Upon the terms and conditions herein contained, the City agrees to provide potable water and domestic sewer services to the User's Property. The term "domestic sewage" used in this paragraph and referred to throughout this Agreement is defined as follows: Human waste including liquids and solid matter carried from plumbing fixtures normally carried off by drains and sewers, and except where specifically excluded bath and toilet wastes, laundry wastes, kitchen wastes and other similar wastes. It does not include commercial or industrial waste. 2. City agrees that after User has connected to the system, thereafter City will provide, at its costs and expense, but in accordance with other provisions of this Agreement, including rules and regulations and rate schedules, sewer service and water service to User's Property in a manner conforming to reasonable requirements of public governmental agencies having jurisdiction over City's water and sewer operations, 3. User shall, at its costs and expense, install all of the potable water distribution and domestic sewage collection lines which may be required on User's property, including engineering cost, to connect City's plant to;.the User's property, and all other facilities necessary to make it possible for the City to provide adequate potable water and domestic sewage service. If buildings more than two stories in height are constructed on the User's property, the User, at its own expense, agrees to furnish to the City any equipment which may be necessary for pumping potable water to the additional height with associated back.-flow preventers, (3) At all times during the construction of the potable water and domestic sewer lines and related equipment, the City shall have access to the construction and the right to inspect the construction to insure that the lines and related equipment are being installed in accordance with the plans and specifications approved by the City. User shall construct the domestic sewage disposal lines in such a manner as to insure that no water from air conditioning systems, ice machines, swimming pools or any other form of condensate water shall flow into the domestic sewage disposal lines of the City and nothing other than sewage in its strictest sense shall be discharged into the domestic sewage disposal system of the City. City shall inspect all connections made by contractors, plumbers, builders, etc. to any portion of the sewer system that discharges into the sewage collection system owned or operated by City or contemplated to be owned and operated by City under the terms and conditions of this Agreement prior to being covered up. City shall only be obligated and will only provide water and sewer service to User's property upon 100% completion of all terms and conditions of this Agreement, 4. User shall pay a planning and inspection fee in order to defray all actual costs to City of preparing and executing this Agreement, including any attorney's fees; and conducting the inspection and testing of the installation of the User's Extension; and all other administrative costs incident to accepting the User's extension, Said fee shall be equal to one half of building permit fee, 5. User shall pay City a "Sewer Impact Fee" of $1,035.00 per residential unit and a water impact fee of $10.00 per Fixture unit/or as otherwise (4) provided in the City's Code of Ordinances, 6. The City shall provide water and sewer service to User's property upon payment to City of the standard meter charges as provided in the City's Code of Ordinances ($85.00/ 5/8 x 3/4 inch meter) , 7. Payment of the Sewer Inpact Fee, Water Impact Fee, P1araiing/ Inspection Fee and Water Pieter Charges, shall be made in full at the time City approves the plans. 8. In the event, at a future date, City's charges, rate schedules or fees are revised, subject to the operating rules and regulations and approval of governmental authorities having jurisdiction, then in that event, User and/or assigns shall pay the charges, rates or ,fees then in effect on date of payment, 9. Hydraulic share of main extensions-payment or refund; User recognizes that water or sewer utility service to th User's property is provided by the use of a main extension and other improvements constructed by a prior developer and that User is obligated to refund to said prior developer User's share.of the cost of said main extension or other improvements, Accordingly, User shall pay its pro rata share of the cost of said main extension or other improvements to City. Said pro rata share shall be based on Developer's percentage of the hydraulic capacity of said extension or other improvements. All costs incurred by the City in making such repairs shall become immediately due and payable and shall be considered in all respects the same as if said charge had arisen in connection with the rendition of the regular services of the City, 11. Notwithstanding any provision of this Agreement, the City shall have no obligation to provide sewer services to any customer producing sewage which is unusually burdensome, unusually costly to process or substantially detrimental to the sewage system, 12. This Agreement shall be bei.nding upon the parties hereto, their successors in interest, grantees, transferees and assigns. In the event User transfers any part of the User's property, it will cause its transferee to comply in all respects with the provisions of this Agreement. 13. In the event the City sells either its sewer treatment plant or collection system or its water treatment plant or water distribution system to any governmental body or any other purchaser, then, in such events, this Agreement shall terminate as to the City on any protion sold and all of its obligations or liabilities hereunder shall cease and determine for that portion sold. 14. The City may shut off the water to the User or any other person and refuse to accept sewage from the User or any other person if the User or any other persons shall fail to pay any sums due hereunder when the same becaue due and payable. Nothing herein contained, however,- not any action taken by the City in pursuance hereof shall impair any other remedy which the City might have, at law or equity, for breach of this Agreement by Owner or any other person. 