s representative is authorized to approve written change orders . 1 : 4 INSPECTION AND CHANGES A. The owner ' s representative shall have access to the work B . If the specifications , the owner ' s representative instructions , laws or regulations require any work be tested or approved , the contractor will give the proper authorities timely notice of its readiness for inspection . If work should be covered without approval or consent , it must , if required by the proper authorities be uncovered for examination at the contractor ' s expense and re- main uncovered until properly tested and approved . C. The owner ' s representative may inspect or require special testing beyond the scope of the plans , specifications or local codes . If the results of special inspection or the tests meet the standards required by the plans or specifications , the owner shall bear the cost of such inspection or tests . If the results do not meet the standards required by the plans , specifications or local codes , the contractor shall bear the cost of such inspections and tests as well as the cost of re-doing the work . D . The contractor shall coordinate with owner ' s representative for a slab inspection to be done by Waffle House , Inc . , prior to the in- stallation of the concrete slab . This inspection will be done when all plumbing , electrical , forms , welded wire fabric , and polyvinyl are in place . Twenty-four hour notification required . E . The owner , without invalidating the contract , may alter by adding to or deducting from the work covered in the contract . All such work shall be executed under the conditions of the original con- tract except that no extra work or changes shall be done without written order from the owner . Such orders shall cover the agreed price and terms of extra work or changes . If work is to be omit- ted , then proper credit for such omitted work shall be given the owner . pg . 4 F . The contractor shall proceed to make such changes wit-hout causing delay , and any claim by the contractor for an extension of time for the completion of the work , due to changes or alterations , shall be made to the owner within ten days of such contemplated change or alteration . G. Contractor must meet with the owner ' s representative and a Waffle House , Inc . , representative for final inspection to establish a formal list of construction deficiencies (hereinafter called the punch list ) and further agrees that all punch list items will be corrected within 30 days after the opening of the store . If these deficiencies are not corrected within said 30 days , the owner may hire an independent contractor to do the work and the owner may deduct said costs from the monies owed the contractor and/or the owner may bill contractor for said costs . Contractor shall agree to pay any of said costs billed by the owner . If an item cannot be corrected wtihin 30 days , this shall be explained in writing to the owner ' s satisfaction . It is hereby agreed that the preparation of a punch list by the parties hereto shall in no way waive or alter any other rights of the owner under this contract including war- ranties for latent defects . The contractor is not responsible for coordinating correction of items excluded from the contract or other items such as kitchen equipment or signage unless owner pays contractor for these items . Items ordered direct by owner shall be supervised by him. Contractor may bill owner for such supervision if not included in the contract . H. The final certificate or final payment of the contract does not relieve the contractor of responsibility for faulty materials or workmanship . Unless otherwise specified , he shall appear within a period of one year from date of substantial completion . The owner ' s representative shall give notice of observed defect with reasonable promptness . 1 : 5 SEPARATE CONTRACTS A. The owner reserves the right to let other contracts in connection with the work . The contractor shall afford other contractors full opportunity for the installation of equipment , storage of their materials , and the execution of their work . The contractor shall properly connect and coordinate his work with their ' s so that there will be no interference or delay . 1 : 6 CONTRACTOR ' S INSURANCE AND BOND A. The contractor shall not commence work until he has furnished the owner with certificates of insurance evidencing that he has ob- tained the following insurance which shall be secured with com- panies having a financial rating of AAAA in Best ' s Insurance Guide Such certificates must provide that the owner be named as an ad- ditional insured as their interests may appear and that the in- surer will give the owner at least thirty (30) days prior written notice of material change in or cancellation of such insurance . p9 . 5 1 . Workmen ' s Compensation insurance : In accordance with the statutory requirements , including Employer ' s Liability Insur- ance in an amount not less than $100 , 000 . If required , the contractor shall also maintain scaffolding insurance and de- molition insurance with bodily injury coverage of $250 , 000/ $500 , 000 . 