entrance into a'pool area by unauthorized persons,particularly the protection of smalichildren.
We aclmowledge the fact that if a neighbor's fence is already in place immediately adjacent to
where your fence should go,adding a second fence on your property,would'not be a suitable
deterren�due to the fact that now both fences have horizontal runners where a child can climb one
side and down on the other.
Therefore,it is our detennination from a practical obserwition,that an existing fence may be
utilized as the required barrier. However,if that fence is removed,you will be responsible to
immediately install a new fence. Failure to do so will place you in noncompliance with the City

Dear Ms. Doerr:
Attached is the survey you requested during our telephone discussion this morning
regarding the fact that when pulling a garage demolition permit yesterday, and needing a
quit claim deed to prove property ownership, my builder was also told by the front desk
that we had an unbuildable property. This is the latest survey, and shows a description of
the property and is accompanied by a copy of the quit claim deed.
I've also attached:
1. the survey we referred to when I originally met with you during my school Christmas
holiday in 2001 to discuss dividing the property and no problems arose concerning
this division
2. the redrawn survey showing the fence dividing the property and a copy of the permit
for the fence
3. copies of the notes I took during our meeting in July 2002, when I talked to you about
where a garage would fit on the property because we were having trouble selling the
property without a garage, and my fax to the realtor about the results of the same
meeting, including the survey we referred to.
Also, during this meeting, we discussed the placement of the existing garage and its
possible use attached to the new house, and the fact that it was skewed so that the back of
the garage was 5 feet from the property, but the front overlapped by a few inches, and
you said that it was within your authority to grant a variance for those few inches.
Hopefully all this will refresh rather than overwhelm your memory. To say that I am
concerned about this is a massive understatement. I hope to either hear from you or meet
with you as soon as possible.

Had an appointment yesterday with Sonya Doerr, Atlantic Beach Comminity Development
Director. We went over the survey to find garage possibilities which are somewhat
brighter than you were told earlier. Here it is:
-the house is on a corner lot, therefore the longest side of the comer is the side yard, that
makes the Ocean Blvd. side of the house, for building purposes, the side of the house
-the 14th St. side of the comer is considered the front yard, and so on
-yard size requirements for this area of AtlanticBeach are front yard-20 feet, rear yard-20
feet, side yard-15 total feet: 5 minimum feet
-the"front yard" of our house (14th St. side) is only 15 feet,but has been grandfathered
in, that means that as long as you stay in the footprint of what's there now, for example
replacing bedroom space with a garage or going second story, you can keep that extra 5
feet
*if, however, you add to either side of the house, you have to go in the other 5 feet
before you go out
-the Ocean Blvd. side yard has to be 15 feet because it is on the street (there still has to be
a 5 foot minimum from the west property line to construction)
-that leaves us to work with: 14 feet from the house out on the Ocean Blvd.(west) side,
from 5 feet in from the south side of the house to 7.3 feet
out from the north side of the house and approximately the
same dimensions from the house to the east property line
with some intrusions into both areas from ftont steps,
kitchen bay, pizza oven, and deck
-so it is possible to put al4x2O+ garage on either side of the steps on the Ocean Blvd. side
of the house, the disadvatage being that to attach the garage to the house to get the 14
foot depth you lose some windows, on the other hand, there are possibilities for opening
up windows on the the north and south end to compensate for that and, even more
important, if the garage is attached to the house, a second, and third story, are permitted
on the garage
-or you can choose a smaller one story detached garage in the same area
-east side of house also a possibility although the garage would be long and narrow
because the entry from either 14th St. or through north side yard from Ocean Blvd
-if you are willing to remodel more extensively, as already mentioned the south end of the
house is a possibility, the lost bedroom space could be replaced above the garage, or the
current family room was originally a garage, etc., etc.
I'm faxing you a survey with this all marked on it. It makes more sense if you can see it.
Obviously, all my markings are approximate. I've also roughed in the approximate size
and shape of the house on the other lot if you want to give people an idea of what they'll
be looking at. I'm also including a survey with only the buildable space marked (also
approximate)if you'd rather keep it simple and let them figure out what to do.
The only other thing that came up yesterday with Ms. Doerr is that there has to be a
parking place within the property lines(not the buildable lines)for two cars, that is, two
I Ox2O places. The half circle slab out front looks like it takes care of it, but legally it
doesn't. I think I filled out a sheet of paper earlier for you about any known code
violations and I guess this would be one, but since everyone is so hot to get a garage, that
will take care of it, if not, it's a manageable problem. Just to let you know.
Son-y to go on and on, but last of all, maybe we need to remind these people that the lot
alone in this location would cost them upwards of $300,000 and there's a good size,
solid, livable house on it. Any work that they do will add double the amount in resale
value. When there are houses half this size and three times as far away from the beach
going for$300,00+, 1 just don't think.we're particularly out of line in our price. Tell them
to stop whining and make me an offer.

I have reviewed the property and subdivision files maintained by the City and related to
your property. The property that you now own consists of all of Lot I and Lot 2 and a
portion of Lot 3 and Lot 7 within Block 60 of Mandalay subdivision. City records
indicate that this property was developed by 1951 and that the property configuration, as
it now exists, was created prior to 1977, and prior to current regulations, which would
now consider such a division of land as an illegal division. Lots 1, 2 and 3 and 7 were
originally platted as 50-foot wide by 100-foot deep lots. In that the division, which you
now propose, does not create new, or additional lots, and maintains two lots, one of
which is larger than the originally platted lot, the City considers the lots to be consistent
with the original subdivision plat and not in conflict with the City's subdivision
regulations. Please be mindful, however, of Section 24-190, a copy of which I have
enclosed.

Any facility maintained, repaired, erected, and/or installed in the exercise of the privilege granted
remains subject to relocation or removal on thirty (30) days notice by CITY to the USER, said notice to

The depositing of said notice of cancellation in the United States mail shall constitute the notice of
cancellation and the burden is upon USER to keep the CITY informed of USER's proper address.
The USER shall promptly make any and all necessary repairs to any facility erected or maintained in
the exercise of the privilege herein granted and shall at all times maintain said facility in good and safe
condition.
In the event it is necessary for the CITY or the City's approved representative or other franchised
utility to enter upon the above-described property of the CITY, the USER shall replace at the USER's
sole expense, any and all material necessarily displaced during the action of maintaining, repairing,
operating, replacing, or adding to of the utilities and facilities of the CITY or franchise utility provider.
The facilities allowed by the permit shall meet the current requirements of the City Code, Building
Codes, Land Development Code, and all other land use and code requirements of the CITY.
The USER, prior to making any changes from the approved plans and/or method, must obtain
written approval from the City of Atlantic Beach, Public Works Department, for said change. The

USER shall, at the discretion of the CITY, be requested to submit as-built drawings showing the change
within thirty (30) days after the day of completion.
This permit shall inure to the benefit of, and be binding upon, the USER and their respective
successors and assigns.
USER shall meet the terms and conditions of this permit and to all of the applicable State and CITY
laws and/or specifications, to include utilities locate requirements and use limitations/requirements of
public rights-of-way and other public land. USER further agrees that the CITY and its officers and
employees shall be saved harmless by the USER from any of the work herein under the terms of this
permit and that all of said liabilities are hereby assumed by the USER.