15. City does not guarantee an uninterrupted supply of water for any purpose or water at any particular pressure for any purpose and reserves and shall have the right to shut off the water in its main at any time for the purpose of making repairs or extensions or for other purposes incidental to its water supply and will not be responsible for any damage caused by low pressure. City shall have the right to turn off water service at the main where the User has been found to be useing water illegally, and to assess a fee for restoration of service. 16. The City shall have the right to assign and transfer this Agreement at any time provided., however, that no such assignment or transfer shall impair the rights or increase the obligations to the User or any other person pursuant to this Agreement. (7) 17. Unless sooner terminated as provided herein, the initial term of this Agreement shall be 15 years. After the initial term of 15 years from the date of the execution of this Agreement, the terms of this Agreement shall automatically be renewed for successive terms of five (5) years each, unless written notice of termination of this Agreement is provided by either party hereto, not less than ninety (90) days prior to the commencement of any such renewal period. 18. It is expressly agreed and understood between User and City that there are no other written or verbal agreements applicable herein between User and City. 19. This Agreement may be amended and modified from time to time as necessary by mutual written agreement of the parties hereto. On the 19th of June a confidential informant under my control went into 86 Ocean. While inside the informant was given alcoholic beverages. The informant saw a "tip"jar on the bar. The informant observed Art work on the walls of the house. Some of the art had a price sticker attached to it. On the 26th of June Officer Cook with the Jacksonville Beach Police Department went to 86 Ocean. Officer Cook was working under cover. (See Officer Cook's report). On June 27 and 28th and also on July 3,4 and 5th I again performed surveillance at 86 Ocean. Again during the course of the night I saw numerous people going in and out of the house. On June 18th 1997 a parking problem was called in by Officer Bull at 86 Ocean. A traffic ticket and a warning was issued by Officer Bull. On June 19th 1997 a noise complaint was called in to the Police station about 86 Ocean. On July 2nd 1997 a 911 call was made from 86 Ocean. There was an open line. No one would talk to the dispatcher. A police Officer was sent to 86 Ocean and no one would open the door. On July 5th 1997 I talked with Helena Norden. She is the artist whose work was displayed at 86 Ocean at that time. I asked her about buying her work. She stated that I would have to be a member of the club to get in. I asked her how I could become a member. She stated that I would have to pay a membership fee of $80. Then she stated that I could buy her work there at 86 Ocean. I asked could I buy it if she was not there. She said yes that they would get the money to her. Detective Hatfield CCR i OFFENSE/INCIDENT REPORT 0 CONTINUATION K NVIL E B POLICE E T ■ SUPPLEMENT OFFENSE TITLE: VICTIM: REPORT DATE: SUPPLEMENT DATE: OFFICER Information 08/06/97 ID: 29 On 06/26/97, at 2130 hrs., I met with Detective Hatfield at the Atlantic Beach Police Department, in reference to an on going investigation. Detective Hatfield advised me that he and Detective R. Jackson were currently investigating a subject who was reportedly operating an "after-hours" club out of his residence, located at 86 Ocean Boulevard. Detective Hatfield advised me that Det. Jackson was surveying the house and that he would notify us as soon as a crowd began to gather at the residence. It was approximately 0200 hrs (06/27/97), before several people were observed entering the house. I arrived a few minutes later and waited in a short line before being greeted by the "door-man". The male subjects, that had been waiting in line ahead of me, were turned away because they were not "members". Another female and I, when confronted by the "door-man", were welcomed and asked only to sign our name and telephone number in a "membership book", for later reference. I signed the name 'Alicia Camp' and provided an old telephone number that is no longer in service. I gained entry into the residence with no problem or additional questions. Once inside, I made my way to the bar area located on the first level of-the residence. I ordered a drink and began to "mingle." As I made my way around the room, I was approached by the "door- man" who began questioning me again, asking for my name and place of employment. I fabricated a story and although I believe the "door-man" may have recognized me, I was allowed to continue through the residence. I was introduced to a young woman (name unknown), who was directed to "show me around." I was given a "tour" of all three (3) levels of the residence, where I observed a game area (cards), a billiards area, a smoking area and several 'lounging' areas consisting of numerous couches and chairs. I made contact with a white male (name unknown) in the billiards area of residence. Subject was drinking and began to talk freely about his membership in "the club." Subject stated that he enjoyed being a member, because he liked having some place to go when the bars closed. I attempted to obtain information regarding fees for membership, but subject stated that the fees varied and would not commit to an amount. I then made contact with a subject (white male) by the name of C.J. Arias, who claimed that he owned the residence.. Although he seemed somewhat reluctant to talk to me about "the club", he did acknowledge the existence of a club, stating that I was welcome anytime, with no fee, because "they needed more women". I asked 'C.J.' about the residence itself and he advised that he not only uses it as a meeting place but that he resides there on a part-time basis. As I walked throughout the residence, I looked for possible personal items to give some indication that the subject resided there, but noted none. I asked subject about possibly "booking" a private party at his residence and he stated that he could arrange something, but became nervous when I began to discuss money and how much he would charge me for the use of his facility. Subject stated that he could possibly arrange for me to get a private room at one of the local bars. Subject then suggested that I return, on some later date, and we would talk again. I left residence at approximately 0400 hours 06/27/97. CHAPTER 3 INSPECTION AND NOTICE OF NONCOMPLIANCE 301 — ACTION REQUIRED 301.1 — GENERAL The Building Official shall inspect or cause to be inspected any building, structure or portion thereof which is or may be unsafe. After the Building Official has inspect- ed or caused to be inspected a building, structure or portion thereof and has deter- mined that such building, structure or portion thereof is unsafe, he shall initiate pro- ceedings to cause the abatement of the unsafe condition by repair, vacation or demo- lition or combination thereof. 