2 . Manufacturer ' s and Contractor ' s General Liability Insurance : Including Wrongful Death , with limits of $250 , 000/$500 , 000 for bodily injury and $ 100 , 000 for property damage . This in- surance shall include contractural liability to cover the lia- bility assumed by the contractor under the indemnification set forth under 1 : 19 . 3 . Comprehensive Automobile Liability : Including owned , non- owned and hired vehicles , with limits of $250 , 0001$500 , 000 for bodily injury and property damage limits of $ 100 , 000 . 4 . Builder ' s Risk Insurance : The owner shall maintain a Builder ' s Risk Insurance Policy of $60 , 000 that when attached to a stand- and fire policy , insures all real property against fire , vandal - ism and malicious mischief and such other perils . 5 . Endorsements : The contractor may obtain at his expense and at his election , separate coverage , part from the real property insurance on construction machinery , tools and equipment owned by the named insured ( subject to 80% or higher co- insurance ) . These endorsements include a limited extension of building coverage to include personal property of others in the care , custody or control of the insured . a . Contractor ' s inclusion : The interest of separate or sub- contractors may be excluded and the interest of general contractors only covered by attachment of a separate or subcontractor ' s endorsement . 1 : 7 SURETY BOND A. At the owner ' s election and judgment , the contractor will provide a bond at the owner ' s expense , for the full amount of the contract price , with an approved licensed surety company , conditional on the full performance of the contract in accordance with the drawings and these specifications . It will provide that work shall at all times be free and clear of all liens of workmen , material suppliers and sub-contractors . pg . 6 1 : 8 AFFIDAVITS AND LIENS A. When making application for payment , the contractor shall furnish a complete overall notarized statement . It shall be accompanied by an affidavit verifying the total overall contract price . All sub elements of the contract for all labor and material incorporate ated in the work and to be incorporated in the work by him in the performance of this contract , the amount of money already paid ( if any) and the amount of money presently due shall be shown . B . The final payment shall not become due until the contractor de- livers to the owner , waivers of lien and a final notarized af - fidavit from all subcontractors , covering all materials and labor incorporated in the work for which a lien might be filed . The con- tractor may , if a subcontractor refuses to furnish a release or receipt in full , furnish a bond satisfactory to the owner to in- demnify him against any claim unsatisfied after all payments are made , the contractor shall refund to the owner all monies that the latter may be compelled to pay in discharging such lien or claim, including all costs and reasonable attorney ' s fee . 1 : 9 DRAWINGS A. All drawings , specifications and addendum, furnished by the owner , are the property of Waffle House , Inc . They will not be used on other work and , with the exception of the signed contract set , are to be returned to the owner at the completion of the contract . B . An approved , signed , and sealed set of drawings will be on the job site at all times to include the approved Waffle House Inc . , site plan . The owner ' s representative is expected to provide sufficient drawings to the contractor at his expense . The contractor shall verify with owner ' s representative availability . 1 : 10 GUARANTEES AND SUBCONTRACTOR LIST A. The general contractor and each subcontractor shall guarantee all work under this contract for one year . Should any defects develop during said period due to improper materials or work- manship , they shall be repaired or materials replaced without expense to the owner . All guarantees and warranties for the mechanical equipment furnished and installed by the general contractor included in the building ( i . e . , hot water heater , air conditioning units , etc . ) , shall be delivered to the owner by the general contractor . The contractor shall furnish a list of subcontractors , addresses and phone numbers who have done the work . 1 : 11 CLEANING AND TURNOVER A. Contractor to clean building and surrounding area to a condition acceptable to begin restaurant ' s operation . Building and oc- cupancy permit to be provided owner at turnover . Health perm-it shall be obtained by the owner . pg . 7 DIVISION 2 EARTH WORK AND SITE LOCATION 2 : 1 SCOPE OF WORK A. Contractor to furnish all labor , material and equipment neces- sary to cler , excavate and prepare site to provide sound con- struction according to the site plan , specifications , and ap- propriate soils report . B. General contractor to excavate and backfill for installation of sewer , gas , electric , phone or other utilities or coodinate for the proper installation of work . All back fill will be properly compacted . C. Any barricades will be furnished by general contractor according to local laws and regulations . 