CRC Minutes 3-1-93 v MINUTES OF THE MEETING OF THE CHARTER REVISION COMMITTEE HELD IN
THE CONFERENCE ROOM, CITY HALL, 800 SEMINOLE ROAD, AT 7 : 00 PM ON
MONDAY, MARCH 1, 1993 .
The meeting was called to order by Commissioner Tucker. The
following committee members were present: Committee Chair Adelaide
Tucker, Ray Salman, Ruth Gregg, Mark Popp, Bob Cook, Bill Dorsey
and Maureen King. The following committee members were absent:
Dorothy Kerber and Gregg McCaulie.
A draft ordinance proposing to establish a procedure to be used to
fill a commission seat which is being vacated by a commissioner
submitting a letter of resignation to run for another office, was
distributed to each committee member. Following brief discussion
it was agreed to present this ordinance to the City Commission for
first reading at the next regular meeting on Monday, March 8, 1993.
Article IX, Elections, of the City Charter was then discussed and
recommendations were as follows:
ARTICLE IX. ELECTIONS
Section 78 . ELECTIONS - The first sentence should be amended to
add "or state law" after the word "Charter. "
Section 79 . ELECTORS - Amend by adding F.S. 166. 032 as follows:
"Any person who is qualified to register to vote and is a resident
of Atlantic Beach, who has qualified as an elector of this state,
and who registers in the manner prescribed by general law and
ordinance of Atlantic Beach, shall be a qualified elector. "
Section 80. REGISTRATION OF VOTERS - Change title to "Registration
of Electors. " The text of Section 80 shall read as follows: "
Registration of electors shall be in accordance with F.S. Chapter
98. "
Section 81 . NOMINATIONS - Following a lengthy discussion, the
first paragraph of Section 81 was revised to read substantially as
follows: "Any elector of the city having the additional
qualifications and limitations as set forth in Article II, Section
6, may be nominated for the commission. Such nomination shall be
only by petition. A petition for this purpose shall be signed by
not less than ten qualified electors. The signatures on the
nominating petition need not all be subscribed on one paper. Each
separate paper shall have affixed a signed statement of the
circulator thereof stating the number of signers of such paper and
that each signature appended thereto was made in the presence of
the circulator and is the genuine signature of the person whose
name it purports to be. Each signer, including the circulator,
shall provide his/her place of residence including the street and
number or other information sufficient to identify the residence. "
Section 82 . ELECTIONS: PRIMARY - Leave as is.

Section 83. ELECTIONS: GENERAL - The first sentence of this
section was amended to read as follows: "A regular or general
election of candidates or nominees to the office of city
commissioner shall be held every two years on the third Tuesday in
October, unless all vacancies have been determined by the primary
election in accordance with Section 82 of this Charter. "
Section 84. ELECTIONS: WRITING IN OF CANDIDATES - Delete
Section 85. ABSENTEE VOTING - Leave as is. It was consensus that
the type of terminology in this section should be used in those
sections where text has been deleted as being superseded by Florida
Statutes.
Section 86 . ELECTIONS: GOVERNED BY STATE LAW OR ORDINANCE - Leave
as is.
Section 87 . ELECTIONS: CANVASS OF RETURNS - Discussion ensued
regarding whether the intent of this section was that a regular
meeting would be held on election day following the canvassing of
the votes, at which time the City Commission would declare the
result of the election, or whether this action should take place at
the next regularly scheduled meeting of the City Commission. It
was the general opinion that the intent was that the results would
be declared at the next regularly scheduled meeting of the City
Commission but it appeared this section had been misinterpreted for
years. It was agreed the City Clerk would advise the City
Commission and candidates that in the future, in accordance with
Section 87, the results of the election would be declared at the
next regularly scheduled meeting of the City Commission.
The next meeting of the Charter Revision Committee was scheduled
for 7 :00 PM on Monday, March 15, 1993 .
There being no further discussion, the meeting was adjourned at
9 :00 PM.
