plan was approved based upon the following information.
1. Parking plan-parking plan showing how site will be accessed and all onsite
and abutting street parking areas.
2. Location of construction trailers, loa ding/unloading area and material storage
area.
3. Location of chemical toilet area-ch,-mical toilets must be kept out of City
right-of-way and not further than 15 feet from structure under construction.
4. Location of dumpster-dumpster nit-st be from approved waste company (in
accordance with Chapter 16 City Cc de). As of 2009, approved dumpster
companies for Ad. Beach are Adva ced Disposal,Realco Recycling, and
Shappells. Dumpsters are to have,-,arp covers or rigid covers on windy days.
Dumpsters must be removed prior to issuance of Certificate of Occupancy or
Completion.
5. Traffic control plan, showing acces< with dimensions, area to be stabilized,
narrative on phasing of construction with adequate parking and delivery of
materials.
6. Site cleanliness. Contractor must have the entire construction site cleaned by
Friday of each week. This means re-noval of scrap lumber, concrete remnants
and other such construction debris fficluding cans, metal,plastic and paper.
7. Erosion and Sediment Control. Cor.tractor must maintain all elements of the
approved Erosion& Sediment Coni rol Plan(silt fence, catch basin filters, etc.)
until sod or other stabilization has 1:een placed and approved by Public Works.
8. Other activities,where special conc itions are identified by the Building
Official.

Your request for a permit pursuant to Section 1 61.053 Florida Statutes, for construction or other activities
seaward of the coastal construction control line, has been approved by the Department of Environmental
Protection; the permit is enclosed. However, construction may not commence until after the permittee
complies with any preconstruction requirements described in Special Permit Condition(s) 1, 2, and 3.
Please read the permit and permit conditions including both the General Permit Conditions and any Special
Permit Conditions closely before starting construction. General Permit Conditions l(q) and I(s) pertain to
written reports which must be submitted to the Depart ent of Environmental Protection at specified times.
Forms -for use.in preparation of these reports are enclosed. Make sufficient copies of the periodic report form
to provide the required reports. The periodic reports are due in the office of the Bureau of Beaches and
Coastal Systems on a monthly basis on the last working day of each month. No progress reports are required
until such time as construction activities have started.
The permit will expire on May 18, 2015. Upon receipt of a written request signed by the-permittee or
authorized agent, the Department will consider extendir g the permit for up to but no more than three years.
You must apply for a new permit for completion of any work not accomplished under the original permit.
Although you may apply for a new permit, there is no assurance that such new permit for the same
construction or activities would be approved.
NOTICE OF RIGHTS
This action is final and effective on the date filed with -he Clerk of the Department unless a petition for an
administrative hearing is timely filed under sections 120.569 and 120.57, Florida Statutes, before the deadline
for filing a petition. On the filing of a timely and sufficicnt petition, this action will not be final and effective
until further order of the Department. Because the administrative hearing process is designed to formulate
final agency action, the hearing process may result in a rr.odification of the agency action or even denial of the

Petition for Administrative Hearin
A person whose substantial interests are affected )y the. Department's action may petition for an
administrative proceeding (hearing) under sections 120.M9 and 120.57, Florida Statutes. Pursuant to rutle 28-
106.201, Florida Administrative Code, a petition for ai administrative hearing must contain the following
information:
(a) The name and address of each agency afficted and each agency's file or identification number,
if known;
(b) The name, address, and telephone number of the petitioner; the name, address, and telephone
number of the petitioner's representativej if any, which shall be the address for service purposes during the
course of the proceeding; and an explanation of how the petitioner's substantial interests are or will be
affected by the agency determination;
(c) A statement of when and how the petitioi ter received notice of the agency decision;
(d) A statement of all disputed 'issues of material fact. If there are none, the petition must so
indicate;
(e) A concise statement of the ultimate facts alleged, including the specific facts that the petitioner
contends warrant reversal or modification of the agency' proposed action;
(f) A statement of the specific rules or statutes that the petitioner contends require reversal or
modification of the agency's proposed action, including an explanation of how the alleged facts relate to the
specific rules or statutes; and
(g) A statement of the relief sought by the p itioner, stating precisely the action that the petitioner