2 : 2 SITE INFORMATION SURVEY AND GRADES A. Contractor shall examine the site and shall take into consideration all such conditions as may affect his work . If available , owner will furnish a log of borings indicating probable subsoil condit- tions for general information . The owner does not guarantee that these indicate actual conditions under entire building or on entire site . B . The exact property lines will be furnished to the contractor . If any markers are displaced , lost or disturbed , they shall be re- stored at no cost to the owner . C_ The relation of the building to the lot lines and established final grades shall be as shown on the approved site plan . The contractor shall accurately lay out his work on the ground according to the drawings furnished , and will be held responsible for the correct location of all work . 2 : 3 EXCAVATION A. Excavations shall be carried down to the lines and levels indicated on the plans plus sufficient space to permit erection and removal of forms or construction of concrete work and its inspection . Bot- toms of all foundations , walls , and concrete walks shall rest on undisturbed soil , free of undesirable material . Should unsuitable bearing be encountered at the depths indicated on the drawings , or soil report , contractor shall immediately report such conditions to the owner ' s representative and shall not proceed with work until he receives further instructions . Bottoms of all foundations bearing on soil shall be on level excavated planes at the eleva- tions indicated . pg 8 B. Foundations are designed for a soil bearing value of 2 , 500 pounds per square foot . Should soil bearing value fall below this value , the contractor shall advise the architect and owner ' s representa- tive for modification of footing design . Plans for 1 , 500 pounds per square foot bearing value are available upon special request . C. Bottoms of excavations shall be protected from frost . kept free from water , and shall be hand-worked. D. Cut , fill and compact as necessary all areas designated to receive walks , driveways . dumpster , parking areas and building floor / slab . 2 : 4 CARE EXAMINATIONOFADJOINING PREMISES AND PUBLIC UTILITIES A. Contractor shall protect adjoining buildings and public thorough- fares including curbs , gutters , sidewalks , and pavements from damage and restore them to their- former condition furnishing all materials-..that/ may be necessary to repair any damages with no cost to - the owner _ B. Excava- tions shall be cleaned of all trash and debris prior to backfil - ling_ Under no circumstances will backfilling be permitted under footings and foundations . . Around the footings and foundation walls , backfill shall be placed-iia ten- inch layers and compacted with Jay-12 or Vibra- pac tamper -of loam, debris or cinders and approved by the owner's representative . Materials which absorb and retain a large amount of moisture shall not be used . If sufficient material of this character is not obtainable from the excava- tion , contractor shall provide additional material to bring fill to required elevation . 2_ Ent i re---area of parking* 1 of sha l l be compacted with f i ve passes of a "Terrapac" vibratory roller pulled by a tractor or com- parable system_ pg 9 3 . Material for fill shall be sand or other materials free of loam, debris or cinders and approved by the owner ' s repre- sentative . If sufficient material of this character is not obtainable from the excavation , contractor shall provide additional material to bring fill to required elevation . 4 . Final four inches of fill under floor slabs shall be broken stone or sand as shown on the plans . 2:6 ROCK A. If rock or other unusual soil conditions are encountered within limits of excavation , the contractor shall immediately notify t the owner ' s representative and shall not proceed further until instructions are given and measurements are made for purpose of establishing volume of rock excavation . Rock is defined as any stone or boulder that cannot be removed by a power shovel , half cubic yard bucket capacity , without use of continuous drilling or by explosives . DIVISION 3 - ASPHALT PAVING 3 : 1 GRADES A. Grades as shown on site plan will be established by the contractor and the grade stakes will be set . In establishing the grades , al - lowances will be made for existing improvements , proper drainage , adjoining property rights and good appearance . A minimum of one percent slope of one foot in 100 feet is required on all asphalt lots . 