acting as a general contractor on this job even tho h he has no license. The homeowner

In September of 2002 my wife& L,(henceforth known Owner),signed a c�ntract witahhern

Comfort Home Improvements of, 176 Roscoe Blvd., Verde. F 1. Owner;11 Robent R to
have new insulated vinyl windows, vinyl siding and a fte ,roof put on our tling,�
,wd,--there-a-as over 50 companies working with him and theywrould be ablelo-gaoft- nd-P�t _

it completed in a timely, manner. All 50 companies he ref oresents were bonded and licensed to do
business in the states of Florida and Georgia.
The rooterwould he:Baird Seymour" and his crew wouli I be available to rip off the ellusting roof
replacing all badwood and install the shingles of my choice�
Theshingles were purchased and placed on the roof rooting permit 4102-OW24 901 was issued on
917,101 Kenny x-ujs supposed to be the job foreman,an , make sum there were no complaints and to
see that all inspections,by city inspector,were accomplished and any i all discrepancieswere taken
care of immediately. I
The first day they were working,a Jamician was causinE trouble and using a lot of profanity. 0-wner
called Robert Rhodes and told him to get rid of this guy. We had a 3 year old Granddaughter staying
with us and didn't need the bad language-, plus,Randy D"an,a neighbor,said,-the Jamician pulled
a hatchet on Kenny and Patrick",that ivas the last straw.
It%vas understood that the large vents like I had on the would be reinstalled.

I also had solar panels, for hotwater,inountedontherooF. Theywere to be removed and reinstalled
and o"er was to have the pipes reinstalled. When they�itarted disassembling,the covers broke so the
roofers were told to leave off both units and owner wouk see about obtaining replacement parts. By
the time the two panelswere on the ground they could not be mused anyway. Wood was replaced and
the inspector said they could proceed- The roof was drie I in and they were going to install the
shingles. Then Kenny brought out small vent covers to I o on the kitchen&bath exhaust fans. These
Nvere not the type that had been originally installed. Thee were, -supposed to be the new approved
type for the roof since regulations,had changed7,so 11, agreed. Then came another surprise,they
cut a 2'wide area out of the roof crown.and installed 3 of low profile roof vents. This wwn7t what
the owner had requested- Fmally Mr Rhodes-%vas cafle&agwn,causing another stoppage. Mr. Rhodes
and Kenny left the site and went to purchase another t,%*of vent matchirig the one the roofers had
destroyed dining the rip off. OxAmer had one vent left to ipstall and the roofers were to install it at no
cost,since they would already be down to tarpaper. After both vents were installed and the crown vent
was removed,Kenny told the roofers to,Just cover up the 2-wide cut and the inspector would
approve thejob' They�the roofers,all left. No call had been made to the city inspe-ctor,. Kenny,said
-he didn't have time to call the inspector, the,
1,had to finish anotherjob so they would get paid". The
next day owner,.i,,ent in attic to replace some torn insula�on on air conditioning system.,while in the
attic the following discrepancies were noted and Mr. Rh was called.
1. T�e' T'opening in the crown had light shu ming through for one end to the other and
roofing,v,kw hanging through the openin&
? 'Water pipes from the solar panels had been misted and jammed under the roof They
had to be cut totally out.
3. The heater exhaust pipes had been stacked together using metal duct tape,instead of
being properly assembled.
4� The hot water heater flue pipe wasn't evei i attached to the heater.
One morning,Patrick,Kenny, and two other workers wer�on the roof when Kenny started threatening
everyone NNith a hatchet. Patrick came down off the roof and left the site in his pick-up,thus leaving the
other.3 strarxW. Mr. Robert Rhodes was called again and he spent the day running after supplies etc.
for the roofers. Mr. Seymour had becn called,but wasn) available. It is commendable for Patrick to
%,valk away rather than have a fight at a work site.
Mr. Seymour was called,by Mr. Rhodes,and owner call d the City Inspector. Inspector said,"the
roofers had to fix it- The crownwas torn off and the 2"s xtion was filled in using treated wood. .30#1
felt was placed on the am and Patrick was able to get tht�flue pipes hooked up proper�y Mr.
Seymour then told his crew to leaAT due to the fact there xas,conflict over money between Mr. Rhodes
and himself They left the site leaving the crown not ft Mr. Rhodes was,apin�called back to
find out%vhv the iob Nvasni"t oompleted-
A Nxvek- went by,owner decided to finish up the roof. Mr. Seymour came by and said the contract-,vas
still in disputevdtli�"Robert Rhodes'but he was going t make sure the roofingjobuas completed.
While Patrick was woiking to finish up the crown cap, Sm, our was walking the roof and found
several shingles that were coming loose,plus,the nails backed out of 14 shingles. Patrick was
asked by Mr. Seymour,"who had done that part of the 1*17 7,he didn't know because it had been done
the daN he n-alked off the roof
Kenny did not install the two flue caps property and the cap on the furnace flue slid down,blocking off
the exhaust gases-This was found when furnace kept goilig out. Gases built up in the furnace and it
exploded- No onewas hurt� but furnace had to be rme la The flue capswould both fall down over
the flues because the caps were found to be much larger I han the outside diameter of the flue pipes.
Owner installed sheet metal screws in each cap so no mo re darnage could be done. The furnace flue
pipe had been replaced VVIlth a single"-Al pipe, not the double wall pipe the roofers tore out during the
roofing rip off,
As of March I",2003 we still do not have a final inspectlon for the roofing, Mr. Seymour is very
much a%Nwe of this.

