Re: 51 Robert Street
On FebrLiary 28, 1996, the building department issued a permit to enclose an
existing porch at 51 Robert Street. The owner, Mr. Ernest Davis, supplied a plan and
filled out the application to be the owner contractor for the project. The new walls
did not exceed the existing footprint of the building. Because of the size of the
project (7'0" x 17'0" entrance room) I walved the requirement for a survey. The job
was estimated at $1377.00, a survey would cost approximately 20% of the job cost.
On February 26, 1998 Mr. Davis brought in a proposed change to the project
which would extend the room size to 7'x38'. These plans -were approved as an
addendum to his existing permit.
On March 25, 1998 1 visited the jobsite after a complaint from a police officer
concerning a safety hazard was called in to the building department. My inspection
found the slab had been enlarged from 7' wide to I Fwide which would encroach the
setback area. I placed a stop work order on the project and informed Mr. Davis he
would have to remove the encroaching part of the slab or file for a variance.
Mr. Davis filed for a variance at the Community Development Board meeting
of April 24, 1998. The board refused to grant the variance.
I have requested an updated survey from Mr. Davis before the project can be
restarted. This survey will determine exactly how much of the existing slab will be
usable as part of the enclosed area of the building.

NUISANCE CONTROL BOARD MEETING
MINUTES
The first meeting of the Nuisance Control Board was called to order at 7:30
P.M. on Wednesday, January 15, 1990 by Police Chief David Thompson. In
attendance were City Attorney Alan Jensen, Board ,Members Jack Brooks, J.C.
Green and Willie Miley. Also present was Sybil Fix with the Florida Times
Union.
Jack Brooks inquired as to whether the board would have problems with the
Code 'Enforcement Board in reference to the duties which they would be
performing. City Attorney said that he felt there would not be a problem
due to the fact that the board would be working closely with Code
Enforcement Officer Don Ford and that the main objective of the board would
be to concentrate on narcotics.
Chief Thompson stated that the board shall hear complaints regarding
nuisances in reference to any premise or place which has been used as the
site of unlawful dealings on more than two occasions. Any resident of the
city can file a complaint before the board, including any employee or any
officer. The Ordinance was also talked about and how it allows the board to
enter an order to declare an establishment or place a public nuisance. It
also states that the establishment would be given a three day notice prior
to their hearing.
The question of seizure of property was brought up and Chief Thompson said
the major goal of the board was to cease the operation of the nuisance.
Chief Thompson also stated that they want to work with people and try to
give them a chance to correct their problem before taking drastic steps.
At this time the City Attorney explained that his duties would be to advise
the board members, while the Police Department will provide the board with
the evidence. Owners of the property where said nuisance is taking place,
can also present their side along with their evidence with the option of
having an attorney present.
At the close of the meeting Chief Thompson said he would contact members
about next meeting date and with no further discussion, the meeting was
adjourned at 7:55 P.M.

in writing, please furnish me immediately a written
statement setting out the following:
1 . The name and address of the complainant .
2 . The date the complaint was made .
3 . Full particulars of the substance of the

MR. DAVIS MET WITH ME AFTER THAT TIME AND I EXPLAINED THE CONCERNS OF THE POLICE
DEPARTMENT IN DETAIL. MR. DAVIS ASKED FOR SOME TIME TO SECURE ADEQUATE SECURITY
AND RESOLVE THE NUISANCE ISSUES. THOSE EFFORTS HAVE BEEN UNSUCCESSFUL, AND THE
MOST RECENT NOTICE WAS SERVED ON MR. DAVIS 07116190.
3) THE CENTRAL ISSUE IN THE COMPLAINT IS THAT THE VOO SWAR RESTAURANT AND
LOUNGE HAS BEEN THE LOCATION OF ONGOING CRIMINAL ACTIVITY. OUR SPECIFIC
CONCERNS ARE WITH THE ILLEGAL DRUG ACTIVITY AND ONGOING ACTS OF VIOLENCE AT THAT
LOCATION. PATRONS AT THE VOO SWAR HAVE RECENTLY ATTACKED POLICE AND PRIVATE
SECURITY GUARDS, AND HAVE COMMITTED ACTS OF VANDALISM AGAINST THE ESTABLISHMENT
ITSELF. MR. DAVIS HAS CONTACTED THE POLICE IN FEAR OF HIS OWN LIFE (THURSDAY
JULY 12, 1990) .
THE VOO SWAR HAS A REPUTATION FOR DRUGS AND VIOLENCE IN THE COMMUNITY. IT
PRESENTS A PUBLIC NUISANCE FOR THE REASONS ABOVE.
RECOMMENDATIONS:
MR. JACOBSON PROBABLY NEEDS A TIMELY RESPONSE TO HIS INQUIRIES. I SUGGEST