3: 2 PREPARATION OF SUBGRADE A. All debris , vegetation or other perishable materials shall be removed from the job site , except for trees or shrubs designated for preservation . The site to be paved shall be graded to the re- quired elevation and all excess material removed from the location of the work . Material in soft spots shall be removed to the depth required to provide a firm foundation and shall be replaced with crushed stone or sand . The entire subgrade area shall be thorough- ly compacted at the lowest moisture content at which a handful of the soil can be molded by a firm closing of the hand . The surface of the subgrade after compaction shall be hard , uniform, smooth and true to grade and cross section . The subgrade shall be primed . The base will be six inches of #57 crusher run gravel or equal . 3 : 3 THICKNESS OF STRUCTURE A. On the prepared subgrade , a plant -mixed asphalt base shall be laid in one course to a compacted thickness of two inches . Placing of the plant-mixed asphalt surface course shall flow and be laid in a single course to a compacted thickness of one inch . pg . 10 3 : 4 TACK COAT A. A tack coat shall be applied on the base course . The tack coat shall be bituiminous prime coat applied at the rate of . 3 gallons per square yard . 3 : 5 EQUIPMENT-MATERIALS-LABOR A. The contractor shall provide the necessary equipment , material , and labor to complete the job acceptable to the owner ' s representative . 3 : 6 SAMPLING AND TESTING A. If specified by the owner , the contractor shall furnish for test an and analysis a representative sample of the materials used in the work . Alternatively , if specified by the owner , the contractor shall provide certification that material furnished is in accor- ance with the contract . Sampling and testing shall be in accor- ance with the latest revisions of the American Association of State Highway and Transportation Officials (AASHTO) or the American So- ciety for the Testing and Materials (ASTM) . Standard procedures for sampling and testing the materials being used in the project shall be used . 3 : 7 SMOOTHNESS A. The surface of the completed work , when tested with a ten ( 10) foot (3m) straight edge , shall not contain irregularities in excess of 1 /4" (6mm) . The lot will have a finish grade of one percent slope . 3 : 8 ASPHALT A. The asphalt for the plant mix shall be as used in normal state highway construction . The asphalt material selected shall meet the requirements of the applicable table in Specifications Series No . 2 The Asphalt Institute . A certificate of compliance with the speci - fications of the asphalt will be presented at completion of work if required by the owner ' s respresentative . 3 :9 MINERAL AGGREGATE A. Asphalt Plant Mix Base and Surface 1 . The mineral aggregate for asphalt plant mix shall consist of coarse aggregate , fine aggregate and , if needed , mineral filler The coarse aggregate shall be sound , angular crushed stone , crushed gravel or crushed slag . Uncrushed coarse aggregate may be used in base coarse mixtures if the mixture meets all design criteria . The fine aggregate shall be well graded , moderatlely sharp to sharp sands . Pg . 11 3 : 10 SPREADING BASE AND SURFACE COURSES A. Asphalt Base and Surface 1 . For all areas , asphalt base and surface sources shall be spread and struck off with a paver . Any irregularities in the surface of the pavement course shall be corrected directly behind the paver . Excess material forming high spots shall be removed with a shovel or a lute . Indented areas shall be filled level . Casting of mix over such areas shall not be permitted . B . If , it is impractical to use a paver or spread box in small areas , asphalt base and surface courses may be spread and finished by hand Wood or steel forms , rigidly supported to assure correct grade and cross section , may be used . Placing by hand shall be performed carefully to avoid segregation of the mix . Broadcasting of the material shall not be permitted . Any lumps that do not break down readily shall be removed . 3 : 11 COMPACTION, ASPHALT BASE , AND SURFACE A. Rolling shall start as soon as the hot mix material can be com- pacted without displacement . Rolling shall continue until thor- oughly compacted and all roller marks have disappeared . In areas too small for the roller , a vibrating plate compactor or hand tamper shall be used to achieve thorough compaction . 3 : 12 METHOD OF MEASUREMENT A. The quantities shall be based upon total square yardage . 3 : 13 BASIS OF PAYMENT A. The total amount will be paid for at the contract unit price bid for one square yard . Payment will be in full compensation for fur - nishing , hauling , and placing materials , for rolling and for all labor and use of equipment , tools and incidentals necessary to complete the work in accordance with these specifications to in- clude sub-base , and surface . 3 : 14 PERFORMANCE GUARANTEE A. The contractor shall guarantee in writing the satisfactory per- formance of the completed pavement for a period of one year . pg . 12 DIVISION 4 - CONCRETE 4 : 1 SCOPE OF WORK A. Contractor shall furnish and install materials required by drawings B . In general , the Code of Standard Practice as adopted by the Ameri - can Concrete Institute and the Concrete Reinforcing Steel Institute shall apply in all respects as to material , design and fabrication . C . Provide first quality concrete work , in accordance with best practice in the trade and with the ACI Building Code CACI 316-56) which is made a part of the specifications . 