The petition must be filed (received by the Cleric) in the. Office of General Counsel of the Department.at
3900 Commonwealth Boulevard, Mail Station 35, Tal ahassee, Florida 32349-3000. Also, a copy of the
petition shall be mailed to the applicant at the address inc icated above at the time of filing.
Time Period for Filing a Petition
In accordance with rule 62-110.106(3), Florida Admininrative Code, petitions for an administrative hearin,c,
by the applicant must be filed within 21 days of receipt of this written notice. Petitions filed by any persons'
other than the applicant, and other than those entitled to written notice under section 120.60(3), Florida
Statutes, must be filed within 21 days of publication of -.he notice or within 21 days of receipt of the written
notice, whichever occurs first. Under section 120.60(3), Florida Statutes, however, any person who has asked

Extension of Time
Under rule 62-110.106(4), Florida Administrative Code, a person whose substantial interests are affected by
the Department's action may also request an extension of time to file a petition for an administrative hearing.
The Department may, for good cause shown, grant tie request for an extension of time. Requests for
extension of time must be filed with the Office of Generil Counsel of the Department at 3900 Commonwealth
Boulevard, Mail Station 35, Tallahassee, Florida 323 9-3000, before the applicable deadline for.filing a
petition for an administrative hearing. A timely request for extension of time shall toll the running of the time
period for filing a petition until the request is acted upon

Judicial Review
Once this decision becomes final, any party to this act on has the right to seek judicial review pursuant to
section 120.68, Florida Statutes, by filing a Notice of Al peal pursuant to rules 9.110 and 9.190, Florida Rules

PURSUANT TO SECTION 16.1.053, FLORIDA STATUTES
FINDINGS OF FACT: An application for authorization to conduct the activities seaward of the coastal
construction control line that are indicated in the project description, was filed by the applicant/permittee
named herein on February 7, 2012, and was determined to be complete pursuant to rule on April 3, 2012.
The proposed project is to be located landward of the 30-year erosion projection and the existing line of
construction established by major structures in the immediate area.
CONCLUSIONS OF LAW: After considering the merits of the proposal and any written objections from
affected persons, the Department finds that upon compliance with the permit conditions, the activities
indicated in the project description of this permit are o F such a nature that they will result in no significant
adverse impacts to the beach/dune areas or to adja ent properties; that the work is not expected to
adversely impact nesting sea turtles, their hatchlings, or their habitat; that the work is expendable in nature
and/or is appropriately designed in accordance with Section 62B-33.005, Florida Administrative Code;
and that it is an activity or type of construction which the designee of the Chief of the Bureau of Beaches
and Coastal Systems has authority to approve or deny .urs.uant to Delegation of Authority, DEP Directive
137, effective May 14, 2001. Based on the foregoing considerations, the designee approves the
application; authorizes construction and/or activities at the location indicated below in strict accordance
with the project description, the approved plans (if any) and the General Permit Conditions which are
attached and are by this reference incorporated hemin, and any additional conditions shown below,
pursuant to Section 161.053(4), Florida Statutes.
EXPIRATION DATE: May 18,2015
LOCATION: Between approximately 322 feet and 173 feet south of the Department of Environmental
Protection's reference monument R-42, in Duval County. Project address: 2061 Beach Avenue, Atlantic
Beach.
PROJECT DESCRIPTION:
Swimming Pool
I Location relative to control line: A maximum f 41 feet seaward.

