Thomson could purchase it, which was to be accom fished by July 15, 2002. He was also to remove all trash, and rubbish from the front and back ards, cut both the front and back yard, treat or secure the pool, and repair or,replace the dilapidated fence. The property has not closed, the City has not been paid the amount due and agreed by Mr. Thomson from the closing of $1,789.38, and Z have been informed by City officials that the property has been neglected, the fencing is down in dertain parts, boards are off the back doors, and in fact the City building official was able to gain access to the inside of the home by merely walking through. This is a dangerous situation, and ra st be addressed immediately. Please be advised that if the agreement we reached can iot be completed within,7 days from the date of this letter, the City will have no option but to with the demolition of the property. This is an action for temporary and permanent injunctive relief against the City. 2. Plaintiff has a pecuniary and/or prop' rty interest in certain real property in issue described as 386 Sargo Road, Atlantic Beach, Florida ("the property"). 3. Plaintiff entered into a purchase and s le agreement dated July 1, 2002, to purchase f the property, attached hereto as Exhib t A. 4. Venue is proper. 5. On days preceding and including July 1, 2002, the city had caused a notice dated Friday, June 14, 2002, regarding the condemnation of the property to be displayed for public viewing at the property. The notice provides in pertinent part that"on July 1, 2002 this structure will be placed out for bids to be demolished by the City of Atlantic Beach." (Exhibit B). The notice also provides that demolition will be completed by July 14, 2002. 6. Plaintiff justifiably relied upon theCity's public notice prior to entering into the purchase and sale agreement of the property. 7. On July 1, 2002, (after entering into the purchase and sale agreement), plaintiff visited the City's building department and delivered to the City a public records request. A true and correct copy of the request is attached hereto as Exhibit C. Plaintiff's purpose in delivering the p blic records request was,in part, in order(1)to obtain a copy of the Notice Inviting Bids mandated by the City's municipal code,and (2) to consider submitting a bid of hic. own. 8. On information and belief, the City, contrary to its public notice, circumvented the disclosed bid process by contracting for the demolition of the property in advance of July 1, 2002, and now plans to demol sh the property forthwith. 9. In adopting this ad hoc process of ne gating its June 14, 2002, notification that the demolition job will be put out to bid the city has contravened its municipal code provisions governing the notice, revi I wing and awarding of bids. 10. Plaintiff, having relied on the city's p blic notice to his detriment, entered into the purchase and sale agreement with the intention of(1)securing the property for safety reasons, (2) immediately beginning the renovation of the property thus bringing the property to all code standards (3) closing on the property as soon as reasonably possible and (4) paying four years' o back property taxes accrued on the property. 2 j f i i 11. Plaintiff is a licensed contractor and is prepared and able to move immediately to secure the property,to apply for theappropriate permits and bring the property up to code. 1 12. Should the City, in contravention to its public notice and its municipal code provisions, demolish the property, Plaintiff will suffer irreparable injury in that the property will be subject to additional iens(demolition costs paid by the city)and he thus will be unable to renovate the existing property for resale. 13. At 4:00 p.m. today(July 1, 2002),Plaintiff submitted a public records request at the City's building department's offices. 14. The first response by the department office representative, Larry Higgins, was "I would not know where to even begin to look for such documents"and"you will have to wait until Mr. Don Ford returns from vacation." On information and belief,Don Ford is the same Don Ford who signed the June 14, 2002 notice. 15. Plaintiff then spoke with a uniformed code enforcement employee who declined to identify himself. That officer, along with Larry Higgins, refused to memorialize receipt of the public records request a d further stated he intended to put a crew onto I the demolition site "so fast that it will cost (plaintiff) even more money." 16.
