Lane 509 3rd Avenue South Jacksonville Beach, FL 32250 Dear Mr. Lane: The Code Enforcement Board of the City of Atlantic Beach was created pursuant to Florida Statutes and exists for the purpose of facilitating the enforcement of the Code of Ordinances. It is comprised of seven citizens, residents of Atlantic Beach, who meet regularly to hear allegations of code violations. You are hereby notified and ordered to appear at the next public hearing of the Code Enforcement Board on TUESDAY, the 29th day of April, 1997 AT 7:30 P. M. at Atlantic Beach City Hall, 800 Seminole Road, to answer and be heard to the alleged violations of the following Section(s): Chapter 12,Sections 12 -1 -8. It is alleged that you are in violation of the above enumerated code section(s) in that there exists on the premises located at 1970 Park Street, a /k/a Lot 7. In order to achieve compliance, it is necessary to : Temporarily secure the building by boarding up all windows ,doors ,and any other openings to the structure 10. I do x Do not have photographs of the property and violations as they exist on the property. They represent a fair and accurate representation of the property at the time they were taken. 11. I would estimate that 5 days would be sufficient time to correct the violation. 12. Further comments and recommendation : This property has been continuously left in an unsafe , unhealthy condition . Following notification of condemnation of building several years ago by the building department rehabilitation was started . It was discontinued after some minor repair . Despite several notifications to secure or rehabilitate the structure no work has been done . The property has been left to deteriate ,broken windows , doors , roof , ceilings ,plumbing etc. J.E. A. was directed to remove the meter when electrical violations were found and no repairs were made. The Code Enforcement Board has heard testimony at the Code Enforcement Board hearing held the 29TH day of APRIL , 1997, and based on the evidence, the Code Enforcement Board enters the following FINDINGS OF FACT, CONCLUSIONS OF LAW, • FINDINGS OF FACT Linzy C. Lane, owner of SAID PROPERTY LOCATED AT 1970 Park Street WAS FOUND TO BE IN VIOLATION OF CHAPTER 12, SECTION 12 -01 -08 OF THE CODE. THE BOARD GAVE MR. LANE UNTIL MAY 5, 1997 TO SECURE THE HOUSE BY REPAIRING OR BOARDING UP THE BROKEN WINDOWS IN A MANNER APPROVED BY THE CODE ENFORCEMENT OFFICER. IF THE PROPERTY IS FOUND TO BE IN NON- COMPLIANCE OF SECTION 12 -01 -08 AFTER SAID DATE, A FINE OF $10.00 PER DAY WILL BE LEVIED AGAINST SAID PROPERTY BEGINNING MAY 6, 1997 AND CONTINUING UNTIL COMPLIANCE IS REACHED TO THE SATISFACTION OF THE CODE ENFORCEMENT OFFICER. Thomps Subject: Inquiry About Fire Department `Burning down" a House Date: April 29, 1998 Based on the question presented by Mayor Shaughnessy last night, the following information may be helpful to you. I am unaware of any such incident where the Fire Department was burning any house for training. However, there was an incident earlier this month that may have been misconstrued and /or exaggerated such that it fits this situation. In 1993, the house located at 1970 Park Street was condemned by the building department. At that time, the notice provided by the City directed the owner to bring the property up to compliance or the City would bid out the demolition of the structure. Over the next few years, this house was taken before the Code Enforcement Board due to its condition. (See Attachments) On July 21, 1997, the City Building Department notified the owner by registered mail that the City was proceeding with the bid process to have the structure demolished. (See Attachment) The signature on the registered mail receipt appears to be the that of the owner. The City did not receive any response from the owner to challenge, contest, appeal or delay the demolition process. During the past year, the Fire Department contacted Community Development about needing houses on which they could "practice." There are some techniques that firefighters rarely get to practice because they need a house that they can damage. This is a common practice in fire departments around the country, including Jacksonville. The Fire Department asked for information on any houses that were scheduled for demolition so that the firefighters could practice on them. The Fire Department received a list of three (3) houses that were scheduled for demolition. (See Attachment) They verified the location, and the fact that the house was scheduled for demolition within the next week. They went to 1970 Park Street and started training, which involved entries and damaging the roof. They trained at the house on March 30, 31, and April 9, 1998. On April 9, a woman drove up and asked what they were doing, and the firefighters explained. When the woman stated that she was the owner and she did not know about it, the firefighters immediately ceased their work and verified the location, again. In light of the questions, the Fire Department ended their training and immediately discussed the matter with Community