2. Exterior dimensions: 27.5 feet in the.shore-nc rinal direction, including the trough, by 16 feet in
the shore-parallel direction.
3. Type of foundation: Helical piles.
4. Deck elevation of swimming pool: Approximately+22.3 feet(NAVD).
5. Bottom elevation of swimming pool: +15.3 fect (NAVD).
6. Maximum depth of swimming pool: 6 feet.
Excavation/Fill
1. Total volume of excavation: Approximately 7 cubic yards. Volume of net excavation: None;
excavated material to be placed as fill on the project site.
2. Location of excavation: From 0 feet to approximately 41 feet seaward of the control line.
3. Maximum depth.of excavation: To bottom of I�ool.
4. Volume of fill to be placed: Approximately 419 cubic yards.
5. Location of fill to be placed: From 0 feet to 70 feet seaward of the control line.
Other Structures/Activities
I A post-supported open, wooden deck 12 fee- wide surrounding the north, landward and south
sides of the proposed pool is to be located a maximum of 41 feet seaward of the control line.
2. A spa of dimensions 6 feet shore-normal by 6 feet shore-parallel within the limits of the wooden
deck is to be located a maximum.of 26 feet seaward of the control line.
3. A fire pit of dimensions 4 feet shore-norma by 4 feet shore-parallel within the limits of the
wooden deck is to be located a maximum of 26.5 feet seaward of the control line.
4. Frangible, keystone block unit retainin g walls are to be located along the north and south sides of
the deck and enclosing the planter areas are to be located a maximum distance of 43 feet seaward
of the control line.
5. A 19-foot long by maximum 3.5-foot high wo)deh retaining wall is to be located along the south
property line and attached to the seaward end c f the keystone block unit retaining wall a maximum
distance of 61 feet seaward of the control line..
6. A 6-foot shore-normal by 8-foot shore-paralle.. wooden platform for a shower and water closet is
to be attached to the seaward side of the wooden deck.

7. Landscaping to be located a maximum of 70 fe--t seaward of the control line.
8. Demolition and removal of existing seaward w)oden deck. See Special Permit Condition 4.
SPECIAL PERMIT CONDITIONS:
I. Prior to commencement of construction acti ity authorized by this permit, a preconstruction
conference shall be held at the site among th-, contractor, the owner or authorized agent, and a
staff representative of the Bureau of Beaches and Coastal Systems to establish an understanding
among the parties as to the items specified in the special and general conditions of the permit. The
proposed locations of the structures shall be slaked out for the conference. Contact Trey Hatch
at (850) 488-7708 to schedule a conference.
2. Prior to commencement of construction a-,tivity authorized by this permit, a temporary
construction fence shall be erected along the erimeter of the permitted activity. The fence shall
remain in place until the construction authorizc by this permit is complete. The optimum siting of
the construction fence shall be determined during the preconstruction conference by the staff
representative of the Bureau of Beaches aid Coastal Systems so as to provide. maximum
protection to the existing vegetation located on the site.
3. All imported fill material shall be obtained fr)m a source landward of the control line and shall
consist of sand which is similar to that alread on the site in both grain size and-coloration. This
fill material shall be free of construction debi s, rocks, or other foreign matter. A sample of the
sand shall be provided to the staff representat.ve of the Bureau of Beaches and Coastal Systems
during the preconstruction conference.
4. All rubble and debris existing on the lot or resulting from new construction shall be removed and
disposed of in a location landward of the coastal construction control line.
5. Prior to completion of construction activities author ized by this permit, the permittee shall remove
all invasive nuisance plants, such as listed 1-1 the Florida Exotic Pest Plant Council's List of
Category I and II Invasive Species and incl ding Australian pine (Casuarina spp.), Brazilian
pepper (Schinus tereben-thifolium), and Beach Napauka (Scaevola sericea). The permittee shall
plant a mix of a minimum of three native salt-lolerant species to restore any disturbed natural area
seaward of the authorized structures. Dune restoration plantings shall consist of salt-tolerant
species indigenous to the native plant commu ties existing on or near the site or with other native
species approved by the Department. Sod composed of non-native grasses is not authorized
seaward of a major structure or decks. Plantings in other areas of the project site shall not include
invasive nuisance plant species such as listed in the Florida Exotic Pest Plant Council's List of
Category I and II Invasive Species.

Roll off container company must be on City approved list
and container cannot be placed on City right-of-way.
(Approved: Advanced Disposal, Realco, Shappelle ' s and Waste
Management)
Full erosion control measures must be installed and
approved prior to beginning any earth disturbing
activities . Contact Public Work (247-5834) for Erosion and
Sediment Control Inspection prior to start of construction.