Re: 51 Robert Street
On February 28, 1996, the building department issued a permit to enclose an
existing porch at 51 Robert Street. The owner, Mr. Ernest Davis, supplied a plan and
filled out the application to be the owner contractor for the project. The new walls
did not exceed the existing footprint of the building. Because of the size of the
project (7'0" x 17'011 entrance room) I waived the requirement for a survey. The job
was estimated at $1377.00, a survey would cost approximately 20% of the job cost.
On February 26, 1998 Mr. Davis brought in a proposed change to the project
which would extend the room size to 7'x38'. These plans were approved as an
addendum to his existing permit.
On March 25, 1998 1 visited the jobsite after a complaint from a police officer
concerning a safety hazard was called in to the building department. My inspection
found the slab had been enlarged from Twide to I Fwide which would encroach the
setback area. I placed a stop work order on the project and infon-ned Mr. Davis he
would have to remove the encroaching part of the slab or file for a variance.
Mr. Davis filed for a variance at the Community Development Board meeting
of April 24, 1998. The board refused to grant the variance.
I have requested an updated survey from Mr. Davis before the project can be
restarted. This survey will determine exactly how much of the existing slab will be
usable a, s part of the enclosed area of the building.

Dear Mr. Jacobson:
Thank you for your inquiry dated November 2 , 1994 about the
closing hours of the property at 51 Robert Street . I hope that
the enclosed information is helpful to you. The City Clerk and
Police Department have discussed this matter with Mr. Davis in
the past , and we have explained the City ordinance to him.
Pleas.e see the attached section of the City Code of Atlantic
Beach. Section 3-2 (a) of the code sets time limitations for
alcoholic beverage sales . Section 3-2 (b) directs the premises
to be closed between 2 : 00 am and 7 :00 am.
The De ' Javu has a large dance floor, seating for shows and
entertainment , and an area for a Disc Jockey . They maintain
billiard tables , and they serve alcoholic beverages . As with
similar businesses , I do not believe that the De' Javu qualifies
under any of the exceptions in the ordinance . I realize that
they serve chicken sandwiches and have recently acquired a
restaurant license, but this does not mean that the premises are
if primarily used and conducted. . . for the sale and serving of
prepared foods for consumption thereon. . . " If you and/or Mr.
Davis would like to provide additional information on this issue,
we will gladly consider it .
We have consistently enforced this ordinance throughout the
City, and I know of no business which is similar to that of Mr .
Davis ' which is allowed to stay open past 2 : 00 am. Although some
businesses have asked to stay open later to "just serve food" , we
do not believe that this is acceptable under the ordinance. This
interpretation has been adopted from the City ordinances and the
city attorney .

While preparing a response to Your letter, I discovered that
Mr. Davis ' state license for beer and wine is outdated. There is
no license for the De' Javu, but there is one for the Voo Swar. I
suggest that he contact the appropriate authority to have the
license brought Up-to-date .
I hope that this information answers some of Your questions .
The police officers are enforcing the City ordinance which
restricts the business hours , and the ordinance is being
consistently enforced throughout the City For further review or
questions , you are welcome to discus 's this with the City
attorney, Alan Jenson.

I am writing on behalf of Ernest Davis, Sr. , the operator of
De'Javu, 51 Robert Street, Atlantic Beach, Florida.
Mr. Davis advises me that your Department is requiring him to
discontinue food service and close up after 2:00 A.M. He believes
he is entitled to remain open for food service after 2:00 A.M. so
long as he discontinues service of alcoholic beverages.
Could you please let me know if your Department does take the
view that Mr. Davis must discontinue food service at 2:00 A.M. If
so, by what authority do you do so? If Mr. Davis is legally
required to close at 2 :00 A.M. , he will, of course, comply. On the
other hand, if there is no legal authority for what your officers
are requiring, he requests that they be instructed to desist from
what they are doing.
I am writing this letter in the hope that this problem can be
dealt with informally without any necessity for formal legal
proceedings.