Mr. Jim Jarboe, City Manager Page 2 April 29, 1998 Development. As it currently stands, the contract for demolition has been awarded and the house is still scheduled for demolition. Community Development is still trying to finalize the contract with the contractor. Since the house is about to be demolished, there does not appear to be any monetary loss on the part of the owner. The Building Official has sent the owner a follow -up letter since this incident to help reinforce the fact that the City plans to demolish the structure as soon as possible. (See Attachment) From the Public Safety point of view, the most serious problem was that the owner had not been notified that the Fire Department would be training on the house. Although the Police and Fire Departments had done similar training on condemned houses in the past, there was no specific guidance or procedure as to notifying the owner in such circumstances. Since this incident, the Fire and Police Departments have been advised to specifically notify in the owner of the property in the future to obtain permission. If the owner denies permission for the training, then the Fire and Police Departments will not train at the location. There is no indication that the Fire Department acted without due care and caution. They obtained information on the houses scheduled to be demolished. They verified the information and conducted training at that location. As soon as they identified a problem, they stopped the training and reported it. In the future, they will take the extra step to notify the owner personally to assure that there are no surprises. Ford Building Official DCF /pah cc: City Manager Minutes Page -10- Code Enforcement Board April 29, 1997 A motion was made by Chairman Martin, seconded by Ken Rogosheske and unanimously carried to establish a fine of $25.00 per day for a violation of any part of Section 12 -1 (3) and the motion carried by a four to two vote with Board Members Deitchman and Mitchelson voting nay. A motion was made by Chairman Martin, seconded by Ken Rogosheske and carried by a -- five to one vote with Board Member Mitchelson voting nay, to give Beaches Aquatic Pool, Inc. until May 12, 1997 to bring the property into compliance or a $25.00 per day fine will be levied beginning May 13, 1997 for each day the property is in non - compliance and continuing until compliance is reached to the satisfaction of the Code Enforcement Officer. A motion to amend the motion was made by Board Member Mitchelson to levy a one time fine of $100.00 to be assessed against the party for whom the responsibility of the pond exists as determined by the City Commission and the city should take immediate steps, at the expense of the city, to eradicate the health hazard which has been identified the cost of which ultimately will be assessed against the responsible party, be it Beaches Aquatic Pool, Inc. or the City of Atlantic Beach. The owner of the property is in violation of Chapter 12, Section 12 -01 -08 of the Code of the City of Atlantic Beach in that there exists on the premises located at 1970 Park Street the following condition(s): The building has fallen into a state of disrepair and is in an unsanitary and unsafe condition. It appears the owner has abandoned the property. Code Enforcement Officer Grunewald explained he was seeking authorization from the Board for the City to board up the building and photos showing the condition of the building were passed out. Chairman Martin inquired if the building was in the same condition as shown in the photos and Code Enforcement Officer Grunewald stated yes. Much discussion ensued concerning the state of disrepair of the building and a history of the property was given by Code Enforcement Officer Grunewald. Chairman Martin asked Mr. Lane what his plans were for the building since more than two years had gone by since initial repair efforts on the property had begun. Mr. Lane produced year old documents indicating payment for work which had not been completed and stated he did not have the money to continue the project at this time. Exterior of building needs paint to prevent further intrusion of moisture to interior; 24. Exterior doors need weatherstripping and thresholds; 25. Bathroom door must have privacy lock. As provided for under Chapter 1, Section 103.2.2 of the Standard Housing Code you have forty-five (45) days from receipt of this letter to correct any major violations and sixty (60) days to correct minor violations. Time limit shall not exceed one hundred twenty (120) days, subject to approval of the Building Official. Repairs or alterations must be accomplished by licensed contractors and conform to the requirements of the Standard Building Code. All required permits must be obtained prior to commencement of any work. Chapter 4, Section 401 of the Standard Unsafe Building Abatement Code (Right of Appeal). Section 401.1 - Filing Any person entitled to service in accordance with the provisions of Chapter 3 may appeal any action of the Building Official under this Code to the Board of Adjustments and Appeals.