302 — NOTICE 302.1 — CONTENT 302.1.1 The Building Official shall prepare and issue a notice of unsafe building directed to the owner of record of the building or structure. The notice shall contain, but not be limited to, the following information: 1. The street address and legal description of the building, structure or premise. 2. A statement indicating the building or structure has been declared unsafe by the Building Official, and a detailed report documenting the conditions deter- mined to have rendered the building or structure unsafe under the provisions of this code. 3. A statement advising that if the following required action as determined by the Building Official is not commenced within or completed by the time specified, the building will be ordered vacated and posted to prevent further occupancy until the work is completed and the Building Official may cause the work to be done and all costs incurred charged against the property or the owner of record. 3.1 If the building or structure is to be repaired, the notice shall require that all necessary permits be secured and the work commenced within 60 days and continued to completion within such time as the Building Official determines. The notice shall also indicate the degree to which the repairs must comply with the provisions of the Standard Building Code©, in accordance with 101.4. 3.2 If the building or structure is to be vacated, the notice shall indicate the time within which vacation is to be completed. 3.3 If the building or structure is to be demolished, the notice shall require that the premises be vacated within 60 days, that all required permits for demoli- tion be secured and that the demolition be completed within such time as determined reasonable by the Building Official 4. A statement advising that any person having any legal interest in the property may appeal the notice by the Building Official to the Board of Adjustment and Appeals; and that such appeal shall be in writing in the form specified in 401 and shall be filed with the Building Official within 30 days from the date of the notice Standard Unsafe Building Abatement Code© 1992 7 f and that failure to appeal in the time specified will constitute a waiver of all rights to an administrative hearing. 302.1.2 The notice and all attachments thereto shall be served upon the owner of record and posted on the property in a conspicious location. A copy of the notice and all attachments thereto shall also be served on any person determined from official public records to have a legal interest in the property. Failure of the Building Official to serve any person herein required to be served other than the owner of record shall not invalidate any proceedings hereunder nor shall it relieve any other person served from any obligation imposed on him. 302.1.3 The notice shall be served either personally or by certified mail, postage prepaid, return receipt requested, to each person at the address as it appears on the official public records. If addresses are not available on any person required to be served the notice, the notice addressed to such person shall be mailed to the address of the building or structure involved in the proceedings. The failure of any person to receive notice, other than the owner of record, shall not invalidate any proceedings under this section. Service by certified or registered mail as herein described shall J be effective on the date the notice was received as indicated on the return receipt. 302.1.4 Proof of service of the notice shall be by written declaration indicating the date, time and manner in which service was made and signed by the person served on by the return receipt. 302.2 — RECORDING OF NOTICE If the notice is not complied with nor an appeal filed within the allotted time, the Building Official shall file in the Office of the Recorder a certificate describing the property and certifying that the building or structure is unsafe and that the owner of record has been served. This certificate shall remain on file until such time as the conditions rendering the building or structure unsafe have been abated. At such time, the Building Official shall file a new certificate indicating that corrective action has been taken and the building or structure is no longer unsafe from that condition. 303 — STANDARDS FOR COMPLIANCE The following action shall be taken by the Building Official when ordering the repair, vacation or demolition of an unsafe building or structure. 1. The building shall be ordered repaired in accordance with the Standard Building Code© or demolished at the option of the owner. 2. The removal of the tape is also under his direction and control. Relative to the issue of having a law enforcement officer on the scene when the property was posted, this is not an unusual practice for Atlantic Beach or other government agencies. The presence of a police officer assures the peaceful posting of the property in a situation where conflict may arise. Detective Hatfield is familiar with the recent history of the property including code enforcement violations as well as other improprieties, and he was assigned to assist the Building Inspector on the scene. The property at 86 Ocean Blvd. was posted based on the authority of the Building Inspector Don Ford. The tenant, C. J. Eiras, was cited on June 5, 1997 for the aforementioned violations and given ten days to apply for permits. I have been in contact with the proprty owner, Rocky Russell, and have been informed of remodeling continuously being performed at 86 Ocean Boulevard by C. J. Eiras during the month of June. On July 11, 1997, Mr. Eiras stated to me he had replaced all the light fixtures in the townhouse. No permits were pulled for this work Due to the exposure by the City in that we are aware of faulty wiring, I had the property posted and a police line taped across the front of the building to keep pedestrian traffic away from the structure.
