The set backs for RS- 2 Zoning are 20 foot front yard and 20 foot rear yard and a total of 15 feet for side yard with the minimum of 5 feet. Presently the property has two structures on it, a main house and an apartment in the rear yard. These structures were in place when the zoning code changed in 1974, therefore they are considered grandfathered. The property is also considered a non-conforming use. Based on these facts, any removal of either structure would require that the property be brought into compliance and a single family home would be the only allowable use. Following our discussion about the project, currently in the design phase, I studied the applicable ordinance again, specifically Sec. 24-85(a)(3)(attached), and believe a different interpretation is more fair. Specifically, I see this 1940's, off-grade wood framed house as Structural Systems, comprised basically of four parts as follows- 1. Roof System 25% 2. Wall Systems(Int & Ext) 20% 3. Floor System 30% 4 Foundation System 25% Total 100% In order to build the two story plan I showed you as a remodel of the existing one story house, my plan would be to remove the roof and most of the walls, repair and strengthen the Floor and Foundation Systems resulting in totally "destroying" only 45% of the nonconforming structure. This may seem like splitting hairs, but I have actually designed my construction techniques to comply with 50% rule as close a possible.
