I have enclosed a copy of Section 20-52 of the City Code to assist you. I have asked that Assistant Fire Chief Mayo get back with you to fully explain the process you need to follow for approval. It is extremely important that requirements to comply with the fire code and fire safety standards are met. Once they are met the City Clerk will be able to issue you your occupational license. I have directed Assistant Chief Mayo to contact you in order to answer any questions regarding these standards. Also, I have discussed the matter with the City Attorney, and he has told me that if you fail to meet City requirements regarding the occupational license and regarding the fire safety standards, you may be subject to the enforcement provisions of the Code Enforcement Board. However, he indicates that the City can certainly allow a reasonable amount of time for you to bring your premises into full compliance with all applicable codes and requirements, and issue an occupational license once all requirements are met. Within all residential Zoning Districts, the maximum amount of Impervious Surface area allowed is fifty percent (50%). Within all commercial and industrial Zoning Districts, the maximum amount of Impervious Surface area allowed is seventy percent (70%). The Zoning regulations define Impervious Surface as follows: Impervious Surface shall mean those surfaces that prevent the entry of water into the soil. Common Impervious Surfaces include, but are not limited to, rooftops, sidewalks, patio areas, driveways, parking Lots, and other surfaces made of concrete, asphalt, brick, plastic, or any surfacing material with a base or lining of an impervious material. Wood decking elevated two or more inches above grade shall not be considered impervious provided that the ground surface beneath the decking is not impervious. Pervious areas beneath roof or balcony overhangs that are subject to inundation by stormwater and which allow the percolation of that stormwater shall not be considered impervious areas. Swimming pools shall not be considered as Impervious Surfaces because of their ability to retain additional rain water, however, decking around a pool may be considered impervious depending upon materials used.
