It was the general feeling of the board, after a lengthy discussion, that �he parking was not situated properly behind the building line and the parkingsite for Unit #1 would be right against the neighbor's lot line, Mr. Russell 'indicated that this could be altered if necessary, and that a survey would be required any- way in order to sell the units individually. The chair questioned Mr, Russell about the fire walls and roofs. Mr. Russell indicated that the units would have a two (2) hour fire wall. The chair stated that the covenents and restrcIdjacent ions would have to address the fire protection in the walls and roofs afforded owners to avoid possible conflicts. The chair also addressed the issue that two (2) units would front to Sturdivant, therefore, beautification should be 'stressed on Sturdivant Street. After further discussion of the project, the chair called for a motion. Attached is a copy of the minutes of that meeting. " The Advisory Planning Board voted 2 to 1 to recommend approval of theappli- cation with the stipulation of a parking feasibility study, particular for Unit #1, The City Manager respectfully suggests to the City Commission that the proposed PUD does violate zoning requirements in the Residence C Dist;r 'ct; specifically, parking for Unit #3 is shown adjacent to the property line on Poinsettia. That portion of the lot has been designated as the front and by the occupant. Section 28-5(h) of the Code states that off-street p ved parking space shall not occupy any part of a required front yard. Additionally, a portion of the Unit #3 is in violation of the rear setback requirements in that a portion of the structure extends into the 20-foot rear setback line. The ordinance provides that any building having three or more units must be considered thru the PUD process. I think it was the `_ntent of this ordinance that multi units should be considered under PUD for the purpose of proper planning, but not to be used as a means to violate the multi-family z;,ning and building require7ents which are still in full force an effect. The layout of the building indicates that the designer fir 'tt determined the maximur,, building site area and then came upI with plans designed to get the maxi;gum number of units on he lot. The resulting building- has rooms with some ceili^ - heights as little as 516�� ; water heaters ;laced in plain sight in hallways; door openings too narrow; main entrance on the north unit is through the kitchen; no storage area that can be reached from the outside which means that !awn care equipment must be taken in or stored in the open: etc. The plans also show that the building violates the rear set'' back and off-street parking requirements. Tr. Fussell said he intends to sell the units as fee simple'' townhouses which means that the lot will be sub-divided into 3 parcels , one of which will be very strangely shaped. I do not feel that this project is in the best interests of', the neighborhood. However, should the Commission decide to! approve the building I think it should be closely checked t see if it meets the requirements of , the Southern Standard Building Code.