The windoAvs that were originally shown to owner vwre 1bund to be,'not authorized in the beach
area".due to high winds. Mr. Rhodes said the new type windo-vvs would also require special clips
installed so protective wxW could be installed in a hum. to protect windows and the inside of the
dwelling,
When-vi,indows am-,ed they were stored ky owmer,until ;5uch time as Mr.Paulist or Mr. Nichols were
able togTt them installed,along with the siding. Owner had originally been told there would be a
storage trailer sat on the East Side of dwelling, so every-diing would be protected and not lost during
the repairs.
At this time Mr Rhodes said owner had miss counted the windows and there was S 1500.00 more in
xxindo,kvs than had been contracted for. Mr. Rhodes had brought several contractors out to the site
before thev-dndows had been measured and ordered and ie told the contractors,"the 3 double
windows counted as one". After the windows had been ordered the manufacturer charged for
individual windowseven though they were built as d&o les. The contract Nvas written to replace all
windows in the deiNvIl mig except I (one)double at the E,-st end of living room,which was to be
insulated and covered with vinyl sidin&thus protecting a curio rnantle piece in front of the'%vindow.
All siding and fascia materials were delivered to site while roofers were working and somebody moved
things around so rain ruined a box ofjoint sealant compo mxL un be knowmest to owner. When Mr.
Paulist started to install the siding he had to stop and go I ack-to buy more compound- Then, work was
stopped by. owmerwhen,Mr. Paulist's-*xork-ers started in!talling the siding N-vith out the specified
aluminum baclied insulation- Mr. Patust said,he was tol4l ,by Mr.Rhodes,he did not have to install
the insulation- Mr. Rhodes was called and said,"it was just an oversight and be would meet W
Paulist and pick up the insulation. In the meantime,Mr.Paulist's workers removed the guttering on the
front of the house and started replacing the fascia. When Mr. Rhodes and Mr. Paulist returned they
had to change from the original style of insulation,Hornt Depot did not carry the type Mr.Rhodes had
described in his proposal. At this time Mr. Paulistwas&-ked for the permits for the siding,f�scia and
the vvindow-s. He didn't have them and stated Mr.Nicho s had the permits in his truck and I-would
have them shortIv. I
Mr. Rhodes-was told that he had promised all permits would be on site&posted before any work
commenced. Mr. Rhodes stated he would get hold of Mr. Nichols and go pick up the permits and post
them. Mr. Rhodes had to end up picking up another forni and filling it out and going to Atlantic Beach
and starting over again. Mr. Nichols never came out to t�site for any reason.
The windows were opened and unpacked only to find u the"special clips�'to hold the wood up in

bad weather bad not been installed. Then owner was tol the wood would be hung on the concrete as

per Atlantic Beach instruction. However,neither,Mr. R odes or Mr. Paulist had a copy of these
instructions. After the windows were installed,Mr. Paulist wanted his money for the work they had
done. Mr. Rhodes had told him that I would pay as soon as the last window was tested.
Mr. Rhodes,had written the contract and there Nvas to be ' three))draws— The first draw being 1,3`1 of
the total as soon as all.building materials were unloaded he site-The 2' U3'was to be paid when
theroofers bad final inspection.And the final LP3'd to be 7d,,Nben everything had been
"satisfactorily'completed- The checks were to be made'out to hinL It turned out that Mr Rhodes
wasn't standing behind his own co-nftwt- Every couple qda-,s7s he had to have a check to go buy
something that had been"forgotten".
Mr. Paulist stated that he would be putting a lien on our Oropertv the next day if we did not give him
the check that Mr Rhodes had promised him.
Mr. Rhodes could not be reached anywhere, convenientl�-
The check waskwitten finally when Mi. Paulist assured owner that Mr. Nichols or himself would call
for a final inspection plus one of them would be here, Neither one called for a final inspection.
Atlantic Beach Inspector came out to go over thewindows and they do not pass because the contractor
did not install the proper anchoring devices nor was the-,000d drilled& labeled as required- The
inspector stated hewas calling Mr. Nichols and that I should call Robert Rhodes.
Mr.Rhodes,%-as finally, reached and he came by and picked up a copy of the requirements and that he
would personally get Mr-Nichols to take care of the pro�=. ChNma hasn't heard an.v more from Mr,
Rhodes and the job hasn't been finished- I
Now the caulking is coming off of the Windows andv%ill�ave to be cleaned and redone.
When the gutters were reinstalled,the workers used all o -nails and tubes.