4 :2 MATERIALS A. Unless noted otherwise , all materials shall conform to the follow- ing requirements : 1 . All concrete for floors , foundations , footings , yard pavement and other concrete work ( except paving) shall be transit mixed concrete attaining a minimum compressive strength of 3 , 000 PSI at twenty-eight (28) days and conforming to the requirements of the ASTM C-94 specifications for ready-mixed concrete . 2 . Portland Cement shall be Type I complying with ASTM C- 150 . 3 . All concrete shall contain not less than five bags of cement per cubic yard . 4 . Fine aggregate shall comply with ASTM C-33 . 5 . Coarse aggregate , Table II , size 57 , shall comply with ASTM C-33 . 6 . The maximum aggregate size for all slabs and footings shall be 3/4" and for all grout to reinforce masonry . 7 . Water : Clean and free from deleterious amounts of acids , alkalides or organic materials , and fit for human consumption . S . Maximum allowable slump will be four inches . B . Reinforcing steel shall be deformed , billet , steel , unpainted , un- coated and free from rust , scale and all injurious foreign sub- stance conforming in all applicable respects to the specifications serially designated Grade 40 or 60 by A615 by the ASTM latest edition . pg . 13 C. Wire mesh shall be of the size and gauge indicated on the drawings and shall be of cold drawn steel wire and conform to ASTM A-185 standard specifications . The wire mesh shall be unpainted , un- coated and free from rust , scale and all injurious foreign sub- stances . D . Accessories such as bolsters , spacers , chairs , etc . , of whatsoever nature indicated or required shall in all respects be of sufficient strength and number to properly carry the steel they support and in accordance with A. C . I . Standard 319 . E . Expansion joints to be 1 /2" thick asphalt impregnated pre-molded fiber as manufactured by the Celotex Corp . , "Elastite" and J&P Petroleum Products "Texmastic" . F . Control joint shall be Burk "keyed-kold" . G . Membrane waterproofing under the slab shall be six mil poly- ethylene . H . Gravel fill under slab shall be #57 crusher run stone , 4 " deep . I . Perimeter insulation shall be styrofoam two inches thick and 24 inches wide . J . No concrete which has been mixing for more than one hour and 30 minutes shall be allowed in project . 4 : 3 PREPARATION OF PLACE OF DEPOSIT A. Before beginning placement of concrete , all water , hardened con- crete and foreign materials shall be removed from spaces to be occupied by concrete . Forms shall be thoroughly cleaned and se- cured in position . All underslab plumbing , electrical conduit sleeves , anchors , anchor slots , keys and insets and other items must be in proper position and securely anchored and inspected by owner ' s representative and Waffle House , Inc . B. Temporary drains , disposal connections , etc . , are to be furnished and maintained at no additional cost to the owner to keep exca- vation free from water . C. Concrete shall be handled from transporting vehicle to place of final deposit as rapidly as practicable by methods which shall prevent separation or loss of ingredients . D. Concrete shall be deposited continuously or in layers of such thickness that no concrete will be placed on concrete which has hardened sufficiently to cause formation of seams and planes of weakness within the section . Pg . 14 4 : 4 FINISHES A. Exposed Surfaces 1 . All concrete exposed to view on outside shall have rough spots ground with carborundum of medium fineness until it presents a uniform and smooth appearance . Cement mortar shall be used in rubbing , but surface shall not be brush-coated with cement or grout after rubbing . B . Rough Finish 1 . All other concrete shall be left as it comes from the forms , except that all fins and rough edges shall be removed and honeycombs or similar defects shall be patched with cement mortar . C . All slabs to receive ceramic tile shall be smooth finished with 1 /8" tolerance . Floor drains will have a very gradual sweep _ No additives permitted if concrete to receive quarry or ceramic tile . D . All exterior concrete slabs shall receive a lightly broomed sur- face finish . Slabs shall be divided in panels according to draw- ings with a groove tooled into the surface with a jointing tool . A two- inch wide smooth finished band shall be finished on each side of the tooled joint at edge of slabs and where slabs abut walls as shown on the drawings . E _ Air entrained concrete is required for all concrete work exposed to the weather for sidewalks , paving and slabs . Maximum allow- able slump will be four inches . An air-entrained mixture shall be used at the mixer to provide an air content of 5- 1 /2% with a tol - erance of plus or minus 1 - 1 /2%. . 4 . 5 GROUTING A. Grout under setting and bearing plates for steel columns . After pipes are installed , grout around pipe drains , etc . , at the floor line . All other miscellaneous concrete grouting of every de- scription shall be performed . 