MAINTENANCE AGREEMENT
This Agreement made and executed this ?i I ' day of January, 2012 by and between
BEACHES HABITAT FOR HUMANITY, INC., a not for profit Florida corporation (the
"Grantor "), whose mailing address is 1671 Francis Avenue, Atlantic Beach, Florida 32233
(hereinafter called "Grantor "), for the benefit of CITY OF ATLANTIC BEACH, a Florida
municipal corporation, whose address is 800 Seminole Road, Atlantic Beach, Florida 32233
(hereinafter called the "City").
WITNESSETH:
WHEREAS, Grantor is the owner of the real property located at 420, 422, 424 and 426 W.
Dutton Island Road, in Atlantic Beach, Duval County, Florida, described as follows (the "Property"):
Lots 2 & 3, STEWART SUBDIVISION SECOND REPLAT,
according to the plat thereof as recorded in Plat Book 46, Page 11
of the public records of Duval County, Florida.
AND WHEREAS, the City has required an Agreement providing for the maintenance and
upkeep of the Retention Areas located on the Property.
NOW THEREFORE, in consideration of Ten and No /100 Dollars ($10.00) and other good
and valuable consideration, receipt of which is hereby acknowledged, the Grantor hereby agrees as
follows:
1. The Grantor, its successors and assigns, shall be responsible for the maintenance,
operation, repair and upkeep of the Retention Areas located on the Property as required by the City.
2. This Agreement shall run with the title to the Property, and the grantee of any deed
conveying any lot on the Property is deemed by the acceptance of such deed to have agreed to
comply with and be bound by this Agreement.
3. The rights and benefits hereunder shall inure to and the duties and responsibilities
hereunder shall be binding upon the successors and assigns of the parties hereto.
IN WITNESS WHEREOF, Grantor has executed this instrument as of the day and year first
above written.
