CRC Minutes 1-18-93 vMINUTES OF THE MEETING OF THE CHARTER REVISION COMMITTEE HELD IN
THE CONFERENCE ROOM, CITY HALL, 800 SEMINOLE ROAD, AT 7:30 PM ON
MONDAY, JANUARY 18, 1993.
Commissioner Tucker called the meeting to order at 7:30 PM and
noted that all members were present. She welcomed Bill Dorsey and
new member, Dorothy Kerber, both of whom were attending for the
first time.
Input regarding the Charter had been received from the City
Manager, Police Chief and Fire Chief, and on motion properly made
and seconded, this information was accepted and entered into the
record. Ray Salman then suggested that the committee review the
Charter section by section and decide whether any change was
necessary.
ARTICLE I. INCORPORATION; FORM OF GOVERNMENT; POWERS
Section 1. PRESENT MUNICIPAL CORPORATION OF CITY OF ATLANTIC BEACH
ABOLISHED and Section 2. INCORPORATION OF CITY OF ATLANTIC BEACH
(ANNEXATIONS). - Discussion ensued regarding whether the area
north of Sixteenth Street which had been annexed to the city by
referendum in November 1986, should be merged into the meets and
bounds of Atlantic Beach. Following brief discussion it was
consensus that it might better preserve the historic record to
leave this section as is.
Section 3. FORM OF GOVERNMENT - No change recommended.
Section 4. GENERAL POWERS - A lengthy discussion ensued
regarding whether the general powers should be delineated as at
present or whether this section should be changed to indicate that
the city would have those powers provided by F.S. Chapter 166. It
was agreed to leave this section as is for now and to revisit it
later.
ARTICLE II. THE COMMISSION
Section 5. NUMBER; SELECTION; TERM - It was noted that this
section had recently been changed by referendum and the wording
will be changed when the next code supplement is received.
Section 6. QUALIFICATIONS AND DISQUALIFICATIONS - Discussion
ensued regarding the residency requirement and the qualifications
of electors. It was agreed that the freeholder requirement was now
unconstitutional and should be deleted. Mr. Dorsey agreed to draft
new language for this section.
Section 7. SALARY - No change recommended.
Section 8. PRESIDING OFFICER: MAYOR - No change recommended.

Section 9. POWERS - Several changes were suggested, including:
(9) Delete reference to municipal court;
(14) Delete municipal judge and municipal prosecutor, leave
city manager, attorney, city clerk, and all others.
At this time it was agreed to prioritize the recommended changes
into primary, secondary, and tertiary categories. Section 9 was
given a primary ranking.
Section 10, APPOINTMENT OF CITY MANAGER - no changes recommended.
Section 11. REMOVAL OF CITY MANAGER - Revision recommended

Section 12. VACANCIES IN THE CITY COMMISSION - Revision
recommended, particularly in regards to the definition of "eligible
person." (Primary)
Section 13. CREATION OF NEW DEPARTMENTS OR OFFICES; CHANGE OF
DUTIES - No changes recommended.
Section 14. INDUCTION OF CITY COMMISSION INTO OFFICE, MEETINGS OF
THE CITY COMMISSION - Revision recommended. (Primary)

RULES OF PROCEDURE; JOURNAL OF MINUTES No changes
Section 17. ORDINANCES - Following discussion of this section it
was felt that Section 17 - 23 should be rewritten to delineate the
procedure for passage of ordinances and emergency ordinances.
Committee members are to read the old Charter and Florida Statutes
relative to enactment of ordinances.
Section 24. INDEPENDENT ANNUAL AUDIT No changes recommended.
The next meeting was scheduled for 7:00 PM on Monday February 1,
1993, at which time the committee will continue with the review of
the Charter beginning with Article III, The City Manager.
There being no further discussion, on motion from Gregg McCaulie,
seconded by Ms. Kerber, the meeting adjourned at 9:20 PM.