4 : 6 CONCRETE PARKING LOT (ALTERNATE DESIGN TO ASPHALT SPECIFICATIONS) A. If soil conditions require extensive grading or large quantities of fill are required to bring a site to grade , this concrete specifi - cation can be used . The owner ' s representative shall be advised of peculiar soil conditions which may require this lot design . in certain cases the site plan may indicate a concrete lot when it may not be required . The owner ' s representativwe will make the final decision . The contractor shall provide an alternate price for this specification if recommended or requested . Pg . 15 B . Pave parking lot with 4 , 000 PSI concrete , 5" thick , air entrained having 1 " course aggregate and five gallons of water per 94 Ib . sack of cement , maximum. Grades shall be as shown on site plan with a minimum of 1 /2% slope . Air entrainment shall be 5-1 /2%. C_ All work on highway right-of-way to include driveway entrances , curbs , and culvert , etc . , shall be installed in accordance with the requirements of the State Highway Commission , local building codes and regulations . 4 : 7 CONCRETE DUMPSTER PAD A. Provide concrete dumpster pad as shown on site plan and building plans _ General contractor to confirm with owner ' s representative the need for a dumpster enclosure . 4 : 8 PLACEMENT OF REINFORCING STEEL A. Reinforcing steel shall be formed in shop to required lengths with bends as shown on drawings . Where walls or other items are shown as built integrally with other sections , but are placed as separate pours , keys and/or dowels must be provided . B . Main reinforcing bars shall not be spliced unless noted on the drawings or approved by the owner ' s representative . Such splices shall have a minimum lap of 24 bar diameters . Continuous lapped reinforcing shall be lapped 40 diameters of the bar , but not less than 24 inches . C. Minimum requirements for flexural and shrinkage and temperature re- inforcement shall be in accordance with ACI 318 , unless otherwise noted on the drawings . 4 : 9 SUPPORTS FOR REINFORCING STEEL A. All reinforcing steel shall be rigidly supported and accurately located and held in position by use of proper reinforcing steel supports , spacers and accessories . B . Stab reinforcing supports shall be spacer type and no bolsters shall be used . 4 : 10 FORMWORK A. Forms may be of wood or metal , free of debris and ice , well oiled . Units shall be without broken corners or blemishes . Face size of units shall be 7-5/8" high and 15-5/8" long . Weight of concrete used for lightweight blocks shall not exceed 98 pounds of dry cement and shall not include any corrosive material . D . Mortar : All cementitious materials shall be delivered to the site in manufacturer ' s standard packages . Mortar for laying up brick concrete masonry units , including brick backup , shall be composed by volume of one part cement , one part lime , and 5- 1 /5 parts sand . Mortar shall have strength of 750 Ib/square inch in 28 days and conform to ASTM C270-74T , Type "N" or "S" if called for in struct- ural calculations . 1 . F . Masonry lintels : Masonry lintels shall be in conformance with ASTM A30 latest edition . G. Joist anchor : Furnish and install steel joist anchor as shown on the structural plans . Joist anchors are to be furnished under the Structural Steel Section of this specifcation . H. All side rods shall be lapped at least 24" at all splices . 1 . Reinforcement shall be so placed as to assure a 5/8" mortar cover on the exterior face of walls and a 1 /2" mortar cover on interior faces . J . All masonry units required to be cut shall be cut with a masonry saw. See 5 : 3 B . 3 following . 5 : 3 ERECTION A. Erection shall be done in accordance with normal construction practice . B . No masonry shall be erected when ambient temperature is below 40 degrees F or when there is probability of such a condition existing within 48 hours , unless special provisions are made for heating materials and protecting completed work for 48 hours at not less than 55 degrees F . 1 . Brick work shall be laid with joints scratched . Mortar joints shall be approximately 3/811 . All joints shall be formed with suitable tools in such manner as to squeeze mortar back into joints , after mortar has taken its initial set . Concrete block joints on the inside shall be tooled , except where ceramic t le is to be applied then surface shall be struck smooth and plumb . Pg . 18 2 _ All concrete masonry partitions shall be laid in a running board . 3 . Job cutting shall be by motor-driven saw. Cut edges shall be lean and sharp . No piece , shorter than 4" shall be used at any vertical corner of jamb . All grounds , frames , sleeves and other appurtenances and provisions for work of other trades shall be built into the work and units shall be carefully cut for in- stallation of electical outlets and conduits , plumbing lines , fixtures and other mechanical installations . Wherever possible , full units of the proper size shall be used in lieu of cut units . 