CRC Minutes 3-15-93 vMINUTES OF THE MEETING OF THE CHARTER REVISIONS COMMITTEE HELD IN THE CONFERENCE ROOM, CITY HALL, 800 SEMINOLE ROAD, AT 7:00 PM ON MONDAY, MARCH 15, 1993 The meeting was called to order by Commissioner Tucker. The following committee members were present: Committee Chair Adelaide Tucker, Ray Salman, Ruth Gregg, Mark Popp, Bob Cook, Dorothy Kerber, and Maureen King. Committee members absent were Gregg McCaulie and Bill Dorsey. On motion made by Ray Salman, seconded by Dorothy Kerber, the minutes of the meeting of February 15, 1993, were unanimously approved. On motion by Ray Salman, seconded by Ruth Gregg, the minutes of the meeting of March 1, 1993, were unanimously approved. Discussion ensued regarding Ordinance No. 33-93-5 which provided that a commission seat being vacated by a commissioner submitting a letter of resignation to run for another office, could be placed on the ballot for election at the next election. It was noted that the ordinance had been passed on first reading at the city commission meeting on March 8, 1993. Bob Cook inquired whether a paragraph should be added regarding notification of the City Commission regarding such aa resignation. Ray Salman moved that the section of the Charter regarding commission vacancies be amended to require that the City Commission be notified at its next regular meeting of any letter of resignation received from a commissioner. The motion was seconded by Commissioner Tucker and was approved by a 4 - 3 vote with Commissioner Tucker, Bob Cook and Mark Popp voting nay. Discussion then ensued regarding the Charter, with discussion beginning with Section 88 and recommendations were as follows: ARTICLE X. INITIATIVE AND REFERENDUM Section 88. POWER OF INITIATIVE - No change Section 89. POWER OF REFERENDUM - Rewrite (Primary) Section 90. FORM OF PETITIONS, COMMITTEE OF PETITIONERS - Rewrite (Primary) Section 91. FILING, EXAMINATION AND CERTIFICATION OF PETITIONS - Rewrite to clarify the meaning of "insufficient." (Primary) Section 92. AMENDMENT OF PETITIONS - Rewrite to clarify "insufficiency" and to clarify the type of amendments which would be permitted. Section 93. EFFECT OF CERTIFICATION OF REFERENDUM PETITION - Rewrite to conform to the amended version of Section 92. (Primary) Page Two Charter Revision Committee Minutes - March 15, 1993 Section 94. CONSIDERATION BY COMMISSION - Rewrite (Primary). The last three lines of the paragraph seems to address a different matter from that of the first five lines. Section 95. SUBMISSION TO ELECTORS - Rewrite (Primary) Section 96. FORM OF BALLOT FOR INITIATED OR REFERRED ORDINANCES - Rewrite to eliminate the use of paper ballots (Primary). Section 97. AVAILABILITY OF LIST OF QUALIFIED ELECTORS - Rewrite to indicate lists of qualified electors are available through the office of the Supervisor of Elections for Duval County and the cost of lists, labels, etc. shall be at the discretion of that office. Section 98. RESULTS OF ELECTION - Rewrite (Primary). Section 98 seems to indicate that conflicting ordinances could appear on the same ballot. Section 99. REPEALING ORDINANCES; POSTING - Rewrite (Primary). Committee felt commission should not have power to amend or repeal ordinances that had been approved by electors by initiative or referendum. ARTICLE XI. RECALL Change editor's note to indicate that recall procedures will follow those procedures as prescribed by F.S. 100.361 ARTICLE XII. FRANCHISES Leave as is. ARTICLE XIII. TAX ADMINISTRATION Rewrite - Tax Administration to be in accordance with F.S. 193.116 or as otherwise provided for in Chapter 20 of the Code of Ordinances. ARTICLE XIV. ZONING Rewrite editor's note. Zoning regulations will be as provided in Chapter 24 of the Code of Ordinances ARTICLE XV. ISSUANCE OF BONDS Rewrite to include summary of provisions of F.S. 166. Change title to "Municipal Borrowing." ARTICLE XVI. MUNICIPAL COURT AND DEPARTMENT OF LAW Page Three Charter Revision Committee Minutes - March 15, 1993 Delete Section 151 - 157 Section 158. CITY ATTORNEY: APPOINTMENT AND QUALIFICATIONS - Relocate sections 158 and 159 and include with other city departments. The next meeting of the Charter Revision Committee was scheduled for 7:00 PM on Monday, April 5, 1993, at which time discussion will commence with Article XVII, Suits Against the City.
