Our builder, David Willis, presented our plans to the Board. After discussion, the Board accepted our plan which showed the siting of the home and the necessary removal of certain trees. The Board, however, required that we plant 25' inches of new trees on the property at a cost of over $2,000. Our appeal is based on our belief that the planting of additional trees on our property is not necessary or appropriate because of the cover that will remain from existing trees after construction of our home. We believe that we will have more tree cover than most lots within Oceanwalk so that a requirement to plan even more trees results in an unfair financial burden to us. We also question whether new trees will thrive under the existing canopy and how the introduction of even more shade will affect our ability to grow and maintain shrubs and sod. We would like to have a landscaped lot that is in harmony with the natural beauty of Oceanwalk. We do not believe the arbitrary addition of more trees accomplishes this goal. We purchased our lot in 1987, in part because we liked its beautiful trees. We were not aware that, in the future when we would proceed with building our home, that a tree board would impose a requirement for additional trees. The Tree Conservation Board reviewed and approved the proposed tree removals subject to mitigation in the form of tree replacement on the site. The applicant has appealed the mitigation requirement. During discussion of the request, the Board determined that w 102 inches (by diameters) of trees would be removed. In response to the applicants assertion that a substantial tree canopy would remain, the Board determined that mitigation would be based only on the removal of three trees totalling 77 inches. The ordered mitigation was the planting of 25 inches of hardwood trees on the site, with a minimum diameter of 3 inches per tree. RECOMMENDATION: In the absence of clearly established mitigation requirements in the ordinance, the Tree Conservation Board has established a policy of requiring 1/3 mitigation of hardwoods removed (by diameter inches). This policy is flexible in that the Board can take into account existing tree canopy as well as other pertinent factors. As evidenced by the attached copy of the Tree Conservation Board minutes, the Board did factor in the remaining canopy and the mitigation was for specific trees proposed for removal. Present were: Hope Van Nortwick, Chairman Mae Jones Richard Beaver Tom Frohne Jim Pelkey Staff: Carl Walker, Coordinator r The meeting was called to order at 7:30 PM by Hope Van Nort- wick, Chairman, in the City Hall Conference Room. The first item of business was the application for tree remo- - Y val at Lot #20, Unit #3, Oceanwalk. David Willis, contractor, introduced himself as representing the property owners. He stated that the owners were concerned with the removal of two large oaks, 28" and 29" DBH, respectively. However, attempts to shift the house footprint on the lot and /or reverse the house plan had not been successful in saving the two oaks. The Board discussed changing the placement of the house on the property but it was finally agreed that the elevation variance of the lot would preclude safely protecting the two oaks. It was calulated that the hardwood trees totaled 102" DBH, not counting the palm trees proposed for removal. Mr. Willis brought out that an extensive tree canopy remained. Jim Pelkey moved to accept the plans with the exception that mitigation be made for the removal of the 28" and 29" DBH oak trees and a 20" DBH bay tree, totaling approximately 77" DBH. Replacement of hardwood trees, each with a DBH of 3" or more, are to be planted on the lot for a total of 25" DBH. The motion was seconded by Mae Jones and carried unanimously. Discussion followed on the requirement of Tiffany by the Sea to install ten (10) trees on public property since there is not sufficient room of the Tiffany property. It was agreed that the location for the planting would be Saturiba Drive and that the trees should be placed approximately 30' apart. Rick Beaver voiced that he felt sycamore trees would be pre- ferable at that location but other members stated that they were in favor of the planting of oak trees. The bottom sash measured 40 -1/8" wide X 29 -1/2" high overall. The top sash measured 39 -1/4" wide X 28 -5/8" high overall. The frame corners were of welded mitered with one screw in bottom corners construction. I The sash corners were of welded mitered type corner construction. Bottom sash had an aluminum exterior screen. Each sash had (2) foam chimney blocks located in the jambs near the balances. One foam chimney block for each side of each sash. Each perimeter frame I member hollows were filled with stirrofoam pieces that measured to be 7/16" x 9/16 ". The bottom rail of the bottom sash had a anti bow sway bar attached to the rail and when the window would shut the bar would slide into an opening that was in the center of the sill. One cam -type sweep lock was attached to the center of the bottom sash meeting rail with keeper on top sash meeting rail. One die -cast pivot bar was fastened with (1) screw at each end of the bottom horizontal rails of the top and bottom sash. The sash utilized two (1/8 ") thick clear annealed glass lites with a 5/8" continuous metal spacer. An exterior snap -in single leaf dual durometer rigid vinyl - glazing bead secured the glass. 1 Weep Holes: Two (3/8" x 3/32 ") weep slots were located at the glazing track through the bottom of the top sash bottom horizontal rail, one 4 -1/8" from each end. Two (1/4" x 3/32 ") weep slots were located at the glazing track of the bottom sash bottom horizontal rail, one 2" from each end. One (3/8" x 3/16 ") weep slot were located just above each of the pivot bars on the ends of the bottom sash rail of the both sashes. Two (1/2" x 1/8 ") baffled weep slots were located on the exterior face of the sill, each one 1 -7/8" from each end. Four (1/2" x 1/8 ") weep slots were located on the inner chamber wall of the sill, two on very end of each side. Each jamb was attached with four sets of 2" long screws. The header was attached with two sets of wood screws. Each set of screws consisted of a screw located on the interior jamb track and one screw located on the exterior track of the frame. Each set of screws were attached parallel to each other. The sill was secured using a built up of wood that was secured to the 1 buck and then the sill was attached with silicone to the wood. The exterior of the sill then used a trim attachment and was secured to the frame sill and buck using silicone. I .