5 : 4 MASONRY WALL INSULATION A. Install one inch of rigid Phenthane II Insulation . Insulation shall be cut 16" wide and as long as practical to allow for brick ties to be installed at 16" spacing . 5 : 5 POINTING, CLEANING A. At completion of work , all holes in mortar joints of exposed sur - faces of masonry work shall be suitably enlarged and pointed com- pletely filled with mortar and scratched to match adjoining work . B _ All exposed face brick surfaces shall be cleaned . This shall be done prior to installation of any aluminum. 5 : 6 PROTECTION A. All masonry work shall be protected after laying against exposure to moisture . Protect all masonry laid during cold weather . Such walls shall be protected with tarpaulins or barricades and temper - ature kept at 55 degrees F for 48 hours after laying by providing temporary heat . Gas fired heaters only . 5 : 7 BRACING A . All exterior masonry walls shall be properly braced during their erection . DIVISION 6 STRUCTURAL AND MISCELLANEOUS STEEL 6 : 1 SCOPE OF WORK A. Furnish all labor , equipment and materials required for fabrication erection , and installation of all structural steel as specified . Pg . 19 B . Materials included in general shall consist of the following : 1 . All structural steel , including columns , beams , steel joist and lintels - 2 . Field connections may be bolted with high strength bolts _ All materials shall be new. All unfinished bolts shall have lock washers . G. Pg . 23 7 :3 WORKMANSHIP IN GENERAL A. All incidents to the fabrication , fitting , assembly and erection of finish , etc . , shall be executed in strict conformity with the standards of the best modern shop and field practices , and in a manner insuring the full development of designed capacities , detail and finishes . Buck anchors , screws , lag screws , spikes and nails shall be accurately spaced in conformity with developed require- ments and/or indications on the drawings , bolts and screws shall be twisted "home" and spikes and nails shall be solidly driven . B. All moldings and other worked edges and sections shall be cleanly cut , sharp and run to indicate profiles _ A neat finish shall be furnished . C . New finish hardware for exterior metal doors will be furnished and delivered to the project as specified . D. All moldings , trim, jambs indicated to be primed shall be thor- oughly cleaned and sanded as required to provide a smooth , even surface prior to receiving the prime painting . 7 : 4 EXTERIOR HOLLOW METAL DOORS AND FRAMES A. Install all hollow metal work as indicated on the drawings . 7 : 5 CAULKING A. The work included under this heading embraces all labor , materials , equipment and services necessary for and reasonably incidental to completion of the following : 1 . Cleaning out , packing , if required , and caulking of all joints on exterior between frames and masonry at hollow metal door openings including the caulking of joints between masonry and lintels . 2 . All other caulked joints specifically indicated on the drawings B_ Materials : Caulking compound shall be a silicone rubber sealant compound as manufactured by General Electric Company , Silicone Product Dept . It shall be of plastic composition and adhere to ad- jacent materials and remain sufficiently plastic , adhesive and co- hesive to maintain watertight joints when exposed to weather and subjected to ordinary structural movements . It shall not shrink excessively , crack , flow or stain . Within seven ( 7) days , it shall form a tough film and shall be neutral in color at concrete block areas and dark brown adjacent to aluminum areas . C. Application of Caulking 1 . Caulk joints of all work after prime painting but before finish painting . Pg . 24 7 : 6 EXTERIOR FACING PANELS A . Condition of Surfaces 1 . Examine substrates and adjoining construction and conditions under which work will be installed . Do not proceed with work until conditions detrimental to proper and timely completion of work has been corrected . B . Preparation 1 . Verify dimensions before proceeding with work and obtain measurements at job site for work required to be accurately fitted to other construction . When edges are exposed , finish smooth by dressing with a carborundum file . D . Cleaning 1 . Clean face of panels where required with mild detergent . No enamel shall be applied when the temperature to which it is exposed in application is below 60 degrees F . , nor shall it be applied in interior areas which are not closed and protected from draft and dust . 4 . All paint and enamel shall , unless otherwise specifically pro- vided , be applied with hair brushes , evenly spread and well brushed , enamel shall be evenly flowed . 5 . All work shall be done in a neat and workmanlike manner by skilled mechanics and shall be uniform in color , texture and appearance . It shall be smooth and free from runs , sags , de- fective brushing , crawls and like mechanical imperfections . 6 . At completion , all paint , oil , and stains shall be removed from walls , floors , woodwork , glass , hardware and all other similar items .
